NOTIFICATION

FIRST AMENDMENT TO UTTAR PRADESH ELECTRICITY REGULATORY COMMISSION (TERMS AND CONDITIONS OF GENERATION TARIFF) REGULATIONS, 2019

In exercise of powers conferred under section 181 of the Electricity Act, 2003 read with Section 61 of the electricity Act'03 and all other powers enabling in this behalf, and after previous publication, the Uttar Pradesh Electricity Regulatory Commission, hereby makes the following Regulations to amend the Uttar Pradesh Electricity Regulatory Commission (Terms and Conditions of Generation Tariff) Regulations, 2019, vide Notification No. UPERC/Secy./ Generation Regulations, 2019/343A Lucknow dated 11.09.2019, namely: -

1. Short Title and Commencement–

1.1 These Regulations may be called the Uttar Pradesh Electricity Regulatory Commission (Terms and Conditions of Generation Tariff) (First Amendment) Regulations, 2022.

1.2 These Regulations shall come into force from the date of their publication in the Official Gazette of the Uttar Pradesh Government.

AMENDMENT

(A) The existing Regulation 24 (i) "Return on Equity" shall be replaced by following:

Existing Regulation Amended Regulation

Explanation: The premium raised by the generating company while issuing share capital and investment of internal resources created out of free reserve of the generating company, if any, for the funding of the project, shall also be reckoned as paid up capital for the purpose of computing return on equity, provided such premium amount and internal resources are actually utilized for meeting the capital expenditure of the generating station and forms part of the approved financial package.

Provided further that a Generating Company, shall be required to file Final Tariff Petition, in prescribed format, within 90 days of date of audited accounts of the year of its Project's COD or within 180 days of determination of its Project's Capital Cost by the Commission; whichever is later, failing which the rate of return on equity shall be reduced by 0.25% per month or part thereof without prejudice to any other fine or penalty to which it may be liable under Electricity Act, 2003 and other Regulations of the Commission including but not limited to UPERC (Fees & Fines) Regulations, 2010, as amended from time to time.

B. The existing Regulation 16(2) shall be replaced by following:–

(2) The generating company shall make an Application in hard and soft copy in specified format as per Appendix II to these Regulations, for carrying out Truing up exercise in respect of the generating station or any of its units or block of units thereof by 30.11.2024.

Provided that in case of truing up application along with requisite documents is not submitted within timeline i.e., by 30.11.2024; no carrying cost / interest shall be allowed to the generating company for the under-recovered amount during the True-up period. However, in case of over - recovered amount during the True-up period and delayed filing of True-up application along with requisite documents, the surplus amount with carrying cost / interest shall be recovered in terms of Regulation 16(4) along with surplus amount.
