संविधान के अनु(cid:6994)छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करके राज्यपाल, उत्तर प्रदेश विकलांग कल्याण विभाग अध्यापक सेवा नियमावली, 2000 में संशोधन करने की दृष्टि से निम्नलिखित नियमावली बनाती हैं ।

संक्षिप्त नाम 1–(1) यह नियमावली उत्तर प्रदेश दि(cid:7018)यांगजन सशक्तिकरण विभाग अध्यापक सेवा (चतुर्थ

और प्रारम्भ संशोधन) नियमावली, 2022 कही जायेगी।

(2) यह तुरन्त प्रवृत्त होगी।

साधारण

संशोधन सहित यथा संशोधित) जिसे आगे उक्त नियमावली कहा गया है में, उद्देशिका और दीर्घनाम

सहित शब्द ''विकलांग'', ''विकलांग कल्याण तथा विकलांग जन विकास विभाग अथवा नि:शक्तजन

सशक्तिकरण विभाग'' जह(cid:7292) कह(cid:7277) आये हों, के स्थान पर शब्द ''दि(cid:7018)यांगजन'', ''दि(cid:7018)यांगजन

सशक्तिकरण'' तथा दि(cid:7018)यांगजन सशक्तिकरण विभाग या दि(cid:7018)यांगजन सशक्तिकरण विभाग (cid:7059)मश: रख

दिये जायेंगे।

नियम 3 का

3–उक्त नियमावली में, नीचे स्तम्भ-1 में दिये गये विद्यमान नियम-3 के उपनियम (ख) संशोधन

के स्थान पर स्तम्भ-2 में दिया गया नियम रख दिया जायेगा, अर्थात् :-

नये उप नियम का

4–उक्त नियमावली में, विद्यमान नियम-3 के उपनियम (ट) के पश्चात् निम्नलिखित बढाया जाना

उपनियम (ठ) दिया जायेगा, अर्थात् – ''ठ'' 'अधीनस्थ आयोग' का तात्पर्य उत्तर प्रदेश अधीनस्थ सेवा चयन आयोग से है।

नियम 5

5– नियमावली में, नीचे स्तम्भ-1 में दिये गये विद्यमान नियम (5) के उप नियमों 1,

का प्रतिस्थापन

2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13 और 14 के स्थान पर स्तम्भ-2 में दिये गये नियम रख

माध्यमिक विद्यालय–

(एक) दस प्रतिशत मौलिक रूप से नियुक्त (एक) दस प्रतिशत मौलिक रूप से नियुक्त

प्रधानाचार्य, स्पर्श दृष्टिबाधित हाईस्कू ल, दृष्टिबाधित हाईस्कू ल के प्रधानाचार्य में से,

प्रधानाचार्य संके त मूक बधिर विद्यालय हाईस्कू ल जिन्होंने भर्ती के वर्ष के प्रथम दिवस को इस रूप

और प्रधानाचार्य प्रयास शारीरिक रूप से अक्षम में पन्(cid:7076)ह वर्ष की सेवा पूरी कर ली हो, और

विद्यालय हाईस्कू ल में से, जिन्होंने भर्ती वर्ष के भारत में विधि द्वारा स्थापित किसी

प्रथम दिवस को इस रूप में बारह वर्ष की सेवा विश्वविद्यालय से स्नातकोत्तर उपाधि रखता

पूरी कर ली हो, और भारत में विधि द्वारा हो, चयन समिति के माध्यम से पदोन्नति द्वारा।

स्थापित किसी विश्वविद्यालय से स्नातकोत्तर

उपाधि धारित करते हों तथा प्रधानाचार्य, स्पर्श

दृष्टिबाधित राजकीय इ(cid:7003)टर कालेज के लिये

सरकार द्वारा मान्यता प्राप्त किसी संस्था से

विशिष्ट शिक्षा (क्षीण दृष्टि) में डि(cid:7061)ी/डिप्लोमा के

साथ ब्रेल लिपि का (cid:6980)ान धारित करते हों, चयन

समिति के माध्यम से पदोन्नति द्वारा।

(दो) नब्बे प्रतिशत मौलिक रूप से नियुक्त दृष्टिबाधित राजकीय इ(cid:7003)टर कालेज के

(दो) नब्बे प्रतिशत मौलिक रूप से नियुक्त स्पर्श दृष्टिबाधित राजकीय इ(cid:7003)टर कालेज के प्रवक्ताओं/समेकित विशेष माध्यमिक विद्यालयों

विद्यालय (हाईस्कू ल)-

(एक) पचास प्रतिशत मौलिक रूप से नियुक्त संके त मूक और बधिर जूनियर हाईस्कू ल के

मौलिक रूप से नियुक्त मूक और बधिर जूनियर हाईस्कू ल के प्रधानाचाय(cid:7300) में से जिन्होंने भर्ती के वर्ष के प्रथम दिवस को इस रूप में चौदह प्रधानाचाय(cid:7300) में से, जिन्होंने भर्ती वर्ष के प्रथम

वर्ष की सेवा पूरी कर ली हो, चयन समिति के दिवस को इस रूप में दस वर्ष की सेवा पूरी कर

माध्यम से पदोन्नति द्वारा।

विद्यालयों में से, जिन्होंने भर्ती वर्ष के प्रथम दिवस

को इस रूप में दस वर्ष की सेवा पूरी कर ली हो,

और जो भारतीय पुनर्वास परिषद,

(आर0सी0आई0) भारत सरकार द्वारा मान्यता प्राप्त किसी संस्था से विशिष्ट शिक्षा

((cid:7088)वणक्षीणता) में डिप्लोमा धारित करते हों,

चयन समिति के माध्यम से पदोन्नति द्वारा।

(4) प्रधानाचार्य, मूक और बधिर विद्यालय

(जूनियर हाईस्कू ल)-

मौलिक रूप से नियुक्त मूक और बधिर विद्यालयों के प्रशिक्षित स्नातक अध्यापकों (एल0टी0(cid:7061)ेड) में से जिन्होंने भर्ती के वर्ष के प्रथम दिवस को इस रूप में चौदह वर्ष की सेवा

पूरी कर ली हो, चयन समिति के माध्यम से

पदोन्नति द्वारा।

(5) प्रधानाचार्य, शारीरिक रूप से अक्षम विद्यालय (हाईस्कू ल)-

मौलिक रूप से नियुक्त शारीरिक रूप से अक्षम और मानसिक रूप से अविकसित प्रशिक्षित स्नातक अध्यापकों (एल0टी0(cid:7061)ेड) में से जिन्होंने भर्ती के वर्ष के प्रथम दिवस को इस रूप

में चौदह वर्ष की सेवा पूरी कर ली हो, चयन समिति के माध्यम से पदोन्नति द्वारा।

(6) प्रवक्ता दृष्टिबाधित राजकीय इ(cid:7003)टर

कालेज -

(4) प्रधानाचार्य, संके त मूक और बधिर

विद्यालय (जूनियर हाईस्कू ल)-

मौलिक रूप से नियुक्त प्रशिक्षित स्नातक अध्यापकों (एल0टी0(cid:7061)ेड)/विशिष्ट अध्यापक संके त मूक बधिर विद्यालय/ प्रशिक्षित स्नातक अध्यापकों (एल0टी0(cid:7061)ेड) प्रयास शारीरिक रूप से विकलांग विद्यालय/प्रशिक्षित स्नातक अध्यापक (एल0टी0(cid:7061)ेड) स्पर्श दृष्टि बाधित विद्यालय/समेकित विशेष माध्यमिक विद्यालयों

में से, जिन्होंने भर्ती वर्ष के प्रथम दिवस को इस

रूप में दस वर्ष की सेवा पूरी कर ली हो, और

जो भारतीय पुनर्वास परिषद, (आर0सी0आई0)

भारत सरकार द्वारा मान्यता प्राप्त किसी संस्था से विशिष्ट शिक्षा ((cid:7088)वणक्षीणता) में डिप्लोमा

धारित करते हों, चयन समिति के माध्यम से

पदोन्नति द्वारा।

(5) प्रधानाचार्य, प्रयास शारीरिक रूप से अक्षम (हाईस्कू ल)-

मौलिक रूप से नियुक्त प्रशिक्षित स्नातक अध्यापकों (एल0टी0(cid:7061)ेड)/प्रयास शारीरिक रूप से अक्षम विद्यालय/प्रशिक्षित स्नातक अध्यापकों (एल0टी0(cid:7061)ेड)/विशिष्ट अध्यापकों (संके त मूक एवं बधिर विद्यालय)/प्रशिक्षित स्नातक अध्यापकों (एल0टी0(cid:7061)ेड) स्पर्श दृष्टि बाधित विद्यालय/समेकित विशेष माध्यमिक विद्यालयों में से, जिन्होंने भर्ती वर्ष के प्रथम दिवस को इस

रूप में दस वर्ष की सेवा पूरी कर ली हो, और

जो भारतीय पुनर्वास परिषद, (आर0सी0आई0)

भारत सरकार द्वारा मान्यता प्राप्त किसी संस्था से विशिष्ट शिक्षा (चल नि:शक्तता/izefLr"d घात) में डिप्लोमा धारित करते हों, चयन

समिति के माध्यम से पदोन्नति द्वारा।

(6) प्रवक्ता, (स्पर्श दृष्टि बाधित राजकीय

इ(cid:7003)टर कालेज/समेकित विशेष माध्यमिक विद्यालय)-

(एक) पचास प्रतिशत आयोग के माध्यम से

(एक) पचास प्रतिशत सीधी भर्ती द्वारा सीधी भर्ती द्वारा।

(दो) पचास प्रतिशत मौलिक रूप से नियुक्त प्रशिक्षित स्नातक अध्यापकों (एल0टी0(cid:7061)ेड)/ विशिष्ट अध्यापकों (स्पर्श दृष्टि बाधित (दो) पचास प्रतिशत मौलिक रूप से नियुक्त दृष्टिबाधित विद्यालयों के प्रशिक्षित स्नातक अध्यापकों (एल0टी0(cid:7061)ेड) में से जिन्होंने भर्ती के वर्ष के प्रथम दिवस को इस रूप में वर्ष की सेवा पूरी कर ली हो, चयन समिति के माध्यम से

पदोन्नति द्वारा:

विद्यालय/समेकित विशेष माध्यमिक विद्यालयों)

में से, जिन्होंने भर्ती वर्ष के प्रथम दिवस को इस परन्तु यह कि यदि पदोन्नति के लिये पर्याप्त संख्या में पात्र या उपयुक्त अ(cid:7012)यर्थी उपलब्ध न हो तो मौलिक रूप से नियुक्त मूक और बधिर विद्यालयों के प्रशिक्षित स्नातक अध्यापकों को और शारीरिक रूप से अक्षम विद्यालयों के और मानसिक रूप से अविकसित विद्यालयों के प्रशिक्षित स्नातक v/;kidksa जिन्होंने भर्ती के वर्ष रूप में वर्ष की सेवा पूरी कर ली हो,

आयोग के परामर्श से पदोन्नति द्वारा:

परन्तु यह और कि यदि प्रथम परन्तुक के अधीन पदोन्नति के लिये पर्याप्त संख्या में पात्र या उपयुक्त अ(cid:7012)यर्थी अब भी उपलब्ध न हों तो पदों को सीधी भर्ती द्वारा भरा जा सकता है।

के प्रथम दिवस को इस रूप में पॉच वर्ष की सेवा

पूरी कर ली हो, और सरकार द्वारा मान्यता प्राप्त

(7) दृष्टिबाधित विद्यालयों के प्रशिक्षित स्नातक अध्यापक (एल0टी0(cid:7061)ेड) (एक) नब्बे प्रतिशत सीधी भर्ती द्वारा (7) प्रशिक्षित स्नातक अध्यापक (एल0टी0(cid:7061)ेड)/विशिष्ट अध्यापक (स्पर्श दृष्टि बाधित विद्यालय/समेकित विशेष माध्यमिक विद्यालय)

(एक) पचास प्रतिशत आयोग के माध्यम से सीधी भर्ती द्वारा

(दो)दस प्रतिशत मौलिक रूप से नियुक्त दृष्टिबाधित विद्यालयों के ऐसे प्रशिक्षित अ(cid:7003)डर (cid:7061)ेजुएट जे0टी0सी0 (जूनियर (cid:7061)ेड) अध्यापकों में

से, जो स्नातक उपाधि रखते हों और भर्ती के वर्ष के प्रथम दिवस को इस रूप में दस वर्ष की

सेवा पूरी कर चुके हों, चयन समिति के माध्यम से पदोन्नति द्वारा। ऐसी पदोन्नति के लिये ब्रेल प(cid:7373)ति की जानकारी आवश्यक होगी :

(दो) पचास प्रतिशत मौलिक रूप से नियुक्त प्रशिक्षित अवर स्नातक अध्यापकों जे0टी0सी0 (कनिष्ठ वेतनमान)/स्पर्श दृष्टि बाधित विद्यालयों के शिल्प अध्यापक (संगीत)/जे0टी0सी0/संके त मूक और बधिर विद्यालय/प्रयास शारीरिक रूप से दि(cid:7018)यांग

विद्यालय में से, जो स्नातक उपाधि धारित

करते हों, और भर्ती वर्ष के प्रथम दिवस को परन्तु यह कि पदोन्नति के लिये पात्र/उपयुक्त अ(cid:7012)यर्थी न होने पर पद को सीधी भर्ती द्वारा भरा जायेगा।

(8) मूक और बधिर विद्यालयों के प्रशिक्षित स्नातक अध्यापक (एल0टी0(cid:7061)ेड)-सीधी भर्ती द्वारा।

इस रूप में वर्ष की सेवा पूरी कर चुके

हों, और जो भारतीय पुनर्वास परिषद, (आर0सी0आई0) भारत सरकार द्वारा मान्यता प्राप्त किसी संस्था से विशिष्ट शिक्षा

(क्षीणदृष्टि) में डिप्लोमा रखते हों, आयोग के

परामर्श से पदोन्नति द्वारा:

परन्तु यह कि पदोन्नति के लिये पात्र/उपयुक्त अ(cid:7012)यर्थी उपलब्ध न होने पर उक्त पद को सीधी भर्ती द्वारा भरा जा सकता है।

(8) प्रशिक्षित स्नातक अध्यापक (एल0टी0(cid:7061)ेड)/विशिष्ट अध्यापक (संके त मूक एवं बधिर विद्यालय/समेकित विशेष माध्यमिक विद्यालय)-

(एक) पचास प्रतिशत आयोग के माध्यम से सीधी भर्ती द्वारा

(दो) पचास प्रतिशत मौलिक रूप से नियुक्त प्रशिक्षित अवर स्नातक अध्यापकों जे0टी0सी0 (कनिष्ठ वेतनमान)/संके त मूक एवं बधिर विद्यालयों के शिल्प अध्यापक (संगीत) जे0टी0सी0/ स्पर्श दृष्टि बाधित विद्यालय/प्रयास शारीरिक रूप से अक्षम विद्यालय में से, जो स्नातक उपाधि धारित करते हों और भर्ती वर्ष के प्रथम दिवस को इस रूप में पॉच वर्ष की सेवा पूरी कर चुके हों,

और जो भारतीय पुनर्वास परिषद, (आर0सी0आई0) भारत सरकार द्वारा मान्यता प्राप्त किसी संस्था से विशिष्ट शिक्षा ((cid:7088)वणक्षीणता)/ (क्षीण दृष्टि) में डिप्लोमा रखते हों, आयोग के परामर्श से पदोन्नति द्वारा।

(9) शारीरिक रूप से अक्षम विद्यालयों के प्रशिक्षित स्नातक (एल0टी0(cid:7061)ेड) अध्यापक-

(एक) पचास प्रतिशत सीधी भर्ती द्वारा

(दो) पचास प्रतिशत मौलिक रूप से नियुक्त शारीरिक रूप से अक्षम विद्यालयों के एच0टी0सी0/जे0टी0सी0 अध्यापकों में से जो संबंधित विषय में स्नातक उपाधि रखते हों और भर्ती के वर्ष के प्रथम दिवस को इस रूप में दस वर्ष की सेवा पूरी कर चुके हों, चयन समिति के

माध्यम से पदोन्नति द्वारा।

(9) प्रशिक्षित स्नातक अध्यापक (एल0टी0(cid:7061)ेड)/विशिष्ट अध्यापक (प्रयास शारीरिक रूप से अक्षम विद्यालय/ समेकित

विशेष माध्यमिक विद्यालय)-

(एक) पचास प्रतिशत आयोग के माध्यम से सीधी भर्ती द्वारा

(दो) पचास प्रतिशत मौलिक रूप से नियुक्त प्रयास शारीरिक रूप से अक्षम विद्यालयों के

अध्यापकों, संके त मूक बधिर विद्यालयों/स्पर्श

दृष्टिबाधित विद्यालयों/प्रयास शारीरिक रूप से अक्षम विद्यालयों के प्रशिक्षित अवर स्नातक जे0टी0सी0 अध्यापकों में से जो स्नातक उपाधि धारित करते हों और भर्ती वर्ष के प्रथम दिवस को इस रूप में पॉच वर्ष की सेवा पूरी कर चुके

हों, और जो भारतीय पुनर्वास परिषद,

(12) प्रयास शारीरिक रूप से अक्षम राजकीय विद्यालयों के प्रशिक्षित अवर स्नातक (जे0टी0सी0) अध्यापक और ममता मानसिक रूप से अविकसित विद्यालयों के प्रशिक्षित अवर स्नातक (जे0टी0सी0 (cid:7061)ेड) अध्यापक-अधीनस्थ आयोग के माध्यम से

(चार) (cid:7088)वण क्षीणजन के अध्यापन में विशिष्ट शिक्षक के रूप में भारतीय

पुनर्वास परिषद (आर0सी0आई0) में पंजीकरण।

11–ममता मानसिक रूप से अविकसित विद्यालयों के प्रशिक्षित अवर स्नातक (जे0टी0सी0 (cid:7061)ेड) अध्यापक-

(एक) माध्यमिक शिक्षा परिषद, उत्तर प्रदेश की इ(cid:7003)टरमीडिएट परीक्षा या

सरकार द्वारा उसके समकक्ष मान्यता प्राप्त कोई परीक्षा अवश्य उत्तीर्ण की हो।

(दो) भारतीय पुनर्वास परिषद (आर0सी0आई0), भारत सरकार द्वारा मान्यता

प्राप्त किसी संस्था से विशिष्ट शिक्षा (मानसिक रूप से अविकसित) में डिप्लोमा।

(तीन) मानसिक अविकास में विशिष्ट शिक्षक के रूप में भारतीय पुनर्वास

परिषद (आर0सी0आई0) में पंजीकरण।

नियम 10 का

9–उक्त नियमावली में, नीचे स्तम्भ-1 में दिये गये विद्यमान नियम-10 के स्थान पर संशोधन

स्तम्भ-2 में दिया गया नियम रख दिया जायेगा, अर्थात् :-

(4) आयोग, अ(cid:7012)य(cid:7414)थयों की उनकी प्रवीणता

के (cid:7059)म में, जैसा कि लिखित परीक्षा और

साक्षात्कार में प्रत्येक अ(cid:7012)यर्थी द्वारा प्राप्त किये

गये अंकों से प्रकट हो, एक सूची तैयार करेगा।

यदि दो या अधिक अ(cid:7012)यर्थी बराबर-बराबर अंक प्राप्त करें तो आयु में ज्येष्ठ अ(cid:7012)यर्थी को सूची में

उ(cid:6994)चतर स्थान पर रखा जायेगा। आयोग,

नियुक्ति प्राधिकारी को सूची अ(cid:7061)सारित करेगा।

टिप्पणी-प्रतियोगी परीक्षा के लिये पाठय(cid:7059)म और नियम ऐसे होंगे जो समय- समय पर सरकार की सहमति से आयोग द्वारा विहित किये जायेंगे।

Welfare Department Teachers Service Rules, 2000.

RULES, 2022

PART-1- GENERAL

Short title and

commencement

1. (1) These rules may be called the Uttar Pradesh Department of Empowerment of Persons with Disabilities Teachers Service (Fourth Amendment) Rules, 2022

(2) They shall come into force at once.

General Amendment

2. In the Uttar Pradesh Handicapped Welfare Department Teachers Service Rules, 2000 (as amended, including the present amendment), hereinafter referred to as the said rule, for the words "Handicapped", "Handicapped welfare" and "Viklang Jan Vikas Vibhag or Department of Empowerment of Persons with Disabilities" where ever occurring including the preamble, the long title, the words "Divyangjan", "Divyangjan Sashaktikaran and "Divyangjan Sashaktikaran Vibhag or Department of Empowerment of Persons with Disabilities" shall be substituted respectively.

3. In the said rules, for existing sub rule (b) of rule 3 as set out in Column-1 Rule-3

below, the rule as set out in Column-2 shall be substituted, namely:-

3(b)-'Appointing Authority' in respect of the post of Principal, Government Inter College for visually handicapped means the Governor; in respect of the posts of Principal, Schools for Deaf and Dumb High School, Principal High School Physically handicapped means the Secretary to the Government in the Viklang Jan Vikas Vibhag and in respect of other posts in the Service means, the Director, Viklang Jan Vikas Vibhag Uttar Pradesh.

3(b)-'Appointing Authority' in respect of the post of Principal Sparsh Government Inter College for visually handicapped/ Principal Samekit Vishesh Madhyamik Vidiyalaya, Principal, Sanket Schools for Deaf and Dumb High School and Principal Prayas High School for Physically handicapped and Principal Sparsh High School for visually handicapped means the Governor; and in respect of other posts in the Service means, the Director, Department of Empowerment of Persons with Disabilities Uttar Pradesh.

4. In the said rule, after existing sub-rule (K) of rule 3, the following Insertion of New Sub-rule

sub-rule (L) shall be inserted, namely:-

(L) 'Subordinate Commission' means the Uttar Pradesh Subordinate Services Selection Commission.

5. In the said rules, for existing sub rules 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13 and 14 of rule 5 as set out in Column-1 below, the rule as set out in Column-2 shall be substituted, namely:-

(i) Ten Percent, by promotion through the Selection Committee from amongst substantively appointed Principal high schools for Visually Handicapped, who have completed fifteen years service as such on the first day of the year of recruitment and who possess a post graduate degree from a University Established by law in India.

(ii) Ninety Percent, by the Promotion through the Selection Committee from amongst substantively appointed Lecturer Government Inter college Visually Handicapped, who have completed fifteen years service as such on the first day of the year of recruitment:

Provided that in case of non- availability of eligible/suitable candidates for promotion, the post may be filled by direct recruitment through the commission.

(2) Principal, High School for Visually Handicapped-by promotion through the Selection Committee from amongst substantively appointed Trained Graduate Teacher (L.T. Grade) of Schools for Visually Handicapped who have completed Fourteen years of service as such on first day of the year of recruitment.

(3) Principal, School for Deaf and Dumb (High School)- by promotion through the Selection Committee from amongst substantively appointed Principal of Junior High School for Deaf and Dumb who have completed Fourteen years of service as such on first day of the year of recruitment.

(1) Principal Sparsh Government Inter College for visually handicapped/ Principal Samekit Vishesh Madhyamik Vidiyalaya–

(i) Ten Percent by promotion through the Selection Committee from amongst substantively appointed Principal Sparsh high schools for Visually Handicapped, Principal Sanket Schools for Deaf and Dumb High School and Principal Prayas High School for Physically handicapped who have completed twelve years service as such on the first day of the year of recruitment and who possess a Post Graduate degree from a University established by law in India and for Principal Sparsh Government Inter College for visually handicapped who possess the knowledge of Braille with a degree/diploma in special education (Visually Impaired) from an institution recognised by Government.

(ii) Ninety Percent, by the Promotion through the Selection Committee from amongst substantively appointed Lecturer Sparsh Government Inter College for visually handicapped/ Lecturer Samekit Vishesh Madhyamik Vidiyalaya who have completed sixteen years service as such on the first day of the year of recruitment:

Provided that in case of non- availability of eligible/suitable candidates for promotion, the post may be filled by direct recruitment through the commission.

(2) Principal, Sparsh High School for Visually Handicapped-by promotion through the Selection Committee from amongst substantively appointed Trained Graduate Teacher (L.T. Grade) Sparsh School for Visually Handicapped/ Samekit vishesh madhyamik schools/ Trained Graduate Teacher (L.T. Grade)/ Special Teachers (Sanket Deaf and Dumb School)/ Trained Graduate Teacher (L.T. Grade) Prayas Schools of Physically handicapped who have completed Fourteen years of service as such on first day of the year of recruitment and who possess Diploma in special education (Visually Impaired) from an Institution recognised by the Rehabilitation Council of India (R.C.I., Government of India).

(3) Principal, Sanket School for

Deaf and Dumb (High School)-

(i) Fifty Percent by promotion through the Selection Committee from amongst substantively appointed Principal of Junior High School for Deaf and Dumb who have completed Ten years of service as such on first day of the year of recruitment.

Grade) of Schools for Deaf and Dumb who have completed Fourteen years of service as such on first day of the year of recruitment.

Grade) of Schools for Physically Handicapped and Mentally Retarded who have completed Fourteen years of service as such on first day of the year of recruitment.

(5) Principal, Prayas High School for Physically Handicapped-by promotion through the Selection Committee from amongst substantively appointed Trained Graduate Teacher (L.T. Grade) Prayas Schools of Physically handicapped/ Trained Graduate Teacher (L.T. Grade)/ Special Teachers (Sanket Deaf and Dumb School)/Trained Graduate Teacher (L.T. Grade) Sparsh School for Visually Handicapped/Samekit vishesh madhyamik schools who have completed ten years of service as such on first day of the year of recruitment and who possess Diploma in special education (Locomotor Disability/ Cerebral Palsy) from an Institution recognised by the Rehabilitation Council of India (R.C.I., Government of India).

College for Visually Handicapped-

Provided that if sufficient number of eligible or suitable candidates are not available for promotion, the field of eligibility may be extended to include substantively appointed Trained Graduate Teacher of schools for Deaf and Dumb and Trained Graduate Teachers of schools for Physically Handicapped and Mentally Retarded who have completed five years service as such on the first day of the year of recruitment and who possess the knowledge of Braille with a Diploma or Certificate from an Institute recognised by the Government and a Post-graduate degree in the concerned subject from a University established by law in India:

Provided further that if the sufficient number of eligible or suitable candidates are still not available for promotion under the first proviso, the post may be filled by the direct recruitment.

(7) Trained Graduate Teacher of Schools for Visually Handicapped (L.T. Grade)–

(i) Ninety Percent by direct recruitment.

(ii) Ten Percent by promotion through the selection committee from amongst such substantively appointed Trained Graduate Teacher J.T.C. (Junior Grade) Teachers of schools for Visually Impaired who possess a Bachelor's degree and have completed ten years service as such on the first day of the year of recruitment and who possess the knowledge of Braille will be essential for such promotion:

Provided that in case of non- availability of eligible/suitable candidates for promotion, the post may be filled by direct recruitment.

(ii) Fifty percent by promotion through the consultation with the Commission from amongst substantively appointed Trained Graduate Teacher (L.T. Grade)/ Special Teachers (Sparsh School for Visually/ Samekit vishesh madhyamik schools) who have completed five years of service as such on the first day of the year of recruitment:

Provided further that if the sufficient number of eligible or suitable candidates are still not available for promotion under the first proviso, the post may be filled by the direct recruitment.

(7) Trained Graduate Teacher (L.T. Grade)/Special Teachers (Sparsh School for Visually/Samekit vishesh madhyamik schools)–

(i) Fifty Percent by direct recruitment through the commission.

(ii) Fifty percent by promotion through the consultation with Commission from amongst such substantively appointed Trained Under Graduate Teacher J.T.C. (Junior Grade)/ Craft Teacher (Music) J.T.C. of Sparsh School for Visually Impaired/ Sanket School for Deaf and Dumb/ Prayas School For Physically Handicapped who possess a Bachelor's degree and have completed Five years service as such on the first day of the year of recruitment and who possess the Diploma in special education (Visually Impaired) from an Institution recognised by the Rehabilitation Council of India (R.C.I., Government of India):

Provided that in case of non- availability of eligible/suitable candidates for promotion, the post may be filled by direct recruitment.

(8) Trained Graduate Teachers (L.T. Grade) Of Schools for Deaf and Dumb- By direct recruitment.

(ii) Fifty percent by promotion through the Selection Committee from amongst substantively appointed HTC/ JTC Teachers of Schools for Physically Handicapped, who possess Bachelor's degree in the concerned subject and have completed ten years service as such on the first day of the year of recruitment.

(10) Trained Graduate Teachers of Schools for Mentally Retarded (L.T. Grade) - By direct recruitment.

(8) Trained Graduate Teachers (L.T. Grade)/Special Teachers (Sanket School for Deaf and Dum/Samekit vishesh madhyamik schools)

(i) Fifty Percent by direct recruitment through the commission.

(ii) Fifty percent by promotion through the consultation with the Commission from amongst such substantively appointed Trained Under Graduate Teacher J.T.C. (Junior Grade)/Craft Teacher (Music) J.T.C. of Sanket School for Deaf and Dumb/ Sparsh School for Visually Impaired/ Prayas School For Physically Handicapped who possess a Bachelor's degree and have completed Five years service as such on the first day of the year of recruitment and who possess the Diploma in special education (Hearing Impaired)/(Visually Impaired) from an Institution recognised by the Rehabilitation Council of India (R.C.I., Government of India).

(9) Trained Graduate Teachers (L.T. Grade)/Special Teachers (Prayas School For Physically Handicapped/ Samekit vishesh madhyamik schools)– (i) Fifty Percent by direct recruitment through the commission.

(ii) Fifty percent by promotion through the consultation with the Commission from amongst such substantively appointed Teacher H.T.C. Grade Prayas School For Physically Handicapped, Trained Under Graduate Teacher J.T.C. of Sanket School for Deaf and Dumb / Sparsh School for Visually Impaired/ Prayas School For Physically Handicapped who possess a Bachelor's degree and have completed Five years service as such on the first day of the year of recruitment and who possess the Diploma in special education (Locomotor Disability/Cerebral Palsy) from an Institution recognised by the Rehabilitation Council of India (R.C.I., Government of India).

(10) Trained Graduate Teachers (L.T. Grade)/Special Teachers (Mamta School for Mentally Retarded/ Samekit vishesh madhyamik schools).

(i) Fifty Percent by the direct recruitment through the commission.

(ii) Fifty percent by promotion through the consultation with the Commission from amongst such substantively appointed Trained Under Graduate Teacher J.T.C. 6. In the said rules, after existing sub rule 14 of rule 5, the following new sub Insertion of new sub-rule 15 rule 15 shall be inserted, namely:-

(ii) Diploma in special education (Visually Impaired) from an Institution recognised by the Rehabilitation Council of India (R.C.I.) Government of India or Special B.Ed. or M.Ed degree Visually Impaired recognised by R.C.I. from a university established by law in India.

(iii) Knowledge of reading and

writing in Hindi/ English in Braille.

(iv) Registration in the Rehabilitation Council of India (R.C.I.) as a special educator for teaching Visually impaired.

Preferential :–

(i) A Post-Graduate Degree in concerned subject from a University established by law in India.

(ii) At least one year's practical experience of teaching the visually impaired.

(3) Trained Graduate Teachers of Schools for Deaf and Dumb (L.T. Grade)-

Essential:-

(i) Bachelor's Degree in concerned subject from a University established by law in India.

(ii) Diploma in special education (Visually Impaired) from an Institution recognised by the Rehabilitation Council of India (R.C.I.) Government of India or Special B.Ed. degree in Hearing Impaired Teaching recognised by R.C.I. from a university established by law in India.

(iii) Knowledge of reading and writing in Hindi/English in Braille/Sign Language.

(iv) Registration in Rehabilitation Council of India (R.C.I.) as a special educator for Teaching Visually impaired/ Hearing Impaired.

(2) Trained Graduate Teacher (L.T. Grade)/Special Teachers (Sparsh School for Visually/Samekit vishesh madhyamik schools).

(i) Bachelor's Degree in concerned subject from a University established by law in India.

(ii) Diploma in special education (Visually Impaired) from an Institution recognised by Rehabilitation Council of India (R.C.I.) Government of India or Special B.Ed. degree in Visually Impaired Teaching recognised by R.C.I. from a university established by law in India.

(iii) Knowledge of reading and writing

in Hindi/ English in Braille.

(iv) Registration in the Rehabilitation Council of India (R.C.I.) as a special educator for teaching Visually impaired.

(3) Trained Graduate Teachers (L.T. Grade)/Special Teachers (Sanket School for Deaf and Dumb/Samekit vishesh madhyamik schools)-

(i) Bachelor's Degree in concerned subject from a University established by law in India.

(ii) Diploma in special education (Visually Impaired) from an Institution recognised by the Rehabilitation Council of India (R.C.I.) Government of India or Special B.Ed. degree in Hearing Impaired Teaching recognised by R.C.I. from a university established by law in India.

(i) Bachelor's Degree in concerned subject from a University established by law in India.

(ii) Diploma in special education (Locomotor Disability/Cerebral Palsy) from an Institution recognised by the Rehabilitation Council of India (R.C.I.) Government of India or Special B.Ed. degree in Locomotor Disability/Cerebral Palsy recognised by R.C.I. from a university established by law in India.

(iii) Registration in the Rehabilitation Council of India (R.C.I.) as a special educator in Locomotor Disability/Cerebral Palsy

Preferential :– (i) Post-graduate degree in concerned subject from a University established by law in India.

(ii) At least one year's practical experience of teaching the student suffering from Locomotor Disability/ Cerebral Palsy.

(5) Trained Graduate Teachers of Schools for Mentally Retarded (L.T. Grade)-

(i) Bachelor's Degree in concerned subject from a University established by law in India.

(ii) Diploma in special education (Mental Retardation) from an Institution recognised by the Rehabilitation Council of India (R.C.I.) Government of India or Special B.Ed. degree in Mental Retardation recognised by R.C.I. from a university established by law in India.

(iii) Registration in the Rehabilitation Council of India (R.C.I.) as a special educator in Mental Retardation.

(iii) Knowledge of reading and writing in Hindi/English in Sign Language.

(iv) Registration in the Rehabilitation Council of India (R.C.I.) as a special educator for teaching Hearing impaired.

(4) Trained Graduate Teachers (L.T. Grade)/Special Teachers (Prayas School For Physically Handicapped/ Samekit vishesh madhyamik schools)-

(i) Bachelor's Degree in concerned subject from a University established by law in India.

(ii) Diploma in special education (Locomotor Disability/Cerebral Palsy) from an Institution recognised by the Rehabilitation Council of India (R.C.I.) Government of India or Special B.Ed. degree in Locomotor Disability/Cerebral Palsy recognised by R.C.I. from a university established by law in India.

(iii) Registration in the Rehabilitation Council of India (R.C.I.) as a special educator in Locomotor Disability/ Cerebral Palsy.

(5) Trained Graduate Teachers (L.T. Grade)/Special Teachers (Mamta School for Mentally Retarded/Samekit vishesh madhyamik schools)-

(i) Bachelor's Degree in concerned subject from a University established by law in India.

(ii) At least one year's practical experience of teaching Mental Retarded.

(6) Trained Under Graduate Teachers of Schools for Visually Handicapped (J.T.C. Grade) (Junior Scale)-

Essential:- (i) Must have passed the Intermediate Examination of the Board of High School and Intermediate Examination, Uttar Pradesh or an Examination Recognised by the Government as equivalent thereto.

(ii) Diploma in special education (Visually Impaired) from an Institution recognised by the Rehabilitation Council of India (R.C.I.) Government of India.

(iii) Knowledge of reading and writing in Hindi/English in Braille.

(iv) Registration in the Rehabilitation Council of India (R.C.I.) as a special educator for teaching Visually impaired.

Preferential :– (i) Bachelor's degree in concerned subject from a University established by law in India.

(ii) At least one year's practical experience of teaching the visually impaired.

(7) Trained Under Graduate Teachers of School for Physically Handicapped (J.T.C. Grade) (Junior Scale)-

Essential:- (i) Must have passed the Intermediate Examination of the Board of High School and Intermediate Examination, Uttar Pradesh or an Examination Recognised by the Government as equivalent thereto.

(ii) Diploma in special education (Locomotor Disability/Cerebral Palsy) from an Institution recognised by the Rehabilitation Council of India (R.C.I.) Government of India or Special B.Ed. degree in Locomotor Disability/Cerebral Palsy recognised by R.C.I. from a university established by law in India.

(iii) Registration in the Rehabilitation Council of India (R.C.I.) as a special educator in Locomotor Disability/Cerebral Palsy.

(6) Trained Under Graduate (J.T.C.) Teachers of Sparsh Schools for Visually Handicapped (Junior Scale) –

(i) Must have passed the Intermediate Examination of the Board of High School and Intermediate Examination, Uttar Pradesh or an Examination recognized by the Government as equivalent thereto.

(ii) Diploma in special education (Visually Impaired) from an Institution recognised by the Rehabilitation Council of India (R.C.I.) Government of India.

(iii) Knowledge of reading and writing in Hindi/English in Braille.

(iv) Registration in the Rehabilitation Council of India (R.C.I.) as a special educator for teaching Visually impaired.

(7) Trained Under Graduate (J.T.C.) Teachers of Government School for Physically Handicapped and Mentally Retarted (Junior Scale)-

(i) Must have passed the Intermediate Examination of the Board of High School and Intermediate Examination, Uttar Pradesh or an Examination recognized by the Government as equivalent thereto.

(ii) Diploma in special education (Locomotor Disability/Cerebral Palsy) from an Institution recognised by the Rehabilitation Council of India (R.C.I.) Government of India or Special B.Ed. degree in Locomotor Disability/Cerebral Palsy recognised by R.C.I. from a university established by law in India.

(iii) Registration in the Rehabilitation Council of India (R.C.I.) as a special educator in Locomotor Disability/ Cerebral Palsy.

(ii) Diploma in special education (Visually Impaired) from an Institution recognised by the Rehabilitation Council of India (R.C.I.) Government of India.

(iii) Knowledge of reading and writing in Hindi/ English in Braille.

(iv) Registration in the Rehabilitation Council of India (R.C.I.) as a special educator for teaching Visually Impaired.

Preferential :– (i) Bachelor's degree in concerned subject (Music) from a University established by law in India.

(ii) At least one year's experience of teaching music to the Visually Impaired.

(9) Trained Under Graduate Teachers of Schools for Physically Handicapped (H.T.C. Grade) (Primary Scale)-

Essential:-

(i) Must have passed the Intermediate Examination of the Board of High School and Intermediate Examination, Uttar Pradesh or an Examination Recognised by the Government as equivalent thereto.

(ii) Diploma in special education (Locomotor Disability/Cerebral Palsy) from an Institution recognised by the Rehabilitation Council of India (R.C.I.) Government of India.

(iii) Registration in the Rehabilitation Council of India (R.C.I.) as a special educator in Locomotor Disability/ Cerebral Palsy.

(8) Trained Craft Teacher (Music) of Schools For Visually Handicapped (J.T.C. Grade) (Junior Scale)-

(i) Must have passed the Intermediate Examination of the Board of High School and Intermediate Examination, Uttar Pradesh or an Examination Recognised by the Government as equivalent thereto with music as a subject or an equivalent Diploma in Music.

(ii) Diploma in special education (Visually Impaired) from an Institution recognised by the Rehabilitation Council of India (R.C.I.) Government of India.

(iv) Registration in the Rehabilitation Council of India (R.C.I.) as a special educator for teaching Visually Impaired.

(9) Trained Under Graduate Teachers of Government School for Physically Handicapped (H.T.C. Grade) (Primary Scale)-

(i) Must have passed the Intermediate Examination of the Board of High School and Intermediate Examination, Uttar Pradesh or an Examination recognized by the Government as equivalent thereto.

(ii) Diploma in special education (Locomotor Disability/Cerebral Palsy) from an Institution recognised by the Rehabilitation Council of India (R.C.I.) Government of India.

(iii) Registration in the Rehabilitation Council of India (R.C.I.) as a special educator in Locomotor Disability/ Cerebral Palsy.

recognized by the Rehabilitation Council of India (R.C.I.)

(3) Knowledge of reading and writing in Hindi/ English in sign language. (4) Registration in the Rehabilitation Council of India (R.C.I.) as a special

educator for teaching hearing impaired.

11. Trained Graduate Teacher of School for Mamta Mentally

Retarded (J.T.C. Grade)

(1) Must have passed the Intermediate Examination of the Board of High School and intermediate education, Uttar Pradesh or an examination recognised by the Government as equivalent thereto.

(2) Diploma in special education (Mentally Retarded) from an

institution recognized by the Rehabilitation Council of India (R.C.I.)

(3) Registration in the Rehabilitation Council of India (R.C.I.) as a

special educator for teaching Mentally Retarded.

9. In the said rules, for existing rule 10 as set out in Column-1 below, the rules Substitution of Rule 10

as set out in Column-2 shall be substituted, namely:-

14. Determination of vacancies- The appointing authority shall determine the number of vacancies to be filled during the course of the year as also the number of vacancies to be reserved for candidates belonging to the scheduled castes, scheduled tribes and other categories under rules 6.

12. In the said rules, for existing rule 15 A as set out in column 1 below, the Substitution of rule 15-A

(1) Application for being considered for selection shall be called by commission in the Performa published in the advertisement issued by commission.

(1) Application for permission to appear in the competitive examination shall be invited by the Commission in the form published in the advertisement issued by the commission.

(2) No candidate shall be admitted to the examination unless he holds a certificate of admission, issued by the commission.

(2) The commission shall, having regard to the need for securing due representation of the candidates belonging to the scheduled castes, scheduled tribes and other categories in accordance with rules 6 call for interview such number of candidates who fulfill the requisite qualification as they consider proper.

(3) The commission shall prepare a list of candidates in order of their proficiency disclosed by the marks obtain by each candidate in the interview, if two or more candidates obtained equal marks the name of the candidates shall be arranged in accordance with the general policy of the commission. The commission shall forward the list to the appointing authority

(3) After the result of the written examination have been received and tabulated, the commission shall, having regard to the need for securing due representation of the candidates belonging to the Scheduled Castes, Scheduled Tribes and other categories in accordance with rule 6, prepare a list of Candidates who are in accordance with the standards disclosed by Commission.

(4) The commission shall prepare a list of candidates in order of their proficiency as disclosed by the marks obtained by each candidate at the written examination and interview. If two or more candidates obtain equal marks, the candidate senior in age shall be placed higher in the list. The commission shall forward the list to the appointing authority.

NOTE:- The syllabus and rule for competitive examination shall be such as may be prescribed by the commission with the concurrence of the government from time to time.

13. In the said rules for existing rule 16, as set out in column-1 below, the Substitution of rule 16

rule as set out in column-2 shall be substituted, namely:-

16 (A) Procedure for recruitment by promotion through the Commission–

16 (1) Procedure for recruitment by promotion through the Commission–

Recruitment by promotion shall be made on the basis of merit/ seniority to the subject to the rejection of the unfit in accordance with the Uttar Pradesh Promotion by Selection in Consultation with Public Service (Procedure) Rule, 1970 as amended from time to time.

Recruitment by promotion shall be made on the basis of seniority to the subject to the rejection of the unfit in through the Selection Committee constituted in accordance with the provisions of the Uttar Pradesh Constitution of Departmental Promotion Committee (for posts outside the purview of the Service Commission) Rules, 1992 as amended from time to time.

16 (B) Procedure for recruit- ment by promotion through the Departmental Selection Committee–

NOTE :-

(1) Nomination of officers for giving representation to the Scheduled Caste, Scheduled Tribes and other backward classes of Citizens in the Selection Committee shall be made in accordance with the order made under section 7 of the Act as amended from time to time.

(2) The appointing authority shall prepare eligibility list of the candidates in accordance with the Uttar Pradesh Promotion by Selection (on posts outside the purview of the Public Service Commission) Eligibility List Rules 1986, as amended from time to time and place the same before the Selection Committee along with their character rolls and such other records pertaining to them, as may be considered proper:

Provided that where there are two or more feeding cadres-

(a) bearing different pay scale, the candidates belonging to the cadre bearing higher pay scale shall be placed higher in the eligibility list.

(1) Recruitment by promotion shall be made on the basis of the criterion laid down in the Uttar Pradesh Government Servants Criterion by Recruitment by Promotion Rule, 1994 as amended from time to time through the selection committee constituted in accordance with the provisions of the Uttar Pradesh Constitution of Departmental Promotion Committee (for Posts outside the purview of the Service Commission) Rules, 1992 as amended from time to time.

NOTE :-

(2) The appointing authority shall prepare eligibility list of the candidates in accordance with the Uttar Pradesh Promotion by Selection (on posts outside the purview of the Public Service Commission) Eligibility List Rules 1986, as amended from time to time and place the same before the Selection Committee along with their character rolls and such other records pertaining to them, as may be considered proper:

(3) The Selection Committee shall consider the cases of candidates on the basis of records, referred to in sub-rule (2), and if it considers necessary it may interview the candidates also.

(4) The Selection Committee shall prepare a list of selected candidates in order of seniority as it stood in the cadre from which they are to be promoted and forward the same to the appointing authority.

14. In the said rules, for existing sub-rule (1) of rule 18 as set out in Column-1 Amendment of rule 18 below, the sub-rule as set out in Column-2 shall be substituted, namely:-
