साधारण ख(cid:503) अधिनियम, 1897 (अधिनियम सं(cid:421)ा 10 सन् 1897) की धारा 21 के साथ पठित मोटर यान अधिनियम, 1988 (अधिनियम सं(cid:421)ा 59 सन् 1988) की धारा 65, 95, 96 तथा 111 के अधीन (cid:366)द(cid:517) श(cid:304)(cid:389)यों का (cid:366)योग करके रा(cid:475)पाल, उ(cid:517)र (cid:366)दे श मोटरयान नियमावली, 1998 को संशोधित करने की n`f'V से जिस नियमावली को बनाने का (cid:366)(cid:721)ाव करती ह(cid:339) उसका नि(cid:635)लि(cid:304)खत (cid:366)ा(cid:349)प उ(cid:389) अधिनियम सन् 1988 की धारा 212 की उपधारा (1) के अधीन सम(cid:721) स(cid:638)(cid:304)(cid:576)त की सूचना के लिये और उसके स(cid:638)(cid:576) म(cid:336) आप(िcid:517)याँ और सुझाव आमं(िcid:361)त किये जाने की n`f'V से ,rn~}kjk (cid:366)काशित किया जाता है।

2- (cid:366)(cid:721)ावित नियमावली के स(cid:638)(cid:576) म(cid:336) आप(िcid:517)याँ और सुझाव (यदि कोई हों) विशेष सचिव, प(cid:303)रवहन अनुभाग-4, उ(cid:517)र (cid:366)देश शासन, क(cid:407) सं(cid:421)ा 711, स(cid:593)म तल, बापू भवन, उ(cid:517)र (cid:366)देश सचिवालय, लखनऊ को स(cid:638)ोधित करके लि(cid:304)खत (cid:349)प म(cid:336) (cid:366)ेषित किये जाने चाहिए। के वल उ(cid:590)ी ं आप(िcid:517)यों और सुझावों पर विचार किया जायेगा, जो इस अधिसूचना के गजट म(cid:336) (cid:366)काशित किये जाने के दिनांक से तीस दिन के भीतर (cid:366)ा(cid:593) होंगे।

3- ऐसा (cid:681)(cid:304)(cid:389), जिसने लि(cid:304)खत (cid:349)प म(cid:336) आप(िcid:517)याँ और सुझाव (cid:366)(cid:721)ुत किया हो, विशेष सचिव, प(cid:303)रवहन अनुभाग-4, उ(cid:517)र (cid:366)दे श शासन के सम(cid:407) दिनांक 08.05.2023 को म(cid:801)या(cid:802)ह 12:00 बजे बापू भवन, उ(cid:517)र (cid:366)दे श सचिवालय, लखनऊ के स(cid:593)म तल (cid:304)(cid:830)थत उनके काया(cid:330)लय क(cid:407) सं(cid:421)ा 711 म(cid:336) सुनवाई के लिये उप(cid:304)(cid:830)थत हो सकता है।

नियमावली का (cid:366)ा(cid:349)प

उ(cid:517)र (cid:366)देश मोटरयान (उनतीसवाँ संशोधन) नियमावली, 2023

1- (1) यह नियमावली उ(cid:517)र (cid:366)दे श मोटरयान (उनतीसवाँ संशोधन) नियमावली, 2023 सं(िcid:407)(cid:593) नाम और

कही जायेगी;

(cid:366)ार(cid:641)

(2) यह गजट म(cid:336) (cid:366)काशित किये जाने के दिनांक से (cid:366)वृ(cid:517) होगी।

नियम-39 का

2- उ(cid:517)र (cid:366)देश मोटरयान नियमावली, 1998 (जिसे आगे उ(cid:389) नियमावली कहा गया संशोधन

है) म(cid:336) नीचे (cid:721)(cid:641)-1 म(cid:336) दिये गये नियम 39 के (cid:830)थान पर (cid:721)(cid:641)-2 म(cid:336) दिया गया नियम रख दिया

जायेगा, अथा(cid:330)त्:-

39-ठीक हालत म(cid:336) होने का (cid:366)माण-प(cid:361) (cid:738)ीकृ त 39-ठीक हालत म(cid:336) होने का (cid:366)माण-प(cid:361) और जारी करना-

(cid:738)ीकृ त और जारी करना-

(1) धारा 56 के (cid:366)योजनाथ(cid:330), विहित (cid:366)ाधिकारी (1)(क) धारा 56 के (cid:366)योजनाथ(cid:330), विहित रजि(cid:720)(cid:332) ीकता(cid:330) (cid:366)ाधिकारी होगा। ठीक हालात म(cid:336) (cid:366)ाधिकारी, रा(cid:475) के किसी जिले का होने का (cid:366)माण-प(cid:361) जारी करने के लिये रजि(cid:720)(cid:332) ीकता(cid:330) (cid:366)ाधिकारी अथवा (cid:738)चालित आवेदन-प(cid:361) (cid:366)प(cid:361) एस.आर. 12 म(cid:336) परी(cid:407)ण के (cid:574) होगा, जहाँ ऐसा यान (cid:366)चालित रजि(cid:720)(cid:332) ीकता(cid:330) (cid:366)ाधिकारी या ऐसे (cid:366)ाधिकृ त किया जा रहा हो। अ(cid:586) रा(cid:475) म(cid:336) यान (cid:366)चालित परी(cid:407)ण के (cid:574) को जिसके काय(cid:330)(cid:407)े(cid:361) म(cid:336) यान किये जाने की दशा म(cid:336) विहित (cid:366)ाधिकारी, रखा जाता हो या जिसके काय(cid:330)(cid:407)े(cid:361) के अ(cid:566)ग(cid:330)त उ(cid:517)र (cid:366)देश के निकटतम जिले का उस माग(cid:330) या (cid:407)े(cid:361) का जिस पर यान से रजि(cid:720)(cid:332) ीकता(cid:330) (cid:366)ाधिकारी अथवा (cid:738)चालित स(cid:638)(cid:304)(cid:576)त परमिट का वि(cid:721)ार हो, (cid:366)मुख भाग

भी है, किया जायेगा।

परी(cid:407)ण के (cid:574) होगा : पर(cid:566)ु यह कि यदि के (cid:574)ीय मोटर यान नियम, 1989 के नियम 62 म(cid:336) विनिदि(cid:330) (cid:700) परी(cid:407)णों का संचालन किसी जिला, जहाँ यान रजि(cid:720)(cid:332) ीकृ त किया गया हो, से भि(cid:580) किसी जिला म(cid:336), किसी निरी(cid:407)णकता(cid:330) अधिकारी या (cid:366)ाधिकृ त परी(cid:407)ण के (cid:574) (cid:554)ारा किया जाता है वहाँ निरी(cid:407)णकता(cid:330) अधिकारी, जिसने परी(cid:407)ण संचालित किया हो, उसी दिवस या अनुवत(cid:334) काय(cid:330)दिवस म(cid:336) अपनी निरी(cid:407)ण (cid:303)रपोट(cid:330) (cid:366)प(cid:361) 38क म(cid:336) parivahan.gov.in/vahan पोट(cid:330)ल पर अपलोड करे गा और यदि निरी(cid:407)णकता(cid:330) अधिकारी (cid:554)ारा यान, अधिनियम तथा नियमावली के उपबंधों के अनुपालन के अनु(cid:349)प पाया जाता है तो रजि(cid:720)(cid:332) ीकता(cid:330) (cid:366)ाधिकारी (cid:554)ारा ठीक हालत म(cid:336) होने का (cid:366)माण-प(cid:361) जारी किये जाने हेतु अपने ह(cid:721)ा(cid:407)र तथा मुहर से निरी(cid:407)ण (cid:303)रपोट(cid:330), रजि(cid:720)(cid:332) ीकता(cid:330) (cid:366)ाधिकारी को निरी(cid:407)ण (cid:303)रपोट(cid:330) के दिनांक से प(cid:574)ह दिवस के भीतर (cid:729)ीड पो(cid:720) से (cid:366)ेषित भी करे गा और उसकी एक (cid:366)ति यान चालक को दी जायेगी: पर(cid:566)ु यह और कि ठीक हालत म(cid:336) होने का अगला (cid:366)माण-प(cid:361) निरी(cid:407)णकता(cid:330) अधिकारी या रजि(cid:720)(cid:332) ीकता(cid:330) (cid:366)ाधिकारी के जिला, जहाँ यान रजि(cid:720)(cid:332) ीकृ त किया गया हो, के किसी (cid:366)ाधिकृ त परी(cid:407)ण के (cid:574) से (cid:366)ा(cid:593) किया जायेगा।

वि(cid:552)मान नियम ,rn~}kjk (cid:366)ति(cid:830)थापित नियम

(ख) किसी यान को निरी(cid:407)ण हेतु (cid:366)(cid:721)ुत किये जाने पर तथा मोटर यान अधिनियम, 1988 तथा त(cid:544)ीन बनायी गयी नियमावली के उपब(cid:576)ों का अनुपालन किये जाने पर रजि(cid:720)(cid:332) ीकता(cid:330) (cid:366)ाधिकारी अथवा (cid:366)ाधिकृ त परी(cid:407)ण के (cid:574) यान के ठीक हालत म(cid:336) होने का (cid:366)माण-प(cid:361) (cid:738)ीकृ त करे गा। (ग) (cid:738)ामी, यान के निरी(cid:407)ण हेतु ठीक हालत म(cid:336) होने का (cid:366)माण-प(cid:361) समा(cid:593) होने के दिनांक से अनधिक 60 दिन पूव(cid:330) किसी काय(cid:330)दिवस म(cid:336) रजि(cid:720)(cid:332) ीकता(cid:330) (cid:366)ाधिकारी अथवा (cid:366)ाधिकृ त परी(cid:407)ण के (cid:574) के सम(cid:407) के (cid:574)ीय मोटरयान नियम, 1989 के नियम 81 म(cid:336) विनिदि(cid:330) (cid:700) परी(cid:407)ण फीस के साथ यान (cid:366)(cid:721)ुत कर सकता है। (घ) यदि यान परी(cid:407)ण म(cid:336) असफल हो जाता है तो पुनः परी(cid:407)ण हेतु यान-(cid:738)ामी के (cid:574)ीय मोटरयान नियम, 1989 के नियम 81 (cid:554)ारा विनिदि(cid:330)(cid:700) परी(cid:407)ण शु(cid:651) जमा कर यान को किसी काय(cid:330) दिवस म(cid:336) (cid:366)(cid:721)ुत कर सकता है। (ङ) निरी(cid:407)णकता(cid:330) अधिकारी अथवा (cid:366)ाधिकृ त परी(cid:407)ण के (cid:574) (cid:554)ारा निरी(cid:407)ण एवं परी(cid:407)ण (cid:303)रपोट(cid:330) (cid:366)प(cid:361) एस.आर.-12 म(cid:336) तैयार किया जायेगा। (च) यदि यान के ठीक हालत म(cid:336) होने के (cid:366)माण प(cid:361) की समा(cid:304)(cid:593) के प(cid:686)ात् किसी दिनांक को यान के ठीक हालत म(cid:336) होने का (cid:366)माण-प(cid:361) का नवीकरण किया जाता है तो नवीकरण (cid:366)माण-प(cid:361) जारी किये जाने के दिनांक से (cid:366)भावी होगाः पर(cid:566)ु यह कि जहां यान के ठीक हालत म(cid:336) होने का (cid:366)माण-प(cid:361) समा(cid:593) होने के पूव(cid:330) किसी दिनांक को यान के ठीक हालत म(cid:336) होने का (cid:366)माण-प(cid:361) का नवीकरण किया जाता है वहाँ नवीकरण यान के ठीक हालत म(cid:336) होने का (cid:366)माण-प(cid:361) समा(cid:593) होने के दिनांक से (cid:366)भावी होगा।

(2) निकाल दिया गया।

(2) रजि(cid:720)(cid:332) ीकता(cid:330) (cid:366)ाधिकारी या (cid:366)ाधिकृ त परी(cid:407)ण के (cid:574) जिसके (cid:554)ारा ठीक हालत म(cid:336) होने का (cid:366)माण-प(cid:361) जारी किया गया था उस पर यान के अगले निरी(cid:407)ण के लिये दिनांक पृ(cid:703)ांकित कर सकता है और तद् नुसार (cid:738)ामी यान को निरी(cid:407)ण के लिये (cid:366)(cid:721)ुत करायेगा।

(3) निकाल दिया गया।

(3) यदि उपनियम (2) म(cid:336) यथा (cid:681)व(cid:304)(cid:830)थत (cid:366)माण-प(cid:361) पृ(cid:703)ांकित नही ं किया गया है तो (cid:738)ामी (cid:366)माण-प(cid:361) की समा(cid:304)(cid:593) के कम से कम एक माह के भीतर (cid:366)प(cid:361) एस.आर.-13 म(cid:336) आवेदन-प(cid:361) दे गा और ऐसे दिनांक को और ऐसे समय और (cid:830)थान पर जैसा रजि(cid:720)(cid:332) ीकता(cid:330) (cid:366)ाधिकारी त(cid:523)(cid:686)ात् यु(cid:304)(cid:389)यु(cid:389) नोटिस पर नियत करे , यान को निरी(cid:407)ण के लिये (cid:366)(cid:721)ुत करायेगा।

(4)  यदि  (cid:738)ामी  उपनियम  (2)  के   अधीन            (4)  यदि  (cid:738)ामी  यान  के   ठीक  हालत  म(cid:336)  होने  का
नियत  दिनांक  को  या  उपनियम  (3)  के                     (cid:366)माण-प(cid:361)  समा(cid:593)  होने  के   पूव(cid:330)  निरी(cid:407)ण  हेतु  यान
अधीन नियत दिनांक, समय और (cid:830)थान पर                  (cid:366)(cid:721)ुत  करने  म(cid:336)  विफल  रहता  है  तो  वह  के (cid:574)ीय
यान को (cid:366)(cid:721)ुत करने म(cid:336) विफल रहता है तो मोटरयान  नियम,  1989  के   नियम  81  म(cid:336)  विनिदि(cid:330)(cid:700)
वह  से(cid:564)(cid:332) ल  (cid:349)(cid:676)  के   नियम  81  के   सारणी फीस  की  धनराशि  और  उसके   बराबर  अति(cid:303)र(cid:389)
के   (cid:354)म  सं(cid:421)ा  11  पर  विनिदि(cid:330)(cid:700)  फीस  की धनराशि का भुगतान करने का दायी होगा।

The following draft rules which the Governor proposes to make in exercise of the powers under Sections 65, 95, 96, 111 of the Motor Vehicles Act, 1988 (Act no. 59 of 1988) read with Section 21 of the General Clauses Act, 1897 (Act no.10 of 1897) with a view to amending the Uttar Pradesh Motor Vehicle Rules, 1998 is hereby published under sub section (1) of Section 212 of the said Act of 1988 for information of all concerned and with a view to inviting objections and suggestions in respect thereof.

2. Objections and suggestions (if any) with respect to the proposed rules should be sent in writing addressed to the Vishesh Sachiv, Parivahan Anubhag-4, Uttar Pradesh Shasan, Room no. 711, 7th floor, Bapu Bhawan, U.P. Secretariat, Lucknow. Only such objections and suggestions shall be taken into consideration as are received within thirty days from the date of publication of this notification in the Gazette.

THE UTTAR PRADESH MOTOR VEHICLE (TWENTY NINTH AMENDMENT) RULES, 2023

1-(1) These rules may be called the Uttar Pradesh Motor Vehicle (Twenty Ninth Short title and commencement Amendment) Rules, 2023.

(2) They shall come into force with effect from the date of their publication in the

Gazette.

2-In the Uttar Pradesh Motor Vehicle Rules, 1998 (hereinafter referred to as the said rules), for rule 39 set out in column-1 below, the rule as set out in column-2 shall be substituted, namely:-

39. Certificate of fitness-Grant and issue –(1)(a) For the purpose of Section 56, the prescribed authority shall be the registering authority or Automated Testing Station of any district of the State, where such vehicle is being operated. In case the vehicle is operating in other state, the prescribed authority shall be the registering authority or Automated Testing Station of the nearest district of Uttar Pradesh:

39. Certificate of fitness-Grant and issue-(1) For the purpose of Section-56, the prescribed authority shall be the registering authority. An application for the issue of a certificate of fitness shall be made in Form-SR-12 to the registering authority or the authorised testing station, in whose functional area the vehicle is kept or whose functional area includes the major portion of the route or area to which the permit relating to the vehicle extends.

Provided that if the tests specified in Rule 62 of Central Motor vehicle Rules, 1989, are conducted by an Inspecting Officer or authorised testing station in any district other than the district, where the vehicle is registered, the Inspecting Officer who conducted the tests shall, on the same day or on the following working day, upload his inspection report in Form 38A at the portal parivahan.gov.in/vahan and also send the inspection report signed under his hand and seal to the registering authority by speed post for issue of certificate of fitness by the registering authority within fifteen days from the date of the inspection report, if the vehicle is found by the Inspecting Officer to be in compliance with the provisions of the Act and rules and a copy shall be given to the driver of the vehicle:

Provided further that the next fitness certificate is obtained from the inspecting officer or an authorised testing station in the district of the registering authority where the vehicle is registered.

(b) The registering authority or the authorised testing station shall grant certificate of fitness when a vehicle is produced for the inspection and complies with the provision of the Motor Vehicles Act, 1988 and rules made there under.

(c) The owner may produce the vehicle for inspection before the registering authority or the authorised testing station on any working day not more than 60 days before expiry of fitness certificate along with test fee specified in rule 81 of the Central Motor Vehicles Rules, 1989.

(d) If the vehicle fails in the test, the owner may produce the vehicle for retest along with test fee as specified in rule 81 of the Central Motor Vehicles Rules, 1989.

(e) The inspection and test report shall be made in Form- SR-12 by the inspecting officer or authorized testing station.

(f) If the vehicle fitness certificate is renewed on any date after the expiry of fitness certificate, the renewal shall be effective from the date of issue of the certificate:

(4) If the owner fails to produce the vehicle for inspection before expiry of fitness certificate, he shall be liable to pay an amount equivalent to and in addition to the amount of the fee specified in rule 81 of the Central Motor Vehicles Rules, 1989.

(4) If the owner fails to produce the vehicle on the date appointed under sub- rule (2) or on the date, time and place as appointed under sub-rule (3) he shall be liable to pay an amount equivalent to and in addition to the amount of fee specified at Serial 11 of the Table of Rule 81 of the Central Rules.
