IN pursuance of the provisions of clause (3) of Article 348 of the Constitution of India, the Governor is pleased to order the publication of the following English translation of the Uttar Pradesh Maharishi Soochna Prodyogiki Vishwavidyalaya (Sanshodhan) Adhyadesh, 2022 (Uttar Pradesh Adhyadesh Sankhya 5 of 2022) promulgated by the Governor. The I.T. evam Electronics Anubhag-2 is administratively concerned with the said Ordinance.

THE UTTAR PRADESH MAHARISHI UNIVERSITY OF INFORMATION

TECHNOLOGY (AMENDMENT) ORDINANCE, 2022

(U.P. ORDINANCE NO. 5 OF 2022)

[Promulgated by the Governor in the Seventy third Year of the Republic of India]

AN

ORDINANCE

further to amend the Uttar Pradesh Maharishi University of Information

Technology Act, 2001.

WHEREAS, the State Legislature is not in session and the Governor is satisfied

that circumstances exist which render it necessary for him to take immediate action;

NOW, THEREFORE, in exercise of the powers conferred by clause (1) of

Article 213 of the Constitution of India, the Governor is pleased to promulgate the

following Ordinance:-

Short title and 1. (1) This Ordinance may be called the Uttar Pradesh Maharishi University of

commencement Information Technology (Amendment) Ordinance, 2022.

(2) It shall be deemed to have come into force with effect from August 07,

2001.

Amendment of 2. In the long title of the Uttar Pradesh Maharishi University of Information

the long title of Technology Act, 2001, hereinafter referred to as the principal Act, for the words

U.P. Act no. 31 "a University" the words "a University at Lucknow with the main campus at Lucknow

of 2001

and with constituent unit/campus at NOIDA" shall be substituted.

3. In section 3 of the principal Act, after sub-section (4) the following Amendment of section 3

sub-section shall be inserted, namely:-

"(4-A) The Noida campus which is being operated since June 9, 2014, shall be deemed to be the constituent unit/campus of the Maharishi University of Information Technology, Lucknow subject to the following conditions :-

(a) for the operation of the constituent unit/campus, permission of University Grants Commission (UGC) will be obtained. The sponsoring body shall duly conform to the norms of the land and other infrastructural and academic facilities as determinded by the Central/State Government or Central/State regulatory bodies for a higher education institute or off-campus centre in the State;

(b) The over-all performance of the constituent unit/campus shall be monitored by the University Grants Commission (UGC)/All India Council for Technical Education (AICTE) and Institutions/Commissions/Boards related to the various courses being run in the campus, under the provisions of this Act. The directions of the University Grants Commission (UGC) and the Government of Uttar Pradesh for management, academic development and improvement shall be binding;

(c) If the functioning of the said constituent unit/campus remains unsatisfactory, the private University shall be instructed by the University Grants Commission (UGC) or State Government to close down the constituent unit/campus and such instruction shall be binding upon the University. In such a situation, the interest of the students already enrolled therein shall be protected under the provisions of this Act."
