No. 100/U.P.-L.C./02/2022-M.L.A. (1) : - Whereas, the seat of Sri Ahmed Hasan in the Legislative Council of the State of Uttar Pradesh, elected by the members of the Legislative Assembly of the State, has become vacant on 20.02.2022 by the reason of his death, before the expiration of his term of office which was up to and including 30.01.2027; and
WHEREAS, a bye-election is to be held for the purpose of filling the vacancy so caused;
NOW, THEREFORE, in pursuance of Section 151, sub-section (1) of Section 39 and Section 56 of the Representation of the People Act, 1951 (43 of 1951), the Election Commission of India hereby-
(A) calls upon the members of the Legislative Assembly of the State of Uttar Pradesh to elect, before 16th August, 2022 (Tuesday), and in accordance with the provisions of the said Act and of the rules and orders made thereunder, a person for the purpose of filling the said vacancy in the Legislative Council of the State;
(B) appoints with respect to said election, -
(a) the 01st August, 2022 (Monday), as the last date for making nominations;
(b) the 02nd August, 2022 (Tuesday), as the date for the scrutiny of the nominations;
(c) the 04th August, 2022 (Thursday), as the last date for the withdrawal of candidatures;
(d) the 11th August, 2022 (Thursday), as the date on which a poll shall, if necessary, be taken; and 2 उत्तर प्रदेश असाधारण गजट, 25 जुलाई, 2022 (e) the 16th August, 2022 (Tuesday), as the date before which the election shall be completed; and

Thakur Jaiveer Singh in the Legislative Council of the State of Uttar Pradesh, elected by the members of the Legislative Assembly of the State, has become vacant on 24.03.2022 by the reason of his resignation, before the expiration of his term of office which was up to and including 05.05.2024; and
WHEREAS, a bye-election is to be held for the purpose of filling the vacancy so caused;
NOW, THEREFORE, in pursuance of Section 151, sub-section (1) of Section 39 and Section 56 of the Representation of the People Act, 1951 (43 of 1951), the Election Commission of India hereby-

(2) : - In pursuance of Section 21, and in exercise of the powers conferred by sub-section (1) of Section 22 of the Representation of the People Act, 1951 (43 of 1951), the Election Commission of India, in consultation with the Government of the State of Uttar Pradesh, hereby: -
(i) designates the officer, specified in column (1) of the Table below, to be the Returning Officer, and
(ii) appoints the officer, specified in column (2) of the said Table, to be the Assistant Returning Officer to assist the Returning officer in the performance of his functions;
in respect of two separate bye-elections to the Legislative Council of the State of Uttar Pradesh by the members of the Legislative Assembly of the State, to be held in pursuance of the Commission's Notifications published in the official Gazette of the State on 25.07.2022.

संo 100/उoप्रo-विoपo/02/2022-एमoएलoएo (1)- यतः, उत्तर प्रदेश राज्य की विधान सभा के सदस्यों द्वारा विधान परिषद के लिए निर्वाचित (cid:7088)ी अहमद हसन, का स्थान उनकी पदावधि, जो कि 30-01-2027 सहित उस तारीख तक थी, के समाप्त होने से पूर्व उनकी मृत्यु होने के कारण 20-02-2022 से रिक्त हो गया है; और
यतः, इस प्रकार (cid:7263)ई रिक्ति को भरने के प्रयोजन से एक उप निर्वाचन आयोजित किया जाना है;
अतः, अब, लोक प्रतिनिधित्व अधिनियम, 1951 (1951 का 43) की धारा 151, धारा 39 की उपधारा (1) और धारा 56 के अनुसरण में, भारत निर्वाचन आयोग एत(cid:7375)ाराः-
(अ) उत्तर प्रदेश राज्य के विधान सभा सदस्यों से यह अपेक्षा करता है कि वे 16 अगस्त, 2022 (मंगलवार) से पूर्व तथा उक्त अधिनियम और त(cid:7373)ीन बनाए 4 उत्तर प्रदेश असाधारण गजट, 25 जुलाई, 2022 गए नियमों और उनके तहत जारी किए गए आदेशों के उपबन्धों के अनुसार राज्य की विधान परिषद में उक्त रिक्ति को भरने के प्रयोजन से एक (cid:7390)क्ति निर्वाचित कर दें;
(आ) उक्त निर्वाचन के संबंध में:-
(क) नाम निद(cid:7287)शित करने की अन्तिम तारीख – 01 अगस्त, 2022 (सोमवार);
(ख) नाम निद(cid:7287)शन की संवीक्षा की तारीख – 02 अगस्त, 2022 (मंगलवार);
(ग) अ(cid:7012)य(cid:7414)थताएं वापस लेने की अन्तिम तारीख – 04 अगस्त, 2022 (गु(cid:7271)वार);
(घ) वह तारीख जिसको यदि आवश्यक (cid:7263)आ तो मतदान होगा – 11 अगस्त, 2022 (गु(cid:7271)वार); और

संo 100/उoप्रo-विoपo/04/2022-एमoएलoएo (1)- यतः, उत्तर प्रदेश राज्य की विधान सभा के सदस्यों द्वारा विधान परिषद के लिए निर्वाचित (cid:7088)ी ठाकु र जयवीर सिह, का स्थान उनकी पदावधि, जो कि 05-05-2024 सहित उस तारीख तक थी, के समाप्त होने से पूर्व त्याग पत्र देने के कारण 24.03.2022 से रिक्त हो गया है; और
यतः, इस प्रकार (cid:7263)ई रिक्ति को भरने के प्रयोजन से एक उप निर्वाचन आयोजित किया जाना है;

(आ) उक्त निर्वाचन के संबंध में:-
(क) नाम निद(cid:7287)शित करने की अन्तिम तारीख – 01 अगस्त, 2022 (सोमवार);

सं. 100/उoप्रo-विoपo/02&04/2022-एमoएलoएo (2)- लोक प्रतिनिधित्व अधिनियम, 1951 (1951 का 43) की धारा 21 के अनुसरण में और धारा 22 की उपधारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते (cid:7263)ए, भारत निर्वाचन आयोग, उत्तर प्रदेश राज्य सरकार के परामर्श से दिनांक 25 जुलाई, 2022 को राज्य के शासकीय राजपत्र में प्रकाशित आयोग की अधिसूचनाओं के अनुसरण में इस राज्य की विधान सभा के सदस्यों द्वारा उत्तर प्रदेश राज्य की विधान परिषद के दो अलग-अलग होने वाले उप निर्वाचनों के संबंध में, एत(cid:7375)ाराः-
(i) नीचे की सारणी के स्तम्भ (1) में विनि(cid:7416)दष्ट अधिकारी को रिट(cid:7418)नग आफिसर के रूप में पदाभिहित करता है; और
(ii) उक्त सारणी के स्तम्भ (2) में विनि(cid:7416)दष्ट अधिकारी को रिट(cid:7418)नग आफिसर की उसके कृ त्यों के पालन में सहायता के लिए सहायक रिट(cid:7418)नग आफिसर नियुक्त करता है।
