IN pursuance of the provisions of clause (3) of Article 348 of the Constitution of India, the Governor is pleased to order the publication of the following English translation of the Uttar Pradesh Rajya Vidhan Mandal (Sadasyon Ki Uplabdhiyan Aur Pension) (Sanshodhan) Adhiniyam, 2023 (Uttar Pradesh Adhiniyam Sankhya 2 of 2023) as passed by the Uttar Pradesh Legislature and assented to by the Governor on March 3, 2023. The Sansadiya Karya Anubhag-1 is administratively concerned with the said Adhiniyam.

PENSION) (AMENDMENT) ACT, 2023

AN
ACT
further to amend the Uttar Pradesh State Legislature (Members' Emoluments
and Pension) Act, 1980 .
IT IS HEREBY enacted in the Seventy fourth Year of Republic of India as
follows :–
1. (1) This Act may be called the Uttar Pradesh State Legislature (Members' Short title and commencement Emoluments and Pension) (Amendment) Act, 2023.
(2) It shall come into force with effect from the date of its publication in the
Gazette.
2. (1) In section 26-A of the Uttar Pradesh State Legislature (Members'
Emoluments and Pension) Act, 1980, in sub-sections (1) and (2) for the words "ten

thousand" the words "twenty five thousand" shall be substituted.

STATEMENT OF OBJECTS AND REASONS
The Uttar Pradesh State Legislature (Members' Emoluments anf Pension) Act, 1980 has been enacted to consolidate and amend the law relating to payment of salaries, allowances and other facilities to the members of the State Legislature.
Under the aforesaid Act, the ex-members of either house of State Legislature are entitled to get pension and other benefits. The spouses of deceased ex-members are also entitled to get family pension under sub-section (2) of section 26-A of the aforesaid Act. Through the Uttar Pradesh State Legislature (Members' Emoluments and Pension) (Amendment) Act, 2016, the pension admissible to ex-members was raised from rupees ten thousand to rupees twenty five thousand by amending the sub-section (1) of section 24 of the aforesaid Act. Therefore the spouses of those ex-members who expired after the commencement of the Uttar Pradesh State Legislature (Members' Emoluments and Pension) (Amendment) Act, 2016 i.e., September 11, 2016, are entitled to a minimum pension of rupees twenty five thousand or pension otherwise admissible to the deceased ex-member, whichever is greater. But the family pension of spouses of those ex-members who expired before the commencement of the aforesaid Act of 2016 is confined to a maximum limit of rupees ten thousand or pension as otherwise admissible to the dues ex-members as per the provision of sub-section (2) of section 26-A of the aforesaid Act. Therefore such spouses are getting 4 mRrj izns'k vlk/kkj.k xtV] 6 ekpZ] 2023 much less family pension as compared to spouses of those ex-members who expired after September 11, 2016. To remove this discrepancy and to provide for giving the benefit of a minimum family pension of rupees twenty five thousand to such spouses, it has been decided to amend the aforesaid Act.
The Uttar Pradesh State Legislature (Members Emoluments and Pension) (Amendment) Bill, 2023 is introduced accordingly.
