उत्तर प्रदेश साधारण खण्ड अधिनियम, 1904 (उत्तर प्रदेश अधिनियम संख्या 1 सन् 1904) की धारा 21 के साथ पठित उत्तर प्रदेश —षि उत्पादन मण्डी अधिनियम, 1964 (उत्तर प्रदेश अधिनियम संख्या 25 सन् 1964) की धारा 40 की उपधारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करके राज्यपाल, उत्तर प्रदेश —षि उत्पादन मण्डी नियमावली, 1965 में संशोधन करने की दृष्टि से निम्नलिखित नियमावली बनाती हैं।
उत्तर प्रदेश —षि उत्पादन मण्डी (पच्चीसवाँ संशोधन) नियमावली, 2022
संक्षिप्त नाम 1-(1) यह नियमावली उत्तर प्रदेश —षि उत्पादन मण्डी (पच्चीसवाँ संशोधन)
और प्रारम्भ नियमावली, 2022 कही जाएगी।
(2) यह दिनांक 11 मई, 2020 से प्रवृत्त हुई समझी जायेगी।
नियम 66-क 2-उत्तर प्रदेश —षि उत्पादन मण्डी नियमावली, 1965, में नियम 66 के पश्चात्
का बढ़ाया जाना निम्नलिखित नियम बढ़ा दिया जायेगा, अर्थातः- 2 उत्तर प्रदेश असाधारण गजट, 20 जून, 2022
''
66-क-प्रधान मण्डी स्थल/उपमण्डी स्थल में
बिक्री के लिए लाये गये गैर विनिर्दिष्ट —षि उत्पादों यथा-अन्न, द्वि-दलीय उत्पाद,
तिलहन, रेशे, स्वापक, मसाले, उद्यान कर्म, फल एवं शाक, द्राक्षा-—षि उत्पाद आदि पर
अधिनियम की धारा 17 (तीन) (ग) के उपबन्धों के अनुसार प्रधान मण्डी
स्थल/उपमण्डी स्थल में उपलब्ध अवस्थापना सुविधाओं और प्रदत्त वस्तुओं तथा
सेवाओं के प्रतिफल स्वरूप मण्डी समिति प्रयोक्ता प्रभार (यूजर चार्ज) उद्ग्रहीत करेगी
और संग्रहीत करेगी :
प्रतिबन्ध यह है कि, घोषित मण्डी उप स्थल में गैर विनिर्दिष्ट —षि उत्पादों पर,
उत्तर प्रदेश —षि उत्पादन मण्डी अधिनियम, 1964 की धारा 7-क (3) में विनिर्दिष्ट
—षि उत्पादों पर मण्डी शुल्क उद्ग्रहण एवं सग्रहण हेतु किये गये उपबन्धों के समान
ही, प्रयोक्ता प्रभार उद्ग्रहीत एवं संग्रहीत किया जायेगा :
अग्रतर प्रतिबन्ध यह है कि, किसी न्यायालय के किसी निर्णय, डिक्री या आदेशों
में किसी प्रतिकूल बात के होते हुए भी, गैर विनिर्दिष्ट —षि उत्पाद बेचने वाला व्यापारी
समिति को प्रयोक्ता प्रभार (यूजर चार्ज) का देनदार होगा और दिनांक 11 मई, 2020
से सदैव देनदार हुआ समझा जायेगा और इस आधार पर कि यह पूर्व में क्रेता से
वसूल नहीं किया गया है, ऐसे दायित्व से मुक्त नहीं होगा।''

IN pursuance of the provisions of clause (3) of Article 348 of the Constitution, the Governor is pleased to order the publication of the following English translation of notification no. 3/2022/54/ LXXX- 1–2022-151-2021, dated June 20, 2022 :

IN exercise of the powers under sub-section (1) of Section 40 of the Krishi Utpadan Mandi Adhiniyam, 1964 (U.P. Act no. 25 of 1964), read with Section 21 of the Uttar Pradesh General Clauses Act, 1904 (U.P. Act no. 1 of 1904), the Governor is pleased to make the following rules with a view to amend the Uttar Pradesh Krishi Utpadan Mandi Niyamawali, 1965.
THE UTTAR PRADESH KRISHI UTPADAN MANDI (PACHCHISWAN SANSHODHAN) NIYAMAWALI, 2022
1. (1) These rules may be called the Uttar Pradesh Krishi Utpadan Mandi Short title and commencement (Pachchiswan Sanshodhan) Niyamawali, 2022.
(2) They shall be deemed to have come into force with effect from
May 11, 2020.
2. In the Uttar Pradesh Krishi Utpadan Mandi Niyamawali 1965 in the said Insertion of rule 66-A
rules, after rule 66 the following rule shall be inserted, namely :-
"User Charge–66-A The Market Committee shall levy and collect user charge as per the provision of section 17 (iii)(c) of the Act on non-specified agricultural produce such as cereals, legumes, oilseeds, fibres, narcotics, spices, horticulture-vegetables and fruits and viticulture produce, etc. brought for sale in the Principal market yard/sub-market yard, in consideration to the rendered material and services of the infrastructure facilities available at Principal market yard/sub-market yard :
उत्तर प्रदेश असाधारण गजट, 20 जून, 2022 3Provided that on non-specified agricultural produce in the declared market sub yard, user charges shall be levied and collected in the same manner as the provision made for levying and collecting market fee on specified agricultural produce in section 7-A(3) of the Uttar Pradesh Krishi Utpadan Mandi Adhiniyam, 1964 :
Provided further that notwithstanding anything to the contrary contained in any judgment, decree or order of any Court, a trader selling non-specified agricultural produce shall be liable to pay user charge to the Committee and shall be deemed to have become liable with effect from May 11, 2020, and shall not be exempted from such liability on the ground that it has not been recovered from that purchaser earlier."
