IN pursuance of the provisions of clause (3) of Article 348 of the Constitution of India, the Governor is pleased to order the publication of the following English translation of notification no. 558/IX- 1–2023-56T.A.-20, dated March 14, 2023 :

Dated Lucknow, March 14, 2023
IN exercise of the powers under clause (2) of Article 243-Q of the Constitution of India read with sub-section (2) of section 3 of the Uttar Pradesh Municipalities Act, 1916 (U.P Act no. 2 of 1916), notification no. 2310/IX-1–2020-56T.A.-20, dated August 10, 2022 was issued and published in the Gazette on the same date with a view to the included 17 Villages of district Gorakhpur in the transitional area of Nagar Panchayat Badhalganj, district Gorakhpur;
AND, WHEREAs, writ petition no. 26793 of 2022 Sujit and other vs State of U.P. and other filed against notification 2310/IX-1–2020-56T.A.-20, dated August 10, 2022, Hon'ble High Court Allahabad passed order dated September 27, 2022, whose creative part is as following :–
"---- In view of what has been stated above, we are of the considered opinion that the final notification dated August 10, 2022, in so far as ti includes the Villages Garthauli, Sansaarpur, Basawanpur, Mishrauli, Kuraon and Mahulia Khajuha, is illegal and unconstitutional and it is quashed to that extent ---";
NOW, THEREFORE, in respect ot above order of Hon'ble High Court, exercise of the powers under clause (2) of Article 243-Q of the Constitution of India read with sub-section (2) of section 3 of the Uttar pradesh Municipalities Act, 1916 (U.P Act no. 2 of 1916), the Governor is pleased to exclude the Villages Garthauli, Sansaarpur, Basawanpur, Mishrauli, Sindhuapar, Kuraon and Mahulia Khajuha from the Schedule of notification no. 2310/IX-1–2020-56T.A.-20, dated August 10, 2022 of transitional area of Nagar Panchayat Badhalganj in district Gorakhpur. The said notification deted August 10, 2022 shall be deemed to be amended to that extent only.
