vkKk ls] 2 mRrj izns'k vlk/kkj.k xtV] 11 vDVwcj] 2022 IN pursuance of the provision of clause (3) of Article 348 of the Constitution, the Governor is pleased to order the publication of the following English translation of notification no. 115/LXXVIII-2– 2022-1599060, dated October 11, 2022 :

WHEREAS there is a provision regarding Missior critical Infrastructure under sub-para 8.1 of para 1 Non-Fiscal incentives under Uttar Pradesh Data Centre Policy, 2021 (notified vide IT and Electronics Section 2 notification no. 4/2021/1792/78-2–2020/254LC-2019, dated January 28, 2021) providing that the Data Centre Industry in the State shall be classified under Essential Services and maintenance Act, 1966 (Uttar Pradesh Act no. 30, 1966 as amended 1982 and 1983) as an essential service provider;
AND, WHEREAS, the Data Centre Industry falls under the category of Critical Infrastructure, which requires to be operated uninterruptedly;
NOW, THEREFORE, in exercise of the powers under sub-clause (vi) of clause (a) of section 2 of Essential Services and Maintenance Act, 1966, the governor is pleased to declare the Data Centre Industries established in the State under the "Uttar Pradesh Data Centre Policy, 2021", to be an "essential service".
