चूँकि भारतीय सेना का आसन फील्ड फायरिंग रेन्ज (एएफएफआर) जिला सहारनपुर, उत्तर प्रदेश के आरक्षित वन क्षेत्र में अवस्थित है ;

और, चूँकि, पर्यावरण, वन और जलवायु परिवर्तन मन्त्रालय (वन संरक्षण प्रभाग), भारत सरकार ने, अपने पत्र संख्या एफ संख्या 8-20/2016-एफ0 सी0 दिनांक 10 अप्रैल, 2018 द्वारा राज्य सरकार के प्रस्ताव का परीक्षण करने के पश्चात्‌ तथा वन संरक्षण अधिनियम, 1980 (अधिनियम संख्या 69 सन्‌ 1980) की धारा 3 के अधीन केन्द्र सरकार द्वारा गठित वन सलाहकार समिति की सिफारिशों के आधार पर पूर्वोक्त फायरिंग रेन्ज के लिए 25885.64 हेक्टेयर वन भूमि के अपयोजन का नवीकरण करने के लिये सिद्धान्ततः अनुमोदन प्रदान कर दिया है ;

और, चूँकि, भारत सरकार के पूर्वोक्त मन्त्रालय ने, उत्तर प्रदेश सरकार के पत्र संख्या 2966/81-2-2019-800(74)-2016, दिनांक 03 फरवरी, 2020 द्वारा प्रस्तुत अनुपालन रिपोर्ट के आधार पर, पूर्वोक्त अधिनियम सन्‌ 1980 की धारा 2 के अधीन पत्र संख्या 8-20/2016 एफ0सी0 दिनांक 06 मार्च, 2020 द्वारा अपना अंतिम अनुमोदन प्रदान कर दिया है ;

और, चूँकि, युद्धाभ्यास और खुले क्षेत्र में गोला चलाने तथा तोप दागने का अभ्यास अधिनियम, 1938 (अधिनियम संख्या 5 सन्‌ 1938) (जिसे आगे ''उक्त अधिनियम'' कहा गया है) की धारा 9 की उपधारा (1) के अधीन शक्तियों का प्रयोग करके राज्यपाल ने अधिसूचना संख्या 1009/तीन-2020-47-2(1)-09, दिनांक 23 मार्च, 2021 द्वारा नीचे अनुसूची में उल्लिखित भूमि को ऐसे क्षेत्र, जिसमें दिनांक 01 जुलाई, 2020 से 30 जून, 2050 तक उक्त भूमि के खुले क्षेत्रों में समय-समय पर गोला चलाने तथा तोप दागने का अभ्यास किया जाना प्राधिकृत किया जा सकता है, के रूप में अधिसूचित किया था ;

और, चूँकि, उक्त अधिनियम की धारा 9 की उपधारा (3) के अधीन शक्तियों का प्रयोग करके राज्यपाल ने, अधिसूचना संख्या 611/तीन-2021-47-2(1)-09 दिनांक 13 दिसम्बर, 2021 द्वारा नीचे अनुसूची में उल्लिखित सम्पूर्ण क्षेत्र अथवा उसके किसी विनिर्दिष्ट भाग में दिनांक 01 जुलाई, 2020 को प्रारम्भ होने वाली और 30 जून, 2050 को समाप्त होने वाली अवधि के दौरान गोला चलाने और तोप दागने का अभ्यास किया जाना प्राधिकृत करते हुये उक्त अधिनियम की धारा 9 की उपधारा (2) के अधीन अधिसूचना जारी किये जाने का अपना आशय अधिसूचित किया था ;

और, चूँकि, उक्त अधिनियम की धारा 9 की उपधारा (4) के अधीन शक्तियों का प्रयोग करके, राज्यपाल ने, अधिसूचना संख्या 01(क)/तीन-2022-47-2(1)-09 दिनांक 14 मार्च, 2022 द्वारा नीचे अनुसूची में विनिर्दिष्ट सम्पूर्ण क्षेत्र अथवा उसके आंशिक भाग में दिनांक 01 जुलाई, 2020 को प्रारम्भ होने वाली और 30 जून, 2050 को समाप्त होने वाली तीस वर्ष की अवधि तक के लिए समय-समय पर गोला चलाने और तोप दागने का अभ्यास किया जाना प्राधिकृत करते हुये उक्त अधिनियम की धारा 9 की उपधारा (2) के अधीन अधिसूचना जारी किये जाने के अपने आशय की अधिसूचना पुनः प्रकाशित की थीं ;

अतएव, अब, उक्त अधिनियम की धारा 9 की उपधारा (2) के अधीन शक्तियों का प्रयोग करके राज्यपाल, नीचे अनुसूची में उल्लिखित सम्पूर्ण क्षेत्र अथवा उसके किसी विनिर्दिष्ट आंशिक भाग में, दिनांक 01 जुलाई, 2020 को प्रारम्भ होने वाली और 30 जून, 2050 को समाप्त होने वाली अवधि तक के लिये निम्नलिखित शर्तों को पूरा किये जाने के अध्यधीन गोला चलाने और तोप दागने का अभ्यास किया जाना प्राधिकृत करती हैं :-

1-अपयोजित वन भूमि की विधिक प्रास्थिति अपरिवर्तित रहेगी।

2-राजाजी राष्ट्रीय पार्क की सीमा से 10 किलोमीटर के भीतर आने वाले क्षेत्र का उपयोग गोलाबारी रेन्ज के लिये नहीं किया जायेगा।

3-हाथी आरक्षित क्षेत्र के अन्तर्गत रात्रि के समय शिविर वास (कैम्पिंग) की अनुज्ञा नहीं होगी।

4-भारतीय सेना को यह भी सुनिश्चित करना होगा कि कोई रोध/बाड़ परिनिर्मित न किये जायं जिससे की हाथियों के प्राकृतिक संचलन में विघ्न न पडे़।

5-भारतीय सेना को यह सुनिश्चित करना होगा कि हाथी प्रव्रजन मौसम और वन अग्नि मौसम के दौरान अभ्यास के प्रयोजनार्थ पूर्वोक्त फायरिंग रेन्ज का उपयोग निर्बन्धित रहेगा।

6-भारतीय सेना को यह सुनिश्चित करना होगा कि हाथी प्रव्रजन मार्ग का उपयोग न किया जाय। 7-गोलाबारी अभ्यास, ऐसे ढलानों, नाला ढलानों और नाला तलों में किया जायेगा, जो वनस्पति रहित हों और हाथी प्रव्रजन मार्ग में न पड़ते हों और चक्रानुक्रम रीति से किया जाय।

8-वन्य जीव को मानसिक आघात से बचाने के लिये गोलाबारी का अभ्यास वास्तविक अभ्यास के एक घण्टा पूर्व फायरिंग ब्लैंक शाट्‌स से प्रारम्भ किया जायेगा।

9-भारतीय सेना वन क्षेत्रों के विभिन्न विषयों यथा खर पतवार उन्मूलन, अवैध कटान नियंत्रण, वन्यजीव शिकार चोरी और पर्यावरणीय/वन्य जागरूकता सृजन में उत्तम प्रबन्धन के लिये प्रभाग के पदाधिकारियों की सहायता/मदद करेगी।

10-भारतीय सेना को यह सुनिश्चित करना होगा कि वनस्पतियों, जीवों और जैव-अपयोजन विषयक गोलाबारी समाघात क्षेत्र, वैज्ञानिक अध्ययन, वन अनुसंधान संस्थान, देहरादून के परामर्श से किया जा सके जो ऐसे अग्रतर प्रस्ताव का आधार होगा।

11- भारतीय सेना द्वारा गोलाबारी रेन्ज में कोई वृ़क्ष कटान नहीं किया जायेगा।

12-वन संरक्षण अधिनियम, 1980 तथा उत्तर प्रदेश सरकार के पत्र संख्या 57/81-2-2020-800(74)/2020, दिनांक 23 जून, 2020 के अनुसार अनुज्ञा, दिनांक 01 जुलाई, 2020 से दिनांक 30 जून, 2050 तक 30 वर्षों की अवधि के लिये प्रदान की गयी है।

13- भारतीय सेना द्वारा गोलाबारी रेन्ज में कोई निर्माण नहीं किया जायेगा/उसकी अनुज्ञा नहीं प्रदान की जायेगी।

14- यदि लागू हो तो उपयोक्ता अभिकरण को पर्यावरण (संरक्षण) अधिनियम, 1986 के उपबंधों के अनुसार पर्यावरण अनापत्ति प्राप्त करनी होगी।

15- गोलाबारी रेंज की अभिन्यास योजना में परिवर्तन केन्द्र सरकार की अनुज्ञा के बिना नहीं किया जायेगा।

16- भारतीय सेना या उसका कोई प्रतिनिधि, वनस्पति और प्राणी को हानि नहीं पहुँचायेगा। यदि हानि पहुँचाई जाती है, तो भारतीय सेना, प्रतिकर का संदाय करने के लिये उत्तरदायी होगी।

17- वन विभाग के अधिकारीगण/कर्मचारिवृन्द, जब कभी अपेक्षित हो किसी समय वन भूमि का निरीक्षण करेंगे।

18- वन भूमि का उपयोग परियोजनागत प्रस्ताव में विनिर्दिष्ट प्रयोजन से भिन्न किसी प्रयोजनार्थ नहीं किया जायेगा और किन्ही परिस्थितियों में इसे किसी अन्य अभिकरण को अंतरित नहीं किया जायेगा।

19- भारतीय सेना, वन संरक्षण अधिनियम, 1980 के अधीन दी गयी किन्हीं शर्तों का अतिक्रमण नहीं करेगी। किसी अतिक्रमण की स्थिति में पर्यावरण, वन एवं जलवायु परिवर्तन मंत्रालय, भारत सरकार, नई दिल्ली के पत्र संख्या एफ संख्या 5-2/2017-एफ0सी0, दिनांक 28-03-2019, पत्र संख्या-8-20/2016 एफ0सी0,107 Samanaya Prasasan Data8d 2022 उत्तर प्रदेश असाधारण गजट, 8 जून, 2022 3 दिनांक 10-04-2018, पत्र संख्या-8-20/2016 एफ0सी0, दिनांक 06-03-2020 और उत्तर प्रदेश सरकार के पत्र संख्या-57/81-2-2020-800(74)/2020, दिनांक 23-06-2020 द्वारा जारी व्यापक मार्गदर्शक सिद्धान्त के प्रस्तर 1.21 के अनुसार कार्यवाही की जायेगी।

20- पर्यावरण, वन एवं जलवायु परिवर्तन मंत्रालय, भारत सरकार, वन तथा वन्य जीव संरक्षण तथा विकास के हित में कोई अन्य शर्तें नियत कर सकती है और उनका अनुपालन राज्य सरकार तथा भारतीय सेना को करना होगा। 21- भारतीय सेना, पर्यावरण, वन एवं जलवायु परिवर्तन मंत्रालय, भारत सरकार के पत्र संख्या-8-20/2016 एफ0सी0, दिनांक 10-4-2018, पत्र संख्या-8-20/2016 एफ0सी0, दिनांक 06-03-2020 और उत्तर प्रदेश सरकार के पत्र संख्या- 57/81-2-2020-800(74)/2020, दिनांक 23-06-2020 में दिये गये मार्गदर्शक सिद्धान्त/शर्तों का अनुसरण करेगी।

22- भारतीय सेना, गोलाबारी अभ्यास क्रियान्वित करने के पूर्व सम्बन्धित प्राधिकारियों को सूचित करेगी। 23- समस्त विधिक औपचारिकतायें गोलाबारी अभ्यास प्रारम्भ किये जाने के पूर्व क्रियान्वित की जायेंगी। 24- दिनांक 15 फरवरी से 15 जुलाई तक किसी गोलाबारी अभ्यास की अनुज्ञा नहीं दी जायेगी। 25- केन्द्र सरकार/राज्य सरकार द्वारा समय-समय पर अधिकथित की गयी किन्हीं शर्तों का कार्यान्वयन भारतीय सेना द्वारा किया जायेगा।

26- गोलाबारी के समय-चक्र की जाँच की जायेगी और यह सुनिश्चित किया जायेगा कि न दगने की स्थिति में उसे अक्रियाशील कर दिया जाय।

-उक्त भूमि का स्थल नक्शा सहारनपुर के कलेक्टर और प्रभागीय वनाधिकारी, शिवालिक वन प्रभाग, सहारनपुर के कार्यालय में देखा जा सकता है।

The Governor is pleased to order the publication of the following English translation of notification no.337/III-2022-47-2(1)-09 dated June 8, 2022 for general information :

No.337 /III-2022–47-2(1)-09

Lucknow, Dated, June 8, 2022

WHEREAS the Asan Field Firing Range (AFFR) of the Indian Army is located in the reserved forest area of District Saharanpur, Uttar Pradesh;

AND, WHEREAS, the Ministry of Environment, Forests and Climate Change (Forest Conservation Division), Government of India vide its Letter no. F.No.8-20/2016-F.C. dated April 10, 2018 has granted in- principle approval for renewal of diversion of 25885.64 hectares of forest land for the aforesaid firing range after examination of the proposal of the State Government and on the basis of the recommendations of the Forest Advisory Committee constituted by the Central Government under section 3 of the Forest Conservation Act, 1980 (Act no.69 of 1980) ;

AND, WHEREAS, the aforesaid Ministry of the Government of India has granted its final approval under section 2 of the aforesaid Act of 1980 vide letter no.8-20/2016-F.C. dated March 6, 2020 on the basis of the compliance report furnished by the Government of Uttar Pradesh vide letter no.2966/81-2-2019- 800(74)/2016 dated February 03, 2020 ; AND, WHEREAS, in exercise of the powers under sub-section (1) of section 9 of the Manoeuvres, Field Firing and Artillery Practice Act, 1938 (Act no. V of 1938), (hereinafter refrerred to as the "said Act"), the Governor Vide Notification no. 1009/III-2020-47-2(1)-09, dated March 23, 2021 was pleased to notify the land mentioned in the Schedule below as the area in which field firing and artillery practice can be authorized from time-to-time in open areas of the said land from July 01, 2020 to June 30, 2050;

AND, WHEREAS, in exercise of the powers under sub-section (3) of section 9 of the said Act, the Governor vide Notification no. 611/III-2021-47-2(1)-09, dated December 13, 2021 was pleased to notify his intention to issue a notification under sub-section (2) of section 9 of the said Act authorizing the carrying out of field firing and artillery practice throughout the area mentioned in the Schedule below or any specified part thereof during the period commencing on the 1st day of July, 2020 ending on 30th June, 2050;

AND, WHEREAS, in exercise of the powers under sub-section (4) of section 9 of the said Act, the Governor vide Notification no. 01(A)/III-2022-47-2(1)-09, dated March 14, 2022 was pleased to repeat the publication of notification of his intention to issue, a notification under sub-section (2) of section 9 of the aforesaid Act authorizing the carrying out, periodically, of field firing and artillery practice throughout the whole or any part of the area specified in the Schedule below for the period of thirty years commencing from the 1st day of July, 2020 and ending on the 30th day of June, 2050;

NOW, THEREFORE, in exercise of the powers under sub-section (2) of section 9 of the said Act, the Governor is pleased to authorize the carrying out of field firing and artillery practice throughout the area mentioned in the Schedule below or any specified part thereof during the period commencing on the 1st day of July, 2020 ending on 30th June, 2050 subject to the fulfilment of following conditions :-

1. Legal status of the diverted forest land shall remain unchanged; 2. Area falling within 10 km. from the boundary of the Rajaji National Park shall not be used for firing range;

3. Night time camping shall not be allowed inside the elephant reserve; 4. Indian Army shall also ensure that no barriers/fences are erected so that natural movement of elephants is not disturbed;

5. Indian Army shall ensure that the usage of the aforesaid Firing Range for practice purpose shall be restricted during elephant migration season and forest fire season;

6. Indian Army shall ensure that the usage of migration route of elephants will not be used; 7. Firing practice shall be carried out on slopes, nallah slopes nallah beds devoid of vegetation not falling in migratory route of elephants and in rotational manner;

8. Firing practice shall start with firing blank shots one hour prior to actual practice to avoid trauma to the wildlife.

9. The Indian Army shall help/assist officials of the division in better management of the forest areas in various issues like eradication of weeds, control of illicit felling, poaching of wild life, generation environment / forest related awareness;

10. Indian Army shall ensure the scientific study of firing impact area regarding flora, fauna and bio- diversion may be taken up in consultations with Forest Research Institute, Dehradun which will become the basis for further such proposal;

11. No tree felling shall be done by the Indian Army in firing range; 12. As per Forest Act, 1980 and Uttar Pradesh Government letter no.-57/81-2-2020-800(74)/2020, dated June 23, 2020 permission has been granted from July 01, 2020 to June 30, 2050 for 30 years;

13. No construction will be made /allowed in Firing Range by Indian Army; 14. The user agency shall obtain Environment Clearance as per the provision of the Environment (protection) Act, 1986, if applicable;

15. The layout plan of the firing range will not be changed without permission from the Central Government;

16. Indian Army or any representative will not harm the Flora and Fauna. If it is harmed, the Indian Army shall be responsible to pay the compensation;

17. Officers/Staff of Forest Department will inspect the forest land at any time whenever required; 18. The forest land shall not be used for any purpose other than that specified in the project proposal, and under no circumstances shall it be transferred to any other agency;

5 19. Indian Army will not violate any conditions given under Forest Conservation Act, 1980. In case of any violation, action would taken as per Para 1.21 of comprehensive guidelines issued vide Government of India, Ministry of Environment, Forest and Climate Change, New Delhi Letter F.no. 5-2/2017-F.C. dated March 28, 2019, Letter No. 8-20/2016 F.C., dated April 10, 2018, Letter No. 8-20/2016 F.C., dated March 06, 2020 and Uttar Pradesh Government Letter No.-57/81- 2-2020-800(74)/ 2020, dated June 23, 2020;

20. Ministry of Environment, Forests and Climate Change, Government of India may stipulate any other conditions from time to time in the interest of conservation, development of forest and wildlife and the same shall be carried out by the State Government and Indian Army;

21. Indian Army will follow the guidelines/conditions given in Ministry of Environment, Forest and Climate Change, Government of India, Letter no. 8-20/2016 F.C. dated April 10, 2018, Letter no. 8-20/2016 F.C. dated March 06, 2020 and Uttar Pradesh Government Letter no. 57/81-2- 2020-800 (74)/2020 dated June 23, 2020;

22. Indian Army, will intimate the concerned authorities prior to carrying out firing practice; 23. All legal formalities to be carried out before starting firing practice; 24. No firing exercise will allowed from 15th February to 15th July; 25. Any other conditions laid down from time to time by the Central/State Government shall be implemented by the Indian Army;

26. At the time of firing round shall be checked and it shall be ensured that in case of misfire the same is be defused;
