उत्तर प्रदेश साधारण खण्ड अधिनियम, 1904 (उत्तर प्रदेश अधिनियम संख्या 1 सन्‌ 1904) की धारा 21 के साथ पठित संयुक्त प्रान्त आबकारी अधिनियम, 1910 (अधिनियम संख्या 4 सन्‌ 1910) की धारा 24 और 41 के अधीन शक्तियों का प्रयोग करके, आबकारी आयुक्त, उत्तर प्रदेष राज्य सरकार की पूर्व स्वीकृति से आबकारी आयुक्त की अधिसूचना संख्या 31276/दस-लाइसेंस-58/2002-2003, दिनांक 26 मार्च, 2002 द्वारा प्रकाषित उत्तर प्रदेष आबकारी (देशी शराब की थोक बिक्री के लिये लाइसेंसों का व्यवस्थापन) नियमावली, 2002 को संशोधित करने की दृष्टि से निम्नलिखित नियमावली बनाते हैं :

(1) यह नियमावली उत्तर प्रदेश आबकारी (देशी शराब की थोक बिक्री के लिये

लाइसेंसों का व्यवस्थापन) (चौदहवां संशोधन) नियमावली, 2021 कही जायेगी।

(2) यह गजट में प्रकाषित किये जाने के दिनांक से प्रवृृत्त होगी।2 उत्तर प्रदेश असाधारण गजट, 3 मार्च, 2022 ई0

उत्तर प्रदेष आबकारी (देशी शराब की थोक बिक्री के लिये लाइसेंसों का व्यवस्थापन) नियमावली, 2002, जिसे आगे उक्त नियमावली कहा गया है, में नीचे स्तम्भ-1 में दिये गये नियम-2 के स्थान पर स्तम्भ-2 में दिया गया नियम रख दिया जायेगा, अर्थात्‌-

विद्यमान नियम

एतद्‌द्वारा प्रतिस्थापित नियम 2-परिभाषायें- (1) जब तक विषय या संदर्भ से कोई बात प्रतिकूल न हो, इस नियमावली में- (क) ''अधिनियम'' का तात्पर्य समय-समय पर यथा संषोधित संयुक्त प्रान्त आबकारी अधिनियम, 1910 से है;

2-परिभाषायें- (1) जब तक विषय या संदर्भ से कोई बात प्रतिकूल न हो, इस नियमावली में- (क) ''अधिनियम'' का तात्पर्य समय-समय पर यथा संषोधित संयुक्त प्रान्त आबकारी अधिनियम, 1910 से है;

(ख) "देशी शराब" ऐसी अल्कोहलीय सान्द्रता वाली तनु

या तीव्र देशी स्प्रिट भी सम्मिलित है, जैसी समय- समय पर राज्य सरकार की पूर्व अनुमति से आबकारी आयुक्त द्वारा नियत की जाय;

(ख) "देशी शराब" ऐसी अल्कोहलीय सान्द्रता वाली तनु या तीव्र देशी स्प्रिट और उत्तर प्रदेश निर्मित शराब (यू0पी0एम0एल0) भी सम्मिलित है, जैसी समय-समय पर राज्य सरकार की पूर्व अनुमति से आबकारी आयुक्त द्वारा नियत की जाय;

(ग) "आबकारी वर्ष" का तात्पर्य 1 अप्रैल से प्रारम्भ होकर आगामी कलेन्डर वर्ष के 31 मार्च तक चलने वाले वित्तीय वर्ष से है;

(ग) "आबकारी वर्ष" का तात्पर्य 1 अप्रैल से प्रारम्भ होकर आगामी कलेन्टर वर्ष के 31 मार्च तक चलने वाले वित्तीय वर्ष से है;

(घ) "परिवार" का तात्पर्य दम्पत्ति (पति या पत्नी), आश्रित पुत्र (पुत्रों), अविवाहित पुत्री (पुत्रियों) से है और इसमें आश्रित माता-पिता सम्मिलित हैं;

(ङ) "प्रपत्र" का तात्पर्य इस नियमावली के साथ संलग्न (ङ) "प्रपत्र" का तात्पर्य इस नियमावली के साथ संलग्न प्रपत्र से है;

(छ) "लाइसेंस फीस" का तात्पर्य अधिनियम की धारा 24 के अधीन देशी शराब के विक्रय के एकान्तिक विशेषाधिकार के लिये लाइसेंस प्रदान किये जाने के प्रतिफल से है जो लाइसेंसधारी द्वारा उसको लाइसेंस प्रदान किये जाने के पूर्व, ऐसी दरों पर, जैसी कि राज्य सरकार की स्वीकृति से आबकारी आयुक्त द्वारा अधिसूचित किया जाय;

(ज) "प्रतिभूति धनराशि" का तात्पर्य लाइसेंस फीस के (ज) "प्रतिभूति धनराशि" का तात्पर्य लाइसेंस फीस के 1/10 भाग के बराबर धनराशि से है, जो 1/10 भाग के बराबर धनराशि से है, जो आबकारी आयुक्त के पक्ष में गिरवीकृत सावधि आबकारी आयुक्त के पक्ष में गिरवीकृत सावधि जमा रसीद के माध्यम से अथवा ई-पेमेन्ट के जमा रसीद के माध्यम से अथवा ई-पेमेन्ट के माध्यम से जमा की जायेगी और जो राज्य सरकार माध्यम से जमा की जायेगी और जो राज्य सरकार के समस्त दावों और देयों के अन्तरिम व्यवस्थापन के समस्त दावों और देयों के अन्तरिम व्यवस्थापन के बाद वापसी योग्य होगी;

स्तम्भ-1 विद्यमान नियम

स्तम्भ-2 एतद्‌द्वारा प्रतिस्थापित नियम (झ) निकाल दिया गया।

(ठ) "कम्पनी" का तात्पर्य कम्पनी अधिनियम, 2013 के (ठ) "कम्पनी" का तात्पर्य कम्पनी अधिनियम, 2013 के अधीन रजिस्ट्रीकृत किसी कम्पनी से है;

(ढ) "अतिरिक्त प्रतिफल शुल्क" का तात्पर्य देशी शराब के आप्टिमम रिटेल प्राइस को पांच रुपये के अगले गुणक तक पूर्णांकित किये जाने के फलस्वरूप प्राप्त अन्तर की धनराशि से है जो, आसवनी स्तर पर देय होगी। आसवनी द्वारा थोक आपूर्तक से एक्स डिस्टलरी प्राइस के अतिरिक्त वसूलनीय होगी एवं जो थोक आपूर्तक द्वारा देशी शराब के फुटकर लाइसेंसधारी से अधिकतम्‌ थोक मूल्य के अलावा वसूल की जा सकेगी;

(ढ) "अतिरिक्त प्रतिफल शुल्क" का तात्पर्य देशी शराब के अधिकतम खुदरा मूल्य को पांच रुपये के अगले गुणक तक पूर्णांकित किये जाने के फलस्वरूप प्राप्त अन्तर की धनराशि से है जो, आसवनी स्तर पर देय होगी। आसवनी द्वारा थोक पूर्तिकर्ता से एक्स डिस्टलरी प्राइस के अतिरिक्त वसूलनीय होगी एवं जो थोक पूर्तिकर्ता द्वारा देशी शराब के फुटकर लाइसेंसधारी से अधिकतम्‌ थोक मूल्य के अलावा वसूल की जा सकेगी;

(ण) "पोर्टल" का तात्पर्य विशेष रूप से निर्मित इलेक्ट्रानिक प्लेटफार्म जिस पर मदिरा निर्माण की प्रक्रिया से लेकर इसके वितरण के अन्तिम अवस्था तक की सूचनाओं को विहत प्रारूप में अपलोड किया जायेगा, से है;

(त) "ऋणशोधन क्षमता" का तात्पर्य थोक लाइसेंस की स्वीकृति के लिये आवेदन करने हेतु आवेदक के लिये निर्धारित वित्तीय पात्रता के मानदण्ड से है;

(थ) "प्रतिफल शुल्क" का तात्पर्य अधिनियम की धारा 30 के अधीन राज्य सरकार द्वारा देशी शराब की तीब्रता के अनुसार प्रति लीटर की दर से निर्धारित फीस से है, जो देशी शराब के आपूर्ति से पूर्व लाइसेंसधारी द्वारा सरकारी कोषागार में जमा की जायेगी।

(द) "उत्तर प्रदेश निर्मित शराब (यू0पी0एम0एल0) ग्रेन एक्सट्रा न्यूट्रल एल्कोहल (ई0एन0ए0) से विनिर्मित ऐसी अल्कोहलीय सांद्रता वाली देशी स्प्रिट सम्मिलित है, जैसा कि समय-समय पर राज्य सरकार के पूर्व अनुमोदन से आबकारी आयुक्त द्वारा नियत की जाय।

NOTIFICATION

In exercise of the powers under sections 24 and 41 of the United Provinces Excise Act, 1910 (U.P.

Act no-IV of 1910), read with section 21 of the Uttar Pradesh General Clauses Act, 1904 (U.P. Act no. 1 of 1904), the Excise Commissioner, Uttar Pradesh with the previous sanction of the State Government hereby makes the following rules with a view to amending the Uttar Pradesh Excise (Settlement of Licenes for wholesale of Country Liquor) Rules,2002 published vide Excise Commissioner notification no. 31276/X- Licence-58/2002-2003, dated March 26, 2002.

THE UTTAR PRADESH EXCISE (SETTLEMENT OF LICENCES FOR WHOLESALE OF COUNTRY LIQUOR) (FOURTEENTH AMENDMENT) RULES, 2021

1. Short title and commencement–(1) These rules may be called the Uttar Pradesh Excise (Settlement of Licenses for Wholesale of Country Liquor) (Fourteenth Amendment) Rules, 2021.

(2) They shall come into force with effect from the date of publication in the official Gazette.

2. Amendment of Rule 2–In the Uttar Pradesh Excise (Settlement of Licenses for Wholesale of Country Liquor) Rules, 2002 hereinafter referred to as the said rules, for rule-2 setout in Column I below, the rule as setout in Column II shall be substituted, namely:

2. Definitions–

(g) "Licence Fee" means the consideration of grant of licence for exclusive privilege of whole sale of country liquor under section- 24 of the Act, payable by the Licensee before the licence is granted to him, on such rates as notified by the Excise Commissioner with the previous sanction of the State Government.

(h) "Security Amount" means a sum equal to the 1/10th part of the license fee to be deposited through Fixed Deposit Receipt pledged in favour of Excise commissioner Uttar Pradesh, or through e-payment and refundable after the final settlement of all the claims and dues to the State Government.
