IN pursuance of the provisions of clause (3) of Article 348 of the Constitution of India, the Governor is pleased to order the publication of the following English translation of the Intermediate Shiksha (Sanshodhan) Adhiniyam, 2022 (Uttar Pradesh Adhiniyam Sankhya 10 of 2022) as passed by the Uttar Pradesh Legislature and assented to by the Governor on September 29, 2022. The Madhyamik Shiksha Anubhag-7 is administratively concerned with the said Adhiniyam.
THE INTERMEDIATE EDUCATION (AMENDMENT) ACT, 2022

AN
ACT
further to amend the Intermediate Education Act, 1921.
IT IS HEREBY enacted in the Seventy third Year of the Republic of India as
follows :–
1. (1) This Act may be called the Intermediate Education (Amendment) Short title and commencement Act, 2022.
(2) It shall be deemed to have come into force with effect from September 6,
2022.
Amendment of 2. For sub-section (4) of section 7 of the Intermediate Education Act, 1921, the
section 7 of following sub-section shall be substituted, namely :–
"To recognize new self-financed High Schools and Intermediate Colleges for
U.P. Act no. 2 of 1921
the purposes of its examination, after the prior approval of the State Government:
Provided that notwithstanding anything contained in this Act, nothing in the
Uttar Pradesh High School and Intermediate Colleges (Payment of Salaries of Teachers
and other Employees) Act, 1971 or the Uttar Pradesh Secondary Education Services
Board Act, 1982, shall apply in relation to the new self-financed school granted
recognition under this sub-section."
3. (1) The Intermediate Education (Amendment) Ordinance,
Repeal and saving
U.P. Ordinance no. 7 of 2022
2022 is hereby repealed.
(2) Notwithstanding such repeal, anything done or any action taken under the provisions of the principal Act as amended by the Ordinance referred to in sub-section (1) shall be deemed to have been done or taken under the corresponding provisions of the principal Act as amended by this Act as if the provisions of this Act were in force at all material times.

4 mRrj izns'k vlk/kkj.k xtV] 29 flrEcj] 2022STATEMENTS OF OBJECTS AND REASONS
The Intermediate Education Act, 1921 (U.P. Act no. 2 of 1921) has been enacted to establish a Board of High School and Intermediate Education to regulate and supervise the system of High School and Intermediate Education in the State and the matters connected therewith or incidental thereto. The powers of the Board are mentioned in section 7 of the aforesaid Act. In the year 1987, a new section 7-A was inserted, clause (a) whereof provided that the Board, may, with the prior approval of the State Government recognize an institution in any new subject or group of subjects or for a higher class. In pursuance of the said section new schools were being given recognition by the Board. The Hon'ble High Court in Special Appeal No. 25/2006 (Manju Awasthi and Ors Vs State of Uttar Pradesh and Ors) clarified that section 7-A (a) does not actually provide the Board with the power to recognize new self financed schools.
In view of the above, to remove the said discrepancy, It was decided to amend section 7 of the aforesaid Act.
Since the State Legislature was not in session and immediate legislative action was necessary to implement the aforesaid decision, the Intermediate Education (Amendment) Ordinance, 2022 (U.P. Ordinance no. 7 of 2022) was promulgated by the Governor on September 6, 2022.
This Bill is introduced to replace the aforesaid Ordinance.
