न्यूनतम मजदूरी अधिनियम, 1948 (अधिनियम संख्या 11 सन् 1948) की धारा 4 की उपधारा (1) के खण्ड (3) के साथ पठित धारा 3 की उपधारा (1) के खण्ड (ख) के अधीन शक्तियों का प्रयोग करके और सरकारी अधिसूचना संख्या 07/2019/791/36-03-2019-01(अधि0)-2005, दिनांक 6 अगस्त, 2019 का अधिक्रमण करके, राज्यपाल इस अधिसूचना के गजट में प्रकाशित किये जाने के दिनांक से उत्तर प्रदेश में —षि नियोजन में नियोजित कर्मचारियों के सम्बन्ध में मजदूरी की न्यूनतम दरें निम्नानुसार निर्धारित और पुनरीक्षित करती हैं :-

| 2 3 | तक परिवहन के लिये पहुंचाने का कार्य और सभी आकार के फामो में, जिनमे र् ं म्यूनिसिपल े ं या कैन्टूनमे ट की सीमाओ ं के छः किलोमीटर ं के भीतर स्थित फार्म भी सम्मिलित हैं, में मशरूम की खेती सहित —षि कायो के ं र् आनुषंगिक रूप में या उनके साथ-साथ की जानेे वाली कोई क्रियाएं। वन सम्बन्धी या काष्ठ उपकरण सम्बन्धी क्रिया, जो किसी —षक द्वारा या —षि क्षेत्र पर —षि कायो के आनुषंगिक रूप मे र् ं या उसके ं साथ-साथ की जाती है। दुग्ध उद्योग, पशुधन में वृद्धि, मधुमक्खी पालन, कुक्कुट पालन और उनकी आनुषंगिक क्रियाएं। |
2-न्यूनतम मजदूरी का भुगतान नकद या कर्मचारियों की सहमति से जिसमें अंशतः नकद या अंशतः जिन्स में, इस प्रकार किया जा सकता है कि मजदूरी का कुल मूल्य, किसी भी दशा में विहित न्यूनतम मजदूरी दरों से कम न हो।
3-मजदूरी की प्रति घंटा दरें, दैनिक दरों के 1/6 भाग से कम न होगी।
4-किशोरों और बालकों को संदेय मजदूरी की न्यूनतम कालानुपाती दर, किसी वयस्क कर्मचारी को अनुमन्य कालानुपाती दर से कम न होगी।
5-किसी भी रूप में मजदूरी की दरें, किसी कर्मचारी के हित के प्रतिकूल लागू न होंगी अर्थात् यदि इस अधिसूचना के अधीन विहित दरों से अधिक मजदूरी की दरों का भुगतान किया जा रहा है, तो उसका भुगतान किया जाता रहेगा और इन्हें इस अधिसूचना के अधीन विहित मजदूरी की न्यूनतम दर समझा जाएगा।

IN exercise of the powers under clause (b) of sub-section (1) of section 3 read with clause (3) of sub-section (1) of section 4 of the Minimum Wages Act, 1948 (Act no. XI of 1948), and in supersession of Government notification no. 07/2019/791/XXXVI-3–2019-01(Estb.)-2005, dated August 6, 2019, the Governor is pleased to fix and revise, with effect from the date of publication of this notification in the Gazette, the minimum rates of wages in respect of the employees, employed in the Employment in agriculture in Uttar Pradesh shall be as under :–

2. The minimum wages may be paid in cash or where so agreed by the employees, inkind or partly cash and partly in kind, so however, that the total value of the wages, shall in no case, be less than the minimum prescribed rates.
3. The hourly rates of wages shall not be less than 1/6 of the daily rates.
4. The minimum time-rate wages payable to adolescents and children shall not be less than time- rate wage admissible to an adult employee.
5. The rates of wages shall not in any way operate to the prejudice of any employee i.e. if more rates of wages are being paid than those prescribed under this notification, they would continue to be paid and they would be deemed to be the minimum rate of wages prescribed under this notification.
