यतः, नीचे की सारणी के स्तम्भ (2) की तत्स्थानी प्रविष्टियों में दी गई संख्याओं के अनुसार, सारणी के स्तम्भ (1) में विनि(cid:7416)दष्ट परिषद् निर्वाचन-क्षेत्रों से उत्तर प्रदेश राज्य की विधान परिषद् के 05 (पांच) सदस्यों के स्थान सारणी के स्तम्भ (3) की तत्स्थानी प्रविष्टियों में उल्लिखित तारीखों को, उन सदस्यों की पदावधि के अवसान पर सेवानिवृत्ति होने से रिक्त होने जा रहे हैं, और;

यतः, इस प्रकार उत्पन्न रिक्तियों को भरने के प्रयोजन से द्विवा(cid:7414)षक निर्वाचन कराया जाना है; अत:, अब लोक प्रतिनिधित्व अधिनियम, 1951 (1951 का 43) की धारा 16 के अनुसरण में, जैसा कि भारत निर्वाचन आयोग ने सिफारिश की है, उत्तर प्रदेश राज्य के राज्यपाल, नीचे की सारणी के स्तम्भ (1) में विनि(cid:7416)दष्ट उक्त परिषद् निर्वाचन क्षेत्र में से प्रत्येक से यह अपेक्षा करते हैं कि वे उक्त अधिनियम के और तn~धीन बनाए गए नियमों और किए गए आदेशों के उपबन्धों के अनुसार उक्त रिक्तियों को भरने के प्रयोजन से राज्य की विधान परिषद् के लिए उक्त सारणी के स्तम्भ (2) में उस निर्वाचन क्षेत्र के सामने विनि(cid:7416)दष्ट संख्या में सदस्य निर्वाचित कर दें:-

IN pursuance of the provisions of clause (3) of Article 348 of the Constitution of India, the Governor of Uttar Pradesh is pleased to order the publication of the following English translation of notification no. 15/61-2023, dated January 5, 2023:

Dated Lucknow, January 5, 2023

WHEREAS, the seats of five members of the Legislative Council of the State of Uttar Pradesh, elected from the Council Constituencies, specified in column (1) of the Table below, as per the numbers shown in the corresponding entries in column (2) of the Table, are going to fall vacant on the retirement of those members, on the dates mentioned in the corresponding entries in column (3) of the Table, on the expiration of their term of office; and

WHEREAS, Biennial election has to be held for the purpose of filling the above vacancies so arising;

NOW, THEREFORE, as recommended by the Election Commission of India in pursuance of Section 16 of the Representation of the People Act, 1951 (43 of 1951), the Governor of the State of Uttar Pradesh is hereby pleased to call upon each of the said Council Constituencies, specified in column (1) of the Table below, to elect the number of members, specified against that Constituency in column (2) of the said Table, to the Legislative Council of the State, for the purpose of filling the above said vacancies, in accordance with the provisions of the said Act and of the rules and orders made thereunder:-

No. 322/UP-LC-G&T/2023 :– WHEREAS, the Governor of the State of Uttar Pradesh has, by notification issued under Section 16 of the Representation of the People Act, 1951 (43 of 1951) and published in the official Gazette of the State on 05th January, 2023, been pleased to call upon each of the Council Constituencies, specified in column (1) of the Table below, to elect the number of members specified against that Constituency in column (2) of the said Table, to the Legislative Council of the State of Uttar Pradesh:-

Act, 1951 (43 of 1951), the Election Commission of India hereby –

(A) appoints, with respect to the said election in each of the Constituencies, -

(a) the 12th January, 2023 (Thursday), as the last date for making nominations;

(b) the 13th January, 2023 (Friday), as the date for the scrutiny of nominations;

(c) the 16th January, 2023 (Monday), as the last date for the withdrawal of candidatures;

(d) the 30th January, 2023 (Monday), as the date on which a poll shall, if necessary, be taken; and

(e) the 04th February, 2023 (Saturday), as the date before which the election shall be completed;

and

(B) fixes the hours from 08:00 am to 04:00 pm, as the hours during which the poll shall, if necessary, be taken on the date specified above for the election.

सं.322/उ.प्र.-वि.प.-जी&टी/2023:–यतः, लोक प्रतिनिधित्व अधिनियम, 1951 (1951 का की धारा 16 के अधीन जारी और राज्य के शासकीय राजपत्र में 5 जनवरी, 2023 को प्रकाशित अधिसूचना द्वारा उत्तर प्रदेश राज्य के राज्यपाल ने नीचे की सारणी के स्तम्भ (1) में विनि(cid:7416)दष्ट परिषद् निर्वाचन-क्षेत्रों में से प्रत्येक से यह अपेक्षा की है कि उत्तर प्रदेश राज्य की विधान परिषद् के लिए उस निर्वाचन-क्षेत्र के सामने उक्त सारणी के स्तम्भ (2) में विनि(cid:7416)दष्ट संख्या में सदस्य निर्वाचित कर दें:-

अतः, अब, उक्त अधिनियम की धारा 30 और धारा 56 के अनुसरण में भारत निर्वाचन आयोग एतद्दवाराः-

(अ) उक्त निर्वाचन के संबंध में:-

(क) नाम निद(cid:7287)शित करने की अन्तिम तारीख -12 जनवरी, 2023 (गु(cid:7271)वार) (ख) नाम निद(cid:7287)शन की संवीक्षा की तारीख -13 जनवरी, 2023 (शु(cid:7059)वार) (ग) अ(cid:7012)य(cid:7414)थताएं वापस लेने की अंतिम तारीख -16 जनवरी, 2023 (सोमवार) (घ) वह तारीख, जिसको यदि आवश्यक (cid:7263)आ तो मतदान -30 जनवरी, 2023 (सोमवार) होगा; और

(³) वह तारीख जिससे पूर्व निर्वाचन सम्पन्न कर लिया -04 फरवरी, 2023 (शनिवार) जाएगा; और (आ) 08:00 बजे पूर्वा(cid:7022)न् से 04:00 बजे अपरा(cid:7022)न् तक का समय, उस समय के रूप में नियत करता है जिसके दौरान यदि आवश्यक (cid:7263)आ तो, उक्त विनि(cid:7416)दष्ट तारीख को, मतदान होगा।
