अधिसूचना
उत्तर प्रदेश साधारण खण्ड अधिनियम, 1904 (उत्तर प्रदेश अधिनियम संख्या 1 सन् 1904) की धारा 21 के साथ पठित उत्तर प्रदेश गन्ना (पूर्ति तथा खरीद विनियमन) अधिनियम, 1953 (उत्तर प्रदेश अधिनियम संख्या 24 सन् 1953) की धारा 28 के अधीन शक्तियों का प्रयोग करके, राज्यपाल उत्तर प्रदेश गन्ना (पूर्ति तथा खरीद विनियमन) नियमावली, 1954 को संशोधित करने की दृष्टि से निम्नलिखित नियमावली बनाती हैं :-

संक्षिप्त नाम और 1-(1) यह नियमावली उत्तर प्रदेश गन्ना (पूर्ति तथा खरीद विनियमन) (बत्तीसवाँ
प्रारम्भ
संशोधन) नियमावली, 2022 कही जायेगी।
(2) उक्त नियमावली का नियम-2 दिनांक 31 दिसम्बर, 2020 से तथा शेष
नियम गजट में प्रकाशित किये जाने के दिनांक में प्रवृत हुए समझे जायेंगें।
नियम 70 का
2-उत्तर प्रदेश गन्ना (पूर्ति तथा खरीद विनियमन) नियमावली, 1954, (जिसे आगे
संशोधन
उक्त नियमावली कहा गया है) में नीचे स्तम्भ-एक में दिये गये नियम 70 के स्थान पर,
स्तम्भ-द में दिया गया नियम रख दिया जायेगा, अर्थात् :-
2 उत्तर प्रदेश असाधारण गजट, 27 अप्रैल, 2022 स्तम्भ-एक स्तम्भ-दो70-वह व्यक्ति, ज ''फैक्ट्री का 70-'किसी कारखाना का अध्यासी' अध्यासी'' प्रख्यापित किया गया ह पचास के रुप में घषित व्यक्ति एक लाख रुपया हजार रुपया नकद अथवा सरकारी नकद अथवा सरकारी प्रतिभूतियं में सिक्यरिटियं में,जिसका बाजार मूल्य जिनका बाजार मूल्य एक लाख रुपया ह पचास हजार रुपया ह, अथवा पस्ट अथवा पस्ट ऑफिस नकद प्रमाण-पत्र, आफिस कैश सर्टीफिकेट, जिसका वर्तमान जिसका वर्तमान नकदीकरण का मूल्य भंजाने का मूल्य पचास हजार रुपया ह, एक लाख रुपया ह प्रतिभूति के रुप में जमानत के रुप में जमा करेगा। ऐसी जमा करेगा। ऐसी प्रतिभूति कलेक्टर के जमानत कलेक्टर के यहाँ जमा की यहाँ जमा की जायेगी अर उसे उस जायेगी अर उस समय तक रखी जायेगी, समय तक प्रतिधारित की जायेगी जब जब तक वह व्यक्ति अध्यासी के रुप मेें तक उक्त व्यक्ति अध्यासी के रुप में कार्य कार्य करेंः

किन्तु प्रतिबन्ध यह है कि कलेक्टर प्रतिबन्ध यह है कि कलेक्टर लेखबद्ध किये गये कारणं से जमानत लिखित रुप में अभिलिखित किये जाने जमा करने से छूट दे सकता है अथवा वाले कारणं से प्रतिभूति जमा करने से वह जमानत की धनराशि उस सीमा तक अभिमुक्ति प्रदान कर सकता है अथवा वह कम कर सकता है, जितनी वह उचित ऐसी लघुतर प्रतिभूति, जमा, जैसा कि वह समझे।
उचित समझे, की अनुज्ञा दे सकता है।
नियम 89 का संशधन
2- उक्त नियमावली में, नीचे स्तम्भ-एक में दिये गये नियम 89 के स्थान पर, स्तम्भ- द में दिया गया नियम रख दिया जायेगा, अर्थातः-
स्तम्भ-एक
स्तम्भ-दो धारा-88 के अधीन लाइसेन्स के लिए -नियम-88 के अधीन लाइसेन्स के लिए प्रार्थना-पत्र प्राप्त हने पर कलेक्टर प्रार्थना-पत्र प्राप्त किये जाने पर, कलेक्टर परिशिष्ट-3 के आकार-पत्र-2 में परिशिष्ट- तीन के प्रपत्र द में लाइसेन्स लाइसेन्स जारी कर सकता है। ऐसे नियम जारी कर सकता है। इस नियम के अधीन के अधीन लाइसेन्स देने के पूर्व लाइसेन्स लाइसेन्स प्रदान करने के पूर्व कलेक्टर की शर्तं का ठीक से पालन कराने के लाइसेन्स की शर्तं का सम्यक रुप से लिए कलेक्टर अधिक से अधिक बीस अनुपालन किये जाने हेतु अनधिक दस हजार रुपया तक की नकद अथवा गर्वमेन्ट हजार रुपया नकद प्रतिभूति अथवा सिक्यरिटी में जमानत मांग सकता है।
सरकारी प्रतिभूतियं की माँग कर सकता
है।

In exercise of the powers under section 28 of the Uttar Pradesh Sugarcane (Regulation of Supply and Purchase) Act, 1953 (U.P. Act no. XXIV of 1953) read with section 21 of the Uttar Pradesh General Clauses Act, 1904 (U.P. Act no. 1 of 1904), the Governor is pleased to make the following rules with a view to amending the Uttar Pradesh Sugarcane (Regulation of Supply and Purchase) Rules, 1954 :-
THE UTTAR PRADESH SUGARCANE (REGULATION OF SUPPLY AND
PURCHASE) (THIRTY SECOND AMENDMENT) RULES, 2022
Short title and 1. (1) These rules may be called the Uttar Pradesh Sugarcane (Regulation of
commencement Supply and Purchase) (Thirty Second Amendment) Rules, 2022.
(2) Rule 2 of the said rules shall be deemed to have come into force with effect from 31 December, 2020 and the remaining rules shall come into force with effect from the date of their publication in the Gazette.
Amendment of
rule 70
2. In the Uttar Pradesh Sugarcane (Regulation of Supply and Purchase) Rules, 1954 (hereinafter referred to as said rules) for rule 70 set out in Column-I below, the rule as set out in column-II shall be substituted, namely :-

The person declared as "occupier of a factory" shall deposit as security a sum of rupees fifty thousand in cash or in Government securities of the market value of rupees fifty thousand or post office cash certificate of the present encashment value of rupees fifty thousand. 89. On receipt of an application for license under rule 88, the Collector may issue a license in Form II,Appendix III. Before granting a license under this rule Collector may demand a security not exceeding rupees twenty thousand in cash or Government securities for the due observance of the conditions of the license.
