अधिसूचना
''भारत का संविधान'' के अनुच्छेद 200 के अधीन श्री राज्यपाल ने उत्तर प्रदेश निजी विश्वविद्यालय (द्वितीय संशोधन), विधेयक, 2022 जिससे उच्च शिक्षा अनुभाग-1 प्रशासनिक रूप से सम्बन्धित है, पर दिनांक 3 जून, 2022 को अनुमति प्रदान की और वह उत्तर प्रदेश अधिनियम संख्या 4 सन् 2022 के रूप में सर्वसाधारण की सूचनार्थ इस अधिसूचना द्वारा प्रकाशित किया जाता है।

उत्तर प्रदेश निजी विश्वविद्यालय अधिनियम, 2019 का अग्रतर संशोधन करने के लिए
अधिनियम
भारत गणराज्य के तिहत्तरवें वर्ष में निम्नलिखित अधिनियम बनाया
जाता है :-
1-(1) यह अधिनियम उत्तर प्रदेश निजी विश्वविद्यालय (द्वितीय संशोधन) स्ांक्षिप्त नाम और प्रारम्भ अधिनियम, 2022 कहा जायेगा।
(2) यह दिनांक 8 जनवरी, 2022 से प्रवृत्त हुआ समझा जायेगा।2 उत्तर प्रदेश असाधारण गजट, 3 जून, 2022 उत्तर प्रदेश 2-उत्तर प्रदेश निजी विश्वविद्यालय अधिनियम, 2019 की अनुसूची 1 और अनुसूची 2 अधिनियम संख्या 12 में, क्रम संख्या 15 पर, क्रम संख्या 15 की प्रविष्टियां निकाल दी जायेंगी और उक्त अनुसूचियां सन् 2019 की तद्नुसार पुनः संख्यांकित की जायेंगी :

परन्तु यह कि उक्त संशोधन यू0जी0सी0 (समवत विश्वविद्यालय श्रेष्ठ संस्थान) अनुसूची 2 में
संशोधन
विनियम, 2017 के अधीन पूर्वोक्त अनुसूचियों में क्रम संख्या 15 पर "समवत विश्वविद्यालय श्रेष्ठ संस्थान" के रूप में सूचीबद्ध विश्वविद्यालय की अधिसूचना के दिनांक से प्रवृत्त होगा। निरसन और

3-(1) उत्तर प्रदेश निजी विश्वविद्यालय (संशोधन) अध्यादेश, 2022
व्यावृत्ति
अध्यादेश संख्या 4 एतद्द्वारा निरसित किया जाता है।
सन् 2022
(2) ऐसे निरसन के होते हुए भी उपधारा (1) में निर्दिष्ट अध्यादेश
द्वारा यथा संशोधित मूल अधिनियम के उपबंधों के अधीन कृत कोई कार्य
या की गयी कोई कार्यवाही, इस अधिनियम द्वारा यथा संशोधित मूल
अधिनियम के सह प्रत्यर्थी उपबंधों के अधीन कृत या की गयी समझी
जायेगी मानों इस अधिनियम के उपबंध सभी सारवान समयों में प्रवृत्त
थे।

उद्देश्य और कारण
उत्तर प्रदेश राज्य में उच्च शिक्षा प्रदान करने के निमित्त उत्तर प्रदेश राज्य में नये निजी विश्वविद्यालयों की स्थापना करने और विद्यमान निजी विश्वविद्यालयों को निगमित करने तथा उनके —त्यों को विनियमित करने एवं उनसे सम्बन्धित या आनुषंगिक मामलों हेतु उपबन्ध करने के लिए उत्तर प्रदेश निजी विश्वविद्यालय अधिनियम, 2019 (उत्तर प्रदेश अधिनियम संख्या 12 सन् 2019) अधिनियमित किया गया है।
तीस निजी विश्वविद्यालय, पूर्वोक्त अधिनियम की अनुसूची 1 और 2 में सम्मिलित है। यू0जी0सी0 (समवत विश्वविद्यालय श्रेष्ठ संस्थान) विनियम, 2017 में किसी निजी विश्वविद्यालय को समवत विश्वविद्यालय श्रेष्ठ संस्था के रूप में घोषित करने का उपबंध है। उक्त उपबंध के आलोक में राज्य सरकार द्वारा उक्त विश्वविद्यालय से संबंधित प्रविष्टियों को हटाकर पूर्वोक्त अनुसूचियों में संशोधन करने का विनिश्चय किया गया ताकि पूर्वोक्त विश्वविद्यालय को उक्त प्रास्थिति प्रदान किया जा सके।
चूंकि राज्य विधान मण्डल सत्र में नहीं था और पूर्वोक्त विनिश्चय को क्रियान्वित करने के लिए तुरन्त विधायी कार्यवाही करनी आवश्यक थी, अतः राज्यपाल द्वारा दिनांक 8 जनवरी, 2022 को उत्तर प्रदेश निजी विश्वविद्यालय (संशोधन) अध्यादेश, 2022 (उत्तर प्रदेश अध्यादेश संख्या 4 सन् 2022) प्रख्यापित किया गया। यह विधेयक पूर्वोक्त अध्यादेश को प्रतिस्थापित करने के लिए पुरःस्थापित किया जाता है।

IN pursuance of the provisions of clause (3) of Article 348 of the Constitution of India, the Governor is pleased to order the publication of the following English translation of the Uttar Pradesh Niji Vishwavidyalaya (Dwitiya Sanshodhan) Adhiniyam, 2022 (Uttar Pradesh Adhiniyam Sankhya 4 of 2022) as passed by the Uttar Pradesh Legislature and assented to by the Governor on June 3, 2022. The Uccha Shiksha Anubhag-1 is administratively concerned with the said Adhiniyam.
THE UTTAR PRADESH PRIVATE UNIVERSITIES (SECOND
AMENDMENT) ACT, 2022
(U.P. Act no. 4 of 2022)
[As passed by the Uttar Pradesh Legislature]
AN
ACT
further to amend the Uttar Pradesh Private Universities Act, 2019.
IT IS HEREBY enacted in the Seventy third Year of the Republic of India as
follows:-
Short title
1.(1) This Act may be called the Uttar Pradesh Private Universities (second
and Commencement Amendment) Act, 2022.
(2) It shall be deemed to have come into force with effect from January 8, 2022.
2. At serial no. 15 in Schedule 1 and Schedule 2 of the Uttar Pradesh Private Amendment of
Schedule 1 and Universities Act, 2019, the entries at serial no. 15, shall be deleted and the said Schedule
Schedule 2 of shall be renumbered accordingly :
U.P. Act no. 12
of 2019
Provided that the said amendment shall come into effect from the date of
notification of the University Scheduled at serial no. 15 in the aforesaid Schedules as
'Institution of Eminence Deemed to be University' under UGC (Institutions of Eminence
Deemed to be Universities) Regulations, 2017.
Repeal and
U.P. Ordinance 3. (1) The Uttar Pradesh Private Universities (Amendment)
saving
no. 4 of 2022 Ordinance, 2022 is hereby repealed.
(2) Notwithstanding such repeal, anything done or any action
taken under the provisions of the principal Act as amended by the
Ordinance referred to in sub-section (1) shall be deemed to have been
done or taken under the corresponding provisions of the principal Act as
amended by this Act as if the provisions of this Act were in force at all
material times.

STATEMENT OF OBJECTS AND REASONS
The Uttar Pradesh Private Universities Act, 2019 (U.P. Act no. 12 of 2019) has been enacted to provide for establishment of new Private Universities and incorporation of existing private Universities in the State of Uttar Pradesh for imparting higher education in the State of Uttar Pradesh and to regulate their functions and for matters connected therewith or incidental thereto.
4 उत्तर प्रदेश असाधारण गजट, 3 जून, 2022Thirty private Universities are included in Schedule 1 and 2 of the aforesaid Act. UGC (Institutions of Eminence Deemed to be Universities) Regulations, 2017 provides for a private Universities to be declared as institution of eminence deemed to be Universities. In the light of the aforesaid provision, it was decided by the State Government to amend the aforesaid Schedules by deleting the entries related to the said University so that the aforesaid status can be conferred on the aforesaid University .
Since the State Legislature was not in session and immediate legislative action was necessary to implement the aforesaid decision, the Uttar Pradesh Private Universities (Amendment) Ordinance, 2022 (U.P. Ordinance no. 4 of 2022) was promulgated by the Governor on January 08, 2022.
This Bill is introduced to replace the aforesaid Ordinance.
