अधिसूचना

चू ंकि साधारण ख(cid:7003)ड अधिनियम, 1897 (अधिनियम संख्या 10 सन् 1897) की धारा-21 के साथ पठित मोटर यान अधिनियम, 1988 (अधिनियम संख्या 59 सन् 1988) की धारा- 65, 95, 96, 111 के अधीन शक्तियों का प्रयोग करके , उत् तर प्रदेश मोटर यान नियमावली, 1998 को संशोधित करने की दृष्टि से, उक् त अधिनियम सन् 1988 की धारा 212 की उपधारा (1) के अधीन निम्नलिखित प्रारूप, अधिसूचना संख्या- 01/2022/03/तीस-4-2022-17 (सा)-2018, दिनांक 04 जनवरी, 2022 गजट में प्रकाशित किया गया था ;

और चू ंकि प्रस्तावित नियमावली के संबंध में विहित अवधि के भीतर किसी से कोई आपत्ति एवं सुझाव प्राप्त नह(cid:7277) (cid:7263)आ ;

अतएव, अब, साधारण ख(cid:7003)ड अधिनियम, 1897 (अधिनियम संख्या 10 सन् 1897) की धारा-21 के साथ पठित मोटर यान अधिनियम, 1988 (अधिनियम संख्या 59 सन् 1988) की धारा- 65, 95, 96, 111 के अधीन शक्तियों का प्रयोग करके , राज्यपाल उत्तर प्रदेश मोटर यान नियमावली, 1998 को संशोधित करने की दृष्टि से निम्नलिखित नियमावली बनाती हैं :-

उत्तर प्रदेश मोटर यान ( अ(cid:7350)ाइसवाँ संशोधन) नियमावली, 2022

1–(1) यह नियमावली उत्तर प्रदेश मोटरयान (अ(cid:7350)ाइसव(cid:7292) संशोधन) नियमावली, 2022 कही संक्षिप्त नाम और प्रारम्भ

जाएगी।

(2) यह गजट में प्रकाशित किये जाने के दिनांक से प्रवृत्त होगी।2 उत्तर प्रदेश असाधारण गजट, 2 मई, 2022 नियम 222-घ का संशोधन

2- उत्तर प्रदेश मोटरयान नियमावली, 1998 जिसे आगे उक् त नियमावली कहा गया है, में, नियम 222 में, नीचे स्तम्भ-1 में दिये गये उपनियम (2) और (3) के स्थान पर स्तम्भ-2 में दिये गये उपनियम रख दिये जायेंगे, अर्थात्ः-

स्तम्भ-1 स्तम्भ-2 (2) डीजल/सी0एन0जी0 चालित निजी (2) डीजल/सी0एन0जी0 चालित निजी बस (ठेका गाड़ी) प्रारम्भिक रजिस्ट्रीकरण के बस (ठेका गाड़ी) प्रारम्भिक रजिस्ट्रीकरण दिनांक से 10 वर्ष से अधिक पुरानी नह(cid:7277) होगी।

के दिनांक से 15 वर्ष से अधिक पुरानी नह(cid:7277) होगी।

(3) डीजल/पेट्रोल/सी0एन0जी0 अथवा किसी अन्य स्व(cid:6994)छ चालित

(3) डीजल/पेट्रोल/सी0एन0जी0 चालित वैन, प्रारम्भिक रजिस्ट्रीकरण वैन, प्रारम्भिक रजिस्ट्रीकरण के के दिनांक से 15 वर्ष से अधिक पुरानी नह(cid:7277) होगी।

दिनांक से 10 वर्ष से अधिक पुरानी नह(cid:7277) होगी।

3- उक्त नियमावली में, नियम 222-ठ में, उपनियम ;1) में,-

नियम 222-ठ (1) का संशोधन

(एक) नीचे स्तम्भ-1 में दिये गये ख(cid:7003)ड (ख) के स्थान पर, स्तम्भ-2 में दिया गया ख(cid:7003)ड रख दिया जायेगा, अर्थात्ः-

स्तम्भ-2 खण्ड

खण्ड (ख) में आवश्यक रूप से एक आपातकालीन और एक आपातकालीन (ख) मिनी और मिडी बसों से भिन्न बसों में सेवा के विपरीत खिड़की अवश्य होगी। आपातकालीन दिशा में एक आपातकालीन निकास होगा। इसके अतिरिक्त, बस के पीछे की

ओर एक आपातकालीन निकास होगा। का आकार 150 से0मी0X120 से0मी0 होगा, जिसे अन्दर की ओर से और बाहर की ओर

तथापि मिनी और मिडी बसों की दशा से भी खोला जा सकता है। आपातकालीन

में न्यूनतम एक आपातकालीन निकास होगा और यह सेवा के विपरीत निकास खिड़की यान के प(cid:7391) भाग की ओर होगी, जो 150 से0मी0X120 से0मी0 के आकार

(तीन) ख(cid:7003)ड (ड) के प(cid:7391)ात्, निम्नलिखित ख(cid:7003)ड बढ़ा दिया जायेगा, अर्थात्ः- (ड-एक) रजिस् ट्रीकरण प्रमाणपत्र में उल्लिखित बैठने की क्षमता से अधिक संख्या में छात्रों को नह(cid:7277) ले जाया जायेगा

परन्तु यह कि स्कू ल बसों की दशा में, बारह वर्ष की आयु से कम आयु के बच्चों

को ले जाने के लिए, बैठने की क्षमता के 1.5 गुना की अनुमति होगी।

(चार) नीचे स्तम्भ-1 में दिये गये ख(cid:7003)ड (ढ), (ण) एवं (त) के स्थान पर, स्तम्भ-2 में

दिये गये ख(cid:7003)ड रख दिये जायेंगे, अर्थात्ः-41 RPH Parivahan (Niyamawali) anu-4, 2022 data 4E उत्तर प्रदेश असाधारण गजट, 2 मई, 2022 3 स्तम्भ-1 स्तम्भ-2 (ढ) यान लोके शन ट्रै(cid:7412)कग डिवाइस से युक्त होगी। यह उपबन्ध इस नियमावली के लागू होने के 03 माह के प(cid:7391)ात् प्रवृत्त हो जायेगा।

(ढ) यान लोके शन ट्रै(cid:7412)कग यंत्र से अवश्य युक् त होगी। यह उपबन्ध, राज्य सरकार द्वारा पृथक से अधिसूचित दिनांक से प्रवृत्त होगा।

(ण) में सी०सी० टीवी कै मरे का उपबन्ध अनिवार्य होगा। यह इस नियमावली के लागू होने के 03 माह प(cid:7391)ात् प्रवृत्त हो जायेगा।

(ण) में सी०सी० टीवी कै मरे का उपबन्ध अनिवार्य होगा। यह उपबन्ध, राज्य सरकार द्वारा पृथक से अधिसूचित दिनांक से प्रवृत्त होगा।

(त) (cid:7071)ाइवर के अतिरिक्त एक परिचर होगा और बालिका विद्यार्थी होने की दशा में, परिचर अनन्य रूप से महिला होनी चाहिए। ऐसी बस में यथासम् भव एक अध्यापक भी यात्रा कर सकता है।

(त) (cid:7071)ाइवर के अतिरिक्त एक परिचर होगा और बालिका विद्यार्थी होने की दशा में परिचर अनन्य रूप से महिला होनी चाहिए। उन्हें यह सुनि(िcid:7391)त करना होगा कि ऐसी बस में एक अध्यापक अवश्य यात्रा करे। (2) उपनियम (2) में,- (एक) नीचे स्तम्भ-1 में दिये गये ख(cid:7003)ड (ग) के स्थान पर, स्तम्भ-2 में दिया गया ख(cid:7003)ड

रख दिया जायेगा, अर्थात्ः-

स्तम्भ-1 स्तम्भ-2 (ग) मिनी और मिडी बसों से भिन्न बसों में सेवा के विपरीत एक आपातकालीन निकास होगा। इसके अतिरिक्त, बस के पीछे की ओर एक आपातकालीन निकास होगा। तथापि मिनी और मिडी बसों की दशा में न्यूनतम एक आपातकालीन निकास होगा और यह सेवा के विपरीत या बस के पीछे की तरफ स्थित होगा। आपातकालीन का निचला किनारा बस के तल के स्तर पर होगा और ऊपरी किनारा खिड़की के ऊपरी किनारे के स्तर पर होगा। आपातकालीन निकास की चौड़ाई 550 मि0मी0 होगी।

(ग) में एक आपातकालीन एवं एक आपातकालीन खिड़की अवश्य होगी। आपातकालीन का आकार 150 से0मी0X120 से.मी. होगा, जिसे भीतर एवं बाहर दोनों ओर से खोला जा सके । आपातकालीन निकास खिड़की यान के पीछे की ओर होगी, जो 150 से0मी0X120 से.मी. में आकार के टफन ग्लास की बनी होगी जो एक स्थायी (cid:7080)े म में फिक्स होगी। आपातकालीन निकास खिड़की के शीशे को तोड़ने के लिए पर्याप्त (cid:7390)वस्था अवश्य की जाएगी।

(दो) नीचे स्तम्भ-1 में दिये गये ख(cid:7003)ड (छ) के स्थान पर, स्तम्भ-2 में दिया गया ख(cid:7003)ड रख दिया जायेगा, अर्थात्ः-

(2) यह कि ऐसे परमिट से आ(cid:6994)छादित यान का प्रयोग किसी भी दशा में किसी सार्वजनिक स्थान में नह(cid:7277) किया जायेगा जब तक कि राज्य सरकार द्वारा उ(cid:7365)हीत और उसके सम्बन्ध में संदेय करों का सम्यक् रूप से संदत्त न कर दिया गया हो, और यदि यथास्थिति, उत्तर प्रदेश मोटर यान कराधान अधिनियम, 1997 के अधीन ऐसे कर का सम्यक् रूप से संदत्त नह(cid:7277) किया जाता है, तो यह उपधारणा की जायेगी कि परमिट के धारक ने साशय ऐसे कर के संदाय का अपवंचन किया है;

जायेगा, जिसमें उससे सम्बन्धित रजिस्ट्रीकरण

प्रमाण-पत्र, उत्तर प्रदेश मोटर यान कराधान

अधिनियम, 1997 और त(cid:7373)ीन बनाये गये

नियमों के उपबन्धों के अनुसार अ(cid:7012)य(cid:7414)पत

किया जाये या अ(cid:7012)य(cid:7414)पत कर दिया गया हो या

निलम्बित या रद्द कर दिया गया हो;

(2) यह कि ऐसे परमिट से आ(cid:6994)छादित यान का

प्रयोग किसी भी दशा में किसी सार्वजनिक

स्थान में नह(cid:7277) किया जायेगा जब तक कि राज्य

सरकार द्वारा उ(cid:7365)हीत और उसके सम्बन्ध में

संदेय करों का सम्यक् रूप से संदत्त न कर

दिया गया हो, और यदि यथास्थिति, उत्तर

प्रदेश मोटर यान कराधान अधिनियम, 1997

के अधीन ऐसे कर का सम्यक् रूप से संदत्त

नह(cid:7277) किया जाता है, तो यह उपधारणा की

जायेगी कि परमिट के धारक ने साशय ऐसे कर

के संदाय का अपवंचन किया है;

स्तम्भ-1

स्तम्भ-2 (3) यह कि धारा 82 की उपधारा (2) में यथा उपबन्धित को छोड़कर परमिट परिवहन प्राधिकरण,

जिसने परमिट स्वीकृ त किया हो, की अनु(cid:6980)ा के

सिवाय परमिट किसी अन्य (cid:7390)क्ति को अन्तरित नह(cid:7277)

की जायेगी;

(4) यह कि यान का उपयोग परमिट में

विनि(cid:7416)दष्ट क्षेत्र में या मार्ग पर या माग(cid:7300) पर किया

जायेगा;

(5) यह कि (cid:7390)क्तियों की अधिकतम संख्या या

सामान का अधिकतम भार जो परमिट से आ(cid:6994)छादित

यान में ले सके , रजिस्ट्रीकरण प्रमाण-पत्र में दी गयी

संख्या या भार से अधिक नह(cid:7277) होगा;

(6) यह कि के वल ऐसे वि(cid:6980)ापन विषय, जो

सीधे परमिटधारक के कारबार से सम्बन्धित हो,

जिसके अ(cid:7061)सर करने में परमिट प्राप्त किया जाये और

जो किसी भी प्रकार यान की पहचान को परिव(cid:7414)तत

नह(cid:7277) करता, यान पर, यान के बोनट, (cid:7080)ं ट स्(cid:7059)ीन और

डैश बोर्ड के किसी भाग के सिवाय प्रद(cid:7414)शत किया जा

सकता है:

परन्तु यह है कि वि(cid:6980)ापन का कोई विषय यान के

ऊपर रंगे (cid:7263)ए, खुदे (cid:7263)ए या जुडे (3) यह कि धारा 82 की उपधारा (2) में यथा उपबन्धित को छोड़कर परमिट परिवहन प्राधिकरण, जिसने परमिट स्वीकृ त किया हो, की अनु(cid:6980)ा के सिवाय परमिट किसी अन्य (cid:7390)क्ति को अन्तरित नह(cid:7277) की जायेगी;

(4) यह कि यान का उपयोग परमिट में विनि(cid:7416)दष्ट क्षेत्र में या मार्ग पर या माग(cid:7300) पर किया जायेगा;

(5) यह कि (cid:7390)क्तियों की अधिकतम संख्या या सामान का अधिकतम भार जो परमिट से आ(cid:6994)छादित यान में ले सके , रजिस्ट्रीकरण प्रमाण-पत्र में दी गयी संख्या या भार से अधिक नह(cid:7277) होगा;

(6) यह कि के वल ऐसे वि(cid:6980)ापन विषय, जो सीधे परमिटधारक के कारबार से सम्बन्धित हो, जिसके अ(cid:7061)सर करने में परमिट प्राप्त किया जाये और जो किसी भी प्रकार यान की पहचान को परिव(cid:7414)तत नह(cid:7277) करता, यान पर, यान के बोनट, (cid:7080)ं ट स्(cid:7059)ीन और डैश बोर्ड के किसी भाग के सिवाय प्रद(cid:7414)शत किया जा सकता है:

परन्तु यह है कि वि(cid:6980)ापन का कोई विषय यान के

़ (cid:7263)ए किसी सारवान

विवरण को न तो आ(cid:6994)छादित करेगा और न उसके

20 सेंटीमीटर के कम की दूरी पर होगा।

(7) यह कि परमिट को परमिटधारक द्वारा

ऐसी रीति से ले जाया जायेगा कि वह किसी भी

समय किसी प्राधिकृ त (cid:7390)क्ति द्वारा निरीक्षण के लिये

तुरन्त उपलब्ध हो सके ।

12. परमिट, नीचे दिये गये सम्भागों में और शर्त के अध्यधीन विधिमान्य होगी- ऊपर रंगे (cid:7263)ए, खुदे (cid:7263)ए या जुडे ़ (cid:7263)ए किसी सारवान विवरण को न तो आ(cid:6994)छादित करेगा और न उसके 20 सेंटीमीटर के कम की दूरी पर होगा।

(7) यह कि परमिट को परमिटधारक द्वारा ऐसी रीति से ले जाया जायेगा कि वह किसी भी समय किसी प्राधिकृ त (cid:7390)क्ति द्वारा निरीक्षण के लिये तुरन्त उपलब्ध हो सके ।

(ङ) यान में कोई वि(cid:6980)ापन सम्बन्धी विषय साधारणतया संप्रद(cid:7414)शत नह(cid:7277) किया जायेगा।41 RPH Parivahan (Niyamawali) anu-4, 2022 data 4E 18 उत्तर प्रदेश असाधारण गजट, 2 मई, 2022 (च) परमिटधारक उस परिवहन प्राधिकरण को जिसके द्वारा परमिट जारी की गयी है ऐसी कालिक विवरणी, सांख्यकीय और अन्य सूचना जैसे राज्य सरकार समय-समय पर विनि(cid:7416)दष्ट करे, प्रस्तुत करेगा। (छ) परमिटधारक निम्नलिखित का भी अनुपालन करेगा-

(एक) मोटर यान अधिनियम, 1988 की धारा 84 के अधीन विहित शत(cid:7288) और अधिनियम के अन्य उपबन्ध, जहाँ तक ये परमिटधारक पर लागू होते हों। (दो) ऐसी कोई अन्य शर्त या शत(cid:7288) जिसे या जिन्हें राज्य परिवहन प्राधिकरण या सम्भागीय परिवहन प्राधिकरण द्वारा विनि(cid:7416)दष्ट किया जाये।

(ज) ऐसा परिवहन प्राधिकरण जिसके द्वारा परमिट जारी की गयी है, कम से कम एक मास की सूचना देने के प(cid:7391)ात् परमिट की शत(cid:7300) में परिवर्तन कर सकता है या उसमें कोई अ(cid:7061)तर शत(cid:7288) बढ़ा सकता है।

(च) परमिटधारक उस परिवहन प्राधिकरण को जिसके द्वारा परमिट जारी की गयी है ऐसी कालिक विवरणी, सांख्यकीय और अन्य सूचना जैसे राज्य सरकार समय-समय पर विनि(cid:7416)दष्ट करे, प्रस्तुत करेगा। (छ) परमिटधारक निम्नलिखित का भी अनुपालन करेगा-

स्तम्भ-2 10. अन्य कोई शत(cid:7288)-

(1) यह कि ऐसे परमिट से आ(cid:6994)छादित यान का प्रयोग किसी भी दशा में किसी सार्वजनिक स्थान में तब तक उस अवधि के दौरान नह(cid:7277) किया जायेगा, जिसमें उससे सम्बन्धित रजिस्ट्रीकरण प्रमाण-पत्र और टोकन उत्तर प्रदेश मोटर यान कराधान अधिनियम, 1997 और त(cid:7373)ीन बनाये गये नियमों के उपबन्धों के अनुसार अ(cid:7012)य(cid:7414)पत किया जाये या अ(cid:7012)य(cid:7414)पत कर दिया गया हो या निलम्बित या रद्द कर दिया गया हो।

(2) यह कि ऐसे परमिट से आ(cid:6994)छादित यान का प्रयोग किसी भी दशा में किसी सार्वजनिक स्थान में तब तक नह(cid:7277) किया जायेगा जब तक कि राज्य सरकार द्वारा उ(cid:7365)हीत और उसके सम्बन्ध में देय करों का सम्यक् भुगतान न कर दिया गया हो, और यदि यथास्थिति, उत्तर प्रदेश मोटर यान कराधान अधिनियम, 1997 में ऐसे कर का सम्यक् भुगतान नह(cid:7277) किया जाता है, तो यह उपधारणा की जायेगी कि परमिट के धारक ने साशय ऐसे कर के भुगतान का अपवंचन किया है।

(3) यह कि धारा 82 की उपधारा (2) में यथा उपबन्धित के सिवाय परिवहन प्राधिकरण, जिसने परमिट स्वीकृ त किया हो, की अनु(cid:6980)ा के सिवाय परमिट किसी अन्य (cid:7390)क्ति को अन्तरित नह(cid:7277) की जायेगी।

परन्तु यह कि वि(cid:6980)ापन का कोई विषय यान के ऊपर रंगे (cid:7263)ए, खुदे (cid:7263)ए या जुडे ़ (cid:7263)ए किसी सारवान विवरण को न तो आ(cid:6994)छादित करेगा और न उसके 20 सेंटीमीटर के कम की दूरी पर होगा।

(7) यह कि परमिट को परमिटधारक द्वारा ऐसी रीति से ले जाया जायेगा कि वह किसी भी समय प्राधिकृ त (cid:7390)क्ति के निरीक्षण के लिये तुरन्त उपलब्ध हो सके ।

11. परमिट सम्भाग में भी नीचे दी गयी शत(cid:7300) के अध्यधीन विधिमान्य है-

AND Whereas no objection and suggestion was received from anyone within the prescribed period with respect to the proposed rules;

(3) That save as provided in sub- section (2) of section 82 the permit shall not be transferred to any other person except with the permission of the Transport Authority which granted the permit;

(5) That the maximum number of persons or maximum weight of luggage that may be carried in the vehicle covered by the permit shall not exceed as given in the certificate of registrations.

Provided that no advertising matter shall cover or be at a distance of less than 20 centimetres of any material descriptions painted, inscribed or fixed in or over the vehicle.

(7) That the holder of the permit shall cause the permit to be carried in the vehicle in such a manner that it is readily available for inspection at any time by any authorised person.

(4) That the vehicle shall be used in the area or on the route or routes specified in permit;

(5) That the maximum number of persons or maximum weight of luggage that may be carried in the vehicle covered by the permit shall not exceed as given in the certificate of registrations.
