IT IS HEREBY enacted in the Seventy-third Year of the Republic of India as
follows :–
1. (1) This Act may be called the Intermediate Education (Second Amendment) Short title and commencement Act, 2022.
(2) It shall be deemed to have come into force with effect from October 4, 2022.

(hereinafter referred to as the "principal Act") for the words "for every institution", the words "for every State Government Aided Institution" shall be substituted .

3. (1) The Intermediate Education (Second Amendment) U.P. Ordinance no. 9 of 2022 Repeal and saving
Ordinance, 2022 is hereby repealed.
(2) Notwithstanding such repeal, anything done or any action taken under the provisions of the principal Act as amended by the Ordinance referred to in sub-section (1) shall be deemed to have been done or taken under the corresponding provisions of the principal Act as amended by this Act as if the provisions of this Act were in force at all material times.

STATEMENT OF OBJECTS AND REASONS
The powers, duties and functions of the Acharya or Principal and the rights, duties and functions of the Management Committee have been prescribed in the administration plan of each institution in order to ensure the efficient operation and management of the institutions. However, it is often seen that disputes are created by the members of the institutions by forming two management committees simultaneously due to which there is disturbance in the efficient running of the institution.
It is notable that there is no system of administration scheme in the schools run by the non- Government recognized institutions under CBSE board or schools run under Basic Education. Instead, the management/operation of the above schools is done by the committee of the General Assembly approved/certified by the Registrar Society and Chits Fund. In view of the above, it was decided to amend section 16-A of the Intermediate Education Act, 1921 to provide for the running of the self-financed Secondary Schools recognized by the U.P. Madhyamik Shiksha Parishad by the parent institutions only.
Since the State Legislature was not in session and immediate legislative action was necessary to implement the aforesaid decision, the Intermediate Education (Second Amendment) Ordinance, 2022 (U.P. Ordinance no. 9 of 2022) was promulgated by the Governor on October 4, 2022.
This Bill is introduced to replace the aforesaid Ordinance.
