अधिसूचना

चूंकि प्रारम्भिक अधिसूचना संख्या 496/77-3-22-63(एम)-2021, दिनांक 7 अप्रैल, 2022, लोक प्रयोजन अर्थात्‌ उत्तर प्रदेश एक्सप्रेसवेज औद्योगिक विकास प्राधिकरण के माध्यम से गंगा एक्सप्रेसवे परियोजना हेतु अपेक्षित जिला मेरठ, तहसील सदर के ग्राम बधौली में क्षेत्रफल 12.4468 हेक्टेयर, अटौला में क्षेत्रफल 0.1150 हेक्टेयर, शाफियाबाद लौटी में क्षेत्रफल 0.4083 हेक्टेयर, खडखडी में क्षेत्रफल 0.5770 हेक्टेयर, गोविन्दपुर में क्षेत्रफल 0.1274180 हेक्टेयर, अतराडा में क्षेत्रफल 1.2950 हेक्टेयर, बिजौली में क्षेत्रफल 5.4517352 हेक्टेयर एवं भगवानपुर मे क्षेत्रफल 2.4250 हेक्टेयर अर्थात्‌ कुल 22.8462532 हेक्टेयर भूमि के संबंध में भूमि अर्जन, पुनर्वासन और पुनव्र्यवस्थापन में उचित प्रतिकर और पारदर्शिता का अधिकार अधिनियम, 2013 (अधिनियम संख्या 30 सन्‌ 2013) (जिसे आगे ''उक्त अधिनियम'' कहा गया है) की धारा 11 की उपधारा (1) के अधीन जारी की गई थी और अंततः दिनांक 7 अप्रैल, 2022 को प्रकाशित की गयी थी। डिप्टी कलेक्टर, सदर, जिला मेरठ को परियोजना से प्रभावित परिवारों के पुनर्वासन और पुनव्र्यवस्थापन के प्रयोजनार्थ प्रशासक नियुक्त किया गया था।

अतएव, अब, उक्त अधिनियम की धारा 15 की उपधारा (2) के अधीन उपबन्धों के अनुसरण में प्रस्तुत की गयी कलेक्टर की रिपोर्ट पर विचार करने के पश्चात्‌, राज्यपाल उक्त अधिनियम की धारा 19 की उपधारा (1) के अधीन घोषणा करती हैं कि उनका यह समाधान हो गया है कि नीचे अनुसूची "क" में उल्लिखित भूमि का क्षेत्रफल लोक प्रयोजन के लिए आवश्यक है और अनुसूची "ख" में यथा-प्रदत्त ग्राम, परगना और जिला मेें कोई भूमि विस्थापित परिवारों के पुनर्वासन और पुनव्र्यवस्थापन के लिए चिन्हांकित नहीं की गयी है (इस परियोजना हेतु भूमि अर्जन के कारण किसी परिवार का विस्थापित होना सम्भाव्य नहीं है)।2 उत्तर प्रदेश असाधारण गजट, 6 जुलाई, 2022 राज्यपाल अग्रतर उक्त अधिनियम की धारा 19 की उपधारा (2) के अधीन मेरठ के कलेक्टर को इस आशय की घोषणा प्रकाशित करने के साथ पुनर्वासन और पुनव्र्यवस्थापन योजना को संक्षिप्त रूप में प्रकाशित करने के लिए निदेश देती हैं। पुनर्वासन और पुनव्र्यवस्थापन योजना का सारांश इसके साथ संलग्न है। (जिला मेरठ में गंगा एक्सप्रेसवे परियोजना हेतु भूमि अर्जन से किसी परिवार का विस्थापित होना संभाव्य नहीं है। अतएव पुनर्वासन और पुनव्र्यवस्थापन हेतु कोई भूमि चिन्हित करने और पुनर्वासन एवं पुनव्र्यवस्थापन योजना का सारांश प्रकाशित किये जाने की आवश्यकता नहीं है।)

IN pursuance of the provisions of clause (3) of Article 348 of the Constitution of India, the Governor is pleased to order the publication of the following English translation of notification no. 914 /LXXVII-3–22-63(M) -2021, dated July 6, 2022 :

Dated Lucknow, July 6, 2022

WHEREAS preliminary notification no. 496/LXXVII-3–22-63(M)-2021, dated April 7, 2022 was issued under sub-section (1) of section 11 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (Act no. 30 of 2013) (hereinafter referred to as the "said Act"), in respect of total 22.8462532 Hectares of land is required in the Village Badholi Area 12.4468 Hect., Atola Area 0.1150 Hect., Shafiabad Loti Area 0.4083 Hect., Khadkhadi Area 0.5770 Hect., Govindpur Area 0.1274180 Hect., Atrada Area 1.2950 Hect., Bijoli Area 5.4517352 Hect. and Bhagwanpur Area 2.4250 Hect. Tehsil Sadar, district Meerut is required for public purpose namely, Ganga Expressway Project through Uttar Pradesh Expressways Industrial Development Authority and lastly published on April 7, 2022. The Deputy Collector, Sadar, district Meerut was appointed as Administrator for the purpose of Rehabilitation and Resettlement of the project-affected families;

NOW, THEREFORE, after considering the report of the Collector, Meerut submitted in pursuance to provision under sub-section (2) of section 15 of the said Act, the Governor is pleased to declare under sub-section (1) of section 19 of the said Act that she is satisfied that the area of the land mentioned in Schedule-A below is needed for public purpose and no land in the Village, Pargana and District as given in Schedule-B has been identified for Rehabilitation and Resettlement of the displaced families (No family is likely to be displaced due to land acquisition for this project).

The Governor is further pleased under sub-section (2) of section 19 of the said Act to direct the Collector of Meerut to publish a summary of the Rehabilitation and Resettlement Scheme with publication of the declaration to this effect. The summary of the Rehabilitation and Resettlement Scheme is attached herewith. (No family is likely to be displaced due to land acquisition for Ganga Expressway Project in district Meerut.
