NOTIFICATION
WHEREAS, the seat of Shri Vikram Singh in the Legislative Assembly of the State of Uttar Pradesh, elected from 15-Khatauli Assembly Constituency, has become vacant on 11th October, 2022, by reason of his disqualification under Article 191(1) (e) of the Constitution of India read with Section 8 of the Representation of the People Act, 1951 on account of conviction and sentence by Additional Session Judge Court No.-4, Special Judge, M.P./ M.L.A. Court, Muzaffarnagar order; and
WHEREAS, a bye-election is to be held for the purpose of filling the vacancy so caused;
NOW, THEREFORE, in pursuance of sub-section (1) of Section 150, and Sections 30 and 56 of the Representation of the People Act, 1951 (43 of 1951), the Election Commission of India hereby:-
(A) calls upon the said 15-Khatauli Assembly Constituency in the State of Uttar Pradesh, to elect, before the 10th December, 2022 (Saturday) and in accordance with the provisions of the said Act and of the rules and orders made thereunder, a person for the purpose of filling the said vacancy in the Legislative Assembly of the State;
(B) appoints, with respect to the said election:-
(a) the 17th November, 2022 (Thursday), as the last date for making nominations; (b) the 18th November, 2022 (Friday), as the date for the scrutiny of nominations; (c) the 21st November, 2022 (Monday), as the last date for the withdrawal of candidatures; (d) the 5th December, 2022 (Monday), as the date on which a poll shall, if necessary, be taken;

यतः , उ(cid:517)र (cid:366)देश रा(cid:475) की िवधान सभा म(cid:336) 15-खतौली िवधान सभा िनवा(cid:330)चन (cid:407)े(cid:361) से िनवा(cid:330)िचत, (cid:373)ी िव(cid:354)म िसंह की सीट, अपर स(cid:361) (cid:586)ायाधीश कोट(cid:330) सं0-4, िवशेष (cid:586)ायाधीश, एम0पी0/ एम0एल0ए0 कोट(cid:330), मुज(cid:608)रनगर के आदेश म(cid:336) दोषिस(cid:304)(cid:544) एवं सजा िदए जाने के कारण, लोक (cid:366)ितिनिध(cid:533) अिधिनयम, 1951 की धारा 8 के साथ पिठत भारत dk संिवधान के अनु(cid:453)े द 191(1)(ङ) के अंतग(cid:330)त उनकी िनरह(cid:330)ता की वजह से, िदनांक 11 अ(cid:389)ूबर, 2022 को (cid:303)र(cid:389) हो गयी है ; और
यतः , इस (cid:366)कार (cid:352)ई (cid:303)र(cid:304)(cid:389) को भरने के (cid:366)योजनाथ(cid:330) उप-िनवा(cid:330)चन कराया जाना है ;
अतः , अब, लोक (cid:366)ितिनिध(cid:533) अिधिनयम, 1951 (1951 का 43) की धारा 150 की उप-धारा (1), तथा धारा 30 और धारा 56 के अनुसरण म(cid:336), भारत िनवा(cid:330)चन आयोग, ,rn~}kjk -
(अ) उ(cid:517)र (cid:366)देश रा(cid:475) म(cid:336) उ(cid:389) 15-खतौली fo/kku lHkk िनवा(cid:330)चन (cid:407)े(cid:361) से यह अपे(cid:407)ा करता है िक 10 िदस(cid:638)र, 2022 (शिनवार) से पूव(cid:330) तथा उ(cid:389) अिधिनयम और त(cid:544)ीन बनाए गए िनयमों और िकए गए आदेशों के उपब(cid:576)ों के अनुसार, रा(cid:475) की िवधान सभा म(cid:336) उ(cid:389) (cid:303)र(cid:304)(cid:389) को भरने के (cid:366)योजन से एक (cid:681)(cid:304)(cid:389) िनवा(cid:330)िचत कर िदया जाए ;
(आ) उ(cid:389) िनवा(cid:330)चन के स(cid:638)(cid:576) म(cid:336) िन(cid:635)िल(cid:304)खत िनधा(cid:330)(cid:303)रत करता है : –
(क) नामिनद(cid:337)शन करने की अ(cid:304)(cid:566)म तारीख : 17 नव(cid:638)र, 2022 (xq:okj); (ख) नामिनद(cid:337)शनों की संवी(cid:407)ा की तारीख : 18 नव(cid:638)र, 2022 (शु(cid:354)वार);
(ग) अ(cid:631)िथ(cid:330)ताएं वापस लेने की अ(cid:304)(cid:566)म तारीख : 21 नव(cid:638)र, 2022 (सोमवार);
(घ) वह तारीख, िजसको यिद आव(cid:692)क (cid:352)आ तो, : 5 िदस(cid:638)र, 2022 (सोमवार); और
मतदान होगा (ङ) वह तारीख, िजससे पूव(cid:330) िनवा(cid:330)चन lEiUu : 10 िदस(cid:638)र, 2022 (शिनवार) करा िलया जाएगा
(इ) 07:00 बजे पूवा(cid:330)(cid:741) से 06:00 बजे अपरा(cid:741) तक का समय ऐसे समय के (cid:349)प म(cid:336) िनयत करता है िजसके दौरान, यिद आव(cid:692)क (cid:352)आ तो, िनवा(cid:330)चन के िलए उपयु (cid:330)(cid:389) िविनिद(cid:330)(cid:700) तारीख को मतदान होगा ।
