भूमि अर्जन, पुनर्वासन और पुनव्र्यवस्थापन में उचित प्रतिकर और पारदर्शिता का अधिकार अधिनियम, 2013 (अधिनियम संख्या 30 सन्‌ 2013) (जिसे आगे उक्त अधिनियम कहा गया है) की धारा 11 की उपधारा (1) के अधीन चूंँकि उत्तर प्रदेश सरकार का यह समाधान हो गया है कि जिला सम्भल की

के ग्राम ततारपुर संदल की 0.250 हेक्टेयर, वसला की 0.0058 हेक्टेयर, ईसापुर सुनवारी की 0.659 हेक्टेयर, रसूलपुर धतरा की 0.8565 हेक्टेयर, कसेरवा की 1.293 हेक्टेयर, भटौला की 1.2865 हेक्टेयर, बंजरपुरी की 1.161 हेक्टेयर, बिचपुरी की 0.187 हेक्टेयर, चिरौंली भगवन्तपुर की 1.513 हेक्टेयर, खिरनी मुहीउद्वीनपुर की 0.819 हेक्टेयर, बहादुरपुर सराय उर्फ रायपुर की 0.175 हेक्टेयर, ढाडौल की 0.3024 हेक्टेयर, धर्मपुर निकट ढाढौल की 0.0498 हेक्टेयर, बल्लमपुर की 0.1795 हेक्टेयर, रायपुर कलां की 0.5271 हेक्टेयर, राजपुर की 3.38929 हेक्टेयर, लहरावन की 1.0765 हेक्टेयर, किरारी की 0.528 हेक्टेयर, अतरासी की 0.49009 हेक्टेयर, मिर्जापुर अख्तरा की 2.477 हेक्टेयर, फतेहपुर शमसोई की 0.9522 हेक्टेयर, बिसारू की 0.8800 हेक्टेयर, भूमि की, लोक मझौला की 0.7406 हेक्टेयर, अचलपुर की 0.0004 हेक्टेयर प्रयोजन अर्थात्‌ उत्तर प्रदेश एक्सपे्रसवेज औद्योगिक विकास प्राधिकरण के माध्यम से गंगा एक्सप्रेसवे परियोजना हेतु आवश्यकता है।

2-राज्य सामाजिक समाघात निर्धारण अभिकरण द्वारा सामाजिक समाघात निर्धारण सम्बन्धी अध्ययन किया गया था और उसने उत्तर प्रदेश सरकार को अपनी संस्तुतियाँ प्रस्तुत कर दी है जिसने दिनांक 12 अप्रैल, 2022 को उसकी संस्तुति को अनुमोदित कर दिया है।39 त्च्भ् ;।नककलवहपा.22द्ध. 2022 कंजं 4म 2 उत्तर प्रदेश असाधारण गजट, 2 मई, 2022 3-संक्षेप में, सामाजिक समाघात निर्धारण रिपोर्ट और सामाजिक समाघात प्रबंध योजना से संबंधित बहुशाखीय विशेषज्ञ समूह की संस्तुतियाँ निम्नानुसार हैं :-

(क) गंगा एक्सप्रेसवे परियोजना एक पारंपरिक परियोजना है, जो किसी प्रभावित ग्राम में अधिकतम 120 मी0 चौड़ाई की भूमि पट्‌टी पर संचालित की जा रही है। इस प्रकार यह परियोजना, किसी ग्राम के अधिकांश अथवा कुल क्षेत्र को प्रभावित नहीं कर रही है ताकि इस परियोजना से विस्थापन नगण्य हो।

(ख) यद्यपि इस परियोजना के संबंधित ग्रामों के कृषि योग्य क्षेत्रफल में कमी आना संभाव्य है किन्तु भूमि के सर्किल दर के चार गुना के बराबर के प्रतिकर से कृषकों को फार्मों का उन्नयन करने, फार्म मशीनरी में वृद्धि करने और सिंचाई सुविधाओं को विकसित करने में सहायता प्राप्त होगी।

(ग) भूमि अर्जन के प्रतिकर से वैकल्पिक रोजगार के साधनों में विकास, उत्तम आवास निर्माण, परिवहन के साधनों तथा कृषि प्रौद्योगिकी में विकास होना संभाव्य है। इससे भू-धृतियों में होने वाली ह्रास की क्षति की पूर्ति होगी।

(घ) लम्बी दूरी की इस परियोजना से उत्तर प्रदेश के सुदूरवर्ती क्षेत्रों का राज्य की राजधानी लखनऊ से जुड़ना संभाव्य होगा जिससे समय और लागत में कमी आयेगी और वाणिज्यिक क्रियाकलापों का विकास होगा। इससे दुग्ध एवं दुग्ध उत्पादों, फलों एवं सब्जियों तथा अन्य विनश्वर वस्तुओं को बड़े बाजारों तक ले जाने में सुविधा होगी और यह कृषि एवं सहबद्ध प्रयोजनों में सहायक होगा।

(ङ) तीव्र एवं अपेक्षाकृत उत्तम परिवहन साधनों की वृद्धि से पर्यटन, चिकित्सा परिचर्या और अन्तर्राज्यीय परिवहन को भी बढ़ावा मिलेगा।

(च) अतएव बहुशाखीय विशेषज्ञ समूह की संस्तुति निम्नानुसार है :-

(एक) जिला सम्भल में गंगा एक्सप्रेसवे परियोजना के प्रयोजनार्थ भूमि अर्जित करना लोकहित में है और इससे लोक प्रयोजन की पूर्ति होती है;

(दो) इस परियोजना की संभाव्य प्रसुविधाएं, सामाजिक व्यय एवं प्रतिकूल सामाजिक समाघातों की अपेक्षाकृत अधिक है और अर्जित की जाने वाली कुल भूमि, इस परियोजना के लिए अपेक्षित कुल भूमि से अत्यंत कम है।

4-समिति की उपरोक्त संस्तुतियों के संदर्भ में यह उल्लेखनीय है कि गंगा एक्सप्रेसवे परियोजना द्वारा प्रभावित क्षेत्र के लिए सर्किल दर का पुनरीक्षण, स्टाम्प एवं निबन्धन विभाग/कलेक्टर, सम्भल द्वारा निर्धारित प्रक्रिया के अनुसार किया जायेगा।

कलेक्टर द्वारा भूमि के बाजार मूल्य का अवधारण किये जाने की प्रक्रिया, उक्त अधिनियम की धारा 26 में उल्लिखित है। उक्त धारा की उपधारा (1) के खण्ड (ख) में यह भी उल्लिखित है कि निकटतम समीपस्थ क्षेत्र में स्थित समान प्रकार की भूमि के औसत विक्रय मूल्य का अवधारण, कलेक्टर द्वारा किया जायेगा।

5-इस परियोजना हेतु भूमि अर्जन के कारण किसी परिवार का विस्थापित होना सम्भाव्य न हो। 6-अतएव, राज्यपाल सामान्य सूचना हेतु यह अधिसूचित करती हैं कि नीचे अनुसूची में उल्लिखित भूमि की लोक प्रयोजन हेतु आवश्यकता है।

अनुसूची

7-राज्यपाल, उक्त अधिनियम की धारा 12 के अधीन यथा उपबन्धित तथा विनिर्दिष्ट रूप में, भूमि अर्जन के प्रयोजन हेतु आवश्यक कदम उठाये जाने, भूमि में प्रवेश करने तथा उसका सर्वेक्षण करने, किसी भूमि का समतलीकरण करने, खुदाई करने तथा कार्य के समुचित क्रियान्वयन हेतु अपेक्षित समस्त कार्य करने के लिए कलेक्टर को प्राधिकृृत करती हैं।

8-उक्त अधिनियम की धारा 15 के अधीन भूमि में हितबद्ध कोई व्यक्ति, इस अधिसूचना को प्रकाशित किये जाने के पश्चात्‌ 60 दिन के भीतर अपने क्षेत्र में भूमि अर्जन करने के विरूद्ध लिखित रूप में कलेक्टर को आपत्ति प्रस्तुत कर सकता है।

9-उक्त अधिनियम की धारा 11 की उपधारा (4) के अधीन कोई व्यक्ति, ऐसी अधिसूचना केे प्रकाशित किये जाने के दिनांक से भूमि अर्जन की कार्यवाहियां पूर्ण होने तक कलेक्टर के पूर्व अनुमोदन के बिना प्रारम्भिक अधिसूचना में विनिर्दिष्ट भूमि का कोई संव्यवहार नहीं करेगा अथवा उसका संव्यवहार अर्थात्‌ विक्रय/क्रय नहीं करने देगा अथवा ऐसी भूमि पर कोई विल्लंगम सृजित नहीं करेगा। उक्त भूमि का स्थल नक्शा कलेक्टर, सम्भल के कार्यालय में देखा जा सकता है।

IN pursuance of the provisions of clause (3) of Article 348 of the Constitution, the Governor is pleased to order the publication of the following English translation of notification no. 459/LXXVII-3– 2022-77(M)-2021, dated May 2, 2022:

UNDER sub-section (1) of section 11 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (Act no. 30 of 2013) (hereinafter referred to as the said Act), whereas the Government of Uttar Pradesh is satisfied that a total of 19.79868 Hectares of land is required in the Village Tatarpur Sandal area 0.250 Hect., Basla area 0.0058 Hect., Isapur Sunwari area, 0.659 Hect., Rasulpur Dhatra area 0.8565 Hect., Kaserwa area 1.293 Hect., Bhatola area 1.2865 Hect., Banjarpuri area 1.161 Hect., Bichpuri area 0.187 Hect., Chiroli Bhagwantpur area 1.513 Hect., Khirni Mohiuddinpur area 0.819 Hect., Bahadurpur Sarai Urf Raipur area 0.175 Hect., Dhadhol area 0.3024 Hect., Dharmpur Nikat Dhadhol area 0.0498 Hect., Ballampur area 0.1795 Hect., Raipur Kalan area 0.5271 Hect., Rajpur area 3.38929 Hect., Lahravan area 1.0765 Hect., Kirari area 0.528 Hect., Atrasi area 0.49009 Hect., Mirjapur Akhtara area 2.477 Hect., Fatehpur Samsoi area 0.9522 Hect., Bisaru area 0.8800 Hect., Majhola area 0.7406 Hect., Achalpur area 0.0004 Hect., Tehsil Sambhal/ Candausi, district Sambhal is required for public purpose, namely, Ganga Expessway Pariyojna through Uttar Pradesh Expressway Industrial Developement Authority (UPEIDA), Lucknow.

2. Social Impact Assessment study was carried out by the State Social Impact Assessment Agency and submitted its recommendations to the Government of Uttar Pradesh which has approved its recommendation on dated April 12, 2022.

3. In brief, the recommendations of Multi Disciplinary Expert group regarding Social Impact Assessment report and Social Impact Management Plan is as follows :–

(a) Ganga Expressway is a linear project which is being run upon a land stretch in maximum 120 mt. width in any affected village. In this way this project is not affecting major or total area of any village. So that the displacement from this project is negligible.

(b) Though this project is likely to reduce the cultivable area in the concerned villages but compensation equal to four times of the circle rate of the land will help the farmers to upgrade the farms, increase in farm machinery and development of irrigation facilities.

(c) The compensation of the land acquisition is likely to develop alternate employment measures, construction of better houses, development of means of transport and agriculture technology. This will compensate the loss due to reduction in land holdings.

(d) This long distance project is likely to connect the remote areas of Uttar Pradesh with the state capital Lucknow reducing the time and cost and improving the commercial activities in the remote areas. It will cause convenience in transporting milk and milk products, fruits and vegetables and other perishable items to big markets and this will help in agricultural and allied purposes.

(e) Growth of fast and better means of transport will help in development of tourism, medical attendance as well as inter-state transport.

(f) Therefore, the recommendation of Multi Disciplinary Expert group is as follows:-

(i) It is in the public interest to acquire land for the purpose of Ganga Expressway Project in District Sambhal and it serves the public purpose;

(ii) The probable benefits from this project are more than the social expenditure and adverse Social Impact and total land to be acquired is much less than the total land required for this project.

4. In reference with the above recommendations of the committee, it is worthy to be noted that the revision of circle rate for the area affected by Ganga Expressway project, will be done by Stamp and Registration Department/Collector, Sambhal per the stipulated procedure.

Procedure for determination of market value of land by Collector is mentioned in section 26 of the said Act. It is also mentioned in clause (b) of sub-section (1) of the said section, that average sale price for similar type of land, situated in the nearest vicinity area will be determined by the Collector.

5. No family is likely to be displaced, due to land acquisition for this project. 6. Therefore, the Governor is pleased to notify for general information that the land mentioned in the Schedule below, is needed for public purpose.

SCHEDULE

7. The Governor is also pleased to authorize the Collector for the purpose of land acquisition to take necessary steps to enter upon and survey of land, take levels of any land, dig and do all the acts required for the proper execution of work as provided and specified under section 12 of the said Act. 8. Under section 15 of the said Act, any person interested in the land may within 60 days after the publication of this notification, make an objection to the acquisition of land in the locality in writing to the Collector.

9. Under section 11 (4) of the said Act, no person shall make any transaction or cause any transaction of land i.e. sale/purchase, specified in the preliminary notification or create any encumbrances on such land from the date of publication of such notification till such time as the proceedings of land acquisition is completed, without prior approval of the Collector.

NOTE: A site plan of the land may be inspected in the Office of the Collector, Sambhal.
