In pursuance of the provisions of clause (3) of Article 348 of the Constitution of India, the Governor is pleased to order the publication of the following English translation of notification no. 133/65-3-2023-01/2017, dated April 26, 2023:

Whereas the draft of the Uttar Pradesh Rights of Persons with Disabilities (Second Amendment) Rules, 2023 was published by Government notification no. 26/65-3-2023-01-2017 dated February 3, 2023 with a view to inviting objections and suggestions from all concerned likely to be affected thereby as required under sub-section (1) of section 101 of the Rights of Persons with Disabilities Act,2016;
AND WHEREAS objections and suggestions recieved in pursuance of the aforesaid notification on the said draft have been considered by the State Government .
mRrj çns'k vlk/kkj.k xtV] 26 vçSy] 2023 3NOW, THEREFORE, in exercise of the powers conferred under section 101 of the Rights of
Persons with Disabilities Act, 2016 (Act no. 49 of 2016) read with section 21 of the General Clauses Act,
1897 (Act no. 10 of 1897), the Governor is pleased to make the following rules with a view to
amaneding the Uttar Pradesh Rigths of Persons with Disabilities Rules, 2017:-
THE UTTAR PRADESH RIGHTS OF PERSONS WITH DISABILITIES (SECOND AMENDMENT) RULES, 2023
1-(1) These rules may be called the Uttar Pradesh Rights of Persons with Short title and commencement Disabilities (Second Amendment) Rules, 2023.
(2) They shall come into force on the date of their final publication in
the Gazette.
Amendment of rule 21
2. In the Uttar Pradesh Rights of Persons with Disabilities Rules, 2017 (hereinafter referred to as the 'said rules'), for the existing clause (c) of sub-rule (1) of rule 21 set out in Column-I below, the clause as set out in column-II shall be substituted, namely :–

(c) he is less than fifty-six years of age as on the 1st January of the year of recruitment;
(c) he is maximum fifty-nine years old as on 1st January of the year of recruitment;
3. In the said rules, for the existing rule 23 set out in Cloumn-I below, the
rule as set out in Column-II shall be substituted, namely:-

23(1) The State Commissioner shall be appointed on full time basis for a period of three years from the date on which he assumes office, or till he attains the age of sixty-five years, whichever is earlier.
23(1) The State Commissioner shall be appointed on full time basis for a period of three years from the date on which he assumes office. A person may serve as State Commissioner for only one term.
(2) Omitted
(2) A person may serve as State Commissioner for a maximum of two terms, subject to the upper age limit of sixty-five years.
