उत्तर प्रदेश साधारण ख(cid:7003)ड अधिनियम, 1904 (उत्तर प्रदेश अधिनियम संख्या 1 सन् 1904) की धारा 21 के साथ पठित संयुक्त प्रान्त आबकारी अधिनियम, 1910 (संयुक्त प्रान्त अधिनियम संख्या 4 सन् 1910) की धारा 41 के अधीन शक्तियों का प्रयोग करके आबकारी आयुक्त, उत्तर प्रदेश राज्य सरकार की पूर्व स्वीकृ ति से आबकारी आयुक्त की अधिसूचना सं0 26743/दस-लाइसेंस-185/2018-2019 प्रयागराज/दिनांक-29 जनवरी, 2019 द्वारा प्रकाशित उत्तर प्रदेश आबकारी (भांग की फु टकर बि(cid:7059)ी के लिये लाइसेंसों का (cid:7390)वस्थापन) नियमावली, 2019 में संशोधन करने की दृष्टि से निम्नलिखित नियमावली बनाती हैः-

1-सं(cid:468)(cid:162)(cid:431) नाम व (cid:292)ारंभ--(1) यह नियमावली उत्तर प्रदेश आबकारी (भांग की फु टकर बि(cid:7059)ी के लिये लाइसेंसों का (cid:7390)वस्थापन) (द्वितीय संशोधन) नियमावली, 2022 कही जायेगी।

(2) यह गजट में प्रकाशित किये जाने के दिनांक से प्रवृत्त होगी।

2-िनयम-2 का संशोधन--उत्तर प्रदेश आबकारी (भांग की फु टकर बि(cid:7059)ी के लिये लाइसेंसों का (cid:7390)वस्थापन) नियमावली, 2019 जिसे आगे उक्त नियमावली कहा गया है, में नीचे स्तम्भ-1 में दिये गये नियम-2 के स्थान पर स्तम्भ-2 में दिया गया नियम रख दिया जायेगा, अर्थात्-

(ग) ''भांग'' का तात्पर्य भांग के पौधे (कै नेबिस सेटाइवा) की एवं छोटे-छोटे डन्ठलों से है, जो भांग के नाम से जाना जाता है;

(ग) ''प्रतिफल शुल्क'' का तात्पर्य अधिनियम की धारा-24 के अधीन भांग की फु टकर बि(cid:7059)ी के एकान्तिक विशेषाधिकार हेतु सम्पूर्ण आबकारी वर्ष या उसके आंशिक भाग के लिए लाइसेंस के प्रदान किए जाने के निमित्त प्रतिफल के उस भाग से है, जो लाइसेंसधारी के रूप में चयनित (cid:7390)क्ति द्वारा, भांग की उठान से पूर्व प्रति किलो (cid:7061)ाम ऐसी दरों पर, जैसा कि समय-समय पर राज्य सरकार के परामर्श से आबकारी आयुक्त द्वारा अधिसूचित की जाय, भुगतान किया जाय।

परन्तु, यदि (cid:7390)वस्थापन मध्य सत्र में होता है, तो प्रतिफल शुल्क आबकारी वर्ष के अवशेष अवधि के

समानुपातिक होगा,

(घ) ''भांग'' का तात्पर्य (कै नेबिस सेटाइवा) के पौधों की पत्तियों एवं छोटे-छोटे डन्ठलों से है, जो भांग के नाम से

जाना जाता है,

(घ) ''प्रतिफल फीस'' का तात्पर्य अधिनियम की धारा 24 के अधीन भांग की फु टकर बि(cid:7059)ी के एकान्तिक विशेषाधिकार हेतु सम्पूर्ण आबकारी वर्ष या उसके आंशिक भाग के लिए लाइसेंस के प्रदान किए जाने के निमित्त प्रतिफल के उस भाग से है, जो लाइसेंसधारी के रूप में चयनित (cid:7390)क्ति द्वारा, भांग की उठान से पूर्व प्रति किलो (cid:7061)ाम ऐसी दरों पर, जैसा कि समय-समय पर राज्य सरकार के परामर्श से आबकारी आयुक्त द्वारा अधिसूचित की जाय, संदेय किया जाय।

परन्तु, यदि (cid:7390)वस्थापन मध्य सत्र में होता है, तो प्रतिफल फीस आबकारी वर्ष के अवशेष अवधि के समानुपातिक होगा;

विद्यमान नियम

(एत(cid:217)(cid:430)ारा प्रतिस्थापित नियम)

(ड.) ''दैनिक लाइसेंस फीस'' का तात्पर्य सम्पूर्ण वर्ष के (ड.) ''दैनिक लाइसेंस फीस'' का तात्पर्य सम्पूर्ण वर्ष के

लिये निर्धारित लाइसेंस फीस के 1/365 वें भाग से है,

लिये नियत लाइसेंस फीस के 1/365 वें भाग से है;

(च) ''दैनिक न्यूनतम प्रत्याभूत मात्रा'' वा(cid:7414)र्षक (च) ''दैनिक न्यूनतम प्रत्याभूत मात्रा'' वा(cid:7414)र्षक

न्यूनतम प्रत्याभूत मात्रा का 1/365 व(cid:7292) भाग होगी,

(छ) ''आबकारी वर्ष'' का तात्पर्य 1 अप्रैल से प्रारम्भ (छ) ''आबकारी वर्ष'' का तात्पर्य 1 अप्रैल से प्रारम्भ

होकर आगामी कलेन्डर वर्ष के 31 मार्च तक चलने वाले होकर आगामी कलेन्डर वर्ष के 31 मार्च तक चलने वाले

(ज) ''परिवार'' का तात्पर्य दम्पत्ति (पति या प(cid:7360)ी), (ज) ''धरोहर धनराशि'' का तात्पर्य लाइसेंस की आ(िcid:7088)त पुत्र (पुत्रों), अविवाहित पुत्री (पुत्रियों) और आ(िcid:7088)त स्वीकृ ति के लिये पात्रता की शत(cid:7300) की पू(cid:7414)र्त सुनि(िcid:7391)त किये

जाने के लिये आवेदन पत्र के साथ जमा की जाने वाली माता-पिता से है,

लाइसेंस फीस की धनराशि के 1/10 वें भाग के समतुल्य

धनराशि से है, और (cid:7390)ति(cid:7059)म की दशा में इस नियमावली के

नियम-12 के उपबन्धों के अधीन समप(cid:7265)त किये जाने योग्य

होगी;

(झ) ''प्रपत्र'' का तात्पर्य इस नियमावली के साथ

(झ) ''परिवार'' का तात्पर्य दम्पत्ति (पति या प(cid:7360)ी), संल(cid:7336) प्रपत्र से है,

आ(िcid:7088)त पुत्र (पुत्रों), अविवाहित पुत्री (पुत्रियों) और आ(िcid:7088)त

माता-पिता से है;

(ञ) ''लाइसेंस प्राधिकारी'' का तात्पर्य जिले के

(ञ) ''प्रपत्र'' का तात्पर्य इस नियमावली के साथ कलेक्टर से है,

संल(cid:7336) प्रपत्र से है;

(ट) ''लाइसेंस फीस'' का तात्पर्य प्रतिफल शुल्क के

(ट) ''अनु(cid:7059)म'' का तात्पर्य ई-लाटरी प्र(िcid:7059)या के माध्यम अतिरिक्त, आबकारी अधिनियम की धारा-24 के अधीन

से लाइसेंसधारी के चयन के लिये आधार के रूप में तात्प(cid:7414)र्यत भांग की फु टकर बि(cid:7059)ी के एकान्तिक विशेषाधिकार के लिए

राज्य सरकार के परामर्श से आबकारी आयुक्त द्वारा समय- दुकानों की धरोहर धनराशि के अवरोही (cid:7059)म से है;

समय पर सम्पूर्ण आबकारी वर्ष या उसके आंशिक भाग के

लिए लाइसेंस प्रदान किए जाने हेतु उ(cid:7365)हणीय प्रतिफल फीस

से है, जो लाइसेंसधारी द्वारा लाइसेंस प्रदान किये जाने से

पूर्व देय होगी,

(ठ) ''(cid:7390)क्ति'' का तात्पर्य ऐसे (cid:7390)क्ति से है जो आवेदन (ठ) ''प्रतिफल शुल्क की मासिक किस्त'' का तात्पर्य

करने के समय इ(cid:7333)ीस वर्ष की आयु से अन्यून, भारत का लाइसेंस प्राधिकारी द्वारा निर्धारित वा(cid:7414)र्षक प्रतिफल शुल्क

नागरिक हो;

के 1/12 वें भाग से है जो प्रत्येक माह देय होगी,

(ड) ''लाइसेंस प्राधिकारी'' का तात्पर्य जिला के (ड) ''मासिक न्यूनतम प्रत्याभूत मात्रा'' वा(cid:7414)र्षक न्यूनतम प्रत्याभूत मात्रा को बारह समान भागों में

कलक्टर से है;

विभाजित किया जायेगा। इन गणनाओं के फलस्वरूप प्राप्त

(एत(cid:217)(cid:430)ारा प्रतिस्थापित नियम)

(ढ) '' प्रतिभूति धनराशि'' का तात्पर्य वा(cid:7414)र्षक प्रतिफल (ढ) ''लाइसेंस फीस'' का तात्पर्य प्रतिफल फीस के शुल्क तथा लाइसेंस फीस के योग के 1/6 वें भाग के बराबर अतिरिक्त, आबकारी अधिनियम की धारा-24 के अधीन की धनराशि से है, जो सावधि जमा रसीद के प्ररूप में जिला भांग की फु टकर बि(cid:7059)ी के एकान्तिक विशेषाधिकार के लिए आबकारी अधिकारी के पक्ष में गिरवीकृ त अथवा ई-पेमे(cid:7003)ट के राज्य सरकार के परामर्श से आबकारी आयुक्त द्वारा समय- माध्यम से जमा की जायेगी और जो राज्य सरकार के समस्त

दावों और देयों के अन्तिम निस्तारण के बाद वापसी योग्य

समय पर सम्पूर्ण आबकारी वर्ष या उसके आंशिक भाग के लिए लाइसेंस प्रदान किए जाने हेतु mn~xzg.kh; प्रतिफल

फीस से है, जो लाइसेंसधारी द्वारा लाइसेंस प्रदान किये जाने होगी,

से पूर्व संदेय होगी;

परन्तु नवीकरण की स्थिति में पूर्व में नगद या राश्ट्रीय

बचत पत्र के माध्यम से जमा की गयी प्रतिभूति तब तक

मान्य होगी, जब तक इसकी वापसी न कर दी जाय।

(ण) 'धरोहर धनराशि' का तात्पर्य लाइसेंस की स्वीकृ ति (ण)"प्रतिफल फीस की मासिक किस्त" का तात्पर्य के लिये पात्रता की शत(cid:7300) की पू(cid:7414)र्त सुनि(िcid:7391)त किये जाने के लिये लाइसेंस प्राधिकारी द्वारा नियत वा(cid:7414)र्षक प्रतिफल फीस के आवेदन पत्र के साथ जमा की जाने वाली लाइसेंस फीस की

1/12 वें भाग से है ,जो प्रत्येक माह संदेय होगी;

धनराशि के 1/10 वें भाग के समतुल्य धनराशि से है, और

(cid:7390)ति(cid:7059)म की दशा में इस नियमावली के नियम-12 के

उपबन्धों के अधीन जब्त किये जाने योग्य होगी,

(त) "मासिक न्यूनतम प्रत्याभूत मात्रा" वा(cid:7414)र्षक (त) 'अनु(cid:7059)म' का तात्पर्य ई-लाटरी प्र(िcid:7059)या के माध्यम

से लाइसेंसधारी के चयन के लिये आधार के रूप में तात्प(cid:7414)र्यत न्यूनतम प्रत्याभूत मात्रा को 12 समान भागों में विभाजित

किया जायेगा। इन गणनाओं के फलस्वरूप प्राप्त मात्रा, दुकानों की धरोहर धनराशि के अवरोही (cid:7059)म से है,

मासिक न्यूनतम प्रत्याभूत मात्रा समझी जायेगी;

(थ)''पोर्टल'' का तात्पर्य विनि(cid:7416)र्दष्ट रूप से सृजित ऐसे (थ)''पोर्टल'' का तात्पर्य विशेष रूप से नि(cid:7414)र्मत

इलेक्ट्रानिक प्लेटफार्म से है जिस पर भांग की फु टकर दुकानों इलेक्ट्रानिक प्लेटफार्म से है, जिस पर भांग की फु टकर के (cid:7390)वस्थापन की प्र(िcid:7059)या से सम्बन्धित सूचनाओं को विहित दुकानों के (cid:7390)वस्थापन की प्र(िcid:7059)या से सम्बन्धित सूचना

प्रारूप में अपलोड किया जायेगा,

विहित प्रपत्र में अपलोड की जायेगी;

(द) ''ऋणशोधन क्षमता'' का तात्पर्य फु टकर लाइसेंस (द) ''प्रतिभूति धनराशि'' का तात्पर्य वा(cid:7414)र्षक प्रतिफल की स्वीकृ ति के लिये आवेदन करने हेतु आवेदक के लिये फीस तथा लाइसेंस फीस के योग के 1/6 वें भाग के बराबर की निर्धारित वित्तीय अर्हता के मानद(cid:7003)ड से है जो किसी दुकान

धनराशि से है, जो सावधि जमा रसीद/बैंक गारंटी के प्ररूप में के लिए निर्धारित लाइसेंस फीस के समतुल्य धनराशि से कम

जिला आबकारी अधिकारी के पक्ष में गिरवीकृ त अथवा ई-पेमे(cid:7003)ट

के माध्यम से संदेय होगी और जो राज्य सरकार के समस्त दावों नह(cid:7277) होगी,

और देयों के अन्तिम निस्तारण के बाद वापसी योग्य होगी,

परन्तु नवीकरण की स्थिति में पूर्व में नकद या राष्ट्रीय

बचत पत्र (एन.एस.सी.) के माध्यम से जमा की गयी

प्रतिभूति तब तक मान्य होगी, जब तक इसकी वापसी न कर

दी जाय।

विद्यमान नियम

(एत(cid:217)(cid:430)ारा प्रतिस्थापित नियम)

(ध) ''(cid:7390)क्ति '' का तात्पर्य ऐसे (cid:7390)क्ति से है जो आवेदन करने के समय इ(cid:7333)ीस वर्ष की आयु से अन्यून, भारत का

नागरिक हो,

(ध) ''ऋणशोधन क्षमता'' का तात्पर्य फु टकर लाइसेंस की स्वीकृ ति के लिये आवेदन करने हेतु आवेदक के लिये निर्धारित वित्तीय अर्हता के मानद(cid:7003)ड से है जो किसी दुकान के लिए अवधारित लाइसेंस फीस के समतुल्य धनराशि से

कम नह(cid:7277) होगी,

(न) ''(cid:7390)वस्थापन'' का तात्पर्य ई-लाटरी के माध्यम से नियत लाइसेंस फीस पर अथवा ई-टे(cid:7003)डर के माध्यम से ऑफर मांगकर दुकानों के (cid:7390)वस्थापन अथवा पुर्न(cid:7390)वस्थापन से है, जो समाचार पत्र एवं आबकारी विभाग की वेबसाइट के माध्यम से पूर्व नोटिस एवं संसूचना देकर सप्ताह के किसी दिन में हो सकता है। आगामी वर्ष के लिये दुकानों का (cid:7390)वस्थापन पूर्ववर्ती वित्तीय वर्ष की समाप्ति के पूर्व किया जा सकता है।

(न) ''(cid:7390)वस्थापन'' का तात्पर्य ई-लाटरी के माध्यम से नियत लाइसेंस फीस पर अथवा ई-टे(cid:7003)डर के माध्यम से ऑफर मांगकर दुकानों के (cid:7390)वस्थापन अथवा पुन(cid:7390र्)वस्थापन से है, जो समाचार पत्र एवं आबकारी विभाग की वेबसाइट के माध्यम से पूर्व नोटिस एवं संसूचना देकर सप्ताह के किसी दिन में हो सकता है। आगामी वर्ष के लिये दुकानों का (cid:7390)वस्थापन वतर्मान वित्तीय वर्ष की समाप्ति के पूर्व किया जा सकता है।

(2) इस नियमावली में अपरिभाषित किन्तु अधिनियम में परिभाषित शब्दों और पदों के वही अर्थ होंगे जो अधिनियम में (cid:7059)मशः उनके लिए समानुदेशित हों।

³- नियम-6 का संशोधन --उक्त नियमावली में, नीचे स्तम्भ-1 में दिये गये विद्यमान नियम-6 के स्थान पर स्तम्भ-2 में दिया गया नियम रख दिया जायेगा, अर्थात्ः--

6 -लाइसेंस की स्वीकृ ति

इस नियमावली के उपबन्धों के अनुसार लाइसेंस फीस को अधिमानतः ई-पेमेन्ट प्लेटफार्म के माध्यम से तथा इस नियमावली के उपबन्धों के अनुसार लाइसेंस फीस को अधिमानतः ई-पेमेन्ट प्लेटफार्म के माध्यम से तथा प्रतिभूति धनराशि को सावधि जमा रसीद के माध्यम से जिला आबकारी अधिकारी के पक्ष में गिरवीकृ त अथवा ई- पेमे(cid:7003)ट के माध्यम से भुगतान करने पर लाइसेंस निर्गत किये जायेगें।

प्रतिभूति धनराशि को सावधि जमा रसीद/बैंक गारंटी के माध्यम से जिला आबकारी अधिकारी के पक्ष में गिरवीकृ त अथवा ई-पेमे(cid:7003)ट के माध्यम से संदाय करने पर लाइसेंस जारी किये जायेगें ।

लाइसेंसधारी से यह अपेक्षा की जायेगी कि वह उस जिला में ऋणशोधन क्षमता प्रमाण पत्र अथवा प्राधिकृ त आयकर मूल्यांकक द्वारा निर्गत सम्पत्ति स्वामित्व प्रमाण-पत्र की मूलप्रति प्रस्तुत करे, जहॉ से उसे लाइसेंस, स्वीकृ ति के समय जारी किया गया है।

लाइसेंसधारी से यह अपेक्षा की जायेगी कि वह उस जिले में ऋणशोधन क्षमता प्रमाण पत्र अथवा प्राधिकृ त आयकर मूल्यांकक द्वारा निर्गत सम्पत्ति स्वामित्व प्रमाण-पत्र की मूलप्रति प्रस्तुत करे, जहॉ से उसे लाइसेंस, स्वीकृ ति के समय जारी किया गया है।

परन्तु यह कि नवीकरण की स्थिति में पूर्व में नकद अथवा राष्ट्रीय बचत पत्र के माध्यम से जमा की गयी प्रतिभूति तब तक स्वीकार्य होगी, जब तक इसकी वापसी न कर दी जाय और गत वर्ष के (cid:7390)वस्थापन के दौरान प्रस्तुत किये गये ऋणशोधन क्षमता प्रमाण पत्र अथवा प्राधिकृ त आयकर मूल्यांकक द्वारा जारी सम्पत्ति स्वामित्व प्रमाण पत्र, यदि यह वैध एवं अपेक्षित धनराशि के लिए है, प्रति(cid:7061)ा(cid:7405) होंगे।

4-िनयम-8 का संशोधन--उ(cid:416) िनयमावली म(cid:581), नीचे (cid:232)त(cid:224)भ-1 म(cid:581) (cid:465)दये गये (cid:466)व(cid:429)मान िनयम-8 के (cid:232)थान पर

8- आवेदकों के लिये पात्रता की शत(cid:7288) - फु टकर भॉग की दुकान के लाइसेंस के लिए पात्र आवेदकों को निम्नलिखित शत(cid:7288) अवश्य पूरी करनी होगी- अर्थात्

8- आवेदकों के लिये पात्रता की शत(cid:7288)- फु टकर भॉग की दुकान के लाइसेंस के लिए पात्र आवेदकों को निम्नलिखित शत(cid:7288) अवश्य पूरी करनी होगी- अर्थात्

(क) भारत का नागरिक हो, परन्तु भांग का थोक आपू(cid:7414)र्तकर्ता किसी फु टकर दुकान का लाइसेंस धारण करने हेतु पात्र नह(cid:7277) होगा। दुकान आवंटन के i'pkr आवेदक की स्थिति में कोई परिवर्तन अनुमन्य न होगा,

(क) भारत का नागरिक हो, परन्तु भांग का थोक आपू(cid:7414)र्तकर्ता किसी फु टकर दुकान का लाइसेंस धारण करने हेतु पात्र नह(cid:7277) होगा। दुकान आवंटन के प(cid:7391)ात आवेदक की स्थिति में कोई परिवर्तन अनुमन्य न होगा, परन्तु, लाइसेंसधारी की मृत्यु की दशा में उसका विधिक वारिस, यदि अन्यथा पात्र हो, लाइसेंस की शेष अवधि के लिए लाइसेंसधारी बना रह सकता है।

परन्तु, लाइसेंसधारी की मृत्यु की दशा में उसका विधिक वारिस, यदि अन्यथा पात्र हो, लाइसेंस की शेष अवधि के लिए लाइसेंसधारी बना रह सकता है।

(ख) आवेदन करने के समय आवेदनकर्ता की आयु

(ग) (cid:7390)ति(cid:7059)मी/काली सूची में सम्मिलित अथवा अधिनियम के अधीन बनाई गई किसी नियमावली के उपबंधों के अधीन आबकारी लाइसेंस धारण करने से विव(cid:7414)र्जत न किया गया हो। कोई (cid:7390)क्ति जिसे किसी न्यायालय द्वारा किसी आबकारी अपराध के लिए दोषसि(cid:7373) किया गया हो, लाइसेंस धारण करने से स्वतः विव(cid:7414)र्जत हो जायेगा जब तक कि उसे पूर्णतः और अन्तिम रूप से दोषमुक्त न कर दिया गया हो।

(घ) आवेदनकर्ता किसी एक दुकान के लिए स्वयं के नाम

(घ) आवेदनकर्ता किसी एक दुकान के लिए स्वयं के नाम से मात्र एक आवेदन प्रस्तुत किये जाने के लिए पात्र होगा।

(ङ) निम्नलिखित की पुष्टि में पब्लिक नोटरी द्वारा सम्यक रूप से अभिप्रमाणित शपथपत्र प्रस्तुत करेगा, अर्थात्ः-

(एक) यह कि समय-समय पर यथा संशोधित उत्तर प्रदेश आबकारी दुकानों की संख्या एवं स्थिति नियमावली, 1968 के उपबंधों के अनुसार उस स्थान पर दुकान खोलने हेतु उपयुक्त परिसर रखता है अथवा किराए पर उस स्थान पर उपयुक्त परिसर का प्रबन्ध कर सकता है।

(दो) यह कि दुकान के उसके प्रस्तावित परिसर के निर्माण में किसी विधि अथवा नियमों का उल्लंघन नह(cid:7277) किया गया है।

(तीन) यह कि उसका एवं उसके परिवार के सदस्यों का नैतिक चरित्र अ(cid:6994)छा है और उनकी कोई अपराधिक पृष्ठभूमि नह(cid:7277) है और संयुक्त प्रान्त आबकारी अधिनियम, 1910 या स्वापक ओषधि एवं मनःप्रभावी अधिनियम 1985 के अधीन द(cid:7003)डनीय किसी अपराध या किसी अन्य सं(cid:6980)ेय एवं गैर जमानती अपराध के लिए दोषसि(cid:7373) न किया गया हो।

लाइसेंस जारी होने के पूर्व प्रस्तुत करेगा कि उसका एवं उसके एवं उनकी कोई अपराधिक पृष्ठभूमि या आपराधिक इतिहास नह(cid:7277) है।

परिवार के सदस्यों का चरित्र अ(cid:6994)छा है एवं उनकी कोई अपराधिक पृष्ठभूमि या आपराधिक इतिहास नह(cid:7277) है।

गतिविधियों में लिप्त है तो उसे प्रदान किया गया लाइसेंस निरस्त कर दिया जायेगा।

अपराधिक गतिविधियों में लिप्त है तो उसे प्रदान किया गया लाइसेंस रदद् कर दिया जायेगा।

(नौ) यह है कि आवेदक बार काउसिंल में रजिस्ट्रीकृ त (नौ) यह है कि आवेदक बार काउसिंल में रजिस्ट्रीकृ त

(च) राज्य सरकार की पूर्व स्वीकृ ति से आबकारी आयुक्त द्वारा नियत धरोहर धनराशि का बैंक (cid:7071)ॉ(cid:7010)ट, जो सम्बन्धित दुकान के जिला के जिला आबकारी अधिकारी के नाम से बना हो, की स्कै न प्रति आँनलाइन आवेदन के साथ अपलोड (च) राज्य सरकार की पूर्व स्वीकृ ति से आबकारी आयुक्त द्वारा यथा निर्धारित धरोहर धनराशि का बैंक (cid:7071)ॉ(cid:7010)ट, जो सम्बन्धित दुकान के जिला के जिला आबकारी अधिकारी के नाम से बना हो, की स्कै न प्रति आनलाइन आवेदन के साथ अपलोड किया जायेगा।

(छ) लाइसेंसधारी के रूप में चयनित हो जाने की दशा में धरोहर धनराशि का बैंक (cid:7071)ा(cid:7010)ट चयन के प(cid:7391)ात् 48 घ(cid:7003)टे के भीतर सम्बन्धित जिला आबकारी अधिकारी के कार्यालय में जमा करना अनिवार्य होगा, जिसे दुकान की सभी (छ) लाइसेंसधारी के रूप में चयन हो जाने की दशा में धरोहर धनराशि का बैंक (cid:7071)ा(cid:7010)ट चयन के प(cid:7391)ात् 48 घ(cid:7003)टे के अन्दर सम्बन्धित जिला आबकारी अधिकारी के कार्यालय में जमा करना अनिवार्य होगा, जिसे दुकान की सभी देयताओं के भुगतान के उपरान्त वापस कर दिया जायेगा।

देयताओं के भुगतान के प(cid:7391)ात् वापस कर दिया जायेगा;

(ज) आवेदक ऋणशोधन क्षमता प्रमाण पत्र या प्राधिकृ त आयकर वैलुअर द्वारा जारी धारित सम्पत्ति प्रमाण-पत्र का धारक हो तथा उसकी ऋणशोधन क्षमता/प्राधिकृ त आयकर वैलुअर द्वारा जारी धारित सम्पत्ति प्रमाण-पत्र की मालियत जिला में आवेदित दुकान का लाइसेंस प्रदान करने के लिये अवधारित लाइसेंस फीस के समतुल्य धनराशि से कम नह(cid:7277) होगी। लाइसेंसधारी से यह अपेक्षा की जायेगी कि वह उस जिला में ऋणशोधन क्षमता प्रमाण-पत्र अथवा प्राधिकृ त आयकर वेल्युअर द्वारा जारी धारित संपत्ति प्रमाण-पत्र की मूल प्रति प्रस्तुत करे, जहां से उसे लाइसेंस स्वीकृ ति के समय (ज) आवेदक ऋणशोधन क्षमता प्रमाण पत्र या प्राधिकृ त आयकर वैलुअर द्वारा निर्गत धारित सम्पत्ति प्रमाण-पत्र का धारक हो तथा उसकी ऋणशोधन क्षमता/प्राधिकृ त आयकर वैलुअर द्वारा निर्गत धारित सम्पत्ति प्रमाण-पत्र की मालियत जिला में आवेदित दुकान का लाइसेंस प्रदान करने के लिये अवधारित लाइसेंस फीस के समतुल्य धनराशि से कम नह(cid:7277) होगी। लाइसेंसधारी से यह अपेक्षा की जायेगी कि वह उस जिले में ऋणशोधन क्षमता प्रमाण-पत्र अथवा प्राधिकृ त आयकर वेल्युअर द्वारा निर्गत धारित संपत्ति प्रमाण-पत्र की मूल प्रति प्रस्तुत करे, जहां से उसे लाइसेंस स्वीकृ ति के समय जारी किया गया है।

जारी किया गया है;

परन्तु नवीकरण की स्थिति में, गत वर्ष के (cid:7390)वस्थापन के दौरान प्रस्तुत किये गये ऋणशोधन क्षमता प्रमाण पत्र अथवा प्राधिकृ त आयकर मूल्यांकक द्वारा जारी सम्पत्ति स्वामित्व प्रमाण पत्र, यदि यह वैध एवं अपेक्षित धनराशि के परन्तु नवीकरण की स्थिति में, गत वर्ष के (cid:7390)वस्थापन के दौरान प्रस्तुत किये गये ऋणशोधन क्षमता प्रमाण पत्र अथवा प्राधिकृ त आयकर मूल्यांकक द्वारा जारी सम्पत्ति स्वामित्व प्रमाण पत्र, यदि यह वैध एवं अपेक्षित धनराशि के लिए है, प्रति(cid:7061)ा(cid:7405) होंगे।

भांग की फु टकर बि(cid:7059)ी के लाइसेंसधारियों के चयन हेतु एक जिला स्तरीय समिति होगी। समिति में निम्नलिखित 9-लाइसेंस के लिये जिला स्तरीय समिति - भांग की फु टकर बि(cid:7059)ी के अनु(cid:6980)ापियों के चयन हेतु एक जिला स्तरीय समिति होगी। समिति में निम्नलिखित

(एक)	जिला का कलेक्टर	अध्यक्ष
(दो)	जिला के वरिष्ठ पुलिस अधीक्षक/ संबंधित जिला के पुलिस अधीक्षक या सम् बन्धित पुलिस कमिशनरी के पुलिस आयुक् त द्वारा नाम नि᳸र्दष्ट एक अधिकारी, जो सहायक पुलिस आयुक् त से अनिम्न हो ,	सदस्य

10. लाइसेंसधारी का चयन -

(1) लाइसेंसधारियों का चयन आनलाइन आवेदन आमंत्रित कर राज्य सरकार द्वारा यथा विनि(cid:7416)र्दष्ट ई-लाटरी अथवा ई-टे(cid:7003)डर की प्र(िcid:7059)या के माध्यम से दुकानवार किया जायेगा। जिला आबकारी अधिकारी आनलाइन प्राप्त आवेदनों की पात्र एवं अपात्र की तैयार सूची ई-लाटरी एवं ई-टे(cid:7003)डर हेतु गठित जिला स्तरीय समिति के समक्ष रखे जाने के लिये अपात्रता के कारणों के उल्लेख सहित तैयार करेगा।

(1) लाइसेंसधारियों का चयन आनलाइन आवेदन आमंत्रित कर राज्य सरकार द्वारा यथा निर्धारित ई- लाटरी अथवा ई-टे(cid:7003)डर की प्र(िcid:7059)या के माध्यम से दुकानवार किया जायेगा। जिला आबकारी अधिकारी आनलाइन प्राप्त आवेदनों की पात्र एवं अपात्र की तैयार सूची ई-लाटरी एवं ई-टे(cid:7003)डर हेतु गठित जिला स्तरीय समिति के समक्ष रखे जाने के लिये अपात्रता के कारणों के उल्लेख सहित तैयार करेगा।

(2) उक्त समिति पात्र एवं अपात्र आवेदकों को चिन्हित करेगी। ई-लॉटरी की स्थिति में पात्र आवेदकों में से प्रत्येक दुकान के लिये लाइसेंसधारी का चयन कम्प्यूटर चलित यादृ(िcid:6994)छक विन्यास के माध्यम से किया जायेगा। यादृ(िcid:6994)छकीकरण प्र(िcid:7059)या सम्बन्धित नियम के अधीन विहित अनु(cid:7059)म के अनुसार फु टकर दुकानों की धरोहर धनराशि के अवरोही (cid:7059)म में अपनायी जायेगी। ई-टे(cid:7003)डर द्वारा लाइसेंसधारियों के चयन की स्थिति में भी पूव(cid:7299)क्त अनु(cid:7059)म का पालन किया जायेगा। किसी भी आवेदक के पक्ष में एक जिला में दो से अधिक भांग की फु टकर दुकानो का लाइसेंस नह(cid:7277) दिया जा सके गा।

(2) उक्त समिति आवंटन हेतु पात्र एवं अपात्र आवेदकों को चिन्हित करेगी। ई-लॉटरी की स्थिति में पात्र आवेदकों में से प्रत्येक दुकान के लिये लाइसेंसधारी का चयन कम्प्यूटर चलित यादृ(िcid:6994)छक विन्यास के माध्यम से किया जायेगा। यादृ(िcid:6994)छकीकरण प्र(िcid:7059)या सम्बन्धित नियम के अधीन विहित अनु(cid:7059)म के अनुसार फु टकर दुकानों की धरोहर धनराशि के अवरोही (cid:7059)म में अपनायी जायेगी। ई- टे(cid:7003)डर द्वारा लाइसेंसधारियों के चयन की स्थिति में भी उक्त अनु(cid:7059)म का पालन किया जायेगा। किसी भी आवेदक के पक्ष में एक जिला में दो से अधिक भांग की फु टकर दुकानो का लाइसेंस नह(cid:7277) दिया जा सके गा।

(3) यदि चयनित आवेदक अपेक्षित लाइसेंस फीस या प्रतिभूति धनराशि जमा नह(cid:7277) करेगा और विहित औपचारिकतायें पूरी नह(cid:7277) करेगा या नियत अवधि में दुकान हेतु उपयुक्त परिसर की (cid:7390)वस्था करने में अक्षम रहेगा तो लाइसेंस प्राधिकारी धरोहर धनराशि को जब्त करते (cid:7263)ये आवंटन को रद्द कर देगा और राज्य सरकार द्वारा विहित प्र(िcid:7059)या के माध्यम से दुकान के पुर्न(cid:7390)वस्थापन हेतु आवश्यक कार्यवाही करेगा।

(3) यदि चयनित आवेदक लाइसेंस फीस या प्रतिभूति धनराशि जमा नह(cid:7277) करेगा और विहित औपचारिकतायें पूरी नह(cid:7277) करेगा या नियत अवधि में दुकान हेतु उपयुक्त परिसर की (cid:7390)वस्था करने में अक्षम रहेगा तो लाइसेंस प्राधिकारी धरोहर धनराशि को जब्त करते (cid:7263)ये आवंटन को निरस्त कर देगा और शासन द्वारा विहित प्र(िcid:7059)या के माध्यम से दुकान के पुर्न(cid:7390)वस्थापन हेतु आवश्यक कार्यवाही करेगा।

(4) यदि किसी विशिष्ट दुकान के लिए कोई आवेदन पत्र प्राप्त न हो या किसी दुकान के लिए कोई अ(cid:7012)यर्थी उपयुक्त नह(cid:7277) पाया जाये तो लाइसेंस प्राधिकारी दुकान के पुर्न(cid:7390)वस्थापन हेतु राज्य सरकार द्वारा विहित प्र(िcid:7059)या के माध्यम से तत्काल उपाय करेगा।

(4) यदि किसी विशिष्ट दुकान के लिए कोई आवेदन पत्र प्राप्त न हो या किसी दुकान के लिए कोई अ(cid:7012)यर्थी उपयुक्त नह(cid:7277) पाया जाये तो लाइसेंस प्राधिकारी दुकान के पुर्न(cid:7390)वस्थापन हेतु शासन द्वारा विहित प्र(िcid:7059)या के माध्यम से तत्काल उपाय करेगा।

परन्तु यह कि पूव(cid:7299)क्त निर्बधंन राज्य सरकार द्वारा निर्धारित मानद(cid:7003)डों के अनुसार लाइसेंसों के नवीकरण एवं लाईसेंसधारी की मृत्यु की दशा में विधिक वारिस के पक्ष में लाईसेंस के नामान्तरण से सम्बन्धित मामलों के लिए लागू नह(cid:7277) होगा ,

परन्तु यह भी कि किसी आवेदक के पक्ष में सम्पूर्ण राज्य में दो या दो से अधिक दुकानों का नवीकरण होने की स्थिति में वह ई-लाटरी के माध्यम से अ(cid:7061)तर दुकानों के चयन हेतु अपात्र होगा।

12 -लाइसेंस फीस और प्रतिभूति धनराशि का संदेय यदि किसी आवेदक को लाइसेंसधारी के (cid:7271)प में चयनित किया जाता है तो, वह अपने चयन की सूचना की प्राप्ति के तीन कार्य दिवसों के भीतर लाइसेंस फीस की सम्पूर्ण धनराशि जमा करेगा। उससे यह अपेक्षा की जायेगी कि वह प्रतिभूति धनराशि का आधा भाग अपने चयनित होने की सूचना के दस कार्यदिवसों के भीतर और अवशेष प्रतिभूति धनराशि अपने चयन होने की सूचना के बीस कार्य दिवसों के भीतर जमा कर दें। आवेदक द्वारा लाइसेंस फीस का समस्त भुगतान अधिमानतः ई-पेमेन्ट के माध्यम से किया जायेगा।

12 -लाइसेंस फीस और प्रतिभूति धनराशि का भुगतान यदि किसी आवेदक को लाइसेंसधारी के (cid:7271)प में चयनित किया जाता है तो वह अपने चयन की सूचना की प्राप्ति के 03 कार्य दिवसों के भीतर लाइसेंस फीस की सम्पूर्ण धनराशि जमा करेगा। उससे यह अपेक्षा की जायेगी कि वह प्रतिभूति धनराशि का आधा भाग अपने चयनित होने की सूचना के 10 कार्यदिवसों के भीतर और अवशेष प्रतिभूति धनराशि अपने चयन होने की सूचना के 20 कार्य दिवसों के भीतर जमा कर दें। आवेदक द्वारा लाइसेंस फीस का समस्त भुगतान अधिमानतः ई-पेमेन्ट के माध्यम से किया जायेगा। प्रतिभूति धनराशि सावधि जमा रसीद के माध्यम से जिला आबकारी अधिकारी के पक्ष में गिरवीकृ त अथवा ई-पेमे(cid:7003)ट द्वारा जमा की जायेगी।

प्रतिभूति धनराशि सावधि जमा रसीद/बैंक गारंटी के माध्यम से जिला आबकारी अधिकारी के पक्ष में गिरवीकृ त अथवा ई- पेमे(cid:7003)ट द्वारा जमा की जायेगी।

परन्तु, यदि वह विहित अवधि के भीतर लाइसेंस फीस या यदि वह विहित अवधि में लाइसेंस फीस और प्रतिभूति धनराशि जमा करने में विफल रहता है तो उसका चयन प्रतिभूति धनराशि जमा करने में विफल रहता है तो उसका चयन रद्द हो जायेगा;

निरस्त हो जायेगा और उसकी धरोहर धनराशि, लाइसेंस

परन्तु यह और कि ई लाटरी/ई टे(cid:7003)डर के माध्यम से लाइसेंस (cid:7018)यवस्थित होने की दशा में, उसकी धरोहर धनराशि तथा

लाइसेंस फीस और प्रतिभूति धनराशि, यदि उसके द्वारा जमा की गयी है, तथा लाइसेंस के नवीकृ त होने की दशा में उसकी गत वर्ष फीस और प्रतिभूति धनराशि, जो उसके द्वारा जमा की गयी हो, राज्य सरकार के पक्ष में समप(cid:7265)त कर ली जायेगी और उक्त दुकान को तत्काल राज्य सरकार द्वारा यथा विहित तरीके से पुर्न(cid:7390)वस्थापित कर दिया जायेगा।

की जमा प्रतिभूति का पन्(cid:7076)ह प्रतिशत तथा नवीकरण फीस व लाइसेंस फीस, यदि उसके द्वारा जमा की गयी हो, राज्य सरकार के पक्ष में समप(cid:7265)त कर ली जायेगी और उक्त दुकान को तत्काल

20- दुकानों का अन्तरिम (cid:7390)वस्थापन -

(1) इन नियमों के उपबन्धों के अनुसार किसी लाइसेंस के निलम्बन, निरस्तीकरण, अ(cid:7012)यर्पण या अन्य किसी कारण से दुकान अ(cid:7390)वस्थित होने के मामले में लाइसेंस प्राधिकारी सरकार की पूर्व स्वीकृ ति से आबकारी आयुक्त द्वारा यथा अधिसूचित ऐसी दरों पर दैनिक लाइसेंस फीस और समानुपातिक प्रतिफल शुल्क (अर्थात दैनिक न्यूनतम प्रत्याभूत मात्रा में निहित प्रतिफल शुल्क), जो कि एक बार में अधिकतम चौदह दिनों की अवधि या नियमित (cid:7390)वस्थापन के दिनांक तक इसमें से जो भी पहले हो, के लिए होगी, के भुगतान पर दुकान का अन्तरिम (cid:7390)वस्थापन सव(cid:7299)(cid:7340) आफर पर कर सकता है। एक दुकान के लिये दो या दो से अधिक समान आफर प्राप्त होने के मामले में सार्वजनिक मैनुअल लाटरी के माध्यम से (cid:7390)वस्थापन कराया जायेगा। ऐसे लाइसेंसधारी को अन्तरिम (cid:7390)वस्थापन की अवधि में निहित प्रतिफल फीस तथा लाइसेंस फीस के योग की1/6 धनराशि के बराबर की प्रतिभूति धनराशि जमा करना होगा।

परन्तु लाइसेंस प्राधिकारी आबकारी आयुक्त को पूर्व सूचना दिये बिना दुकान का अन्तरिम (cid:7390)वस्थापन दो बार से अधिक नह(cid:7277) करेगा।

(2) इस नियमावली के उपबन्धों के अनुसार किसी लाइसेंस के निरस्तीकरण या अ(cid:7012)यर्पण के मामले में दुकान का मध्य-सत्र में नियमित (cid:7390)वस्थापन लाइसेंस प्राधिकारी द्वारा शी(cid:7062)ातिशी(cid:7062) सार्वजनिक वि(cid:6980)ापन देकर ई-टे(cid:7003)डर प्रणाली के माध्यम से कराया जायेगा। उक्त (cid:7390)वस्थापन की सूचना आबकारी आयुक्त को तत्काल प्रेषित किया जाना होगा।

(2) इस नियमावली के उपबन्धों के अनुसार किसी लाइसेंस के निरस्तीकरण या अ(cid:7012)यर्पण के मामले में दुकान का मध्यसत्र में नियमित (cid:7390)वस्थापन लाइसेंस प्राधिकारी द्वारा शी(cid:7062)ातिशी(cid:7062) सार्वजनिक वि(cid:6980)ापन देकर ई-टे(cid:7003)डर प्रणाली के माध्यम से कराया जायेगा। उक्त (cid:7390)वस्थापन की सूचना आबकारी आयुक्त को तत्काल प्रेषित किया जाना होगा।

यह लाइसेंस निम्नलिखित निबन्धन व शत(cid:7300) के अधीन रहते (cid:7263)ए प्रदान किया जाता है, इसमें से किसी का (cid:7390)ति(cid:7059)म करने अथवा उत्तर प्रदेश आबकारी (भांग के फु टकर लाइसेंसों का (cid:7390)वस्थापन) नियमावली, 2019 के नियम-21 में व(cid:7414)र्णत उपबंधों का उल्लंघन करने पर अथवा उत्तर प्रदेश आबकारी अधिनियम, 1910 अथवा स्वापक ओषधि एवं मनः प्रभावी पदार्थ अधिनियम 1985 की विधियों के अधीन किसी अपराध के लिए दोषसि(cid:7373) होने पर लाइसेंस धारक का लाइसेंस निरस्त हो जायेगा और सुसंगत विधियों के अधीन अधिरोपित किन्ह(cid:7277) शास्तियों के अतिरिक्त प्रतिभूति निक्षेप समप(cid:7265)त कर ली जायेगी।

निबन्धन एवं शत(cid:7287)

1-नियम-13 के उपबन्धों के अनुसार लाइसेंसधारी भांग के लागत मूल्य को आर0टी0जी0एस0 द्वारा एवं प्रतिफल फीस अधिमानतः ई- पेमेन्ट के द्वारा जमा करने के प(cid:7391)ात् भांग का उठान जिला के बंधित भांडागार अथवा प्राधिकृ त बंधित भांडागार से करेगा। 1-नियम-13 के उपबन्धों के अनुसार लाइसेंसधारी भांग के लागत मूल्य को आर0टी0जी0एस0 द्वारा एवं प्रतिफल शुल्क अधिमानतः ई-पेमेन्ट के द्वारा जमा करने के प(cid:7391)ात् भांग का उठान जिला के बंधित गोदाम अथवा प्राधिकृ त बंधित गोदाम से करेगा। 2-नियम-14 के उपबन्धों के अनुसार लाइसेंसधारी को प्रतिफल शुल्क की मासिक किस्त माह की 20व(cid:7277) तारीख तक जमा करनी होगी।

2-नियम-14 के उपबन्धों के अनुसार लाइसेंसधारी को प्रतिफल फीस की मासिक किस्त माह की 20व(cid:7277) तारीख तक जमा करनी होगी।

3-भांग की बि(cid:7059)ी खुले अथवा पिसी गोली के (cid:7271)प में करेगा। लाइसेंसधारी को किसी भी (cid:7390)क्ति को 120 (cid:7061)ाम से ज्यादा भांग की बि(cid:7059)ी की अनुमति नही होगी।

4-भूगृहादि के बाहर उपभोग के लिए भांग की बि(cid:7059)ी की 4-परिसर के बाहर उपभोग के लिए भांग की बि(cid:7059)ी की

जायेगी।

5- लाइसेंसधारी यथा विहित प्रपत्र और रजिस्टर में नियमित और सही-सही दैनिक लेखा रखेगा और उसे आबकारी पोर्टल पर भी अपलोड करेगा। जब कभी सक्षम निरीक्षण प्राधिकारी द्वारा मांगा जायेगा, तो उक्त लेखा रजिस्टर को प्रस्तुत करेगा। 5- लाइसेंसधारी यथा विहित प्रपत्र और रजिस्टर में नियमित और सही-सही दैनिक लेखा रखेगा और उसे आबकारी पोर्टल पर भी अपलोड करेगा। जब कभी सक्षम निरीक्षण प्राधिकारी द्वारा मांगा जायेगा, तो उक्त लेखा रजिस्टर को प्रस्तुत करेगा।

6-भांग की फु टकर बि(cid:7059)ी को छोड़कर, जिसके लिए कि लाइसेंस दिया गया है, लाइसेंसधारी को लाइसेंस प्राप्त परिसर में कोई अन्य (cid:7390)वसाय चलाने की अनुमति नह(cid:7277) दी जायेगी। 6-भांग की फु टकर बि(cid:7059)ी को छोड़कर, जिसके लिए कि लाइसेंस दिया गया है, लाइसेंसधारी को लाइसेंस प्राप्त परिसर में कोई अन्य (cid:7390)वसाय चलाने की अनुमति नह(cid:7277) दी जायेगी।

NOTIFICATION

In exercise of the powers conferred under section 41 of the United Provinces Excise Act, 1910 (U.P. Act No. IV of 1910), read with section 21 of the Uttar Pradesh General Clauses Act, 1904 (U.P.Act. no.1 of 1904) the Excise Commissioner, Uttar Pradesh with the previous sanction of the State Government makes the following rules with a view to amending the Uttar Pradesh Excise (Settlement of licenses for Retail Sale of Bhang) Rules, 2019 published vide Excise Commissioner notification no. 26743/X-Licence 185 /2018-2019/ Prayagraj: January 29, 2019.

THE UTTAR PRADESH EXCISE (SETTLEMENT OF LICENSES FOR RETAIL SALE OF BHANG) (SECOND AMENDMENT) RULES, 2022

1. Short title and Commencement–(1) These rules may be called the Uttar Pradesh Excise (Settlement of licenses for Retail Sale of Bhang) (Second Amendment) Rules, 2022.

(2) They shall come into force from the date of their publication in the Gazette.

2. Amendement of rule-2–In the Uttar Pradesh Excise (Settlement of licenses for Retail Sale of Bhang) Rules, 2019, hereinafter referred to as the said rules, for rule 2 set out in Column-I below, the rule as set out in Column-II shall be substituted, namely:-

However, if any license is granted after the commencement of the excise year then its annual minimum guaranteed quantity shall be reduced proportionately according to the number of days remaining in the excise year;

(c)"Consideration fee" means that part of consideration for the grant of license for the exclusive privilege of retail sale of bhang under section 24 of the Act, payable by the person selected as licensee before lifting of bhang for the whole excise year or part thereof on such rates per kilogram as notified by the Excise Commissioner in consultation with the State Government from time to time:

Provided, if settlement is done in mid-session the consideration fee shall be in proportion to the remainder part of the Excise Year.

(d) "Bhang" means the leaves and small stalks of hemp

plant (Cannabis Sativa ), known as bhang;

(d) "Consideration fee" means that part of consideration for the grant of license for the exclusive privilege of retail sale of bhang under section 24 of the Act, payable by the person selected as licensee before lifting of bhang for the whole excise year or part thereof on such rates per kilogram as notified by the Excise Commissioner in consultation with the State Government from time to time;

(h)"Earnest money" means the amount equal to 1/10thpart of license fee, to be tendered with application form, for ensuring the fulfillment of the eligibility conditions for the grant of license and is liable to be forfeited in case of default under provisions of rule-12 of these rules;

(i) "Form" means the form, appended to these rules;

(i) "Family" means and includes spouse (husband or wife), dependent son(s), unmarried daughter (s) and dependent parents;

(j) "Form" means the form, appended to these rules;

(j) "Licensing authority" , means the Collector of the District;

(k) "Hierarchy" means the earnest money of shops in the descending order purported to be the basis for the selection of licensee through the process of e-lottery;

(k) "License Fee" means the consideration fee leviable for grant of license for exclusive privilege of retail sale of Bhang under section 24 of the Act, payable by the licensee before license is granted, in addition to consideration fee, for the whole excise year or part thereof on such rates as notified by the Excise Commissioner in consultation with the State Government from time to time;

(l) 'Individual' means a person who is the citizen of India not below the age of twenty-one years at the time of making application;

(l)"Monthly installment of consideration fee" means 1/12thpart of the annual consideration fee fixed by the licensing authority, which shall be payable every month;

(m) "Licensing authority" , means the Collector of

the District;

(m) "Monthly minimum guaranteed quantity":- Annual minimum guaranteed quantity shall be divided in 12 equal parts. Quantity obtained as a result of these calculations shall be deemed to be monthly minimum guaranteed quantity;

(n) "Security amount" means 1/6th part of sum of annual consideration fee and the license fee, which shall be payable in the form of Fixed Deposit Receipt pledged in favour of District Excise Officer or through e-payment refundable after the final settlement of all the claims and dues to the State Government;

(n) "License Fee" means the consideration fee leviable for grant of license for exclusive privilege of retail sale of Bhang under section 24 of the Act, payable by the licensee before license is granted, in addition to consideration fee, for the whole excise year or part thereof on such rates as notified by the Excise Commissioner in consultation with the State Government from time to time;

Provided in case of renewal security deposited prior in cash or through national saving certificate (N.S.C) shall be acceptable till it is not refunded .

(o) "Monthly installment of consideration fee" means 1/12thpart of the annual consideration fee fixed by the licensing authority, which shall be payable every month;

(p) "Hierarchy" means the earnest money of shops in the descending order purported to be the basis for the selection of licensee through the process of e-lottery;

(q) "Portal" means the specifically created electronic platform where on information in the prescribed form with regard to the process of settlement of retail shops of bhang shall be uploaded;

(q) "Portal" means the electronic platform created specifically for the purpose of uploading information in the prescribed form with regard to the process of manufacturing liquor up to the terminal stage of its distribution;

(r) "Solvency" means financial eligibility criteria set for an applicant applying for the grant of retail license which shall be equivalent to not less than license fee determined for any shop;

(r) "Security amount" means 1/6th part of sum of annual consideration fee and the license fee, which shall be payable in the form of Fixed Deposit Receipt/Bank Guarantee pledged in favour of District Excise Officer or through e- payment refundable after the final settlement of all the claims and dues to the State Government; Provided in case of renewal security deposited prior in cash or through national saving certificate (N.S.C) shall be acceptable till it is not refunded;

(t) "Settlement" means settlement or re-settlement of shops through the medium of e-lottery at fixed fee or through the process of e-tender by inviting offer which may take place on any day of the week by giving prior notice and intimation through the newspaper and website of the excise department. The settlement of shops for the forthcoming year may also be done prior to the cessation of preceding financial year;

(2) Words and expressions not defined in these rules but defined in the Act shall have the meanings respectively assigned to them in the Act.

3. Amendment of rule 6-- In the said rules, for existing rule 6 set out in Column-I below, the rule as set out

6- Grant of License-

The license shall be issued on payment of license fee preferably through e-payment platform and deposit of security amount through Fixed Deposit Receipt pledged in favour of District Excise Officer or through e-payment in accordance with the provisions of these rules.

The licensee shall be required to furnish the solvency certificate or certificate of owned property issued by an authorized Income Tax Valuer in original copy in the district from where it has been issued at the time of grant of license.

Provided that in case of renewal security deposited prior in cash or through National Saving Certificate (N.S.C.) shall be acceptable till it is not refunded and the solvency certificate or certificate of owned property issued by an authorized Income Tax Valuer during the settlement of previous year shall be acceptable if it is valid and is for the required amount.

4-Amendment of rule-8-- In the said rules, for existing rule 8 set out in Column-I below, the rule as set out

8- Eligibility conditions for applicants-- Eligible applicants for license of a retail bhang shop must fulfill following conditions namely-

(a) be a citizen of India, but whole sale supplier of bhang shall be not eligible for holding license of any retail shop. No change in the status of applicant shall be allowed after allotment of shop.

Provided, in the event of death of licensee, his/her legal heir, if otherwise eligible, may continue to hold the license for the remaining period of the license;

(c) not be defaulter/blacklisted or debarred from holding an excise license under the provisions of any rules made under act. Any person who has been convicted of any excise offence by any court of law unless fully and finally acquitted shall be automatically debarred from holding the license;

(iii) that he and his family members possess good moral character and have no criminal background nor have been convicted of any offence punishable under United Provinces Excise Act. 1910 or Narcotics Drugs and Psychotropic Substances Act, 1985 or any other cognizable and non-bailable offence;

(iv) that in case of being selected as licensee he will furnish a certificate issued by Senior Superintendent/ Superintendent of Police of the district of which he is resident, showing that he as well as his family members possess good moral character and have no criminal background or criminal record prior to issuance of license.

(iv) that in case of being selected as licensee he will furnish a certificate issued by the District Collector or Superintendent of Police/Senior Superintendent of Police of the concerned district or an officer not below the rank of assistant commissioner of police nominated by the police commissioner of the concerning police Commissionerate of the district of which he is resident, showing that he as well as his family members possess good moral character and have no criminal background or criminal record prior to issuance of license;

(v) that he shall not employ any salesmen or representative who has criminal background as mentioned in clauses (iii) or who suffers from any infectious diseases or is below twenty-one years of age or a woman. Licensee shall have to obtain Identity Cards bearing photographs of his authorized salesman / representative from District Excise Officer.

(vi) that he is not in arrear of any public dues or (vi)that he is not in arrear of any public dues or Government dues.

(vii) that he is solvent and has the necessary funds or has made arrangements for the necessary funds, for conducting the business, the details of which shall be made available to the licensing authority if required.

(viii) that applicant is not involved in mafia activities, anti social activities and organized offensive activities. If after issuance of license it is proved that he is involved in mafia activities, anti social activities and organized offensive activities then the allotted license shall be cancelled.

(ix) that applicant is not an advocate registered with Bar Council. If he is found registered advocate after getting the license then the license shall be cancelled. An employee of the Government shall also be ineligible to apply for the grant of license.

(x) that in case of being selected as licensee, bank drafts of earnest money which has been uploaded online along with application shall be deposited by him in the office of District Excise Officer within 48 hours after selection.

(x)that in case of being selected as licensee, bank drafts of earnest money which has been uploaded online along with application shall be deposited by him in the office of District Excise Officer within 48 hours after selection;

(xi) that he has not made use of the bank drafts of earnest money in making application for any other shop in the same phase.

(f) That he shall upload a scanned copy of bank draft of earnest money issued in favour of District Excise Officer of the district of the concerned shop along with online application as may be fixed by the Excise Commissioner with the prior sanction of the State Government.

(g) In case of being selected as licensee, it shall be necessary to deposit bank draft of earnest money in the office of the concerned District Excise Officer within 48 hours after selection, which shall be refunded to applicant after payment of all dues.

(h) That he is holder of solvency certificate or certificate of owned property issued by Income Tax valuer and the worth of solvency or certificate of owned property issued by Income Tax valuer shall be equivalent to not less than the amount of license fee determined for the grant of license of applied shop in the district. Licensees shall be required to submit the original copy of solvency certificate or certificate of owned property issued by Income Tax valuer in that district from where it has been issued at the time of grant of license:

Provided, in case of renewal, solvency certificate or certificate of owned property issued by an authorized Income Tax Valuer produced during the settlement of previous year shall be acceptable if it is valid and is for the required amount.

5. Amendment of rule-9-- In the said rules, for existing rule 9 set out in Column-I below, the rule as set out in Column-II shall be substituted, namely:-

9. District Level Committee for Licensing-

There shall be a District Level Committee for selection of licensees for retail sale of Bhang. The committee shall consist of the following members, namely-

6. Ammendement of rule 10--In the said rules, for existing rule 10 set out in Column-I below, the rule as set out in Column-II shall be substituted, namely:-

10- Selection of licensee- (1) Licensees shall be selected shop wise through the process of e-lottery or e-tender, as specified by the State Government, through inviting online applications. District Excise Officer shall scrutinize the applications received online and prepare list of all eligible and ineligible applications, describing the reasons of ineligibility and shall put up this list before the District Level Committee of Licensing constituted for e-lottery and e-tender.

(2) The said committee shall identify eligible and ineligible applicants. In case of e-lottery the licensee shall be selected for each shop from amongst the eligible applicants through the computer driven randomized arrangement. Randomization process shall be adopted in the descending order of earnest money of retail shop as per prescribed hierarchy under respective rule. In case of selection of licensee through e-tender the same aforesaid sequence shall be adopted. Not more than two bhang shops shall be allotted in favour of an applicant in the district.

(3) In case, the selected applicants does not deposit the required license fee or security amount and does not fulfill the prescribed formalities or is unable to arrange suitable premises for the shop within the stipulated period, the Licensing Authority shall cancel the allotment and take steps for resettlement of the shop through the process as prescribed by the State Government.

(4) In case, no application is received for a particular shop or no candidate is found suitable for a shop, the Licensing Authority shall take immediate steps for resettlement of the shop through the process as prescribed by the State Government.

Provided that aforesaid restriction shall not be applicable to matter related to renewal of licenses and mutation of licence in favor of legal heir in the event of death of licencee as per the criteria laid down by the State Government:

Provided also that in case of renewal of two or more shops in favour of any applicant in the entire State, he will be ineligible for selection of further shops through e- lottery.

7. Amendment of rule-12-- In the said rules, for existing rule 12 set out in Column-I below, the rule as set out in Column-II shall be substituted, namely:-

12-Payment of License fee & Security amount-In case an applicant is selected as licensee, he shall deposit the entire amount of license fee within three working days of being intimated of his selection. He shall be required to deposit half of the security amount within ten working days of intimation of his selection and balance of the security amount within twenty working days of intimation of his selection. Entire amount of license fee shall be deposited by the applicant preferably through e-payment. Security amount shall be deposited through Fixed Deposit Receipt pledged in favour of District Excise Officer or through e-payment.

12-Payment of License fee and Security amount-In case an applicant is selected as licensee, he shall deposit the entire amount of license fee within three working days of being intimated of his selection. He shall be required to deposit half of the security amount within ten working days of intimation of his selection and balance of the security amount within twenty working days of intimation of his selection. Entire amount of license fee shall be deposited by the applicant preferably through e-payment. Security amount shall be deposited through Fixed Deposit Receipt/Bank Guarantee pledged in favour of District Excise Officer or through e-payment: Provided, if he fails to deposit the amount of license fee and security amount within prescribed period, his selection shall stand cancelled:

If he fails to deposit the amount of the license fee and security amount within prescribed period, his selection shall stand cancelled and his earnest money and license fee as well as the security amount deposited by him, shall be forfeited in favor of State Government and the said shop shall be resettled forthwith in manner as prescribed by the State Government.

Provided further that in case of licence being settled through the e-lottery/ e-tender, his earnest money and license fee as well as the security amount, if deposited by him, and in case of licence being renewed, fifteen percent of security amount of last year along with renewal fee and licence fee, if deposited by him, shall also be forfeited in favour of State Government and the said shop shall be resettled forthwith, in manner as prescribed by the Government.

8. Amendment of rule-20-- In the said rules, for existing rule 20 set out in Column-I below, the rule as set out in Column-II shall be substituted, namely:-

(Rule as hereby substituted ) 20- Interim Settlement of shop- (1) In case a license is suspended, cancelled or surrendered in accordance with the provisions of these rules or if the shop remains unsettled for any reasons the licensing authority may make interim settlement of the shop at the highest offer on the payment of daily license fee on such rates as notified by the Excise Commissioner with the prior sanction of the Government and proportionate consideration fee (i.e. consideration fee involved in the daily minimum guaranteed quantity) for a maximum period of fourteen days at one stretch or till the date of regular settlement, whichever is earlier. In case of obtaining two or more equal offers for one shop, settlement shall be done through manual public lottery. Such licensee shall also be required to deposit security amount equivalent to 1/6th of the sum of consideration fee and license fee involved in the period of interim settlement.

Such settlement of shop can be done more than twice by the licencing authority, but in such situation it will be essential to inform the Excise Commissioner. Provided that the licensing authority shall not make interim settlement of the shop for more than two times without prior intimation to the Excise Commissioner.

(2) In case any license is cancelled or surrendered in accordance with the provisions of these rules, regular settlement of the shop shall be done as soon as possible by the Licensing Authority through the process of e-tender in mid-session after giving public advertisement. The intimation of aforesaid settlement shall be sent forthwith to the Excise Commissioner.

The License is subject to the following terms and conditions the infraction of any of which or violation of the provisions as expounded in Rule-21 of U.P. Excise (Settlement of licenses for retail sale of Bhang) Rules- 2019 or conviction for any offence under the U.P. TERMS AND CONDITIONS

1. According to provisions of Rule-13 the licensee shall lift the quantity of bhang from the bonded warehouse of the district or entitled bonded warehouse after making payment of cost price through RTGS and consideration fee preferably through e-payment.

3. Bhang shall be sold in loose or in form of grounded pellets. The licensee shall not be allowed to sell more than 120 gram bhang to any person.

The license premises shall remain open for sale on all days from 10.00 A.M. to 10 P.M. , except on 14th April (Ambedkar Jayanti), 15th August (Independence Day), 2nd October (Gandhi Jayanti), 26th January (Republic Day) and up to 3 more days as notified for closures by the Licensing Authority. Licensing Authority may also order closure of shop on account of law and order or General Election related activity etc. under the provisions of relevant laws. No compensation shall be given for the closure of shop on above dates/days.

10. The Licensee shall not employ any person as salesman who is below 21 years of age or is suffering from any infectious diseases or has criminal background or a woman. The Licensee shall have to obtain identity cards of the salesmen bearing their photographs duly issued by the District Excise Officer, which shall be produced as and when demanded by inspecting authorities.

17. The licensee shall submit the list of salesmen to the district excise officer for sale of liquor at his shop. The district excise officer shall issue Naukarnama in prescribed form accordingly.
