चूँकि सेवायें या प्रसुविधायें या सहायिकी प्रदान करने के पहचान दस्तावेज के रूप में आधार के उपयोग से सरकारी परिदान प्रक्रियाएं सुगम हो जाती हैं, पारदर्शिता और दक्षता आ जाती है और लाभार्थी अपना पहचान साबित करने के लिए बहुविध दस्तावेज प्रस्तुत करने की आवश्यकता से मुक्त होते हुए सुविधाजनक और निर्बाध रीति से सीधे अपना हक प्राप्त करने के योग्य हो जाते हैं;

और, चूँकि, बेसिक शिक्षा विभाग (जिसे आगे उक्त ''विभाग'' कहा गया है) राज्य के कक्षा 1 से 8 तक के पात्र बालक/बालिकाओं (जिन्हें आगे ''लाभार्थी'' कहा गया है) को यूनीफार्म, स्वेटर, जूता-मोजा एवं स्कूल बैग के वितरण (जिन्हें आगे उक्त ''योजना'' कहा गया है) को प्रशासित कर रहा है, जिसे बेसिक शिक्षा निदेशालय, उत्तर प्रदेश सरकार (जिसे आगे ''क्रियान्वयनकर्ता अभिकरण'' कहा गया है), के माध्यम से क्रियान्वित किया जा रहा है;

और, चूँकि, उक्त योजना के अधीन क्रियान्वयनकर्ता अभिकरण द्वारा विद्यमान योजना के मार्गदर्शी सिद्धान्तों के अनुसार (एक) सरकारी/परिषदीय विद्यालयों के कक्षा 1 से 8 तक के ए0पी0एल0 बालकों तथा सरकार द्वारा सहायता प्राप्त विद्यालयों के समस्त छात्र-छात्राओं को यूनीफार्म क्रय हेतु, (दो) सरकारी/परिषदीय विद्यालयों के कक्षा 1 से 8 तक के समस्त छात्र-छात्राओं को स्वेटर एवं जूता-मोजा क्रय हेतु, (तीन) सरकारी/परिषदीय एवं सरकार द्वारा सहायता प्राप्त विद्यालयों के कक्षा 1 से 8 तक के समस्त छात्र-छात्राओं को स्कूल बैग क्रय हेतु नकदी (जिसे आगे ''प्रसुविधा'' कहा गया है) प्रदान की जाती है;

और, चूँकि, पूर्वोक्त योजना में उत्तर प्रदेश की संचित निधि से उपगत आवर्ती व्यय अन्तर्विष्ट है;

अतएव, अब, आधार (वित्तीय और अन्य सहायिकियों, प्रसुविधाओं और सेवाओं का लक्ष्यित परिदान) अधिनियम, 2016 (अधिनियम संख्या 18 सन्‌ 2016) (जिसे आगे ''उक्त अधिनियम'' कहा गया है) की धारा 7 के अनुसरण में, उत्तर प्रदेश सरकार, एतद्‌द्वारा निम्नानुसार अधिसूचित करती है, अर्थात्‌ :-

(1) उक्त योजना के अधीन प्रसुविधा का उपभोग करने के इच्छुक बालक/बालिका से एतद्‌द्वारा आधार संख्या धारित करने का प्रमाण प्रस्तुत करने या आधार अधिप्रमाणित कराने की अपेक्षा की जायेगी। (2) उक्त योजना के अधीन प्रसुविधा का उपभोग करने के इच्छुक किसी बालक/बालिका, जो आधार संख्या धारित न करता/करती हो या जिसने अभी तक आधार के लिए नामांकन न किया हो, से उक्त योजना में रजिस्ट्री—त किए जाने से पूर्व उसके माता-पिता या संरक्षक की सहमति के अध्यधीन आधार नामांकन के लिए आवेदन करने की अपेक्षा की जायेगी, परन्तु यह कि वह उक्त अधिनियम की धारा 3 के अनुसार आधार प्राप्त करने का/की हकदार हो, और ऐसे बालक/बालिकाओं को आधार नामांकन कराने हेतु किसी आधार नामांकन केन्द्र [भारतीय विशिष्ट पहचान प्राधिकरण (यू0आई0डी0ए0आई0) की वेबसाइट www.uidai.gov.in पर उपलब्ध सूची] पर जाना होगा।

3-आधार (नामांकन और अद्यतन) विनियम, 2016 के विनियम 12 के अनुसार, विभाग से अपने क्रियान्वयनकर्ता अभिकरण के माध्यम से आधार हेतु अभी तक नामांकित न किए गए लाभार्थियों के लिए आधार नामांकन सुविधायें प्रदान किए जाने के अपेक्षा की जायेगी और यदि सम्बन्धित ब्लॉक या तालुका या तहसील में कोई आधार नामांकन केन्द्र अवस्थित न हो तो विभाग के अपने क्रियान्वयनकर्ता अभिकरण के माध्यम से भारतीय विशिष्ट पहचान प्राधिकरण (यू0आई0डी0ए0आई0) के विद्यमान रजिस्ट्रारों के साथ समन्वय करके या स्वयं भारतीय विशिष्ट पहचान प्राधिकरण का रजिस्ट्रार होकर सुविधाजनक अवस्थानों पर आधार नामांकन सुविधायें प्रदान करना होगा :

परन्तु यह कि बालक/बालिका को आधार सौंपे जाने के समय तक ऐसे बालक/बालिका को उक्त योजना के अधीन प्रसुविधा निम्नलिखित दस्तावेज प्रस्तुत किये जाने के अध्यधीन प्रदान की जायेगी, अर्थात्‌ :-

(क) यदि बालक/बालिका पाँच वर्ष की आयु प्राप्त करने के पश्चात्‌ नामांकित किया गया/की गयी हो (बायोमेट्रिक संग्रह के साथ) तो उसकी आधार नामांकन पहचान पर्ची, या बयोमेट्रिक अद्यतन पहचान पर्ची; और

(ख) निम्नलिखित दस्तावेजों में से कोई एक दस्तावेज, अर्थात्‌ :-

(एक) जन्म प्रमाणपत्र, या समुचित प्राधिकारी द्वारा जारी जन्म अभिलेख; या

(दो) विद्यालय के प्रधानाचार्य द्वारा सम्यक्‌ रूप से हस्ताक्षरित विद्यालय पहचान-पत्र, जिसमें माता-पिता का नाम अन्तर्विष्ट हो; तथा

(ग) विद्यमान योजना के मार्गदर्शी सिद्धान्तों के अनुसार माता-पिता या वैध संरक्षक के साथ लाभार्थी के सम्बन्ध के प्रमाण स्परूप निम्नलिखित दस्तावेजों में कोई एक दस्तावेज, अर्थात्‌ :-

(एक) जन्म प्रमाणपत्र, या समुचित प्राधिकारी द्वारा जारी जन्म अभिलेख; या

(दो) राशन कार्ड; या

(तीन) भूतपूर्व सैनिक अंशदायी स्वास्थ्य योजना कार्ड या कर्मचारी राज्य बीमा निगम कार्ड या केन्द्र सरकार स्वास्थ्य योजना कार्ड; या

(चार) पेंशन कार्ड; या

(पाँच) आर्मी कैंटीन कार्ड; या

(छः) कोई सरकारी पारिवारिक हक पत्र; या

(सात) विभाग द्वारा विनिर्दिष्ट कोई अन्य दस्तावेजः

परन्तु यह और कि, उपर्युक्त दस्तावेजों की जाँच, विभाग द्वारा उक्त प्रयोजनार्थ विनिर्दिष्ट रूप से अभिहित किसी अधिकारी द्वारा की जायेगी।

2-उक्त योजना के अधीन लाभार्थियों को सुविधाजनक रूप से प्रसुविधायें प्रदान करने के उद्‌देश्य से विभाग को अपने क्रियान्वयनकर्ता अभिकरण के माध्यम से यह सुनिश्चित करने के लिए समस्त अपेक्षित व्यवस्थाएँ करनी होंगी कि मीडिया के माध्यम से लाभार्थियों के लिए व्यापक प्रचार-प्रसार, उन्हें उक्त आवश्यकता से अवगत कराने के लिए किया जायेगा।

3-समस्त मामलों में, जहाँ लाभार्थियों के खराब बायोमेट्रिक्स के कारण या किसी अन्य कारण से आधार अधिप्रमाणन विफल हो जाता है, वहाँ निम्नलिखित उपचारात्मक तन्त्र अपनाये जायेंगे, अर्थात्‌ :-

(क) खराब फिंगरप्रिंट गुणवत्ता के मामले में, अधिप्रमाणन के लिए एकी—त जोखिम सूचना प्रणाली स्कैन या फेस अधिप्रमाणन सुविधा अपनायी जाएगी जिससे विभाग अपने क्रियान्वयनकर्ता अभिकरण के माध्यम से सहज रीति से प्रसुविधा प्रदान करने के लिए फिंगर प्रिंट अधिप्रमाणन के साथ ही साथ एकी—त जोखिम सूचना प्रणाली स्कैनर या फेस अधिप्रमाणन के लिए उपबन्ध करेगा;

(ख) यदि फिंगरप्रिंट या एकी—त जोखिम सूचना प्रणाली स्कैन या फेस अधिप्रमाणन के माध्यम से बायोमेट्रिक अधिप्रमाणन सफल नहीं होता है तो जहाँ कहीं सम्भाव्य और अनुज्ञेय हो, सीमित समय की वैधता के साथ यथास्थिति आधार वन टाइम पासवर्ड या समय-आधारित वन-टाइम पासवर्ड द्वारा अधिप्रमाणन, प्रदान किया जा सकता है;

(ग) अन्य समस्त मामलों में जहाँ बायोमेट्रिक या आधार वन-टाइम पासवर्ड या समय-आधारित वन-टाइम पासवर्ड अधिप्रमाणन सम्भव न हो, वहाँ उक्त योजना के अधीन प्रसुविधायें, ऐसे भौतिक आधार-पत्र के आधार पर दी जा सकती हैं जिसकी अधिप्रमाणिकता, आधार-पत्र पर मुद्रित क्विक रिस्पान्स कोड (क्यू0 आ0 कोड) के माध्यम से सत्यापित की जा सकती है और क्विक रिस्पान्स कोड रीडर की आवश्यक व्यवस्था, विभाग द्वारा अपने क्रियान्वयनकर्ता अभिकरण के माध्यम से सुविधाजनक अवस्थानों पर प्रदान की जायेगी।

4-ऊपर अन्तर्विष्ट किसी बात के होते हुए भी उक्त योजना के अधीन किसी बालक/बालिका को अधिप्रमाणन कराकर या आधार संख्या धारित किये जाने का प्रमाण उपलब्ध कराकर अपनी पहचान स्थापित करने में विफल होने की स्थिति में अथवा नामांकन हेतु आवेदन प्रस्तुत करके किसी बालक/बालिका को आधार संख्या न समनुदेशित किये जाने की स्थिति में उक्त प्रसुविधा से वंचित नहीं किया जायेगा। उक्त प्रसुविधा उसे पैराग्राफ-1 के उप पैराग्राम (3) के परन्तुक के खण्ड (ख) और (घ) में यथा उल्लिखित अन्य दस्तावेजों के आधार पर उसकी पहचान सत्यापित करके प्रदान की जायेगी और जहाँ प्रसुविधा ऐसे अन्य दस्तावेजों के आधार पर प्रदान की जाय वहाँ उसे अभिलिखित करने हेतु पृथक रजिस्टर अनुरक्षित करना होगा जिसका समय-समय पर पुनरीक्षण और उसकी लेखा परीक्षा विभाग द्वारा अपने क्रियान्वयनकर्ता अभिकरण के माध्यम से की जायेगी।

5-यह अधिसूचना सरकारी गजट में प्रकाशित किये जाने के दिनांक से प्रवृत्त होगी।

IN pursuance of the provisions of clause (3) of Article 348 of the Constitution, the Governor is pleased to order the publication of the following English translation of notification no. 686/LXVIII-5– 2022-20-2021 T.C., dated July 13, 2022 :

No. 686/LXVIII-5–2022-20-2021 T.C.

Dated Lucknow, July 13, 2022

WHEREAS the use of Aadhaar as an identity document for delivery of services or benefits or subsidies simplifies the Government delivery processes, brings in transparency and efficiency and enables beneficiaries to get their entitlements directly in a convenient and seamless manner by obviating the need to produce multiple documents to prove one's identity;

AND, WHEREAS, the Basic Education Department (hereinafter referred to as the "Department") administers the distribution of uniforms, sweaters, shoes and socks and school bags (hereinafter referred to as the "Schemes") to the eligible children of class 1st to 8th of the State, (hereinafter referred to as the "beneficiaries") which is being implemented through the Directorate of Basic Education, Government of Uttar Pradesh [hereinafter referred to as the Implementing Agency (ies)];

AND, WHEREAS, under the Schemes, cash is provided by the Implementing Agency (i) for purchase of uniform of class 1st to 8th of APL boys of Government/Parishadiya schools and all students of Government aided schools; (ii) for purchase of sweaters, shoes and socks of all students of class 1st to 8th of Government/Parishadiya schools; and (iii) for purchase of school bags of all students of class 1st to 8th of Government/Parishadiya schools and Government aided schools (hereinafter referred to as the "benefits"), as per the extant Scheme guidelines;

AND, WHEREAS, the aforesaid Scheme involves recurring expenditure incurred from the Consolidated Fund of Uttar Pradesh;

NOW, THEREFORE, in pursuance of section 7 of the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016 (Act no. 18 of 2016) (hereinafter referred to as the said Act), the Government of Uttar Pradesh hereby notifies the following, namely :–

1. (1) A child desirous of availing the benefit under the Scheme shall hereby be required to furnish proof of possession of the Aadhaar number or undergo Aadhaar authentication.

(2) Any child desirous of availing the benefit under the Scheme, who does not possess the Aadhaar number or, has not yet enrolled for Aadhaar, shall be required to make application for Aadhaar enrolment subject to the consent of his/her parents or guardians, before registering for the Scheme provided that he/she is entitled to obtain Aadhaar as per section 3 of the said Act and such children shall visit any Aadhaar enrolment centre [list available at the Unique Identification Authority of India (UIDAI) website www.uidai.gov.in] to get enrolled for Aadhaar.

(3) As per regulation 12 of the Aadhaar (Enrolment and Update) Regulations, 2016, the Department through its Implementing Agency, is required to offer Aadhaar enrolment facilities for the beneficiaries who are not yet enrolled for Aadhaar and in case there is no Aadhaar enrolment centre located in the respective Block or Taluka or Tehsil, the Department through its Implementing Agency shall provide Aadhaar enrolment facilities at convenient locations in coordination with the existing Registrars of UIDAI or by becoming a UIDAI Registrar themselves:

Provided that till the time Aadhaar is assigned to the child, benefit under the Scheme shall be given to such children subject to the production of the following documents, namely :–

(a) if the child has been enrolled after attaining the age of five years (with biometrics collection), his/her Aadhaar Enrolment Identification slip, or of biometric update identification slip; and

(b) any one of the following documents, namely :–

(i) Birth Certificate, or record of birth issued by the appropriate authority; or

(ii) School identity card, duly signed by the Principal of the School, containing parents' names; and

(c) any one of the following documents as proof of relationship of the beneficiary with the parent or legal guardian as per the extant Scheme guideline, namely :–

(i) Birth Certificate, or record of birth issued by the appropriate authority; or

(ii) Ration Card; or

(iii) Ex-Servicemen Contributory Health Scheme (ECHS) Card, or Employees' State Insurance Corporation (ESIC) Card, or Central Government Health Scheme (CGHS) Card; or

(iv) Pension Card; or

(v) Army Canteen Card; or

(vi) Any Government Family Entitlement Card; or

(vii) Any other document as specified by the Department :

Provided further that the above documents shall be checked by an officer specifically designated by the department for that purpose.

2. In order to provide benefits to the beneficiaries under the Scheme conveniently, the Department through its Implementing Agency shall make all the required arrangements to ensure that wide publicitythrough the media shall be given to the beneficiaries to make them aware of the said requirement. 351 RPH (Basic Siksha Anubhag-5) 2022 data 4e उत्तर प्रदेश असाधारण गजट, 13 जुलाई, 2022 5 3. In all cases, where Aadhaar authentication fails due to poor biometrics of the beneficiaries or due to any other reason, the following remedial mechanisms shall be adopted namely :–

(a) in case of poor fingerprint quality, Integrated Risk Information System scan or face authentication facility shall be adopted for authentication, thereby the department, through its Implementing Agency shall make provisions for Integrated Risk Information System Scanners or face authentication along with fingerprint authentication for delivery of benefits in seamless manner;

(b) In case the biometric authentication through fingerprints or Integrated Risk Information System scan or face authentication is not successful, wherever feasible and admissible authentication by Aadhaar One Time Password or Time-based One-Time Password with limited time validity, as the case may be, shall be offered;

(c) in all other cases where biometric or Aadhaar One Time Password or Time-based One- Time Password authentication is not possible, benefits under the scheme may be given on the basis of physical Aadhaar letter whose authenticity can be verified through the Quick Response Code printed on the Aadhaar letter and the necessary arrangement of Quick Response Code reader shall be provided at the convenient locations by the Department through its Implementing Agency.

4. Notwithstanding anything contained herein above, no child shall be denied benefit under the Scheme in case of failure to establish his/her identity by undergoing authentication, or furnishing proof of possession of Aadhaar number or in the case of a child to whom no Aadhaar number has been assigned, producing an application for enrolment. the benefit shall be given to him/her by verifying his/her identity on the basis of other documents as mentioned in clauses (b) and (c) of the proviso of sub-paragraph (3) of paragraph 1, and where benefit is given on the basis of such other documents, a separate register shall be maintained to record the same, which shall be reviewed and audited periodically by the Department through its Implementing Agency.

5. This notification shall come into effect from the date of its publication in the Official Gazette.
