चूँकि प्रारम्भिक अधिसूचना संख्या 495/77-3-22-61(एम)-2021, दिनांक 7 अप्रैल, 2022 लोक प्रयोजन अर्थात्‌ उत्तर प्रदेश एक्सप्रेसवेज औद्योगिक विकास प्राधिकरण के माध्यम से गंगा एक्सप्रेसवे परियोजना हेतु अपेक्षित जिला अमरोहा की तहसील हसनपुर के ग्राम पाईन्दापुर एहतमाली रकबा 0.0483 हेक्टेयर, पाईन्दापुर मुस्तहकम रकबा 0.5400 हेक्टेयर, पिपलौती खुर्द मुस्तहकम रकबा 0.0487 हेक्टेयर, रूखालू रकबा 1.9610 हेक्टेयर, शकरौली रकबा 0.0700 हेक्टेयर, मंगरौला रकबा 0.8780 हेक्टेयर, कनैटा रकबा 0.7280 हेक्टेयर, सूंगाठेर रकबा 1.0360 हेक्टेयर, राजूपुर रकबा 0.1994 हेक्टेयर, सांपा रकबा 0.5465 हेक्टेयर, अकबरपुर शर्की रकबा 0.0610 हेक्टेयर, कुआंडाली रकबा 0.3165 हेक्टेयर, खरसौली रकबा 0.2480 हेक्टेयर, गारबपुर उर्फ रूस्तमपुर रकबा 0.2870 हेक्टेयर व पांडली रकबा 0.1528 हेक्टेयर कुल रकबा 7.1212 हेक्टेयर भूमि के सम्बन्ध में भूमि अर्जन, पुनर्वासन और पुनव्र्यवस्थापन में उचित प्रतिकर और पारदर्शिता का अधिकार अधिनियम, 2013 (अधिनियम संख्या 30 सन्‌्‌ 2013) (जिसे आगे ''उक्त अधिनियम'' कहा गया है) की धारा 11 की उपधारा (1) के अधीन जारी की गई थी और अंततः दिनांक 7 अप्रैल, 2022 को प्रकाशित की गयी थी। डिप्टी कलेक्टर, हसनपुर, जिला अमरोहा को परियोजना से प्रभावित परिवारों के पुनर्वासन और पुनव्र्यवस्थापन के प्रयोजनार्थ प्रशासक नियुक्त किया गया था;

अतएव, अब, उक्त अधिनियम की धारा 15 की उपधारा (2) के अधीन उपबन्धों के अनुसरण में प्रस्तुत की गयी कलेक्टर की रिपोर्ट पर विचार करने के पश्चात्‌, राज्यपाल उक्त अधिनियम की धारा 19 की उपधारा (1) के अधीन घोषणा करती हैं कि उनका यह समाधान हो गया है कि नीचे अनुसूची-क में उल्लिखित भूमि का क्षेत्रफल लोक प्रयोजन के लिए आवश्यक है और अनुसूची-ख में यथा-प्रदत्त ग्राम, परगना और जिला मेें कोई भूमि2 उत्तर प्रदेश असाधारण गजट, 7 जुलाई, 2022 विस्थापित परिवारों के पुनर्वासन और पुनव्र्यवस्थापन के लिए चिन्हांकित नहीं की गयी है (इस परियोजना हेतु भूमि अर्जन के कारण किसी परिवार का विस्थापित होना सम्भाव्य नहीं है)।

राज्यपाल अग्रतर उक्त अधिनियम की धारा 19 की उपधारा (2) के अधीन अमरोहा के कलेक्टर को इस आशय की घोषणा प्रकाशित करने के साथ पुनर्वासन और पुनव्र्यवस्थापन योजना को संक्षिप्त रूप में प्रकाशित करने के लिए निदेश देती हैं। पुनर्वासन और पुनव्र्यवस्थापन योजना का सारांश इसके साथ संलग्न है। (जिला अमरोहा में गंगा एक्सप्रेसवे परियोजना हेतु भूमि अर्जन से किसी परिवार का विस्थापित होना संभाव्य नहीं है। अतएव पुनर्वासन और पुनव्र्यवस्थापन हेतु कोई भूमि चिन्हित करने और पुनर्वासन एवं पुनव्यर्वस्थापन योजना का सारांश प्रकाशित किये जाने की आवश्यकता नहीं है।)

टिप्पणी-अर्जन के प्रयोजनार्थ उक्त भूमि का नक्शा कलेक्टर, अमरोहा के कार्यालय में देखा जा सकता है।

Dated Lucknow, July 7, 2022

WHEREAS preliminary notification no. 495 /LXXVII-3–22-61(M)-2021, dated April 7, 2022 was issued under sub-section (1) of section 11 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (Act no. 30 of 2013) (hereinafter referred to as the "said Act"), in respect of total 7.1212 Hectares of land is required in the Tehsil Hasanpur, Village Paindapur Ahetmali Area 0.0483 Hect., Paindapur Musthakam Area 0.5400 Hect., Piploti Khurd Musthakam Area 0.0487 Hect., Rukhalu Area 1.9610 Hect., Shakroli Area 0.0700 Hect., Mangraula Area 0.8780 Hect., Kaneita Area 0.7280 Hect., Sungather Area 1.0360 Hect., Rajupur Area 0.1994 Hect., Sanpa Area 0.5465 Hect., Akbarpur Sharki Area 0.0610 Hect., Kuandali Area 0.3165 Hect., Kharsauli Area 0.2480 Hect., Garabpur Urf Rushtampur Area 0.2870 Hect. and Pandli Area 0.1528 Hect. district Amroha required for public purpose namely, Ganga Expessway Project through Uttar Pradesh Expressways Industrial Development Authority and lastly published on April 7, 2022. The Deputy Collector, Hasanpur, district Amroha was appointed as Administrator for the purpose of rehabilitation and resettlement of the project affected families;

NOW, THEREFORE, after considering the report of the Collector, Amroha submitted in pursuance to provision under sub-section (2) of section 15 of the said Act, the Governor is pleased to declare under sub-section (1) of section 19 of the said Act that she is satisfied that the area of the land mentioned in Schedule-A below is needed for public purpose and no land in the Village, Pargana and District as given in Schedule-B has been identified for rehabilitation and resettlement of the displaced families (No family is likely to be displaced due to land acquisition for this project).

The Governor is further pleased under sub-section (2) of section 19 of the said Act to direct the Collector of Amroha to publish a summary of the Rehabilitation and Resettlement Scheme with publication of the declaration to this effect. The summary of the Rehabilitation and Resettlement Scheme is attached herewith. (No family is likely to be displaced due to land acquisition for Ganga Expressway Project in district Amroha . Hence there is no need for identification of any land for rehabilitation and resettlement and publication of summary of Rehabilitation and Resettlement Scheme.)
