संविधान के अनु(cid:453)े द 309 के पर(cid:566)ुक (cid:554)ारा (cid:366)द(cid:517) श(cid:304)(cid:389)यों का (cid:366)योग करके और इस विषय पर सम(cid:721) वि(cid:552)मान नियमों और आदेशों का अधि(cid:354)मण करके , रा(cid:475)पाल, उ(cid:517)र (cid:366)दे श प(cid:303)रवहन विभाग (cid:366)वत(cid:330)न कम(cid:330)चा(cid:303)रवग(cid:330) (समूह-'गʼ) सेवा म(cid:336) नियु(cid:389) (cid:681)(cid:304)(cid:389)यों की भत(cid:334) और सेवा शत(cid:344) को विनियमित करने के लिए नि(cid:635)लि(cid:304)खत नियमावली बनाती ह(cid:339)I

भाग-एक-सामा(cid:586)

सं(िcid:407)(cid:593) नाम और 1-(एक) यह नियमावली उ(cid:517)र (cid:366)देश प(cid:303)रवहन विभाग (cid:366)वत(cid:330)न कम(cid:330)चा(cid:303)रवग(cid:330) (समूह-'गʼ)

(cid:366)ार(cid:641)

सेवा नियमावली, 2022 कही जायेगी;

(दो) यह तुर(cid:566) (cid:366)वृ(cid:517) होगी।

सेवा की (cid:366)ा(cid:304)(cid:830)थति 2–उ(cid:517)र (cid:366)देश प(cid:303)रवहन विभाग (cid:366)वत(cid:330)न कम(cid:330)चा(cid:303)रवग(cid:330) (समूह-'गʼ) सेवा म(cid:336) समूह-'गʼ के

पद समावि(cid:700) ह(cid:339)।

प(cid:303)रभाषाएँ 3–जब तक विषय या संदभ(cid:330) म(cid:336) कोई (cid:366)तिकू ल बात न हो, इस नियमावली म(cid:336):-

(क) ʼअधिनियमʼ का ता(cid:523)य(cid:330) समय-समय पर यथासंशोधित उ(cid:517)र (cid:366)देश लोक सेवा (अनुसूचित जातियों, अनुसूचित जनजातियों एवं अ(cid:586) पिछड़े oxksZa के लिये आर(cid:407)ण) अधिनियम, 1994 से है ;

(ख) 'नियु(cid:304)(cid:389) (cid:366)ाधिकारीʼ का ता(cid:523)य(cid:330) काया(cid:330)लय, प(cid:303)रवहन आयु(cid:389), उ(cid:517)र (cid:366)देश म(cid:336) तैनात अपर प(cid:303)रवहन आयु(cid:389) ((cid:366)वत(cid:330)न) से है;

(ग) 'भारत का नाग(cid:303)रकʼ का ता(cid:523)य(cid:330) ऐसे (cid:681)(cid:304)(cid:389) से है जो संविधान के भाग दो के अधीन भारत का नाग(cid:303)रक हो या समझा जाय;

(घ) ʼआयोगʼ का ता(cid:523)य(cid:330) उ(cid:517)र (cid:366)दे श अधीन(cid:830)थ सेवा चयन आयोग से है;

(ङ) ʼसंविधानʼ का ता(cid:523)य(cid:330) भारत का संविधान से है;

(च) 'सरकारʼ का ता(cid:523)य(cid:330) उ(cid:517)र (cid:366)दे श रा(cid:475) सरकार से है ;

(छ) 'रा(cid:475)पालʼ का ता(cid:523)य(cid:330) रा(cid:475)पाल, उ(cid:517)र (cid:366)दे श से है ;

(ज) ʼविभागा(cid:559)(cid:407)ʼ का ता(cid:523)य(cid:330) प(cid:303)रवहन आयु(cid:389), उ(cid:517)र (cid:366)दे श से है;

(झ) 'सेवाʼ का ता(cid:523)य(cid:330) उ(cid:517)र (cid:366)दे श प(cid:303)रवहन विभाग (cid:366)वत(cid:330)न कम(cid:330)चा(cid:303)रवग(cid:330) (समूह-'गʼ) सेवा से है;

(ञ) ʼसेवा का सद(cid:735)ʼ का ता(cid:523)य(cid:330) सेवा के संवग(cid:330) म(cid:336) किसी पद पर इस नियमावली अथवा इस नियमावली के (cid:366)ार(cid:641) होने के पूव(cid:330) (cid:366)वृ(cid:517) नियमों या आदे शों के अधीन मौलिक (cid:349)प से नियु(cid:389) (cid:681)(cid:304)(cid:389) से है;

(ट) ʼनाग(cid:303)रकों के अ(cid:586) पिछड़े oxksZa का ता(cid:523)य(cid:330) समय-समय पर यथासंशोधित उ(cid:389) अधिनियम की अनुसूची-एक म(cid:336) विनिदि(cid:330)(cid:700) नाग(cid:303)रकों के पिछड़े वग(cid:344) से है;

(ठ) 'मौलिक नियु(cid:304)(cid:389)ʼ का ता(cid:523)य(cid:330) सेवा के संवग(cid:330) म(cid:336) किसी पद पर ऐसी नियु(cid:304)(cid:389) से है जो तदथ(cid:330) नियु(cid:304)(cid:389) न हो, तथा नियमों के अनुसार चयन के प(cid:686)ात् की गयी हो और यदि कोई नियम न हो तो सरकार (cid:554)ारा जारी काय(cid:330)पालक अनुदे शों (cid:554)ारा त(cid:534)मय विहित (cid:366)(िcid:354)या के अनुसार की गयी हो;

(ड) ʼप(cid:303)रवहन आयु(cid:389)ʼ, ʼअपर प(cid:303)रवहन आयु(cid:389)((cid:366)वत(cid:330)न)ʼ, ʼसहायक प(cid:303)रवहन आयु(cid:389) ((cid:366)वत(cid:330)न)ʼ, ʼसंभागीय प(cid:303)रवहन अधिकारी* ((cid:366)वत(cid:330)न)ʼ, ʼसंभागीय प(cid:303)रवहन अधिकारी और सहायक संभागीय प(cid:303)रवहन अधिकारी का ता(cid:523)य(cid:330) सरकार (cid:554)ारा इस (cid:349)प म(cid:336) नियु(cid:389) अधिका(cid:303)रयों से है; और

(ढ) 'भत(cid:334) वष(cid:330)ʼ का ता(cid:523)य(cid:330) किसी कै ले(cid:503)र वष(cid:330) की पहली जुलाई को (cid:366)ार(cid:641) होने वाली बारह मास की अवधि से है।

भाग दो-संवग(cid:330)

सेवा का संवग(cid:330)

4-(1) सेवा की सद(cid:735) सं(cid:421)ा और उसम(cid:336) (cid:366)(cid:529)ेक (cid:373)ेणी के पदों की सं(cid:421)ा उतनी होगी, जितनी सरकार (cid:554)ारा समय-समय पर अवधा(cid:303)रत की जाय।

(2) जब तक कि उप नियम (1) के अधीन प(cid:303)रवत(cid:330)न करने के आदेश न दिये जाय(cid:336), सेवा की सद(cid:735) सं(cid:421)ा और उसम(cid:336) (cid:366)(cid:529)ेक (cid:373)ेणी के पदों की सं(cid:421)ा उतनी होगी जितनी प(cid:303)रशि(cid:700) ʼʼकʼʼ म(cid:336) दी गयी है %&

पर(cid:566)ु यह कि ;-

(एक) नियु(cid:304)(cid:389) (cid:366)ाधिकारी किसी (cid:303)र(cid:389) पद को बिना भरे (cid:352)ए छोड़ सकता है

या रा(cid:475)पाल उसे आ(cid:830)थगित रख सकती ह(cid:339), जिससे कोई (cid:681)(cid:304)(cid:389) (cid:366)तिकर का

हकदार न हो; या

(दो) रा(cid:475)पाल ऐसे अति(cid:303)र(cid:389) (cid:830)थायी या अ(cid:830)थायी पदों का सृजन कर सकती

ह(cid:339), जि(cid:590)(cid:336) वह उचित समझ(cid:336)।

भाग तीन-भत(cid:334)

5- सेवा म(cid:336) विभि(cid:580) (cid:373)ेणियों के पदों पर भत(cid:334) नि(cid:635)लि(cid:304)खत (cid:375)ोतों से की जायेगीः - भत(cid:334) का (cid:375)ोत

(1) (cid:366)वत(cid:330)न पय(cid:330)वे(cid:407)क : मौलिक (cid:349)प से नियु(cid:389) (cid:366)वत(cid:330)न कां(cid:720)ेबलों, जि(cid:590)ोंने भत(cid:334) वष(cid:330)

के (cid:366)थम दिवस को इस (cid:349)प म(cid:336) दस वष(cid:330) की सेवा पूण(cid:330) कर ली हों, म(cid:336) से पदो(cid:580)ति (cid:554)ारा।

(2)-(cid:366)वत(cid:330)न कां(cid:720)ेबल : (1) आयोग के मा(cid:559)म से सीधी भत(cid:334) (cid:554)ारा।

आर(cid:407)ण

6-अनुसूचित जातियों, अनुसूचित जनजातियों और अ(cid:586) (cid:373)ेणियों के अ(cid:631)थि(cid:330)यों के लिए

आर(cid:407)ण, समय-समय पर यथासंशोधित उ(cid:389) अधिनियम और उ(cid:517)र (cid:366)दे श लोक सेवा (शारी(cid:303)रक

(cid:349)प से विकलांग, (cid:738)तं(cid:361)ता सं(cid:356)ाम सेनानियों के आ(िcid:373)तों एवं भूतपूव(cid:330) सैनिकों के लिये आर(cid:407)ण)

अधिनियम, 1993 तथा भत(cid:334) के समय (cid:366)वृ(cid:517) शासनादे शों के अनुसार होगा।

टि(cid:596)णी-उपरो(cid:389) पद विकलांग क(cid:670)ाण विभाग के शासनादेश सं(cid:421)ा-35/65- 03-11-

78/99, दिनांक 13.01.2011 के अनुसार आर(cid:407)ण हेतु चि(cid:304)(cid:590)त नही ं किये गये ह(cid:339)।

भाग चार-अह(cid:330)ताएं

7-सेवा म(cid:336) किसी पद पर सीधी भत(cid:334) के लिए यह आव(cid:692)क है कि अ(cid:631)थ(cid:334) :– रा(cid:700)(cid:332) ीयता

(क) भारत का नाग(cid:303)रक हो; या

(ख) ति(cid:620)ती शरणाथ(cid:334) हो, जो भारत म(cid:336) (cid:830)थायी निवास के अभि(cid:366)ाय से पहली जनवरी,

1962 के पूव(cid:330) भारत म(cid:336) आया हो; या

(ग) भारतीय मूल का ऐसा (cid:681)(cid:304)(cid:389) हो, जिसने भारत म(cid:336) (cid:830)थायी निवास के अभि(cid:366)ाय से

पाकि(cid:721)ान, बमा(cid:330), (cid:373)ीलंका या किसी पूव(cid:334) अ(cid:367)ीकी देश के निया, युगांडा और यूनाईटेड

(cid:303)रप(cid:304)(cid:624)क आफ त(cid:802)जानिया (पूव(cid:330)वत(cid:334) तांगानिका और जंजीबार) से (cid:366)वजन किया हो :

पर(cid:566)ु यह कि उपयु (cid:330)(cid:389) (cid:373)ेणी (ख) या (ग) के अ(cid:631)थ(cid:334) के लिये ऐसा (cid:681)(cid:304)(cid:389) होना आव(cid:692)क

है जिसके प(cid:407) म(cid:336) सरकार (cid:554)ारा पा(cid:361)ता (cid:366)माण प(cid:361) जारी किया गया हो :

पर(cid:566)ु यह और कि (cid:373)ेणी (ख) के अ(cid:631)थ(cid:334) से यह भी अपे(cid:407)ा की जायगी कि वह पुलिस

उपमहानिरी(cid:407)क, अभिसूचना शाखा, उ(cid:517)र (cid:366)दे श से पा(cid:361)ता (cid:366)माण-प(cid:361) (cid:366)ा(cid:593) कर ले :

पर(cid:566)ु यह भी कि यदि कोई अ(cid:631)थ(cid:334) उपयु (cid:330)(cid:389) (cid:373)ेणी (ग) का हो तो पा(cid:361)ता (cid:366)माण प(cid:361) एक

वष(cid:330) से अधिक अवधि के लिए जारी नही ं किया जायेगा और ऐसे अ(cid:631)थ(cid:334) को एक वष(cid:330) की अवधि के

आगे सेवा म(cid:336) इस शत(cid:330) पर रहने दिया जायगा कि वह भारत की नाग(cid:303)रकता (cid:366)ा(cid:593) कर ले।

टि(cid:596)णीः ऐसे अ(cid:631)थ(cid:334), जिसके मामले म(cid:336) पा(cid:361)ता (cid:366)माण-प(cid:361) आव(cid:692)क हो, कि(cid:566)ु जिसे न

तो जारी किया गया हो और न देने से इ(cid:561)ार किया गया हो, को किसी परी(cid:407)ा या सा(cid:407)ा(cid:509)ार म(cid:336)

स(cid:304)(cid:643)लित किया जा सकता है और उसे इस बात के अ(cid:559)धीन औपब(cid:304)(cid:576)क (cid:349)प से नियु(cid:389) भी

किया जा सकता है कि आव(cid:692)क (cid:366)माण-प(cid:361) उसके (cid:554)ारा (cid:366)ा(cid:593) कर लिया जाय या उसके प(cid:407) म(cid:336)

जारी कर दिया जाय।

8-(1) (cid:366)वत(cid:330)न कां(cid:720)ेबल के पद पर सीधी भत(cid:334) के लिए अ(cid:631)थ(cid:334) के लिये मा(cid:559)मिक शि(cid:407)ा शै(cid:407)णिक व अ(cid:586) अह(cid:330)ताएं प(cid:303)रषद् , उ(cid:517)र (cid:366)देश से इ(cid:501)रमीडिएट परी(cid:407)ा या सरकार (cid:554)ारा उसके समक(cid:407) मा(cid:586)ता (cid:366)ा(cid:593) कोई

परी(cid:407)ा उ(cid:517)ीण(cid:330) करना आव(cid:692)क है।

(2) लि(cid:304)खत परी(cid:407)ा उ(cid:517)ीण(cid:330) अ(cid:631)थि(cid:330)यों की क(cid:817)(cid:599)ूटर (cid:366)वीणता परी(cid:407)ा, चयनकता(cid:330) सं(cid:830)था

(उ(cid:517)र (cid:366)दे श अधीन(cid:830)थ सेवा चयन आयोग) (cid:554)ारा संचालित की जायेगी। (cid:366)वीणता परी(cid:407)ा उ(cid:517)ीण(cid:330)

अ(cid:631)थि(cid:330)यों को ही चयन हेतु सं(cid:721)ुत किया जायेगा।

(3) शारी(cid:303)रक मानक–

पु(cid:349)ष अ(cid:631)थि(cid:330)यों के लिये (cid:586)ूनतम् शारी(cid:303)रक मानक नि(cid:635)वत है :-

(क) ऊँ चाई:

(एक) अनुसूचित जनजाति के पु(cid:349)ष अ(cid:631)थि(cid:330)यों के लिए (cid:586)ूनतम ऊँ चाई

160 से(cid:564)ीमीटर होनी चाहिए।

(दो) अ(cid:586) अ(cid:631)थि(cid:330)यों के लिए (cid:586)ूनतम ऊँ चाई 168 से(cid:564)ीमीटर होनी

चाहिए।

(ख) व(cid:407):

(एक) अनुसूचित जन जातियों के अ(cid:631)थि(cid:330)यों के लिये फु लाये बिना

77 स(cid:336)टीमीटर और फु लाने पर अ(cid:586)ून 82 स(cid:336)टीमीटर।

(दो) अ(cid:586) अ(cid:631)थि(cid:330)यों के लिए (cid:586)ूनतम व(cid:407) की माप फु लाये बिना

79 स(cid:336)टीमीटर और फु लाने पर अ(cid:586)ून 84 स(cid:336)टीमीटर होनी चाहिए।

टि(cid:596)णी :- (cid:586)ूनतम 5 स(cid:336)टीमीटर व(cid:407) फु लाव आव(cid:692)क है।

महिला अ(cid:631)थि(cid:330)यों के लिए (cid:586)ूनतम शारी(cid:303)रक मानक नि(cid:635)वत है :-

(क) ऊँ चाई:

(एक) अनुसूचित जनजाति की महिला अ(cid:631)थि(cid:330)यों के लिए (cid:586)ूनतम ऊँ चाई

147 से(cid:564)ीमीटर होनी चाहिए।

(दो) अ(cid:586) महिला अ(cid:631)थि(cid:330)यों के लिए (cid:586)ूनतम ऊॅ चाई 152 से(cid:564)ीमीटर होनी

चाहिए।

(ख) वजन:

महिला अ(cid:631)थि(cid:330)यों के लिये (cid:586)ूनतम 40 किलो(cid:356)ाम।

अधिमानी अह(cid:³³⁰)ता 9-किसी अ(cid:631)थ(cid:334) को सीधी भत(cid:334) के मामले म(cid:336) अ(cid:586) बातों के समान होने पर अधिमान (cid:366)दान किया जायेगा, जिसने -

(एक) (cid:366)ादे शिक सेना म(cid:336) (cid:586)ूनतम दो वष(cid:330) की अवधि तक सेवा की हो, या

(दो) अ(cid:586) बातों के समान होने पर रा(cid:700)(cid:332) ीय कै डेट कोर म(cid:336) 'बीʼ (cid:366)माण प(cid:361) (cid:366)ा(cid:593)

किया हो।

आयु 10-(cid:366)वत(cid:330)न कां(cid:720)ेबल के पद पर सीधी भत(cid:334) हेतु किसी अ(cid:631)थ(cid:334) के लिए यह आव(cid:692)क है कि वह उस कै ले(cid:503)र वष(cid:330), जिसम(cid:336) सीधी भत(cid:334) के लिए (cid:303)र(cid:304)(cid:389)यां वि(cid:466)ापित की जायं, के (cid:366)थम जुलाई को 18 वष(cid:330) की आयु (cid:366)ा(cid:593) कर ली हो और 25 वष(cid:330) से अधिक की आयु (cid:366)ा(cid:593) न की हो :

पर(cid:566)ु यह कि अनुसूचित जातियों, अनुसूचित जनजातियों और ऐसी अ(cid:586) (cid:373)ेणियों, जो सरकार (cid:554)ारा समय-समय पर अधिसूचित की जायं, के अ(cid:631)थि(cid:330)यों के मामले म(cid:336) ऊपरी आयु सीमा उतने वष(cid:330) अधिक होगी, जितनी विनिदि(cid:330) (cid:700) की जाय।

च(cid:303)र(cid:361) 11-सेवा म(cid:336) किसी पद पर सीधी भत(cid:334) हेतु अ(cid:631)थ(cid:334) के लिए ऐसे च(cid:303)र(cid:361) का होना आव(cid:692)क है जैसा कि वह सरकारी सेवा म(cid:336) सेवायोजन के लिए सभी (cid:366)कार से उपयु(cid:389) हो।

नियु(cid:304)(cid:389) (cid:366)ाधिकारी इस बि(cid:802)दु पर अपना समाधान कर लेगा।

टि(cid:596)णी :- संघ सरकार या किसी रा(cid:475) सरकार (cid:554)ारा या संघ सरकार या किसी रा(cid:475) सरकार के (cid:738)ामि(cid:533)ाधीन या नियं(cid:361)णाधीन किसी (cid:830)थानीय (cid:366)ाधिकरण या किसी निगम या निकाय (cid:554)ारा पद(cid:457)ुत (cid:681)(cid:304)(cid:389) सेवा म(cid:336) किसी पद पर नियु(cid:304)(cid:389) के लिये पा(cid:361) नहीं होंगे।

नैतिक अधमता से अ(cid:566)व(cid:330)लित किसी अपराध के लिये दोषसि(cid:544) (cid:681)(cid:304)(cid:389) भी पा(cid:361) नही ं होंगे।

वैवाहिक

12-सेवा म(cid:336) किसी पद पर नियु(cid:304)(cid:389) के लिये ऐसा पु(cid:349)ष अ(cid:631)थ(cid:334) पा(cid:361) न होगा, जिसकी एक

(cid:366)ा(cid:304)(cid:830)थति से अधिक प(िcid:521)यां जीवित हों या ऐसी महिला अ(cid:631)थ(cid:334) पा(cid:361) न होगी जिसने ऐसे पु(cid:349)ष से विवाह किया

हो, जिसकी पहले से एक प(cid:521)ी जीवित हो :

पर(cid:566)ु यह कि सरकार किसी (cid:681)(cid:304)(cid:389) को इस नियम के (cid:366)वत(cid:330)न से छू ट (cid:366)दान कर सकती है

यदि उसका यह समाधान हो जाय कि ऐसा करने के लिए विशेष कारण वि(cid:552)मान ह(cid:339)।

शारी(cid:303)रक

13-किसी अ(cid:631)थ(cid:334) को सेवा म(cid:336) किसी पद पर तब तक नियु(cid:389) नहीं किया जायेगा जब तक

(cid:738)(cid:830)थता कि वह मानसिक और शारी(cid:303)रक (cid:778)(िcid:700) से (cid:738)(cid:830)थ न हो, और ऐसे शारी(cid:303)रक दोष से मु(cid:389) न हो, जिससे

उसे अपने कत(cid:330)(cid:681)ों का द(cid:407)तापूव(cid:330)क पालन करने म(cid:336) बाधा पड़ने की स(cid:641)ावना न हो। किसी अ(cid:631)थ(cid:334)

को नियु(cid:304)(cid:389) के लिये अ(cid:304)(cid:566)म (cid:349)प से अनुमोदित किये जाने के पूव(cid:330) उससे यह अपे(cid:407)ा की जायेगी कि

वह फाइने(cid:304)(cid:588)यल है(cid:503) बुक ख(cid:503)-दो, भाग तीन के अ(cid:559)ाय-तीन म(cid:336) अ(cid:566)वि(cid:330)(cid:700) फ(cid:565)ामे(cid:501)ल (cid:349)ल

10 के अधीन बनाये गये नियमों के अनुसार चिकि(cid:534)ीय (cid:738)(cid:830)थता (cid:366)माण-प(cid:361) (cid:366)(cid:721)ुत कर(cid:336) :

पर(cid:566)ु यह कि पदो(cid:580)ति (cid:554)ारा भत(cid:334)कृ त किसी अ(cid:631)थ(cid:334) से चिकि(cid:534)कीय (cid:738)(cid:830)थता (cid:366)माण-प(cid:361)

की अपे(cid:407)ा नही ं की जायेगी।

भाग-पांच –भत(cid:334) की (cid:366)(िcid:354)या

(cid:303)र(cid:304)(cid:389)यों का 14-नियु(cid:304)(cid:389) (cid:366)ाधिकारी भत(cid:334) वष(cid:330) के (cid:366)(cid:354)म के दौरान भरी जाने वाली (cid:303)र(cid:304)(cid:389)यों की सं(cid:421)ा

अवधारण

और नियम 6 के अधीन अनुसूचित जातियों, अनुसूचित जनजातियों और अ(cid:586) (cid:373)ेणियों के

अ(cid:631)थि(cid:330)यों के लिए आर(िcid:407)त की जाने वाली (cid:303)र(cid:304)(cid:389)यों की सं(cid:421)ा भी अवधा(cid:303)रत करे गा। आयोग के

मा(cid:559)म से भरी जाने वाली (cid:303)र(cid:304)(cid:389)यों की सूचना उसे दी जायेगी।

आयोग के

15-(एक) सेवा म(cid:336) (cid:366)वत(cid:330)न कां(cid:720)ेबल के पद पर सीधी भत(cid:334), समय-समय पर यथासंशोधित

नियत समय म(cid:336) दौड़ पूरा करने म(cid:336) विफल रहने वाले अ(cid:631)थ(cid:334) असफल माने जाय(cid:336)गे।

(क) नियु(cid:304)(cid:389) (cid:366)ाधिकारी अ(cid:559)(cid:407)

(ख) नियु(cid:304)(cid:389) (cid:366)ाधिकारी (cid:554)ारा नाम निदि(cid:330)(cid:700) दो राजप(िcid:361)त अधिकारी, सद(cid:735)

जो उस पद की पय(cid:330)वे(cid:407)कीय हैसियत रखते हों जिसके लिये चयन

किया जाना है।

टि(cid:596)णी :- चयन समिति म(cid:336) अनुसूचित जातियों, अनुसूचित जनजातियों और नाग(cid:303)रकों के अ(cid:586) पिछड़े वग(cid:344) को (cid:366)तिनिधि(cid:533) दे ने के लिये अधिका(cid:303)रयों का नाम-निद(cid:337) शन, समय-समय पर यथासंशोधित उ(cid:517)र (cid:366)दे श लोक सेवा (अनुसूचित जातियों, अनुसूचित जनजातियों और अ(cid:586) पिछड़े oxksZa के लिए आर(cid:407)ण) अधिनियम, 1994 की धारा 7 के अधीन कृ त आदे श के अनुसार किया जाएगा।

(दो) नियु(cid:304)(cid:389) (cid:366)ाधिकारी, अ(cid:631)थि(cid:330)यों की पा(cid:361)ता सूची, समय-समय पर यथासंशोधित उ(cid:517)र (cid:366)दे श (लोक सेवा आयोग के (cid:407)े(cid:361) के बाहर के पदों पर) चयनो(cid:580)ति पा(cid:361)ता सूची नियमावली, 1986 के अनुसार तैयार करे गा और उसे उनकी च(cid:303)र(cid:361) पंजियों और उनसे संबंधित ऐसे अ(cid:586) अभिलेखों के साथ, जो उचित समझे जायं, चयन समिति के सम(cid:407) रखेगा।

(तीन) चयन समिति ख(cid:503) (दो) म(cid:336) निदि(cid:330) (cid:700) अभिलेखों के आधार पर अ(cid:631)थि(cid:330)यों के मामलों पर विचार करे गी।

(चार) चयन समिति चयनित अ(cid:631)थि(cid:330)यों की (cid:475)े(cid:703)ता (cid:354)म, जैसा कि उस संवग(cid:330) म(cid:336) हो, जिससे उनकी पदो(cid:580)ति की जानी हो, म(cid:336) एक सूची तैयार करे गी और उसे नियु(cid:304)(cid:389) (cid:366)ाधिकारी को अ(cid:356)सा(cid:303)रत करे गी।

भाग-छः –नियु(cid:304)(cid:389), प(cid:303)रवी(cid:407)ा, (cid:830)थायीकरण, (cid:475)े(cid:703)ता और (cid:366)शि(cid:407)ण

नियु(cid:304)(cid:389) 17-(1) उपनियम (2) के उपब(cid:576)ों के अ(cid:559)धीन नियु(cid:304)(cid:389) (cid:366)ाधिकारी अ(cid:631)थि(cid:330)यों के नाम उसी (cid:354)म, जिसम(cid:336) वे यथा(cid:304)(cid:830)थति नियम 15 और 16 के अधीन तैयार की गयी सूची म(cid:336) आये हों, म(cid:336) लेकर नियु(cid:304)(cid:389) करेगा।

(2) यदि किसी एक चयन के संबध म(cid:336) नियु(cid:304)(cid:389) के एक से अधिक आदे श जारी किये जायं तो एक संयु(cid:389) आदे श भी जारी किया जायेगा, जिसम(cid:336) (cid:681)(cid:304)(cid:389)यों के नामों का उ(cid:671)ेख, उसी (cid:475)े(cid:703)ता (cid:354)म म(cid:336) किया जायेगा जैसाकि चयन म(cid:336) अवधा(cid:303)रत किया गया हो।

प(cid:303)रवी(cid:407)ा 18-(1) सेवा म(cid:336) किसी पद पर मौलिक (cid:349)प से नियु(cid:389) किसी (cid:681)(cid:304)(cid:389) को समय- समय पर यथासंशोधित उ(cid:517)र (cid:366)दे श सरकारी सेवक प(cid:303)रवी(cid:407)ा नियमावली, 2013 के अनुसार प(cid:303)रवी(cid:407)ा पर रखा जायेगा।

(2) यदि प(cid:303)रवी(cid:407)ा अवधि या बढ़ायी गयी प(cid:303)रवी(cid:407)ा अवधि के दौरान किसी समय या उसके अ(cid:566) म(cid:336) नियु(cid:304)(cid:389) (cid:366)ाधिकारी को यह (cid:366)तीत हो कि प(cid:303)रवी(cid:407)ाधीन (cid:681)(cid:304)(cid:389) ने अपने अवसरों का पया(cid:330)(cid:593) उपयोग नही ं किया है या स(cid:566)ोष (cid:366)दान करने म(cid:336) अ(cid:586)था विफल रहा है तो उसे उसके मौलिक पद, यदि कोई हो, पर (cid:366)(cid:529)ावति(cid:330)त किया जा सकता है और यदि उसका किसी पद पर धारणाधिकार न हो तो उसकी सेवाय(cid:336) समा(cid:593) की जा सकती ह(cid:339)।

(3) ऐसा प(cid:303)रवी(cid:407)ाधीन (cid:681)(cid:304)(cid:389) जिसे उपनियम (2) के अधीन (cid:366)(cid:529)ावति(cid:330)त किया गया हो या जिसकी सेवाय(cid:336) समा(cid:593) कर दी गयी हों, किसी (cid:366)तिकर का हकदार नही ं होगा।

(4) नियु(cid:304)(cid:389) (cid:366)ाधिकारी संवग(cid:330) म(cid:336) स(cid:304)(cid:643)लित किसी पद पर या किसी अ(cid:586) समक(cid:407) या उ(cid:452) पद पर (cid:830)थानाप(cid:580) या अ(cid:830)थायी हैसियत से की गयी निर(cid:566)र सेवा को प(cid:303)रवी(cid:407)ा अवधि की संगणना करने के (cid:366)योजनाथ(cid:330) गिने जाने की अनुमति दे सकता है।

(cid:830)थायीकरण 19-(1) उपनियम (2) के उपबंधों के अ(cid:559)धीन किसी प(cid:303)रवी(cid:407)ाधीन (cid:681)(cid:304)(cid:389) को प(cid:303)रवी(cid:407)ा अवधि या बढ़ायी गयी प(cid:303)रवी(cid:407)ा अवधि के अंत म(cid:336) उसकी नियु(cid:304)(cid:389) म(cid:336) (cid:830)थायी कर दिया जायेगा; यदि -

(क) उसने सफलतापूव(cid:330)क विहित (cid:366)शि(cid:407)ण, यदि कोई हो, (cid:366)ा(cid:593) कर लिया हो;

(ख) उसका काय(cid:330) और आचरण संतोषजनक बताया जाय;

(ग) उसकी स(cid:529)नि(cid:703)ा (cid:366)माणित हो, और

(घ) नियु(cid:304)(cid:389) (cid:366)ाधिकारी का यह समाधान हो जाय कि वह (cid:830)थायी किये जाने

हेतु अ(cid:586)था उपयु(cid:389) है।

(2) जहाँ उ(cid:517)र (cid:366)देश रा(cid:475) के सरकारी सेवकों की (cid:830)थायीकरण नियमावली, 1991 के

उपबंधों के अनुसार (cid:830)थायीकरण किया जाना आव(cid:692)क न हो, वहाँ उस नियमावली के नियम 5 के

उप-नियम (3) के अधीन यह घोषणा करते (cid:352)ए आदे श कि संबंधित (cid:681)(cid:304)(cid:389) ने प(cid:303)रवी(cid:407)ाधीन अवधि

सफलतापूव(cid:330)क पूण(cid:330) कर ली है, (cid:830)थायीकरण का आदेश माना जायेगा।

(cid:475)े(cid:703)ता

20-सेवा म(cid:336) किसी (cid:373)ेणी के पदों पर मौलिक (cid:349)प से नियु(cid:389) (cid:681)(cid:304)(cid:389)यों की (cid:475)े(cid:703)ता समय-

समय पर यथासंशोधित उ(cid:517)र (cid:366)देश सरकारी सेवक (cid:475)े(cid:703)ता नियमावली, 1991 के अनुसार

अवधा(cid:303)रत की जायेगी।

(cid:366)शि(cid:407)ण

21-(cid:366)(cid:529)ेक अ(cid:631)थ(cid:334), चाहे उसकी नियु(cid:304)(cid:389) सीधी भत(cid:334) अथवा पदो(cid:580)ति (cid:554)ारा की गयी हो,

से समय-समय पर विभाग (cid:554)ारा यथा विहित (cid:366)शि(cid:407)ण (cid:366)ा(cid:593) करने की अपे(cid:407)ा की जायेगी।

भाग सात-वेतन इ(cid:529)ादि

वेतनमान

22-(1) सेवा म(cid:336) विभि(cid:580) (cid:373)ेणियों के पदों पर नियु(cid:389) (cid:681)(cid:304)(cid:389)यों का अनुम(cid:586) वेतनमान ऐसा

होगा, जैसा कि सरकार (cid:554)ारा समय-समय पर अवधा(cid:303)रत किया जाय।

(2) इस नियमावली के (cid:366)ार(cid:641) के समय के वेतनमान 'प(cid:303)रशि(cid:700)-ख' म(cid:336) दिए गए ह(cid:339)।

प(cid:303)रवी(cid:407)ा अवधि 23-(1) फ(cid:503)ाम(cid:336)टल (cid:349)(cid:676) म(cid:336) किसी (cid:366)तिकू ल उपब(cid:576) के होते (cid:352)ए भी, प(cid:303)रवी(cid:407)ाधीन

म(cid:336) वेतन

(cid:681)(cid:304)(cid:389), यदि वह पहले से (cid:830)थायी सरकारी सेवा म(cid:336) न हो, को समयमान म(cid:336) उसकी (cid:366)थम वेतनवृ(िcid:554)

तभी दी जायेगी जब उसने एक वष(cid:330) की संतोषजनक सेवा पूरी कर ली हो, विभागीय परी(cid:407)ा उ(cid:517)ीण(cid:330)

कर ली हो और जहॉ विहित हो (cid:366)शि(cid:407)ण (cid:366)ा(cid:593) कर लिया हो और (िcid:554)तीय वेतनवृ(िcid:554) दो वष(cid:330) की सेवा

के प(cid:686)ात् तभी दी जायगी जब उसने प(cid:303)रवी(cid:407)ा अवधि पूरी कर ली हो और उसे (cid:830)थायी भी कर दिया

गया हो :

पर(cid:566)ु यह कि यदि संतोष (cid:366)दान करने म(cid:336) विफल रहने के कारण प(cid:303)रवी(cid:407)ा अवधि बढ़ायी

जाय तो इस (cid:366)कार बढ़ायी गयी अवधि की गणना तब तक वेतनवृ(cid:304)(cid:544) के लिए नही ं की जायगी, जब

तक कि नियु(cid:304)(cid:389) (cid:366)ाधिकारी अ(cid:586)था निदेश न दे।

(2) ऐसे (cid:681)(cid:304)(cid:389), जो पहले से सरकार के अधीन कोई पद धारण कर रहा हो, का

प(cid:303)रवी(cid:407)ा अवधि म(cid:336) वेतन, सुसंगत फ(cid:503)ाम(cid:336)टल (cid:349)(cid:676) (cid:554)ारा विनियमित किया जायेगा:

पर(cid:566)ु यह कि यदि संतोष (cid:366)दान करने म(cid:336) विफल रहने के कारण प(cid:303)रवी(cid:407)ा अवधि बढ़ायी

जाय तो इस (cid:366)कार बढ़ायी गयी अवधि की गणना वेतनवृ(cid:304)(cid:544) के लिए तब तक नही ं की जायेगी जब

तक कि नियु(cid:304)(cid:389) (cid:366)ाधिकारी अ(cid:586)था निदेश न दे।

(3) ऐसे (cid:681)(cid:304)(cid:389), जो पहले से (cid:830)थायी सरकारी सेवा म(cid:336) हो, का प(cid:303)रवी(cid:407)ा अवधि म(cid:336) वेतन,

रा(cid:475) के काय(cid:330)कलापों के संबंध म(cid:336) सेवारत् सरकारी सेवकों पर सामा(cid:586)तया लागू सुसंगत नियमों

(cid:554)ारा विनियमित किया जायेगा।

भाग-आठ-अ(cid:586) उपब(cid:576)

प(cid:407) समथ(cid:330)न 24-सेवा म(cid:336) किसी पद पर लागू नियमों के अधीन अपे(िcid:407)त सिफा(cid:303)रशों से भि(cid:580) कि(cid:590)ी ं

सिफा(cid:303)रशों, चाहे लि(cid:304)खत हों या मौ(cid:304)खक हों, पर विचार नही ं किया जायेगा। किसी अ(cid:631)थ(cid:334) की

ओर से अपने अ(cid:631)थ(cid:330)न के लिए (cid:366)(cid:529)(cid:407) या अ(cid:366)(cid:529)(cid:407) (cid:349)प से समथ(cid:330)न (cid:366)ा(cid:593) करने का कोई (cid:366)यास

उसे नियु(cid:304)(cid:389) के लिए अनह(cid:330) कर देगा।

अ(cid:586) विषयों का 25-ऐसे विषयों के स(cid:638)(cid:576) म(cid:336) जो विनिदि(cid:330)(cid:700) (cid:349)प से इस नियमावली या विशेष आदे शों से

विनियमन

आ(cid:453)ादित न हों, सेवा म(cid:336) नियु(cid:389) (cid:681)(cid:304)(cid:389), रा(cid:475) के काय(cid:330)कलापों के स(cid:638)(cid:576) म(cid:336) सेवारत् सरकारी

सेवकों पर सामा(cid:586)तया लागू नियमों, विनियमों और आदेशों (cid:554)ारा शासित होंगे।

सेवा की शत(cid:344) म(cid:336)

26-जहाँ रा(cid:475) सरकार का यह समाधान हो जाय कि सेवा म(cid:336) नियु(cid:389) (cid:681)(cid:304)(cid:389)यों की शिथिलता

सेवा शत(cid:344) को विनियमित करने वाले किसी नियम के (cid:366)वत(cid:330)न से किसी विशि(cid:700) मामले म(cid:336) अनुचित कठिनाई होती है, वहां वह उस मामले म(cid:336) लागू नियमों म(cid:336) अ(cid:566)वि(cid:330)(cid:700) किसी बात के होते (cid:352)ए भी, आदे श (cid:554)ारा उस नियम की अपे(cid:407)ाओं को उस सीमा तक और ऐसी 'krksZa के अ(cid:559)धीन, जि(cid:590)(cid:336) वह मामले म(cid:336) (cid:586)ायसंगत और सा(cid:644)पूण(cid:330) रीति से काय(cid:330)वाही करने के लिए आव(cid:692)क समझे, अभिमु(cid:389) या शिथिल कर सकती है:

IN exercise of the powers conferred by the proviso to Article 309 of the Constitution and in supersession of all existing rules and orders on the subject, Governor is pleased to make the following rules regulating recruitment and the conditions of service of persons appointed to the Uttar Pradesh Transport Department Enforcement Staff (Group 'C') Service:

THE UTTAR PRADESH TRANSPORT DEPARTMENT ENFORCEMENT STAFF

(GROUP 'C') SERVICE RULES, 2022

PART-I–GENERAL

Short title and 1. (1) These rules may be called "The Uttar Pradesh Transport Department

commencement Enforcement Staff (Group 'C') Service Rules, 2022".

(2) They shall come into force at once .

Status of the 2. The Uttar Pradesh Transport Department Enforcement Staff (Group 'C')

service

Service is a service comprising Group 'C' posts.

Definitions 3. In these rules, unless there is anything repugnant in the subject or context:

(a) 'Act' means the Uttar Pradesh Public Services (Reservation for

Scheduled Castes, Scheduled Tribes and Other Backward Classes) Act, 1994, as

amended from time to time;

(b) 'Appointing authority' means the Additional Transport Commissioner

(Enforcement) posted in the office of the Transport Commissioner,

Uttar Pradesh;

(c) 'Citizen of India' means a person who is or is deemed to be a citizen of

India under Part II of the Constitution ;

(d) 'Commission' means Uttar Pradesh Subordinate Services Selection

Commission ;

(e) 'Constitution' means the Constitution of India ;

(f) 'Government' means the State Government of Uttar Pradesh;

(g) 'Governor' means the Governor of Uttar Pradesh;

(h) 'Head of the Department' means the Transport Commissioner of

Uttar Pradesh;

(i) 'Service' means the Uttar Pradesh Transport Department Enforcement

Staff (Group 'C') Service ;

(j) 'Member of service' means a person substantively appointed under these

rules or the rules or orders in force prior to the commencement of these rules to

a post in the cadre of the service ;

(k) 'Other Backward Classes of Citizens' means the backward classes of

citizens specified in Schedule I of the Act, as amended from time to time;

(l) 'Substantive appointment' means an appointment, not being an ad-hoc

appointment, on a post in the cadre of the service, made after selection in

accordance with the rules, and, if there were no rules, in accordance with the

procedure prescribed for the time being by executive instructions issued by the

Government;

(m) 'Transport Commissioner', 'Additional Transport Commissioner

(Enforcement)', 'Assistant Transport Commissioner (Enforcement)',

'Regional Transport Officer (Enforcement)', 'Regional Transport Officer'

and 'Assistant Regional Transport Officer' means the officers appointed as

such by the Government; and

(n) 'Year of recruitment' means a period of twelve months

commencing on the first day of July of a calendar year.

PART-II – CADRE

Cadre of service 4. (1) The Strength of the service and of each category of posts therein shall be as such as may be determined by the Government from time to time.

(2) The strength of the service and of each category of posts therein shall, until orders varying the same are passed under sub-rule (1), be as given in Appendix 'A'.

Provided that ,–

(i) the appointing authority may leave unfilled or the Governor may hold

in abeyance any vacant post, without thereby entitling any person to

compensation; or

(ii) the Governor may create such additional permanent or temporary

posts, as he may consider proper.

PART-III–RECRUITMENT

Source of

5. Recruitment to the various categories of posts in the service shall be made recruitment

from the following sources :

(1) Enforcement Supervisor : By promotion from amongst substantively appointed Enforcement Constables who have completed ten years' service as such on the first day of the year of recruitment.

(2) Enforcement Constable : (i) By direct recruitment through the Commission.

Reservation 6. Reservation for the candidates belonging to the Scheduled Castes, Scheduled Tribes and other categories shall be in accordance with the Act and, the Uttar Pradesh Public Services (Reservation for Physically Handicapped, Dependents of Freedom Fighters and Ex-Servicemen) Act, 1993, as amended from time to time, and the orders of the Government in force at the time of the recruitment.

NOTE :– As per Government Order of Handicapped Welfare Department No. 35/65-03-11-78/99, dated January 13, 2011 above posts are not indentified for reservation.

PART-IV–QUALIFICATIONS

Nationality

7. A candidate for direct recruitment to a post in the service must be :

(a) a citizen of India ; or

(b) a Tibetan Refugee who came over to India before the 1st January,

1962 with the intention of permanently settling in India; or

(c) a person of Indian origin who has migrated from Pakistan, Burma,

Sri Lanka or any of the East African Countries of Kenya, Uganda and the

United Republic of Tanzania (formerly Tanganyika and Zanzibar) with the

intention of permanently settling in India:

Provided that a candidate belonging to category (b) or (c) above must be a person in whose favour a certificate of eligibility has been issued by the State Government:

Provided further that a candidate belonging to category (b) will also be required to obtain a certificate of eligibility granted by the Deputy Inspector General of Police, Intelligence Branch, Uttar Pradesh:

Provided also that if a candidate belongs to category (c) above, no certificate of eligibility will be issued for a period of more than one year and the retention of such a candidate in service beyond the period of one year, shall be subject to his acquiring Indian citizenship.

NOTE :– A candidate in whose case a certificate of eligibility is necessary but the same has neither been issued nor refused, may be admitted to an examination or interview and he may also be provisionally appointed subject to the necessary certificate being obtained by him or issued in his favour.

Academic and

other

qualifications 8. (1) A candidate for direct recruitment to the post of Enforcement Constable must have passed the Intermediate examinations of the Board of High School and Intermediate Education Uttar Pradesh or an examination recognised by the Government as equivalent thereto.

(2) Computer skill test of written test passed candidates will be conducted by the selection institution (Uttar Pradesh Subordinate Service Selection Commission). Only skill test passed candidates will be recommended for selection.

(3) Physical Standard

Minimum Physical Standards for male candidates are as follows:- (a) Height:-

(i) For Scheduled Tribes male candidates minimum height should be

160 centimeter.

(ii) For other candidates minimum height should be

168 centimeter. (b) Chest:-

(i) For the Scheduled Tribes candidates 77 centimeters without

expansion and not less than 82 centimeters on expansion.

(ii) For other candidates minimum chest measurement should be 79 centimeters without expansion and not less than 84 centimeters on expansion.

NOTE :- Minimum 5 centimeter chest expansion is essential.

Minimum Physical Standards for female candidates are as follows:-

(a) Height:-

(i) For Scheduled Tribe female candidates minimum height should be

147 centimeter.

(ii) For other female candidates minimum height should be 152

centimeter. (b) Weight : minimum 40 kg. for female candidates.

Preferential

9. A candidate who has :-

qualification (i) served in the Territorial Army for a minimum period of two years; or

(ii) obtained a 'B' certificate at the national cadet corps, shall other things

being equal be given preference in the matter of direct requirement.

Age

10. A candidate for direct recruitment to the post of enforcement constable must have attained the age of 18 years and must not have attained the age of more than 25 years on the first day of July of the calendar year in which vacancies for direct recruitment are advertised :

Provided that the upper age limit in the case of candidates belonging to the Scheduled Castes, Scheduled Tribes and such other categories as may be notified by the Government for time to time shall be greater by such number of years as may be specified.

Character

11. The character of a candidate for direct recruitment to a post in the service must be such as to render him suitable in all respects for employment in Government Service. The appointing authority shall satisfy itself on this point.

NOTE :– Persons dismissed by the Union Government or a State Government or by a Local Authority or a Corporation or Body owned or controlled by the Union Government or a State Government shall be ineligible for appointment to any post in the service. Persons convicted of an offence involving moral turpitude shall also be ineligible.

Marital status

12. A male candidate who has more than one wife living or a female candidate who has married a man already having a wife living shall not be eligible for appointment to a post in the service :

Provided that the Government may, if satisfied that there exist special grounds for doing so, exempt any person from the operation of this rule.

Physical fitness

13. No candidate shall be appointed to a post in the service unless he be in good mental and bodily health and free from any physical defect likely to interfere with the efficient performance of his duties. Before a candidate is finally approved for appointment. He shall be required to produce a Medical certificate of fitness in accordance with the rules framed under Fundamental Rule 10, contained in Chapter-III of the Financial Hand Book, Volume II, Part III :

Provided that a medical certificate of fitness shall not be required from a candidate recruited by promotion.

PART-V–PROCEDURE FOR RECRUITMENT

Determination of vacancies

14. The appointing authority shall determine the number of vacancies to be filled during the course of the year of recruitment as also the number of vacancies to be reserved for candidates belonging to the Scheduled Castes, Scheduled Tribes and other categories under rule 6. The vacancies to be filled through the commission shall be intimated to them.

Procedure for Direct Recruitment through the Commission

15. (i) Direct recruitment to the post of Enforcement Constable in the service shall be made in accordance with the provision of the Uttar Pradesh Direct Recruitment to Group "C" Posts (Mode And Procedure) Rules, 2015 as amended from time to time.

(ii) Physical Efficiency Test for Direct Recruitment

Run for physical efficiency test for direct recruitment of constables:

(a) For male candidates 4.8 Km. (kilometer) in 27 minutes.

(b) For female candidates 2.4 Km. (Kilometer) in 16 minutes.

Those candidates who fail to complete the run in stipulated time will be treated unsuccessful.

NOTE :– Above Tests will be conducted by the Commission.

(iii) The candidates who have qualified the aforesaid Physical Standard/ Physical Efficiency Test shall be recommended for appointment to the appointing authority for the post of enforcement constable in order of merit as recommended by the Commission.

Procedure for recruitment by promotion

16 (i) Recruitment by promotion to the post of Enforcement Supervisor in the service shall be made on the basis of the criterion laid down in the Uttar Pradesh Government Servants Criterion for Recruitment by Promotion Rules, 1994, as amended from time to time. Notwithstanding anything to the contrary contained in the Uttar Pradesh Constitution of Departmental Promotion Committee for posts outside the purview of the Service Commission Rules, 1992, the Selection Committee shall be constituted as under:-

Chairman (a) Appointing Authority

Members (b) Two Gazetted officers nominated by the Appointing Authority, having supervisory capacity of the post for which selection is made.

NOTE :– Nomination of officers for giving representation to the Scheduled Castes, Scheduled Tribes and Other Backward Classes of Citizens in the Selection Committee shall be made in accordance with the order made under section 7 of the Uttar Pradesh Public Services (Reservation For Scheduled Castes, Scheduled Tribes And Other Backward Classes) Act, 1994, as amended from time to time.

(ii) The appointing authority shall prepare eligibility list of the candidates in accordance with the Uttar Pradesh Promotion by Selection (on posts outside the purview of the Public Service Commission) Eligibility List Rules, 1986, as amended from time to time, and place the same before the Selection Committee their Character Rolls and such other records, pertaining to them, as may be considered proper.

(iii) The Selection Committee shall consider the cases of the candidates on the

basis of the records, referred to in clause (ii).

(iv) The Selection Committee shall prepare a list of selected candidates in order

of seniority as it stood in the cadre from which they were to be promoted and forward the

same to the appointing authority.

PART-VI–APPOINTMENT, PROBATION, CONFIRMATION, TRAINING AND SENIORITY

Appointment 17. (1) Subject to the provisions of sub-rule (2) the appointing authority shall

make appointment by taking the names of candidates in the order in which they stand in

the lists prepared under rules 15 & 16 as the case may be.

(2) If more than one order of appointment are issued in respect of any one

selection, a combined order shall also be issued, mentioning the names of the persons in

order of seniority as determined in the selection.

Probation

18. (1) A person on substantive appointment to a post in the service shall be

placed on probation in accordance with the Uttar Pradesh Government Servants

Probation Rules, 2013 as amended from time to time.

(2) If it appears to the appointing authority at any time during or at the end of

the period of probation or extended period of probation that a probationer has not made

sufficient use of his opportunities or has otherwise failed to give satisfaction, he may be

reverted to his substantive post, if any, and if he does not hold a lien on any post, his

services may be dispensed with.

(3) A probationer who is reverted or whose services are dispensed with under

sub-rule (2) shall not be entitled to any compensation.

(4) The appointing authority may allow continuous service, rendered in an

officiating or temporary capacity in a post included in the cadre or any other equivalent

or higher post, to be taken into account for the purpose of computing the period of

probation.

Confirmation 19. (1) Subject to the provisions of sub-rule (2) a probationer shall be confirmed

in his appointment at the end of the period of probation or the extended period of

probation if-

(a) he has successfully undergone the prescribed training if any;

(b) his work and conduct is reported to be satisfactory;

(c) his integrity is certified ; and

(d) the appointing authority is satisfied that he is otherwise fit for

confirmation.

(2) Where in accordance with the provisions of the Uttar Pradesh State

Government Servants Confirmation Rules, 1991 Confirmation is not necessary, the order

under sub-rule (3) of the rule 5 of those rules declaring that the person concerned has

successfully completed the probation, shall be deemed to be the order of confirmation.

Seniority

20. The seniority of persons substantively appointed in any category of posts in the service shall be determined in accordance with the Uttar Pradesh Government Servants Seniority Rules, 1991, as amended from time to time.

Training 21. Every candidate, whether appointed by direct recruitment or promotion, will be required to undergo training as may be prescribed by the Department from time to time.

PART-VII–PAY ETC.

Scales of pay

22. (1) The scales of pay admissible to persons appointed to the various categories of posts in the service shall be such as may be determined by the Government from time to time.

(2) The scales of pay at the time of the commencement of these rules are given in Appendix 'B'.

Pay during probation

23. (1) Notwithstanding any provision in the Fundamental Rules to the contrary, a person on probation, if he is not already in permanent Government service, shall be allowed his first increment in the time-scale when he has completed one year of satisfactory service, has passed departmental examination and undergone training, where prescribed, and second increment after two years service when he has completed the probationary period and is also confirmed :

Provided that, if the period of probation is extended on account of failure to give satisfaction, such extension shall not count for increment unless the appointing authority directs otherwise.

(2) The pay during probation of a person who was already holding a post under the Government, shall be regulated by the relevant fundamental rules:

Provided that, if the period of probation is extended on account of failure to give satisfaction, such extension shall not count for increment unless the appointing authority directs otherwise.

(3) The pay during probation of a person already in permanent Government service shall be regulated by the relevant rules, applicable generally to Government servants serving in connection with the affairs of the State.

PART-VIII–OTHER PROVISIONS

Canvassing

24. No recommendations, either written or oral, other than those required under the rules applicable to the post or service will be taken into consideration. Any attempt on the part of a candidate to enlist support directly or indirectly for his candidature will disqualify him for appointment.

Regulation of other matters

25. In regard to the matters not specifically covered by these rules or special orders, persons appointed to the service shall be governed by the rules, regulations and orders applicable generally to Government servants serving in connection with the affairs of the State.

Relaxation from the conditions of service

26. Where the State Government is satisfied that the operation of any rule regulating the conditions of service of persons appointed to the service causes undue hardship in any particular case, it may, notwithstanding anything contained in the rules applicable to the case, by order, dispense with or relax the requirements of that rule to such extent and subject to such conditions as it may consider necessary for dealing with the case in a just and equitable manner.

Savings

27. Nothing in these rules shall affect reservations and other concessions required to be provided for the candidates belonging to the Scheduled Castes, Scheduled Tribes and other special categories of persons in accordance with the orders of the Government issued from time to time in this regard.
