संयुक्त प्रान्त आबकारी अधिनियम, 1910 (संयुक्त प्रान्त अधिनियम संख्या 4 सन् 1910) की धारा 41 के अधीन प्रदत्त शक्तियों का प्रयोग करके , आबकारी आयुक्त, उत्तर प्रदेश, राज्य सरकार की पूर्व स्वीकृ ति से उत्तर प्रदेश आबकारी (विदेशी मदिरा के प्रीमियम फु टकर वि(cid:7059)य के लाइसेंसों का (cid:7390)वस्थापन) नियमावली, 2021, में संशोधन करने की दृष्टि से निम्नलिखित नियमावली बनाते हैं:-

1–संक्षिप्त नाम एवं प्रारम्भ–(1) यह नियमावली उत्तर प्रदेश आबकारी (विदेशी मदिरा के प्रीमियम फु टकर वि(cid:7059)य के लाइसेंसों का (cid:7390)वस्थापन) (द्वितीय संशोधन) नियमावली, 2022 कही जायेगी।

(2) यह गजट में प्रकाशित किये जाने के दिनांक से प्रवृत्त होगी।2 उत्तर प्रदेश असाधारण गजट, 28 जून, 2022 ई0 2– उत्तर प्रदेश आबकारी (विदेशी मदिरा के प्रीमियम फु टकर वि(cid:7059)य के लाइसेंसों का (cid:7390)वस्थापन) नियमावली, 2020, जिसे आगे उक्त नियमावली कहा गया है, में नीचे स्तम्भ-1 में दिए गए विद्यमान नियम-2 के स्थान पर स्तम्भ-2 में दिया गया नियम रख रख दिया जायेगा, अर्थात्:-

2. परिभाषा-

परिभाषा-

विशेषाधिकार के लिए लाइसेंस स्वीकृ त करने हेतु राज्य से, आबकारी आयुक्त द्वारा समय-समय पर किसी आबकारी

(ठ) ''प्रतिभूति धनराशि'' का तात्पर्य लाइसेंस फीस के एक (ठ) ''प्रतिभूति धनराशि'' का तात्पर्य लाइसेंस फीस के एक चौथाई धनराशि के समतुल्य धनराशि, जो सावधि जमा

एफ0एल0-2, एफ0एल0-2बी, एवं बी0आई0ओ0-1 से विदेशी मदिरा के परिवहन हेतु जारी अनु(cid:6980)ापन से है।

3–नियम-8 का संशोधन–उक्त नियमावली में नीचे स्तम्भ-1 में, दिए गए विद्यमान नियम-8 के स्थान पर स्तम्भ-2 में दिया गया नियम रख दिया जायेगा, अर्थात्:-

8. लाइसेंस शुल्क का संदाय- लाइसेंस स्वीकृ ति की सूचना प्राप्त 8. लाइसेंस शुल्क का संदाय- लाइसेंस स्वीकृ ति की सूचना करने के तीन दिनों के भीतर आवेदक को राज्य सरकार द्वारा

प्राप्त करने के तीन दिनों के भीतर आवेदक को राज्य समय-समय पर विहित लाइसेंस शुल्क जमा करना होगा।

सरकार द्वारा समय-समय पर विहित लाइसेंस शुल्क जमा प्रतिभूति धनराशि दस कार्यदिवसों के भीतर सावधि जमा

करना होगा। प्रतिभूति धनराशि दस कार्यदिवसों के भीतर रसीद या ई-पेमेन्ट के माध्यम से जमा की जायेगी।

सावधि जमा रसीद/बैंक गारंटी या ई-पेमेन्ट के माध्यम से

जमा की जायेगी।

4–प्रपत्र-एफ0एल0-4 (ग) का संशोधन–उक्त नियमावली, में नीचे स्तम्भ-1 में दिये गये विद्यमान प्रपत्र एफ0एल0-4 (ग) के स्थान पर स्तम्भ-2 में दिया गया प्रपत्र रख दिया जायेगा, अर्थातः-

NOTIFICATION

In exercise of powers conferred under section 41 of the United Provinces Excise Act, 1910 (U.P.

Act no. 4 of 1910), the Excise Commissioner, Uttar Pradesh with the previous sanction of the State Government, makes the following rules with a view to amending the Uttar Pradesh Excise (Settlement of Licenses for Premium Retail Vends of Foreign Liquor) Rules, 2020.

THE UTTAR PRADESH EXCISE (SETTLEMENT OF LICENSES FOR PREMIUM RETAIL VENDS OF FOREIGN LIQUOR)(SECOND AMENDMENT ) RULES, 2022 1. Short title and commencement–(1) These rules may be called the Uttar Pradesh Excise (Settlement of Licenses for Premium Retail Vends of Foreign Liquor) (Second Amendment) Rules, 2022.

(2) They shall come into force with effect from the date of their publication in the Gazette.

2. Amendment of rule-2–In the Uttar Pradesh Excise (Settlement of Licenses for Premium Retail Vends of Foreign Liquor) Rules, 2020, hereinafter referred to as the said rules, for existing rule-2 setout in Column-I below, the rule as setout in Column-II shall be substituted, namely:-

(2) Indian Made Foreign Liquor(IMFL):- Spirit or liquor made in India and sophisticated or coloured so as to resemble in flavour or colour, liquor imported into India and includes Malt spirit, Whisky, Rum, Brandy, Gin, Vodka and liqueurs. It also includes beer brewed in India or packed draught beer, porter, cider, ale, wine and low alcoholic beverages(LAB).

(l) "Security Amount" means the amount equal to one-fourth of the amount of license fee, to be deposited through F.D.R pledged in favor of District Excise Officer or through e-payment within fifteen days of grant of license and is liable to be forfeited in case of any default committed by the licensee in the operation of license.
