चूंकि साधारण खण्ड अधिनियम, 1897 (अधिनियम संख्या 10 सन् 1897) की धारा-21 के साथ पठित मोटर यान अधिनियम , 1988 (अधिनियम संख्या 59 सन् 1988 ) की धारा65, 95, 96, 111 के अधीन शक्तियों का प्रयोग करके, उत्तर प्रदेश मोटर यान नियमावली, 1998 को संशोधित करने की दृष्टि से, उक्त अधिनियम सन् 1988 की धारा 212 की उपधारा ( 1 ) के अधीन निम्नलिखित प्रारूप , अधिसूचना संख्या-01 /2022/03/तीस- 4-2022-17 ( सा) -2018 , दिनांक 04 जनवरी, 2022 गजट में प्रकाशित किया गया था :

और चूंकि प्रस्तावित नियमावली के संबंध में विहित अवधि के भीतर किसी से कोई आपत्ति एवं सुझाव प्राप्त नहीं हुआ:

अतएव, अॅब, साधारण खण्ड अधिनियम, 1897 (अधिनियम संख्या10 सन् 1897 ) की धारा-21 के साथ पठित मोटर यान अधिनियम, 1988 (अधिनियम संख्या 59 सन् 1988) की धारा65, 95, 96, 111 के अधीन शक्तियों का प्रयोग करके, राज्यपाल उत्तर प्रदेश मोटर यान नियमावली , 1998 को संशोधित करने की दृष्टिसे निम्नलिखित नियमावली बनाती हैं :-

उत्तर प्रदेश मोटर यान ( अट्ठाइसवाँ संशोधन) नियमावली, 2022

1-(1 ) यह नियमावली उत्तर प्रदेश मोटरयान (अ‌ट्ठाइसवाँ संशोधन) नियमावली, 2022 संक्षिप्त नाम कहीजाएगी । और प्रारम्भ

(2) यह गजट में प्रकाशित किये जाने के दिनांक से प्रवृत्त होगी।

नियम 222-घ कासंशोधम

2- उत्तर प्रदेश मोटरयान नियमावली , 1998 जिसे आगे उक्त नियमावली कहा गया है, में, नियम 222 में , नीचे स्तम्भ-1 में दिये गये उपनियम (2) और ( 3 ) के स्थान पर स्तम्भ-2 में दिये गये उपनियम रख दिये जायेंगे, अर्थात्ः-

स्तम्भ-2

स्तम्भ-1 विद्यमान उपनियम

एतद्वारा प्रतिस्थापित उपनियम

(2) डीजल /सी० एन०जी० चालित निजी बस (ठेका गाड़ी) प्रारम्भिक रजिस्ट्रीकरण के दिनांक से 10 वर्ष से अधिक पुरानी नहीं होगी।

(2) डीजल/सी० एन०जी० चालित निजी बस ( ठेका गाड़ी) प्रारम्भिक रजिस्ट्रीकरण के दिनांक से 15 वर्ष से अधिक पुरानी नहीं होगी।

(3) डीजल/पेट्रोल/सी०एन०जी० चालित विद्यालय वैन, प्रारम्भिक रजिस्ट्रीकरण के दिनांक से 15 वर्ष से अधिक पुरानी नहीं होगी।

(3) डीजल/पेट्रोल/सी०एन०जी० अथवा किसी अन्य स्वच्छ ईधन चालित विद्यालय वैन , प्रारम्भिक रजिस्ट्रीकरण के दिनांक से 10 वर्ष से अधिक पुरानी नहीं होगी।

नियम 222- ठ 3- उक्त नियमावली में, नियम 222 -ठ में, उपनियम ( 1 ) में, -

(1)का

संशोधन

(एक) नीचे स्तम्भ-1 में दिये गये खण्ड (ख) के स्थान पर, स्तम्भ-2 में दिया गया खण्ड रख दिया जायेगा , अर्थात्ः-

स्तम्भ-2 एतद्वारा प्रतिस्थापित खण्ड

(ख) में आवश्यक रूप से एक आपातकालीन द्वार और एक आपातकालीन खिड़की अवश्य होगी। आपातकालीन द्वार का आकार 150 से0 मी0X120 से० मी० होगा , जिसे अन्दर की ओर से और बाहर की ओर से भी खोला जा सकता है । आपातकालीन निकास खिड़की यान के पश्च भाग की ओर होगी, जो 150 से0मी0X120 से० मी ० के आकार के टफन ग्लास की बनी होगी जिसे एक स्थायी फ्रेम में फिक्स किया गया होगा । आपातकालीन निकास खिड़की के शीशे को तोड़ने के लिए पर्याप्त व्यवस्था करनी आवश्यक होगी।

(ख) मिनी और मिडी बसों से भिन्न बसों में सेवा द्वार के विपरीत दिशा में एक आपातकालीन निकास होगा। इसके अतिरिक्त, बस के पीछे की ओर एक आपातकालीन निकास होगा। तथापि मिनी और मिडी बसों की दशा में न्यूनतम एक आपातकालीन निकास होगा और यह सेवा द्वार के विपरीत या बस के पीछे की तरफ स्थित होगा । आपातकालीन द्वार का निचला किनारा, बस के तल के स्तर पर होगा और ऊपरी किनारा खिड़की के ऊपरी किनारे के स्तर पर होगा। आपातकालीन निकास की चौड़ाई 550 मिमी होगी।

(दो) नीचे स्तम्भ-1 में दिये गये खण्ड (ञ) के स्थान पर , स्तम्भ-2 में दिया गया खण्ड रख दिया जायेगा, अर्थात्ः-

स्तम्भ-1

विद्यमान खण्ड

एतद्वारा प्रतिस्थापित खण्ड

(ञ) में सीट बैल्ट लगायी जायेंगी ।

(ञ) की समस्त सीटों में सीट बैल्ट

लगाई जायेंगी ।

(तीन) खण्ड (ड) के पश्चात्, निम्नलिखित खण्ड बढ़ा दिया जायेगा, अर्थात्ः-

(ड-एक) रजिस्ट्रीकरण प्रमाणपत्र में उल्लिखित बैठने की क्षमता से अधिक संख्या में छात्रों को नहीं ले जाया जायेगाः

परन्तु यह कि स्कूल बसों की दशा में, बारह वर्ष की आयु से कम आयु के बच्चों को ले जाने के लिए , बैठने की क्षमता के 1.5 गुना की अनुमति होगी ।

(चार) नीचे स्तम्भ-1 में दिये गये खण्ड (ढ) , (ण) एवं (त) के स्थान पर, स्तम्भ-2 में दिये गये खण्ड रख दिये जायेंगे , अर्थात्ः-

एतद्वारा प्रतिस्थापित खण्ड

(ढ) यान लोकेशन ट्रैकिंग यंत्र से अवश्य युक्त होगी। यह उपबन्ध, राज्य सरकार द्वारा पृथक से अधिसूचित दिनांक से प्रवृत्त होगा।

(ढ) यान लोकेशन ट्रैकिंग डिवाइस से युक्त होगी । यह उपबन्ध इस नियमावली के लागू होने के 03 माह के पश्चात् प्रवृत्त हो जायेगा।

(ण) में सी०सी० टीवी कैमरे का उपबन्ध अनिवार्य होगा । यह उपबन्ध, राज्य सरकार द्वारा पृथक से अधिसूचित दिनांक से प्रवृत्त होगा ।

(ण) में सी०सी० टीवी कैमरे का उपबन्ध अनिवार्य होगा। यह इस नियमावली के लागू होने के 03 माह पश्चात् प्रवृत्त हो जायेगा।

(त) ड्राइवर के अतिरिक्त एक परिचर होगा और बालिका विद्यार्थी होने की दशा में , परिचर अनन्य रूप से महिला होनी चाहिए । ऐसी बस में यथासम्भव एक अध्यापक भी यात्रा कर सकता है ।

(त) ड्राइवर के अतिरिक्त एक परिचर होगा और बालिका वि‌द्यार्थी होने की दशा में परिचर अनन्य रूप से महिला होनी चाहिए । उन्हें यह सुनिश्चित करना होगा कि ऐसी बस में एक अध्यापक अवश्य यात्रा करे ।

(2) उपनियम (2) में, -

(एक) नीचे स्तम्भ-1 में दिये गये खण्ड ( ग) के स्थान पर , स्तम्भ-2 में दिया गया खण्ड रख दिया जायेगा, अर्थात्ः-

(घ) एक फर्स्ट-एड बाक्स तथा

एक 02 किग्रा० के बी० आई० एस ० मार्क के एक अग्नि शामक यन्त्र से (घ) एक फर्स्ट-एड बाक्स तथा एक 5 किग्रा० के बी०आई० एस० मार्क के एक अग्नि शामक यन्त्र से सुसज्जित होगी।

सुसज्जितहोगी।

(दो) नीचे स्तम्भ-1 में दिये गये खण्ड (च) के स्थान पर स्तम्भ-2 में दिया गया खण्ड रख दिया जायेगा, अर्थात्ः-

होंगी। (च) में सीट बैल्ट सुसज्जित (च) की समस्त सीटें सीट बैल्ट से सुसज्जितहोगी।

(झ) में यान लोकेशन ट्रैकिंग यन्त्र अवश्य लगा होना चाहिए । यह उपबन्ध, राज्य सरकार द्वारा पृथक से अधिसूचित दिनांक से प्रवृत्त होगा ।

(झ) में यान लोकेशन ट्रैकिंग यन्त्र अवश्य लगा होना चाहिए। यह उपबन्ध इस नियमावली के लागू होने के 03 माह पश्चात्प्रवृत्त होगा।

(ञ) ऐसे विद्यालय वैनों में सी०सी० टीवी कैमरे का उपबन्ध किया जाना अनिवार्य होगा। यह इस नियमावली के लागू होने के 03 माह पश्चात् प्रवृत्त हो जायेगा ।

(ञ) ऐसे विद्यालय वैनों में सी०सी० टीवी कैमरे का उपबन्ध किया जाना अनिवार्य होगा। यह उपबन्ध, राज्य सरकार द्वारा पृथक से अधिसूचित दिनांक से प्रवृत्त होगा।

(ट) ड्राइवर के अतिरिक्त एक परिचर होगा और यदि बालिका विद्यार्थी हो तो परिचर महिला होनी चाहिए।

(ट) ड्राइवर के अतिरिक्त एक परिचर होगा और यदि बालिका वि‌द्यार्थी हो तो परिचर महिला होनी चाहिए । उन्हें यह सुनिश्चित करना होगा कि ऐसे वैन में एक अध्यापक अवश्य यात्रा करे ।

नियम 222-5 का संशोधन 4- उक्त नियमावली में, नियम 222 -ड में, खण्ड (ख) के पश्चात्, निम्नलिखित खण्ड बढ़ा दिये जायेंगे, अर्थात्ः-

(ख -एक) "मिडी बस " का तात्पर्य ऐसी किसी ओमनी बस से है जिसकी जिसकी सीटिंग क्षमता 23 से 37 तक हो।

(ख-दो) "मिनी बस " का तात्पर्य ऐसी किसी ओमनी बस से है, जिसकी सीटिंग क्षमता 13 से 22 तक हो ।

21क एवं 5- द्वितीय अनुसूची में , नीचे स्तम्भ-1 में दिये गये प्रपत्र एस 0आर0-21क एवं एस0आर0-21ख के स्थान पर , स्तम्भ-2 में दिये गये प्रपत्र रख दिये जायेंगे, अर्थात्ः-

10. अन्य शर्तें-

(1) यह कि ऐसे परमिट से आच्छादित यान का उपयोग किसी भी दशा में किसी सार्वजनिक स्थान में उस अवधि के दौरान नहीं किया जायेगा, जिसमें उससे सम्बन्धित रजिस्ट्रीकरण प्रमाण-पत्र, उत्तर प्रदेश मोटर यान कराधान अधिनियम, 1997 और तद्धीन बनाये गये नियमोंके उपबन्धों के अनुसार अभ्यर्पित किया जाये या अभ्यर्पित कर दिया गया हो या निलम्बित या रद्द कर दिया गया हो।

(1 ) यह कि ऐसे परमिट से आच्छादित यान का उपयोग किसी भी दशा में किसी सार्वजनिक स्थान में उस अवधि के दौरान नहीं किया जायेगा, जिसमें उससे सम्बन्धित रजिस्ट्रीकरण प्रमाण-पत्र, उत्तर प्रदेश मोटर यान कराधान अधिनियम, 1997 और तद्धीन बनाये गये नियमों के उपबन्धोंके अनुसार अभ्यर्पित किया जाये या अभ्यर्पित कर दिया गया हो या निलम्बित या रद्द कर दिया गया हो।

(2) यह किऐसे परमिट से आच्छादित यान का उपयोग किसी भी दशा में किसी सार्वजनिक स्थान में नहीं किया जायेगा जब तक कि राज्य सरकार द्वारा उद्वहित और उसके सम्बन्ध में संदेय करों का सम्यक् रूप से संदत्त न कर दिया गया हो, और यदि यथास्थिति, उत्तर प्रदेश मोटर यान कराधान अधिनियम, 1997 के अधीन ऐसे कर का सम्यक् रूप से संदत्त नहीं किया जाता है, तो यह उपधारणा की जायेगी कि परमिट के धारक ने साशय ऐसे कर के संदाय का अपवंचन किया है।

(3) यह कि धारा 82 की उपधारा (2) में यथा उपबन्धित के सिवाय परिवहन प्राधिकरण , जिसने परमिट स्वीकृत किया हो, कीअनुज्ञा के सिवाय परमिट किसी अन्य व्यक्तिको अन्तरित नहीं किया जायेगा।

(4) यह कि यान का उपयोग परमिट में विनिर्दिष्ट क्षेत्र में या मार्ग पर या मार्गों पर किया जायेगा।

(5) यह कि व्यक्तियों की अधिकतम संख्या या सामान का अधिकतम भार जो परमिट से आच्छादित यान में ले जाया जा सके, रजिस्ट्रीकरण प्रमाण-पत्र में दीगयी संख्या या भार से अधिक नहीं होगा।

यह कि केवल ऐसे विज्ञापन विषय, जो

(6) यह कि केवल ऐसे विज्ञापन विषय, जो सीधे परमिटधारक के कारबार से सम्बन्धित हो, जिसके अग्रसर करने में परमिट प्राप्त किया जाये और जो किसी भी प्रकार यान की पहचान को परिवर्तित नहीं करता, यान पर, यान के बोनट, फ्रंट स्क्रीन और डैश बोर्ड के किसी भाग के सिवाय प्रदर्शित किया जा सकता है:-

(6) सीधे परमिटधारक के कारवार से सम्बन्धित हो, जिसके अग्रसर करने में परमिट प्राप्त किया जाये और जो किसी भी प्रकार यान की पहचान को परिवर्तित नहीं करता, यान पर, यान के बोनट, फ्रंट स्क्रीन और डैश बोर्ड के किसी भाग के सिवाय प्रदर्शित किया जा सकता है:-

परन्तुविज्ञापन का कोई विषय यान के ऊपर रंगे हुए, खुदे हुए या जुड़े हुए किसी सारवान विवरण को न तो आच्छादित करेगा और न उसके 20 सेंटीमीटर के कम की दूरी पर होगा।

(7) यह कि परमिट को परमिटधारक द्वारा ऐसी रीतिसे ले जाया जायेगा कि वह किसी भी समय किसी प्राधिकृत व्यक्ति के निरीक्षण के लिये तुरन्त उपलब्ध हो सके।

(1) यह कि ऐसे परमिट से आच्छादित यान का उपयोग किसी भी दशा में किसी सार्वजनिक स्थान में उस अवधि के दौरान नहीं किया जायेगा, जिसमें उससे सम्बन्धित रजिस्ट्रीकरण प्रमाण-पत्र, उत्तर प्रदेश मोटर यान कराधान अधिनियम, 1997 और तद्धीन बनाये गये नियमों के उपबन्धों के अनुसार अभ्यर्पित किया जाये या अभ्यर्पित कर दिया गया हो या निलम्बित या रद्द कर दिया गया हो,

(1 ) यह कि ऐसे परमिट से आच्छादित यान का उपयोग किसी भी दशा में किसी सार्वजनिक स्थान में उस अवधि के दौरान नहीं किया जायेगा, जिसमें उससे सम्बन्धित रजिस्ट्रीकरण प्रमाण-पत्र, उत्तर प्रदेश मोटर यान कराधान अधिनियम, 1997 और तद्धीन बनाये गये नियमों के उपबन्धों के अनुसार अभ्यर्पित किया जाये या अभ्यर्पित कर दिया गया हो या निलम्बित या रद्द कर दिया गया हो;

9. शर्ते-

(क) यान का उपयोग केवल परमिट में निर्दिष्ट क्षेत्र मेंयान मार्ग या मार्गों पर किया जाएगा।

(ख) परमिटधारक यान के सामने छत के स्तर पर लगाये गये पट्टे या प्लेट या सफेद आधार पर काले अक्षरों में कम से कम 10 सेन्टीमीटर की ऊँचाई के शब्द "निजी सेवायान" सुपाठ्य रूप से संप्रदर्शित करेगा।

(ग) परमिट से आच्छादित यान में ऐसे व्यक्तियों की जिन्हें यान में ले जाया जा सका है, अधिकतम संख्या से अधिक नहीं होगी और सामान जो ले जाया जा सकता है अधिकतम भार ...कुन्तल से अधिक नहीं होगा।

(घ) यान की सुख सुविधा, स्वच्छता और अनुरक्षण का मानक जैसा कि मोटरयान अधिनियम, 1988 या तद्धीन बनाये गये नियमों में सार्वजनिक सेवायानों के लिए विनिर्दिष्ट है, यान में बनाये रखा जायेगा।

(ङ) यान में कोई विज्ञापन सम्बन्धी विषय साधारणतया संप्रदर्शित नहीं किया जायेगा।

(च) परमिटधारक उस परिवहन प्राधिकरण को जिसके द्वारा परमिट जारी की गयी है ऐसी कालिक विवरणी, सांख्यकीय और अन्य सूचना जैसे राज्य सरकार समय - समय पर विनिर्दिष्ट करे, प्रस्तुत करेगा।

(छ) परमिटधारक निम्नलिखित का भी अनुपालन

करेगा-

(एक) मोटर यान अधिनियम, 1988 की धारा 84 के अधीन विहित शर्तें और अधिनियम के अन्य उपबन्ध, जहाँ तक ये परमिटधारक पर लागूहोते हों।

(दो) ऐसी कोई अन्य शर्त या शर्तें जिसे या जिन्हें राज्य परिवहन प्राधिकरण या सम्भागीय परिवहन प्राधिकरण द्वारा विनिर्दिष्ट किया जाये।

(ज) ऐसा परिवहन प्राधिकरण जिसके द्वारा परमिट जारी की गयी है, कम से कम एक मास की सूचना देने के पश्चात् परमिट की शर्तों में परिवर्तन कर सकता है या उसमें कोई अग्रतर शर्तें बढ़ा सकता है।

(2) यह कि ऐसे परमिट से आच्छादित यान का प्रयोग किसी भी दशा में किसी सार्वजनिक स्थान में तब तक नहीं किया जायेगा जब तक कि राज्य सरकार द्वारा उद्वहीत और उसके सम्बन्ध में देय करों का सम्यक् भुगतान न कर दिया गया हो, और यदि यथास्थिति, उत्तर प्रदेश मोटर यान कराधान अधिनियम, 1997 में ऐसे कर का सम्यक् भुगतान नहीं किया जाता है, तो यह उपधारणा की जायेगी कि परमिट के धारक ने साशय ऐसे कर के भुगतान काअपवंचन किया है।

(3) यह कि धारा 82 की उपधारा (2) में यथा उपबन्धित के सिवाय परिवहन प्राधिकरण, जिसने परमिट स्वीकृत किया हो, की अनुज्ञा के सिवाय परमिट किसी अन्य व्यक्ति को अन्तरित नहीं की जायेगी।

(3) यह कि धारा 82 की उपधारा (2 ) में यथा उपबन्धित के सिवाय परिवहन प्राधिकरण , जिसने परमिट स्वीकृत किया हो, की अनुज्ञा के सिवाय परमिट किसी अन्य व्यक्ति को अन्तरित नहीं की जायेगी।

(4) यह कि यान का प्रयोग परमिट में विनिर्दिष्ट क्षेत्र में या मार्ग पर या मार्गों पर किया जायेगा।

(5) यह कि व्यक्तियों की अधिकतम संख्या या सामान का अधिकतम भार जो परमिट से आच्छादित यान में ले जा सके, रजिस्ट्रीकरण प्रमाण-पत्र में दी गयी संख्या या भार से अधिक नहींहोगा।

(6) यह कि केवल ऐसे विज्ञापन विषय, जो सीधे परमिटधारक के कारवार से सम्बन्धित हो, जिसके अग्रसर करने में परमिट प्राप्त किया जाये और जो किसी भी प्रकार यान की पहचान को परिवर्तित नहीं करता, यान पर बोनट, फ्रंट स्क्रीन और डैश बोर्ड के किसी भाग के सिवाय प्रदर्शित किया जा सकता है।

परन्तु यह कि विज्ञापन का कोई विषय यान के ऊपर रंगे हुए, खुदे हुए या जुड़े हुए किसी सारवान विवरण को न तो आच्छादित करेगा और न उसके 20सेंटीमीटर के कम की दूरी पर होगा।

(7) यह कि परमिट को परमिटधारक द्वारा ऐसी रीति से ले जाया जायेगा कि वह किसी भी समय प्राधिकृत व्यक्ति के निरीक्षण के लिये तुरन्त उपलब्ध होसके।

IN pursuance of the provisions of clause (3 ) of Article 348 of the Constitution , the Governor is pleased to order the publication of the following English translation of notification no . 11 /2022 /526 /XXX- 4-2022-17( sa. ) -2018, dated May 2, 2022:

WHEREAS in exercise of the powers under sections 65, 95 , 96, 111 of the Motor Vehicles Act , 1988 (Act no . 59 of 1988) read with section 21 of the General Clauses Act, 1897 (Act no . 10 of 1897) the following draft was published in the Gazette with a view to amending the Uttar Pradesh Motor Vehicles Rules , 1998 vide notification no . 01 /2022 /03/XXX-4-2022-17(sa)-2018 , dated 4 January, 2022 as required under sub section ( 1 ) of Section 212 of the said Act of 1988 ;

AND Whereas no objection and suggestion was received from anyone within the prescribed periodwith respect to the proposed rules;

NOW, THEREFORE, in exercise of the powers under sections 65 , 95 , 96, 111 of the Motor Vehicles Act, 1988 (Act no . 59 of 1988 ) read with section 21 of the General Clauses Act, 1897 (Act no . 10 of 1897) , the governor is pleased to make the following rules with a view to amending the Uttar Pradesh Motor Vehicles Rules , 1998 .

THE UTTAR PRADESH MOTOR VEHICLES (TWENTY EIGHTH AMENDMENT) RULES , 2022

Short title and

commencement 1. (1 ) These rules maybe called the Uttar Pradesh Motor Vehicles (Twenty Eighth Amendment ) Rules , 2022.

(2) They shall come into force with effect from the date of their publication in theGazette.

Amendment of Rule 222 D 2. In the Uttar Pradesh Motor Vehicles Rules , 1998 , hereinafter referred to as the said rules , in rule 222 for sub - rules (2) and (3 ) set out in Column- 1 below , the sub- rules as set out in Column-2 shall be substituted, namely: -

(2) The diesel/CNG driven private bus(contract carriage) shall not be more than 15 years old from the date of initial registration.

(3) The school van, driven by diesel/petrol/CNG , shall not be more than 15 years old from the date of initial registration.

3. In the said rules in rule 222 L , -

(i) for clause (b) set out in Column - 1 below, the clause as set out in Column- 2 shall be substituted, namely: -

(b) shall have necessarily an emergency gate and an emergency window. The size of the emergency gate will be 150 cms X 120 cms , which may be opened from inside and outside also. The emergency exit window will be at rear side of the vehicle which will be 150 cms X 120 cms size made of tuffened glass which will be fixed in a fixed frame. Adequate arrangement must be kept to break the glass of the emergency exit window.

(b) other than mini and midi buses , shall have an emergency exit on the opposite side of service door . In addition, there shall be an emergency exiton the rear side of bus . However in case of mini and midi buses there shall be minimum one emergency exit and it shall be situated either on the opposite side of service door or at the rear side of the bus . The lower edge of the emergency door shall be at the level of bus floor and top edge shall be at the level of upper edge of window. The width of emergency exit shall be 550 mm.

(ii) for clause (j ) set out in Column - 1 below, the clause as set out in Column - 2 shall be substituted, namely:-

(iv) for clauses (n) , (o) and (p ) set out in Column - 1 below , the clauses as set out in Column-2 shall be substituted, namely : -
