vf/klwpuk विद्युत अधिनियम, 2003 (36 सन्‌ 2003) की धारा 61, 66, 86(1)(ई) एवं 181 के अन्तर्गत प्रदत्त अधिकारों तथा इस निमित्त दिये गये समस्त अन्य अधिकारों का प्रयोग करते हुये, उत्तर प्रदेश विद्युत नियामक आयोग द्वारा (रूफटॉप सोलर पी वी ग्रिड पारस्परिक प्रणालियाँ सकल/शुद्ध मापन) विनियमावली, 2019 द्वारा बनायी गयी थी, जो कि अधिसूचना संख्या यूपीईआरसी/सेक्रेटरी/आरएसपीवी विनियमावली/434(ए) दिनांक 04 जनवरी, 2019 द्वारा प्रकाशित की गयी थी।

और जबकि, विद्युत मंत्रालय, भारत सरकार द्वारा निवल बिलिंग अथवा निवल फीड-इन की संकल्पना को उसकी अधिसूचना जी0एस0आर0(ई) 448(ई) दिनांक 28 जून, 2021 के द्वारा आरम्भ किया गया, जिसको कि निम्नानुसार पुनः प्रस्तुत किया गया है-

(ञक) शुद्ध बिलिंग अथवा शुद्ध फीड-इन से आपूर्ति स्थल पर शुद्ध-बिलिंग अथवा शुद्ध फीड-इन के लिए प्रयोग किया गया एकल द्विदिशात्मक ऊर्जा मीटर अभिप्रेत है जिसमें ग्रिड से आयातित ऊर्जा और प्रोज्यूमर की2 उत्तर प्रदेश असाधारण गजट, 1 जून, 2022 ई0 ग्रिड इंटरेक्टिव रूफ टॉप सोलर फोटोवाल्टिक प्रणाली से निर्यातित ऊर्जा का मूल्यांकन दो अलग-अलग टैरिफों पर किया जाता है,

विद्युत मंत्रालय, भारत सरकार की उपरोक्त अधिसूचना को ध्यान में रखते हुए उत्तर प्रदेश विद्युत नियामक आयोग विद्युत अधिनियम, 2003 की धारा 61, 86(1)(ई) एवं 181 तथा उपरोक्त विनियमावली के विनियम 17 संशोधन का अधिकार के अन्तर्गत प्रदत्त अधिकारों तथा इस निमित्त समर्थकारी समस्त शक्तियों का प्रयोग करते हुये संशोधन हेतु निम्नलिखित विनियमावली बनाते हैं- (अ) ये विनियमावली यूपीईआरसी (रूफटॉप सोलर पी वी ग्रिड पारस्परिक प्रणालियाँ सकल/शुद्ध मापन) विनियमावली, 2019 (प्रथम संशोधन/परिशिष्ट) कहलायेगी, (इससे आगे आरएसपीवी विनियमावली, 2019 (प्रथम संशोधन) के रूप में संदर्भित।

(ब) राज्य के सरकारी गजट मेें इसकी अधिसूचना की तिथि से ये विनियमावली प्रभावी होंगे। परिभाषा एवं 2(ह) ''सक्षम उपभोक्ता'' का तात्पर्य शुद्ध 2 (ह) ''सक्षम उपभोक्ता'' का तात्पर्य- व्याख्या मीटरिंग योजना हेतु अनुज्ञप्तिधारी के (I) सकल मापन योजना का तात्पर्य वितरण एलएमवी-5 श्रेणी के अन्तर्गत कृषि तथा अनुज्ञप्तिधारी के आपूर्ति क्षेत्र के अन्तर्गत किसी एलएमवी-1 श्रेणी के अन्तर्गत घरेलू उपभोक्ता भी श्रेणी के ऐसे विद्युत प्रोज्यूमर से है जो अपने से है, जबकि सकल मापन (मीटरिंग) योजना परिसर जो कि स्व स्वामित्व अथवा तीसरे पक्ष के के अन्तर्गत उपभोक्ता का तात्पर्य ऐसे स्वामित्व में हो सकता है, में ग्रिड से सम्बद्ध उपभोक्ता से है जो वितरण अनुज्ञप्तिधारी के रूफटाप सोलर पीवी पद्धति स्थापित करने का आपूर्ति क्षेत्र के अन्तर्गत स्व स्वामित्व अथवा इच्छुक/स्थापित कर चुका है, जिसका उद्‌देश्य तीसरे पक्ष के स्वामित्व वाले परिसर में ग्रिड से समस्त ऊर्जा विद्युत वितरण अनुज्ञप्तिधारी को सम्बद्ध रूफटाप सोलर पीवी पद्धति स्थापित आयोग द्वारा निर्धारित दर पर विक्रय करना है। करने का इच्छुक है, जिसका उद्‌देश्य समस्त

ऊर्जा विद्युत वितरण अनुज्ञप्तिधारी को आयोग

द्वारा निर्धारित दर पर विक्रय करना है।

(II) शुद्ध बिलिंग अथवा शुद्ध फीड-इन योजना

का तात्पर्य वितरण अनुज्ञप्तिधारी के आपूर्ति क्षेत्र

के अन्तर्गत किसी भी श्रेणी के ऐसे विद्युत

प्रोज्यूमर से है जो अपने परिसर जो कि स्व

स्वामित्व अथवा तीसरे पक्ष के स्वामित्व में हो

सकता है, जिसमेंं ग्रिड से आयातित ऊर्जा एवं

प्रोज्यूमर के ग्रिड से सम्बद्ध रूफटाप सोलर पीवी

पद्धति को निर्यातित ऊर्जा का मापन एकल

द्विदिशात्मक ऊर्जा मीटर के माध्यम से आयोग

द्वारा निर्धारित किये गये दो भिन्न टैरिफ पर

मूल्यांकित किया जाता है।उत्तर प्रदेश असाधारण गजट, 1 जून, 2022 ई0 3 परिभाषा एवं

व्याख्या

(III) शुद्ध बिलिंग योजना का तात्पर्य अनुज्ञप्तिधारी के मीटर्ड प्रोज्यूमर से है जो कृषि श्रेणी (एलएमवी-5) अथवा एलएमवी-1 श्रेणी का घरेलू उपभोक्ता है, जो उपभोक्ता परिसर में जो कि स्व स्वामित्व अथवा तीसरे पक्ष के स्वामित्व में हो सकता है, में ग्रिड से सम्बद्ध रूफटाप सोलर पीवी पद्धति स्थापित करने का इच्छुक/स्थापित कर चुका है, जिसमें ग्रिड से आयातित ऊर्जा एवं ग्रिड से सम्बद्ध रूफटाप सोलर पीवी पद्धति को निर्यातित ऊर्जा को एकल द्विदिशात्मक ऊर्जा मीटर के माध्यम से निवल किया जाता है। कार्य क्षेत्र एवं लागू करना

3.2 सक्षम उपभोक्ता सकल मापन व्यवस्था या शुद्ध बिलिंग व्यवस्था अथवा शुद्ध बिलिंग/शुद्ध फीड-इन व्यवस्था के अन्तर्गत रूफटाप सोलर पी वी प्रणाली सम्बन्धित पात्रता के अनुसार स्थापित कर सकेगा।

3.2 सक्षम उपभोक्ता सकल मापन व्यवस्था या शुद्ध बिलिंग व्यवस्था के अन्तर्गत रूफटाप सोलर पी वी प्रणाली स्थापित कर सकेगा। मापित कृषि अथवा मापित आवासीय/घरेलू वर्ग का सक्षम उपभोक्ता क्रमशः एलएमवी-5 व एलएमवी-1 वर्ग के अन्तर्गत शुद्ध मापन अथवा सकल मापन व्यवस्था के अन्तर्गत रूफटाप सोलर पी वी प्रणाली स्थापित कर सकता है जो..

सामान्य सिद्धान्त

4.1 इस विनियमावली में विनिर्दिष्ट सीमाओं तथा अन्य नियमों एवं शर्तों के शर्ताधीन वितरण अनुज्ञप्तिधारी के सक्षम उपभोक्ता सकल मापन व्यवस्था अथवा शुद्ध मापन व्यवस्था के अन्तर्गत रूफटाप सोलर पीवी प्रणाली अधिष्ठापित करने हेतु सक्षम होंगे।

4.1 इस विनियमावली में विनिर्दिष्ट सीमाओं तथा अन्य नियमों एवं शर्तों के शर्ताधीन वितरण अनुज्ञप्तिधारी के सक्षम उपभोक्ता सकल मापन व्यवस्था अथवा शुद्ध मापन व्यवस्था अथवा शुद्ध बिलिंग/शुद्ध फीड-इन व्यवस्था के अन्तर्गत रूफटाप सोलर पीवी प्रणाली अधिष्ठापित करने हेतु सम्बन्धित पात्रता के अनुसार सक्षम होंगे। प्रतिबंध यह कि तृतीय पक्ष स्वामियों, जिन्होंने उपभोक्ता वर्ग के भवनों में रूफटाप के लिये पट्‌टा या वाणिज्यिक अनुबन्ध किया है, वे भी शुद्ध मापन व्यवस्था के अन्तर्गत वितरण अनुज्ञप्तिधारी के साथ ऐसी क्षमता के लिये रूफटाप सोलर पी वी प्रणाली अधिष्ठापित करने के अधिकारी होंगे, जो प्रत्येक सक्षम उपभोक्ता वर्ग के लिये रूफटाप सोलर पी वी क्षमता की निर्धारित सीमाओं के संचयमान होगी, जिसकी रूफटाप वितरण परिवर्तक (उस सीमा तक जैसा कि इस विनियमावली को डीटी का क्षमता के अन्र्तगत परिभाषित है) से सम्बद्ध तृतीय पक्ष स्वामी द्वारा पट्‌टे पर दे दी गयी है।

प्रतिबंध यह कि तृतीय पक्ष स्वामियों, जिन्होंने उपभोक्ता वर्ग के भवनों में रूफटाप के लिये पट्‌टा या वाणिज्यिक अनुबन्ध किया है, वे भी सकल मापन व्यवस्था अथवा शुद्ध मापन व्यवस्था अथवा शुद्ध बिलिंग/शुद्ध फीड-इन व्यवस्था के अन्तर्गत वितरण अनुज्ञप्तिधारी के साथ ऐसी क्षमता के लिये रूफटाप सोलर पी वी प्रणाली अधिष्ठापित करने के अधिकारी होंगे, जो प्रत्येक सक्षम उपभोक्ता वर्ग के लिये रूफटाप सोलर पी वी क्षमता की निर्धारित सीमाओं के संचयमान होगी, जिसकी रूफटाप वितरण परिवर्तक (उस सीमा तक जैसा कि इस विनियमावली को डीटी का क्षमता के अन्र्तगत परिभाषित है) से सम्बद्ध तृतीय पक्ष स्वामी द्वारा पट्‌टे पर दे दी गयी है।4 उत्तर प्रदेश असाधारण गजट, 1 जून, 2022 ई0 4.2 प्रतिबंध यह कि इस विनियमावली के 4.2. प्रतिबंध यह कि सक्षम उपभोक्ता, जैसा सामान्य

सिद्धान्त अन्तर्गत सकल मापन व्यवस्था का लाभ प्राप्त प्रकरण हो, सकल मापन व्यवस्था अथवा शुद्ध कर रहे सक्षम उपभोक्ता अथवा तृतीय पक्ष मापन व्यवस्था अथवा शुद्ध बिलिंग/शुद्ध फीड- स्वामी, जैसा प्रकरण हो, को उन्हीं भवनों में इन व्यवस्था में से केवल एक ही प्रकार के ग्रिड शुद्ध मापन व्यवस्था के लिये आवेदन करने से सम्बद्ध रूफटाप सोलर पीवी पद्धति का लाभ हेतु अनुमति नहीं दी जायेगी।

4.3 प्रतिबंध यह कि इस विनियमावली के 4.3 विलोपित

वाले सक्षम उपभोक्ता को उन्हीं भवनों में

सकल मापन व्यवस्था के लिये आवेदन करने

हेतु अनुमति नहीं दी जायेगी।

4.4 प्रतिबंध यह कि वितरण अनुज्ञप्तिधारी 4.4 प्रतिबंध यह कि वितरण अनुज्ञप्तिधारी जैसी जैसी कि उपर्युक्त शर्तें इस विनियमावली में कि उपर्युक्त शर्तें इस विनियमावली में निर्दिष्ट हैं, निर्दिष्ट हैं, सक्षम उपभोक्ता अथवा तृतीय पक्ष उपभोक्ता को सकल मापन व्यवस्था अथवा शुद्ध स्वामी, जैसा भी प्रकरण हो, को सकल मापन मापन व्यवस्था अथवा शुद्ध बिलिंग/शुद्ध फीड- व्यवस्था या शुद्ध बिलिंग व्यवस्था अथवा शुद्ध इन व्यवस्था की अनुमति प्रदान करेगा। मापन व्यवस्था की अनुमति प्रदान करेगा, जो

ग्रिड सम्बद्ध रूफटाप सोलर पी वी प्रणाली

अधिष्ठापित करने का विचार रखता है।

4.6 यदि सक्षम उपभोक्ता शुद्ध मापन योजना 4.6 यदि सक्षम उपभोक्ता शुद्ध मापन अथवा शुद्ध के अन्तर्गत सोलर रूफटाप प्रणाली स्थापित बिलिंग/शुद्ध फीड-इन योजना के अन्तर्गत सोलर करता है, ऐसा सक्षम उपभोक्ता अपने भवनों रूफटाप प्रणाली स्थापित करता है, ऐसा सक्षम पर रूफटाप सोलर पीवी प्रणाली से उत्पादित उपभोक्ता अपने भवनों पर रूफटाप सोलर पीवी विद्युत का उपयोग करने का अधिकारी होगा। प्रणाली से उत्पादित विद्युत का उपयोग करने का अधिशेष विद्युत अनुज्ञप्तिधारी को वितरण अधिकारी होगा। अधिशेष विद्युत अनुज्ञप्तिधारी को प्रणाली में अन्तर सम्बन्ध बिन्दु पर डाली जा वितरण प्रणाली में अन्तर सम्बन्ध बिन्दु पर डाली सकती है।

जायेगा जबकि शुद्ध मीटरिंग के प्रकरण में संलग्नक iii (स) क्रमशः में निर्धारित प्रारूप पर संलग्नक iii (ब) के अनुसार दोनों पक्षों के पक्षों में अंतर सम्बद्धता अनुबंध हस्ताक्षरित किया अनुबंध हस्तान्तरित किया जायेगा।

11. सकल मापन, शुद्ध मापन अथवा शुद्ध बिलिंग/शुद्ध फीड-इन पद्वति के अन्तर्गत रूफटाप सोलार पी वी प्रणाली में चाहे स्व स्वामित्व वाली या तृतीय पक्ष स्वामित्व वाली तथा सक्षम उपभोक्ता भवनों पर अधिष्ठापित हो, चक्रीय तथा क्रास सहायक प्रभारों से मुक्त रहेगी। 11. सकल मापन पद्धति अथवा शुद्ध बिलिंग पद्धति या शुद्ध मापन पद्धति के अन्तर्गत रूफटाप सोलार पी वी प्रणाली में चाहे स्व स्वामितव वाली या तृतीय पक्ष स्वामित्व वाली तथा सक्षम उपभोक्ता भवनों पर अधिष्ठापित हो, चक्रीय तथा क्रास सहायक प्रभारों से मुक्त रहेगी।

सौर नवीकरणीय क्रय बाध्यता

12.2 शुद्ध मापन पद्धति की दशा में सक्षम उपभोक्ता के लिये शुद्ध मापन व्यवस्था के अन्तर्गत उत्पादित सौर विद्युत की कुल मात्रा, जिसे बाह्‌य अस्तित्व के रूप में परिभाषित नहीं किया गया है, वितरण अनुज्ञप्तिधारी, जिसके आपूर्ति क्षेत्र में योग्य उपभोक्ता अवस्थित है, के लिये नवीकरणीय क्रय बाध्यता (आर पी ओ) के लिये योग्य होगी।

12.2 शुद्ध मापन अथवा शुद्ध बिलिंग/शुद्ध फीड- इन पद्वति की दशा में सक्षम उपभोक्ता के लिये शुद्ध मापन अथवा शुद्ध बिलिंग/शुद्ध फीड-इन व्यवस्था के अन्तर्गत उत्पादित सौर विद्युत की कुल मात्रा, जिसे बाह्‌य अस्तित्व के रूप में परिभाषित नहीं किया गया है, वितरण अनुज्ञप्तिधारी, जिसके आपूर्ति क्षेत्र में योग्य उपभोक्ता अवस्थित है, के लिये नवीकरणीय क्रय बाध्यता (आर पी ओ) के लिये योग्य होगी। अर्थदण्ड या क्षतिपूर्ति

14. सकल मापन अथवा शुद्ध बिलिंग या शुद्ध मापन पद्धति, जैसी स्थिति हो, की असफलता की स्थिति में, अर्थदण्ड या क्षतिपूर्ति के प्रावधान उप्रविनिआ (विद्युत आपूर्ति संहिता) विनियमावली, 2005 तथा इसके अनुवर्ती संशोधनों तथा समय-समय पर आयोग द्वारा निर्धारित किये गये प्रावधानों के अनुसार होंगे।

14. सकल मापन अथवा शुद्ध मापन, शुद्ध बिलिंग/शुद्ध फीड-इन पद्धति जैसी स्थिति हो, की असफलता की स्थिति में, अर्थदण्ड या क्षतिपूर्ति के प्रावधान उप्रविनिआ (विद्युत आपूर्ति संहिता) विनियमावली, 2005 तथा इसके अनुवर्ती संशोधनों तथा समय-समय पर आयोग द्वारा निर्धारित किये गये प्रावधानों के अनुसार होंगे। (रर) ''

- का तात्पर्य ऐसी व्यवस्था से है जिसमेंं ग्रिड से आयातित ऊर्जा एवं ग्रिड से सम्बद्ध रूफटाप सोलर पीवी पद्धति को निर्यातित ऊर्जा को आपूर्ति बिन्दु पर द्विदिशात्मक ऊर्जा मीटर के माध्यम से दो भिन्न टैरिफ पर मूल्यांकित किया जाता है।

(लल) ''

का तात्पर्य वितरण अनुज्ञप्तिधारी को शुद्ध बिलिंग/शुद्ध फीड-इन व्यवस्था के अन्तर्गत आपूरित विद्युत के लिए जैसा कि आयोग द्वारा समय-समय पर निर्धारित टैरिफ से है जो कि सकल मीटरिंग व्यवस्था के लिए समान होगा।

शुद्ध बिलिंग/शुद्ध फीड-इन व्यवस्था के अन्तर्गत रूफटाप सोलार पी वी प्रणाली स्थापित करने एवं परिचालन करने वाले सक्षम उपभोक्ता/तृतीय पक्ष स्वामित्व के लिये ऊर्जा लेखांकन एवं समझौता कार्यप्रणाली निम्नलिखित प्रक्रिया के अनुसार होगी-

(i) प्रत्येक बिलिंग अवधि के लिए, अनुज्ञप्तिधारी बिलिंग अवधि में रूफटाप सोलार पी वी प्रणाली द्वारा डाली गयी विद्युत की मात्रा एवं वितरण अनुज्ञप्तिधारी द्वारा आपूरित विद्युत, पृथक रूप से दर्शायेगा। (ii) आयातित ऊर्जा का मौद्रिक मूल्य लागू फुटकर प्रशुल्क पर आधारित होगा। निर्यातित सौर ऊर्जा का मौद्रिक मूल्य विनियम 2 (लल) में पारिभाषित शुद्ध बिलिंग/शुद्ध फीड-इन प्रशुल्क जैसा कि आयोग द्वारा निर्धारित किया गया हो, पर आधारित होगा।

(iii) शुद्ध देय/प्राप्य बिल निर्यातित ऊर्जा के मौद्रिक मूल्य एवं वितरण अनुज्ञप्तिधारी द्वारा आपूरित विद्युत के बिल (राजकीय लेवी आदि को सम्मिलित करते हुए) के अन्तर से निर्धारित किया जायेगा। शुद्ध देय6 उत्तर प्रदेश असाधारण गजट, 1 जून, 2022 ई0 बिल की दशा में लागू टैरिफ आदेश एवं विद्युत प्रदाय संहिता के लेट पेमेंट सरचार्ज एवं अन्य प्रावधान लागू होंगे। शुद्ध प्राप्य बिल की दशा में धनराशि को आगे ले जाया जायेगा एवं भविष्य में जारी किये जाने वाले बिल में समायोजित किया जायेगा।

(iv) जब एक सक्षम उपभोक्ता प्रणाली को छोड़ेगा अथवा वित्तीय वर्ष के अन्त में, जो भी पहले हो, उपभोक्ता को वितरण अनुज्ञप्तिधारी से कोई शेष प्राप्य हो, उपभोक्ता को शेष का भुगतान कर दिया जायेगा। (v) सामूहिक शुद्ध बिलिंग/शुद्ध फीड-इन की दशा में, समूह में एकल उपभोक्ता एवं तृतीय पक्ष (यदि सम्मिलित हो) के मध्य समायोजन का दायित्व समूह अथवा तीसरे पक्ष का होगा एवं उनके बीच के अनुबन्ध से आच्छादित होगा। डिस्काम द्वारा इस खाते में कोई फिक्स चार्ज तृतीय पक्ष एग्रीगेटर पर आरोपित नहीं किया जायेगा, किन्तु आयातित ऊर्जा के लिए लागू नियम एवं विनियम के अनुसार आरोपित किया जायेगा। (vi) सक्षम उपभोक्ता को माने हुए उत्पादन शुल्क देय नहीं होंगे।

(vii) लागू टैरिफ में kVAh के आधार पर बिलिंग होने की दशा में, ऊर्जा के ड्राल एवं इन्जेक्शन को भी kVAh में मापा जायेगा।

(viii) वितरण अनुज्ञप्तिधारी प्रत्येक बिलिंग अवधि के लिए विद्युत बिल के साथ निम्नलिखित विवरण अनिवार्य रूप से उपलब्ध करायेगा-

[अ] रूफटाप सोलार पी वी प्रणाली से उत्पादित विद्युत की मात्रा,

[ब] रूफटाप सोलार पी वी प्रणाली द्वारा वितरण प्रणाली में इंजेक्ट की गयी विद्युत की मात्रा, [स] सक्षम उपभोक्ता को वितरण अनुज्ञप्तिधारी द्वारा आपूरित विद्युत की मात्रा,

[द] आयोग द्वारा निर्धारित फीड-इन टैरिफ के आधार पर रूफटाप सोलार पी वी प्रणाली द्वारा वितरण प्रणाली में इन्जेक्ट की गयी विद्युत का मौद्रिक मूल्य,

[य] टैरिफ आदेश के आधार पर वितरण अनुज्ञप्तिधारी द्वारा सक्षम उपभोक्ता को आपूरित विद्युत का मौद्रिक मूल्य,

[र] शुद्ध देय प्राप्य बिल वितरण अनुज्ञप्तिधारी द्वारा आपूरित विद्युत के बिल (राजकीय लेवी आदि को सम्मिलित करते हुए) तथा निर्यातित ऊर्जा के मौद्रिक मूल्य एवं गत माह से आगे लाया गया प्राप्य, यदि कोई हो, के योग के अन्तर से निर्धारित किया जायेगा।

10.6 सकल मापन व्यवस्था अथवा शुद्ध मापन व्यवस्था अथवा शुद्ध बिलिंग/शुद्ध फीड-इन व्यवस्था को अनुमोदन प्रदान करने के लिए प्रक्रिया एवं समससीमा को, सम्बन्धित पात्रता के अनुसार, यूपीनेडा/स्टेट डेजिगनेटेड एजेंसी द्वारा डिस्काम के साथ विचारोपरान्त इन विनियमों की अधिसूचना के 60 दिवसों के भीतर अन्तिम रूप दिया जायेगा एवं आयोग के समक्ष अनुमोदन के लिए प्रस्तुत किया जायेगा।

18- यदि इन विनियमों के किसी भी प्रावधान को लागू करने में कोई दिक्कत आती है तो आयोग सामान्य या विशेष आदेश द्वारा ऐसे निर्देश दे सकता है, जो अधिनियम एवं इन विनियमों के प्रावधानों से असंगत न हो एवं कठिनाईयों को दूर करने के लिए आवश्यक एवं उचित लगे। अनुलग्नक-III (स)

अन्तर सम्बद्धता अनुबंध (षुद्ध मापन/षुद्ध फीड-इन व्यवस्था)

यह अनुबंध दिनांक------ (तिथि)------ (माह)------ (वर्श)----- को सक्षम उपभोक्ता अथवा प्रथम अथवा तृतीय स्वामी के---------------नाम से भवन का--------------(पते पर) स्वामी अथवा पट्‌टे पर अथवा भवन का वाणिज्य अधिकार रखने वाले प्रथम पक्ष / सक्षम उपभोक्ता के रूप में तथा वितरण अनुज्ञप्तिधारी (जिसे आगे अनुज्ञप्तिधारी कहा गया है)---------(कार्यालय का पदानाम) द्वारा प्रतिनिधित्व किया गया तथा जिसका कार्यालय------ -------(पता) पर स्थित है, द्वितीय पक्ष के रूप में, के मध्य --------- (स्थान) में सम्पन्न एवं हस्ताक्षरित हुआ एवं जबकि--------------(अनुज्ञप्तिधारी का नाम) सक्षम उपभोक्ता को अपने आर एस पी वी---------किलोवाट क्षमता के संयत्र से उत्पादित विद्युत अनुज्ञप्तिधारी की विद्युत प्रणाली में डालने के लिये ग्रिड सम्बद्धता प्रदान करने हेतु सहमत है तथाउत्तर प्रदेश असाधारण गजट, 1 जून, 2022 ई0 7 इस अनुबन्ध की शर्तों एवं उ0प्र0 विद्युत नियामक आयोग द्वारा निर्गत आर एस पी वी विनियमावली/आदेषों के अनुसार दोनों पक्ष एतद्‌द्वारा निम्नवत्‌ सहमत हैं-

1-पात्रता-

1.1 शुद्ध मापन/शुद्ध फीड-इन व्यवस्था उप्रविनिआ (रूफटाफ सोलार पीवी ग्रिड पारस्परिक प्रणाली सकल/शुद्ध मापन) विनियमावली, 2019 (प्रथम संषोधन/परिषिश्ट) (इसके पष्चात्‌ इसे आरएसपीवी विनियमावली, 2019 के रूप में संदर्भित किया गया है) (प्रथम संषोधन) में विनिर्दिश्ट किया गया है। सक्षम उपभोक्ता को पहले सही मानकों तथा शर्तों के प्रति जागरूक होना अपेक्षित है, जिनका उनकी प्रणाली को शुद्ध मापन/शुद्ध फीड-इन के लिए ग्रिड वितरण प्रणाली में समाकलित होने पर सामना करना है। 2-प्राविधिक एवं अन्तर सम्बन्ध आवष्यकताएँ -

2.1 सक्षम उपभोक्ता/प्रथम पक्ष सहमत है कि उसकी रूफटाप सोलार पीवी उत्पादन संयंत्र एवं शुद्ध मापन/ शुद्ध फीड-इन प्रणाली, इस विनियमावली एवं निम्नलिखित विनियमावलियों तथा संहिता, जैसा कि समय-समय पर संषोधित, में विनिर्दिश्ट मानकों एवं आवष्यकताओं का अनुपालन करेगा-

(i) केन्द्रीय विद्युत प्राधिकरण (वर्गीकृत उत्पादन स्रोतों से सम्बद्धता हेतु तकनीकी मानक) विनियमवली, 2013 तथा इसके अनुवर्ती संषोधन।

(ii) केन्द्रीय विद्युत प्राधिकरण (मीटरों का अधिश्ठापन एवं परिचालन) विनियमावली, 2006 तथा इसके अनुवर्ती संषोधन।

(iii) केन्द्रीय विद्युत प्राधिकारण (विद्युत आपूर्ति तथा सुरक्षा उपाय/विनियमावली, 2010 तथा इसके अनुवर्ती संषोधन।

(iv) उप्रविनिआ ग्रिड संहिता, 2007 तथा इसके अनुवर्ती संषोधन। (v) उप्रविनिआ (अन्तर्राज्यीय पारेशण प्रणाली से सम्बद्धता की अनुमति) विनियमावली, 2010 तथा इसके अनुवर्ती संषोधन उप्रविनिआ आरएसपीवी विनियमावली, 2019 में विनिर्दिश्ट सीमा तक इसके अनुवर्ती संषोधन।

(vi) उप्रविनिआ आपूर्ति संहिता विनियमावली, 2005 तथा इसके अनुवर्ती संषोधन। (vii) वितरण अनुज्ञप्तिधारी के विद्युत उपभोक्ता पर लागू अन्य कोई प्रावधान।

2.2 सक्षम उपभोक्ता/प्रथम पक्ष सहमत है कि वह अनुज्ञप्तिधारी की वितरण प्रणाली से फोटोवोलटाइक प्रणाली के संयोजन से पूर्व अलगाव यन्त्र (स्वचालित एवं इनवर्टर के अन्दर अन्तर्निहित तथा बाह्‌य हस्तचालित रिले-दोनों स्थापित कर चुका है या स्थापित करेगा इस पर पहुँच रखने एवं इसके परिचालन से वितरण प्रणाली की मरम्मत एवं अनुरक्षण हेतु, यदि आवष्यक हुआ, अनुज्ञप्तिधारी से सहमत है।)

2.3 सक्षम उपभोक्ता/प्रथम पक्ष सहमत है कि अनुाप्तिधारी की प्रणाली की विद्युत कटौती की दशा में, फोटोवोलटाइक प्रणाली स्वचालित रूप से विच्छेदन अलगाव करेगी तथा उसका संयंत्र अनुज्ञप्तिधारी की वितरण प्रणाली के अन्दर विद्युत नहीं डालेगा।

2.4 वितरण प्रणाली से सम्बद्ध सभी उपकरण प्रासंगिक अन्तर्राश्ट्रीय (आईईईई/ईसी) अथवा भारतीय मानक (बी आई एस) से शासित होंगे तथा विद्युत उपकरणों के अधिश्ठापन हेतु केन्द्रीय विद्युत प्राधिकार (विद्युत आपूर्ति एवं सुरक्षा उपाय) विनियमावली, 2010 का अनुपालन करेगा।

2.5 सक्षम उपभोक्ता/प्रथम पक्ष सहमत है कि अनुज्ञप्तिधारी इन्टरफेस/अन्तर सम्बद्ध बिन्दु तथा मीटरिंग बिन्दु का विस्तृत विवरण देगा।

2.6 सक्षम उपभोक्ता/प्रथम पक्ष तथा अनुज्ञप्तिधारी संयंत्र के परिचालन एवं अनुरक्षण, ड्राइंग एवं डाईग्राम, स्थल उत्तरदायित्व सारिणी, हारमोनिक, समकालन, वोल्टेज, आवृत्ति टिमटिमाहट आदि के सम्बन्ध में सम्बद्ध के0वि0प्रा0 एवं उप्रविनिआ विनियमावली का पालन करने के लिये सहमत है।

2.7 सुरक्षित एवं विष्वसनीय वितरण प्रणलाी के अनुरक्षण करने का दायित्व अनुज्ञप्तिधारी का होने के कारण सक्षम उपभोक्ता/प्रथम पक्ष सहमत है कि यदि अनुज्ञप्तिधारी द्वारा यह निर्धारित किया जाता है कि सक्षम उपभोक्ता/प्रथम पक्ष की फोटोवोल्टाइक प्रणाली अन्य उपभोक्ताओं या अनुज्ञप्तिधारी की परिसम्पत्तियों को या तो क्षतिग्रस्त करती है अथवा विपरीत प्रभाव उत्पन्न करती है, सक्षम उपभोक्ता/प्रथम पक्ष को अनुज्ञप्तिधारी से निर्देश प्राप्त होने पर वितरण प्रणाली से तुरन्त फोटोवोल्टाइक प्रणाली को अलग करना होगा और संयोजन से पूर्व व्यवस्था को अपने स्वयं के खर्चें पर सुधारेगा। 3-अनुमति एवं अनुमोदन-

3.1 सक्षम उपभोक्ता/प्रथम पक्ष वितरण प्रणाली से फोटोवोल्टाइक प्रणाली को जोड़ने से पूर्व सभी आवष्यक अनुमोदन एवं अनुमतियां (पर्यावरण सम्बंधी एवं ग्रिड संयोजन सम्बन्धी) प्राप्त करने हेतु सहमत है।8 उत्तर प्रदेश असाधारण गजट, 1 जून, 2022 ई0 4-पहुँच एवं विच्छेदन -

4.1 अनुज्ञप्तिधारी सोलार फोटोवोल्टाइक प्रणाली के मीटर उपकरण एवं विच्छेदन साधनों पर हर समय पहुँच रखेगा। 4.2 आपात एवं कालावधि स्थिति में जहाँ विच्छेदन करने वाले साधनों, स्वचालित एवं हस्तचालित दोनों, जैसे कि स्विच या ब्रेकर पर पहुंँच नहीं है, अनुज्ञप्तिधारी सक्षम उपभोक्ता/प्रथम पक्ष के भवन की सेवा विच्छेदित कर सकेगा।

दायित्व -

5.1 सक्षम उपभोक्ता/प्रथम पक्ष और अनुज्ञप्तिधारी फोटोवोल्टाइक प्रणाली या अनुज्ञप्तिधारी की वितरण प्रणाली के संयोजन एवं परिचालन में किसी भी पक्ष को लापरवाही या जानबूझकर अनाचार से क्षतियाँ या वितपरीत प्रभाव के लिए एक दूसरे को क्षतिपूर्ति करेंगे।

5.2 अनुज्ञप्तिधारी एवं सक्षम उपभोक्ता/प्रथम पक्ष किसी हानि या लाभ, या राजस्व, व्यवसाय व्यवधान हानि, संविदा की हानि या ख्याति की हानि अथवा अप्रत्यक्ष परिमाणिक प्रासंगिक या विशेश क्षतियों सहित किन्तु दण्डात्मक या कठोर दण्ड तक सीमित नहीं, चाहे कथित दायित्व हानि या क्षतियाँ संविदा में या अन्यथा उत्पन्न हो, के लिये एक दूसरे के लिये उत्तरदायी नहीं होंगे।

5.3 अनुज्ञप्तिधारी आयोग द्वारा इसके सम्बद्ध आदेश में विनिर्दिश्ट कार्यक्षेत्र में बाहर केन्द्र/राज्य सरकार द्वारा प्रदान किये गये किसी राजपाट सम्बन्धी या अन्य प्रोत्साहन के लिये सक्षम उपभोक्ता/प्रथम पक्ष द्वारा वितरण या वसूली के लिये उत्तरदायी नहीं होगा।

5.4 अनुज्ञप्तिधारी रूफटाप सोलार पीवी प्रणाली से विद्युत उत्पादन के परिमाण को आर.पी.ओ. के प्रति विचार कर सकता है।

5-वाणिज्यिक समझौता :

6.1 इस अनुबन्ध के अन्तर्गत सभी वाणिज्यिक समझौते उप्रविनिआ द्वारा निर्गत आरएसपीवी विनियावमली, 2019 (प्रथम संषोधन) का अनुकरण करेंगे।

6-संयोजन लागत :

7.1 सक्षम उपभोक्ता/प्रथम पक्ष मीटरिंग तथा अन्तर संबंध लागत सहित फोटोवोल्टाइक प्रणाली लगाने से सम्बन्धित सभी लागत वहन करेगा। सक्षम उपभोक्ता फोटोवोल्टाइक प्रणाली को ग्रिड से सम्बद्ध करने के लिये आवष्यक सर्विस लाइन, यदि यह आवष्यक है, के सुधारों तथा उच्च वर्गीकरण की वास्तविक लागत का भुगतान करने के लिये सहमत है।

7-समाप्ति :

8.1 सक्षम उपभोक्ता/प्रथम पक्ष अनुज्ञप्तिधारी को 90 दिनों की पूर्व सूचना देकर किसी भी समय अनुबन्ध समाप्त कर सकता है।

8.2 सक्षम उपभोक्ता/प्रथम पक्ष इस अनुबन्ध के किसी नियम का उल्लंघन करता है तथा उल्लंघन की अनुाप्तिधारी से लिखित सूचना प्राप्त करने के 30 दिनों के अन्दर नियम भंग का उपचार नहीं करता है, तो अनुाप्तिधारी को 30 दिनों की पूर्व सूचना देने पर अनुबंध समाप्त करने का अधिकार है।

8.3 सक्षम उपभोक्ता/प्रथम पक्ष अनुबन्ध की समाप्ति पर अनुज्ञप्तिधारी की वितरण प्रणाली से फोटोवोल्टाइक प्रणाली को सामयिक विधि एवं अनुज्ञप्तिधारी की संतुश्टि के अनुसार विच्छेदित करेगा। उपर्युक्त के साक्ष्य में--------------------------सक्षम उपभोक्ता/प्रथम पक्ष की ओर से श्री तथा अनुज्ञप्तिधारी के वास्ते एवं उनकी ओर से श्री------------------ने दो मूल प्रतियाँ हस्ताक्षरित की। सक्षम उपभोक्ता/प्रथम पक्ष/तृतीय पक्ष नाम------------------ पता--------------- सेवा संयोजन संख्या

U.P.E.R.C. (Rooftop Solar PV Grid Interactive System Gross/Net Metering) Regulation, 2019 (First Amendment/Addendum)

In exercise of the power conferred on it by Section 61,66, 86(1) (e) and 181 of the Electricity Act, 2003 (36 of 2003) and all other powers enabling in its behalf, the Uttar Pradesh Electricity Regulatory Commission has made (Rooftop Solar PV Grid Interactive System Gross/ Net Metering) Regulation, 2019, which were published vide notification no. UPERC/Secretary/RSPV Regulations/434(A) dated 04.01.2019.

AND WHEREAS, the Ministry of Power, Government of India has introduced a concept of Net Billing or Net Feed-In in its notification G.S.R.(E) 448 (E). dated June 28, 2021, which is reproduced as below:

(ja) "net billing or net feed-in" means a single bidirectional energy meter used for net-billing or net feed-in at the point of supply where-in the energy imported from the Grid and energy exported from the Grid Interactive rooftop Solar photovoltaic system of a Prosumer are valued at two different Tariff

In view of the above notification of Ministry of Power, Government of India, Uttar Pradesh Electricity Regulation Commission, now in exercise of its power conferred under section 61, 86 (1) (e) and 181 of Electricity Act, 2003 and clause 17 of the aforesaid Regulation i.e. Power to Amend and all other enabling powers hereby makes the following amendments, namely:

1. Short Title and Commencement–

(a) These Regulations shall be called UPERC (Rooftop Solar PV Grid Interactive System Gross/ Net Metering) Regulation, 2019 (First Amendment / Addendum) hereinafter referred to as RSPV Regulation, 2019) (First Amendment).

(b) These Regulations shall come into force from the date of their notification in the Official Gazette of the State.

2. Amendments–

3. Addendum–

Following addition is being made to Regulation 2. 10.4 (A) The energy accounting and settlement procedure for eligible consumer / third party owners installing and operating rooftop solar PV system under net-billing / net feed-in shall be as per the following procedure:

(i) For each billing period, the licensee shall show the quantum of electricity injected by the rooftop solar PV system and electricity supplied by the Distribution Licensee in the billing period separately.

(ii) The monetary value of the imported energy shall be based on the applicable retail tariff.

The monetary value of the exported solar energy shall be based on Net billing/Net feed-in Tariff, as defined in Regulation 2(gg), decided by the Commission.

(iii) The net bill payable/ receivable shall be determined as the difference between the monetary value of the exported energy and electricity bill of the electricity supplied by the Distribution licensee (including government levy etc.). In case of net bill payable, the provisions of applicable Tariff Order and Supply Code shall be applicable in terms of late payment surcharge. In case of net bill receivable, the amount shall be carried forward and adjusted against the bills generated in future.

(iv) When an eligible consumer leaves the system or at the end of financial year, whichever happened earlier, any balance that is pending to be received by the consumer from the distribution licensee shall be paid to the consumer.

(v) In case of Group Net billing / net feed-in, the settlement between the individual consumer in the group and the third party (if involved) will be the responsibility of the group or third party itself and shall be governed by the agreement between them. The third party aggregator shall not be charged by DISCOM any fixed charges on this account but shall be charged for energy imported as per prevailing Rules and Regulations.

(vi) There shall be no deemed generation charges payable to the eligible consumer.

(vii) In case the applicable tariff provides for billing on kVAh basis, the drawl or injection of energy shall also be measured in kVAh.

(viii) The Distribution Licensee shall necessarily provide the following details along with the electricity bill relating to each billing period:

[a] Quantum of electricity generated from the rooftop solar PV system.

[b] Quantum of electricity injected into the distribution system by the rooftop solar PV system.

[c] Quantum of electricity supplied by the Distribution Licensee to the eligible consumer. [d] The monetary value of electricity injected into the distribution system by the rooftop solar PV system based on feed-in tariff determined by the Commission.

[e] The monetary value of electricity supplied by the Distribution Licensee to the eligible consumer as per the Tariff Order.

[f] The net bill payable/ receivable shall be determined as the difference between electricity bill of the electricity supplied by the Distribution licensee (including government levy etc.) and the sum of monetary value of the exported energy & receivables, if any, carried over from last month.

10.6 the procedure and timelines for granting approval for gross metering arrangement or net metering arrangement or net billing / net feed-in arrangement, as per respective eligibility, shall be finalized by UPNEDA/ state designated agency in consultation of the Discom within 60 days of notification of this Regulation and will be submitted before the Commission for its approval.

Addition of Regulation 18. Power to Remove Difficulties–

18. If any difficulty arises in giving effect to any of the provisions of this Regulation, the Commission may direct, by a general or special order, not being inconsistent with the provisions of this Regulation or the Act, which appear to be necessary or expedient for the purpose of removing the difficulties.

Inter connection agreement (Net Billing / Net Feed-in Arrangement)

(Name of the Licensee) agrees to provide grid connectivity to the eligible consumer for injection of the electricity generated from his RSPV plant of capacity ……….. kW into the power system of Licensee and as per conditions of this agreement and RSPV Regulations/Orders issued by the Uttar Pradesh Electricity Regulatory Commission.

Both the parties hereby agree to as follows–

1. Eligibility–

1.1. Eligibility for Net Billing / Net Feed-in arrangement has been specified in the UPERC (Rooftop Solar PV Grid Interactive System Gross/Net Metering) Regulations, 2019 (First Amendment / Addendum) (hereinafter referred to as RSPV Regulations, 2019) (First Amendment). Eligible consumer is required to be aware, in advance, of the standards and conditions his system has to meet for being integrated into grid/distribution system for net billing / net feed-in.

2. Technical and Interconnection Requirements–

2.1. The eligible consumer / First Party agrees that his Rooftop Solar PV generation plant and Net- Billing / net Feed-in system will conform to the standards and requirements specified in these regulations and in the following Regulations and codes as amended from time to time.

i. Central Electricity Authority (Technical Standards for connectivity of the Distributed Generating Resources) Regulations, 2013 and subsequent amendments thereof;

ii. Central Electricity Authority (Installation and Operation of Meters) Regulation, 2006 and subsequent amendments thereof;

iii. Central Electricity Authority (Measures of Safety and Electricity Supply) Regulations, 2010 and subsequent amendments thereof;

iv. UPERC Electricity Grid Code, 2007 and subsequent amendments thereof;

v. UPERC (Grant of Connectivity to intra-State Transmission System) Regulations, 2010 and subsequent amendments thereof to the extent specified in the UPERC RSPV Regulations, 2019;

vi. UPERC Supply Code Regulations, 2005 and subsequent amendments thereof;

vii. Any other provisions applicable to the electricity consumer of the Distribution Licensee.

2.2. Eligible consumer / First Party agrees that he has installed or will install, prior to connection of Photovoltaic system to Licensee's distribution system, an isolation device (both automatic and inbuilt within inverter and external manual relays) and agrees for the Licensee to have access to and operation of this, if required and for repair & maintenance of the distribution system.

2.3 Eligible consumer / First Party agrees that in case of a power outage on Licensee's system, photovoltaic system will disconnect/isolate automatically and his plant will not inject power into Licensee's distribution system.

2.4 All the equipment connected to distribution system shall be compliant with relevant International (IEEE/IEC) or Indian standards (BIS) and installations of electrical equipment must comply with Central Electricity Authority (Measures of Safety and Electricity Supply) Regulations, 2010.

2.5. Eligible consumer/First Party agrees that Licensee will specify the interface/interconnection point and metering point.

2.6. Eligible consumer/First Party and Licensee agree to comply with the relevant CEA and UPERC Regulations in respect of operation and maintenance of the plant, drawing and diagrams, site responsibility schedule, harmonics, synchronization, voltage, frequency, flicker etc.

2.7. Due to Licensee's obligation to maintain a safe and reliable distribution system, eligible consumer/First Party agrees that if it is determined by the Licensee that eligible consumer's photovoltaic system either causes damage to and/or produces adverse effects affecting other consumers or Licensee's assets, eligible consumer/First Party will have to disconnect photovoltaic system immediately from the distribution system upon direction from the Licensee and correct the problem at his own expense prior to a reconnection.

3. Clearances and Approvals–

3.1. The eligible consumer / First Party agrees to obtain all the necessary approvals and clearances (environmental and grid connection related) before connecting the photovoltaic system to the distribution system.

4. Access and Disconnection–

4.1. Licensee shall have access to metering equipment and disconnecting means of the solar photovoltaic system, both automatic and manual, at all times.

4.2. In emergency or outage situation, where there is no access to the disconnecting means, both automatic and manual, such as a switch or breaker, Licensee may disconnect service to the premises of the eligible consumer.

5. Liabilities–

5.1. Eligible consumer/First Party and Licensee will indemnify each other for damages or adverse effects from either party's negligence or intentional misconduct in the connection and operation of photovoltaic system or Licensee's distribution system.

5.2. Licensee and eligible consumer/First Party will not be liable to each other for any loss of profits or revenues, business interruption losses, loss of contract or loss of goodwill, or for indirect, consequential, incidental or special damages, including, but not limited to, punitive or exemplary damages, whether any of the said liability, loss or damages arise in contract, or otherwise.

5.3. Licensee shall not be liable for delivery or realization by eligible consumer / First Party for any fiscal or other incentive provided by the Central/State Government beyond the scope specified by the Commission in its relevant Order

5.4. The Licensee may consider the quantum of electricity generation from the Rooftop Solar PV system towards RPO.

6. Commercial Settlement–

6.1. All the commercial settlement under this agreement shall follow the RSPV Regulations, 2019 (First Amendment) issued by the UPERC.

7. Connection Costs–

7.1. The eligible consumer / First Party shall bear all costs related to setting up of photovoltaic system including metering and interconnection costs. The eligible consumer agrees to pay the actual cost of modifications and upgrades to the service line required to connect photovoltaic system to the grid in case it is required.

8. Termination–

8.1. The eligible consumer / First Party can terminate agreement at any time by providing Licensee with 90 days prior notice.

8.2. Licensee has the right to terminate Agreement on 30 days prior written notice, if eligible consumer / First Party commits breach of any of the term of this Agreement and does not remedy the breach within 30 days of receiving written notice from Licensee of the breach.

8.3. Eligible consumer / First Party shall upon termination of this Agreement, disconnect the photovoltaic system from Licensee's distribution system in a timely manner and to Licensee's satisfaction.
