IN pursuance of the provisions of clause (3) of Article 348 of the Constitution, the Governor is

pleased to order the publication of the following English translation of "Uttar Pradesh Kshettra Panchayat

Tatha Zila Panchayat (Sansodhan) Vidheyak, 2022" introduced in the Uttar Pradesh Legislative Assembly

on December 6, 2022.

THE UTTAR PRADESH KSHETTRA PANCHAYATS AND ZILA PANCHAYATS (SANSHODHAN) VIDHEYAK, 2022 A BILL

further to amend the Uttar Pradesh Kshettra Panchayats and Zila

Panchayats Adhiniyam, 1961.

IT IS HEREBY enacted in the Seventy-third Year of the Republic of India as

follows :–

1. (1) This Act may be called the Uttar Pradesh Kshettra Panchayats and Zila

Panchayats (Sanshodhan) Adhiniyam, 2022.

Short title and commencement (2) It shall be deemed to have come into force with effect from October 4, 2022.

2. In section 15 of the Uttar Pradesh Kshettra Panchayats and Zila Panchayats section 15 of

Adhiniyam, 1961 (hereinafter referred to as the "principal Act"),-

U.P. Act no. 33

(a) in sub-section (11), for the words "more than half", the words of 1961

"not less than two-third" shall be substituted;

(b) in sub-section (13), for the words "one year", the words "two years" shall be substituted.

Amendment of

3. In section 28 of the principal Act,-

section 28

(a) in sub-section (11), for the words "more than half", the words "not less than two-third" shall be substituted;

(b) in sub-section (13), for the words "one year", the words "two years" shall be substituted.

Repeal and

U.P. Ordinance 4. (1) The Uttar Pradesh Kshettra Panchayats and Zila

no. 8 of 2022 saving

Panchayats (Sanshodhan) Adhyadesh, 2022 is hereby repealed.

(2) Notwithstanding such repeal, anything done or any action

taken under the provisions of the principal Act as amended by the

Ordinance referred to in sub-section (1) shall be deemed to have been

done or taken under the corresponding provisions of the principal Act

as amended by this Act as if the provisions of this Act were in force at

all material times.

STATEMENT OF OBJECTS AND REASONS

The Uttar Pradesh Kshettra Panchayats and Zila Panchayats Adhiniyam, 1961 (U.P. Act no. 33 of 1961) has been enacted to provide for the establishment of Kshettra Panchayats and Zila Panchayats in the State of Uttar Pradesh. Sections 15 and 28 of the said Act, deals with the motion of no-confidence in Pramukh of Kshettra Panchayats and Adhyakshya of Zila Panchayats respectively. Sub-section (11) of the said section provides that if the motion of no-confidence is carried with the support of more than half of the total numbers of elected members of Kshettra Panchayats and Zila Panchayats, as the case may be, then the Pramukh or Adhyakshya, as the case may be, shall cease to hold office as such. Sub-section (13) of the said sections provides that no notice of motion of no-confidence shall be received within one year of assumption of office by the Pramukh or the Adhyaksha, as the case may be. Due to these provisions there was always a situation of instability in the Kshettra Panchayats and Zila Panchayats . With a view to ensure stability of Kshettra Panchayats and Zila Panchayats it was decided to amend the said Act to Provide that no notice of motion of no-confidence against a Pramukh under section 15 or against an Adhyaksha under section 28, as the case may be, shall be received within two years of the assumption of office by a Pramukh or an Adhyaksha respectively and the Pramukh of Kshettra Panchayats or Adhyaksha of Zila Panchayats shall not cease to hold office unless no-confidence motion is carried with the support of not less than two-thirds of the total number of elected members thereof.

implement the aforesaid decision, the Uttar Pradesh Kshettra Panchayats and Zila Panchayats (Amendment) Ordinance, 2022 (Uttar Pradesh Ordinance no. 8 of 2022) was promulgated by the Governor on October 4, 2022.

This Bill is introduced to replace the aforesaid Ordinance.
