उत्तर प्रदेश माल और सेवाकर अधिनियम, 2017 (उत्तर प्रदेश अधिनियम संख्या 1 सन् 2017) की धारा 11 की उपधारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करके राज्यपाल, परिषद् की सिफारिशों पर, एतद्द्वारा, अधिसूचना संख्या क0नि0-2–837/ग्यारह-9(47)-17-उ0प्र0अधि0-1-2017-आदेश(07)-2017, दिनांक 30 जून, 2017 में अग्रतर निम्नलिखित संशोधन करतीं हैं, अर्थात् :-
उक्त अधिसूचना में,-
(क) अनुसूची में,-
(i) क्रम संख्या 9 और 22 के समक्ष, कॉलम (3) में शब्द ''जिन्हें किसी यूनिट कंटेनर'' से प्रारम्भ होने वाले और शब्द ''परित्याग कर दिया गया हो'' से समाप्त होने वाले के स्थान पर शब्द ''जिन्हें प्री-पैकेज्ड और लेबल किया गया हो'' रख दिये जायेंगे;
(ii) क्रम संख्या 26 के समक्ष, कॉलम (3) की प्रविष्टि के स्थान पर प्रविष्टि,-
''दही, लस्सी, छाछ, उनसे भिन्न, जिन्हें प्री-पैकेज्ड और लेबल किया गया हो'' रख दिये जायेंगे;
(iii) क्रम संख्या 27, 29, 30ख, 45, 46क के समक्ष कॉलम (3) में, शब्द ''जिन्हें किसी यूनिट कंटेनर'' से प्रारम्भ होने वाले और शब्द ''परित्याग कर दिया गया हो'' से अन्त होने वाले के स्थान पर शब्द ''जिन्हें प्री-पैकेज्ड और लेबल किया गया हो'' रख दिये जायेंगे;
2 उत्तर प्रदेश असाधारण गजट, 18 जुलाई, 2022(iv) क्रम संख्या 46ख के समक्ष, कॉलम (3) में शब्द ''जिन्हें किसी यूनिट कंटेनर'' से प्रारम्भ होने वाले और शब्द ''परित्याग कर दिया गया हो'' से अन्त होने वाले के स्थान पर शब्द ''जिन्हें प्री-पैकेज्ड और लेबल किया गया हो'' रख दिये जायेंगे;
(v) क्रम संख्या 65, 66, 67, 68, 69, 70, 71, 72, 73, 74 और 75 के समक्ष, कॉलम (3) में, शब्द ''जिन्हें किसी यूनिट कंटेनर'' से प्रारम्भ होने वाले और शब्द ''परित्याग कर दिया गया हो'' से अन्त होने वाले के स्थान पर शब्द ''जिन्हें प्री-पैकेज्ड और लेबल किया गया हो'' रख दिये जायेंगे;
(vi) क्रम संख्या 77 और 78 के समक्ष, कॉलम (3) में, शब्द ''जिन्हें किसी यूनिट कंटेनर'' से प्रारम्भ होने वाले और शब्द ''परित्याग कर दिया गया हो'' से अन्त होने वाले के स्थान पर शब्द ''जिन्हें प्री-पैकेज्ड और लेबल किया गया हो'' रख दिये जायेंगे;
(vii) क्रम संख्या 94 के समक्ष, कॉलम (3) की प्रविष्टि के स्थान पर प्रविष्टि,-
''(i) सभी प्रकार के गुड़, जिसमें गन्ने से प्राप्त होने वाले गुड़ (सामान्य गुड़), पलमेरा गुड़ भी आते हैं उनसे भिन्न, जिन्हें प्री-पैकेज्ड और लेबल किया गया हो;
(ii) खांडसारी चीनी उनसे भिन्न, जिन्हें प्री-पैकेज्ड और लेबल किया गया हो'' रख दिये जायेंगे;
(viii) क्रम संख्या 95 के समक्ष, कॉलम (3) में, शब्द ''मुर्की के नाम से ज्ञात है'' के पश्चात् शब्द और प्रतीक ''उनसे भिन्न, जिन्हें प्री-पैकेज्ड और लेबल किया गया हो'' बढ़ा दिये जायेंगे;
(ix) क्रम संख्या 97क के समक्ष, कॉलम (3) में, शब्द ''यूनिट कंटेनर'' से प्रारम्भ होने वाले और शब्द ''परित्याग कर दिया गया हो'' से अन्त होने वाले के स्थान पर शब्द ''उनसे भिन्न, जिन्हें प्री-पैकेज्ड और लेबल किया गया हो'' रख दिये जायेंगे;
(x) क्रम संख्या 99 के समक्ष, कॉलम (3) में, शब्द ''शुद्धी—त'' को निकाल दिया जाएगा;
(xi) क्रम संख्या 108 के समक्ष, कॉलम (3) में, शब्द ''जिन्हें किसी यूनिट कंटेनर'' से प्रारम्भ होने वाले और शब्द ''परित्याग कर दिया गया हो'' से अन्त होने वाले के स्थान पर शब्द ''जिन्हें प्री-पैकेज्ड और लेबल किया गया हो'' रख दिये जायेंगे;
(xiii) क्रम संख्या 118 और 122 तथा उससे सम्बन्धित प्रविष्टियों को निकाल दिया जाएगा;
(xiv) क्रम संख्या 132क के समक्ष, कॉलम (3) में, शब्द ''जो यूनिट कंटेनर'' से प्रारम्भ होने वाले और शब्द ''परित्याग कर दिया गया हो'' से अन्त होने वाले के स्थान पर ''जिन्हें प्री-पैकेज्ड और लेबल कर दिया हो'' रख दिये जायेंगे;
(xv) क्रम संख्या 141 और उससे सम्बन्धित प्रविष्टियों को निकाल दिया जाएगा;
(ख) अनुसूची के पश्चात्, स्पष्टीकरण में, खण्ड (i) के स्थान पर, निम्नलिखित खण्ड रख दिया जाएगा, अर्थात् :-
''(ii) 'प्री-पैकेज्ड और लेबल' वाक्यांश का अर्थ है 'प्री-पैकेज्ड कमोडिटी' जैसा कि विधिक माप विज्ञान अधिनियम, 2009 (अधिनियम संख्या 1 सन् 2010) की धारा 2 के खण्ड 1 में परिभाषित किया गया है, जहाँ पैकेज जिसमें माल पहले से पैक किया गया है अथवा लेबल सुरक्षित रूप से चिपका हुआ है, को विधिक माप विज्ञान अधिनियम, 2009 (अधिनियम संख्या 1 सन् 2010) और उसके अधीन बनाए गए नियमों के उपबन्धों में नियत घोषणाएं धारित करना आवश्यक है।''
2-यह अधिसूचना तारीख 18 जुलाई, 2022 को प्रवृत्त होगी।

IN exercise of the powers conferred by sub-section (1) of section 11 of the Uttar Pradesh Goods and Services Tax Act, 2017 (U.P. Act no. 1 of 2017), the Governor, on the recommendations of the Council, hereby makes the following further amendment in the notification no. KA.Ni.-2-837/XI-9(47)- 17-U.P. Act-1-2017-Order (07)-2017, dated June 30, 2017, namely :–
In the said notification,–
(A) in the Schedule,–
(i) against Sl. Nos. 9 and 22, in Column (3), for the portion beginning with the words "other than those put up in" and ending with the words "conditions as in the ANNESURE-I", the words "other than pre-packaged and labelled" shall be substituted;
(ii) against Sl. no. 26, for the entry in Column (3), the entry "Curd, Lassi, Butter Milk, other than pre-packaged and labelled" shall be substituted;
(iii) against Sl. nos. 27, 29, 30B, 45, 46A in Column (3), for the portion beginning with the words "other than those put up in" and ending with the words "conditions as in the ANNEXURE-I", the words "other than pre-packaged and labelled" shall be substituted;
(iv) against Sl. no. 46 in Column (3), for the portion beginning with the words "[other than those" and ending with the words "conditions as in the ANNEXURE-I]", the words "other than pre-packaged and labelled" shall be substituted;
(v) against Sl. nos. 65, 66, 67, 68, 69, 70, 71, 72, 73, 74 and 75 in Column (3), for the portion beginning with "[other than those" and ending with the words "conditions as in the ANNEXURE-I]", the words "other than pre-packaged and labelled" shall be substituted;
(vi) against Sl. nos. 77 and 78 in Column (3), for the portion beginning with the words "[other than those" and ending with the words "conditions as in the ANNEXURE-I]", the words "other than pre-packaged and labelled" shall be substituted;
(vii) against Sl. no. 94 for the entry in Column (3), the entry,–
"(i) Jaggery of all types including Cane Jaggery (gur), Palmyra Jaggery, other than pre-packaged and labelled;
(ii) Khandsari Sugar, other than pre-packaged and labelled" shall be substituted;
(viii) against Sl. no. 95, in column (3), after the word "Murki", the words and symbols, "other than pre-packaged and labelled" shall be inserted;
(ix) against Sl. no. 97A, in Column (3), for the portion beginning with the words "[other than those putup" and ending with the words "as specified in the ANNEXURE-I]", the words "other than pre-packaged and labelled" shall be substituted;
(x) against Sl. no. 99, in column (3), the word "purified" shall be omitted;
(xi) against Sl. no. 108 in Column (3), for the portion beginning with the words "[other than those" and ending with the words "conditions as in the ANNEXURE-I]", the words "other than pre-packaged and labelled" shall be substituted;
(xiii) Sl. no. 118 and 122 and the entries relating thereto shall be omitted;
4 उत्तर प्रदेश असाधारण गजट, 18 जुलाई, 2022(xiv) against Sl. no. 132A in Column (3), for the portion beginning with the words "[other than those put up" and ending with the words "as in the ANNEXURE-I]", the words "other than pre-packaged and labelled" shall be substituted;
(xv) Sl. no. 141 and the entries relating thereto shall be omitted;
(B) after the Schedule, in the Explanation, for clause (ii), the following clause shall be substituted, namely :–
"(ii) The expression 'pre-packaged and labelled' means a 'pre-packaged commodity' as defined in clause (1) of section 2 of the Legal Metrology Act, 2009 (Act no. 1 of 2010) where, the package in which the commodity is pre-packed or a label securely affixed thereto is required to bear the declarations under the provisions of the Legal Metrology Act, 2009 (Act no. 1 of 2010) and the rules made thereunder.".
2. This notification shall come into force on the 18th day of July, 2022.
