चू ंकि साधारण ख(cid:503) अधिनियम, 1897 (अधिनियम सं(cid:421)ा 10 सन् 1897) की धारा 21 के साथ पठित मोटर यान अधिनियम, 1988 (अधिनियम सं(cid:421)ा 59 सन् 1988) की धारा 211 और धारा 65 की उपधारा (2) के ख(cid:503) (ज) के अधीन श(cid:304)(cid:389)यों का (cid:366)योग करके , उ(cid:517)र (cid:366)दे श मोटरयान नियमावली, 1998 को संशोधित करने की n`f"V से, उ(cid:389) अधिनियम सन् 1988 की धारा 212 की उपधारा (1) की अपे(cid:407)ानुसार नि(cid:817)नलि(cid:304)खत नियमावली का (cid:366)ा(cid:349)प अधिसूचना सं(cid:421)ा 10/2023/457/तीस-4-2023-8(19)/2018टीसी, दिनांक 5 अ(cid:366)ैल, 2023 (cid:554)ारा गजट म(cid:336) (cid:366)काशित किया गया था;

और, चू ंकि, (cid:366)(cid:721)ावित नियमावली के स(cid:638)(cid:576) म(cid:336) विहित अवधि के भीतर किसी से कोई आप(िcid:517) एवं सुझाव (cid:366)ा(cid:593) नही ं (cid:352)ए;

अतएव, अब, साधारण ख(cid:503) अधिनियम, 1897 (अधिनियम सं(cid:421)ा 10 सन् 1897) की धारा 21 के साथ पठित मोटर यान अधिनियम, 1988 (अधिनियम सं(cid:421)ा 59 सन् 1988) की धारा 211 और धारा 65 की उपधारा (2) के ख(cid:503) (ज) के अधीन श(cid:304)(cid:389)यों का (cid:366)योग करके , रा(cid:475)पाल उ(cid:517)र (cid:366)दे श मोटर यान नियमावली, 1998 को संशोधित करने की n`f"V से नि(cid:817)नलि(cid:304)खत नियमावली बनाती ह(cid:339):-

उ(cid:517)र (cid:366)दे श मोटरयान (तीसवाँ संशोधन) नियमावली, 2023

1–(1) यह नियमावली उ(cid:517)र (cid:366)दे श मोटर यान (तीसवाँ संशोधन) नियमावली, 2023 कही सं(िcid:407)(cid:593) नाम और (cid:366)ार(cid:641) जायेगी।

(2) यह गजट म(cid:336) (cid:366)काशित किये जाने के दिनांक से (cid:366)वृ(cid:517) होगी।

नियम 50 का

2–उ(cid:517)र (cid:366)देश मोटरयान नियमावली, 1998 म(cid:336), नीचे (cid:721)(cid:641)-1 म(cid:336) दिये गये वि(cid:552)मान संशोधन

नियम 50 के (cid:830)थान पर (cid:721)(cid:641)-2 म(cid:336) दिया गया नियम रख दिया जायेगा, अथा(cid:330)त् ः -

(cid:366)ित(cid:830)थािपत िनयम 50–रजि(cid:720)(cid:332) ीकरण फीस के भुगतान से 50–रजि(cid:720)(cid:332) ीकरण फीस के भुगतान से छू ट- नि(cid:635)लि(cid:304)खत विवरणों के मोटर यानों के छू ट- नि(cid:635)लि(cid:304)खत विवरणों के मोटर यानों के रजि(cid:720)(cid:332) ीकरण के लिए कोई फीस नही ं ली रजि(cid:720)(cid:332) ीकरण अथा(cid:330)त् रजि(cid:720)(cid:332) ीकरण, पुनः जाएगीः -

रजि(cid:720)(cid:332) ीकरण एवं ठीक हालत म(cid:336) होने (परी(cid:407)ण

तथा (cid:366)माण-प(cid:361) निग(cid:330)मन) के लिए कोई फीस

(cid:366)भा(cid:303)रत नही ं की जाएगीः -

(एक) कृ षि (cid:366)योजनों के लिए अन(cid:586) (cid:349)प (एक) कृ षि (cid:366)योजनों के लिए अन(cid:586) (cid:349)प से (cid:366)योग किए जाने वाले ट(cid:332) ै(cid:387)र और से (cid:366)यु(cid:779)त ट(cid:332) ै(cid:387)र और लोकोमोटिव;

लोकोमोटिव,

(दो) पूत(cid:330) सं(cid:830)थाओं के (cid:738)ामि(cid:533)ाधीन और (दो) पूत(cid:330) सं(cid:830)थाओं के (cid:738)ामि(cid:533)ाधीन और के वल बीमारों या घायलों के प(cid:303)रवहन के लिए बीमारों या घायलों के प(cid:303)रवहन के लिए अन(cid:586) अन(cid:586) (cid:349)प से (cid:366)योग किये जाने वाले मोटर (cid:349)प से (cid:366)यु(cid:779)त मोटर ए(cid:638)ुले(cid:588);

ए(cid:638)ुले(cid:588),

(तीन) ऐसे मोटर वाहन जो सरकार के (तीन) ऐसे मोटर यान, जो या तो सरकार (cid:738)ामि(cid:533)ाधीन हों या त(cid:534)मय सरकार की सेवा के (cid:738)ामि(cid:533)ाधीन हों या त(cid:534)मय सरकार की म(cid:336) हों,

सेवा म(cid:336) हों;

(चार) के (cid:574)ीय मोटरयान नियम, 1989 के

अधीन जारी मोटर यान (यान (cid:716)े पिंग सुविधा

का रजि(cid:720)(cid:332) ीकरण और काय(cid:330)) नियम, 2021 के

अधीन (cid:830)थापित रजि(cid:720)(cid:332) ीकृ त यान (cid:716)े पिंग

सुविधा के (cid:574) म(cid:336) (cid:716)े प किये गये मोटर यानों पर

इस अधिसूचना के दिनांक से एक वष(cid:330) के लिए।

IN pursuance of the provisions of clause (3) of Article 348 of the Constitution of India, the Governor is pleased to order the publication of the following English translation of notification no. 21/2023/814/XXX-4–2023-8(19)-2018 TC, dated June 12, 2023 :

WHEREAS in exercise of the powers under clause (h) of sub-section (2) of the section 65 and section 211 of the Motor Vehicles Act, 1988 (Act no. 59 of 1988) read with section 21 of the General Clauses Act, 1897 (Act no. 10 of 1897) the following draft rules were published in the Gazette, vide notification no. 10/2023/457/XXX-4–2023-8(19)-2018 TC, dated April 5, 2023 as required under sub-section (1) of section 212 of the said Act of 1988 with a view to amend the Uttar Pradesh Motor Vehicles Rules, 1998;

AND, WHEREAS, no objections and suggestions were received from anyone within the prescribed period with respect to the proposed rules;

NOW, THEREFORE, in exercise of the powers under clause (h) of sub-section (2) of the section 65 and section 211 of the Motor Vehicles Act, 1988 (Act no. 59 of 1988) read with section 21 of the General Clauses Act, 1897 (Act no. 10 of 1897), the Governor is pleased to make the following rules with a view to amend the Uttar Pradesh Motor Vehicles Rules, 1998.

THE UTTAR PRADESH MOTOR VEHICLES (THIRTIETH AMENDMENT)

RULES, 2023

Short title and 1. (1) These rules may be called the Uttar Pradesh Motor Vehicles (Thirtieth

commencement Amendment) Rules, 2023.

(2) It shall come into force with effect from the date of publication in the

official Gazette.

Amendment of

2. In the Uttar Pradesh Motor Vehicles Rules, 1998, for the existing rule 50 set rule 50

out in Column-I below the rule as set out in Column-II shall be substituted, namely :–

50. Exemption from payment of registration fees- No fee shall be charged for the registration of motor vehicles of the following descriptions-

50. Exemption from payment of registration fees- No fee shall be charged for the registration i.e., registration, re-registration and fitness (test and issuance of certificate) of motor vehicles of following descriptions :-

(i) Tractors and locomotives used (i) Tractors and locomotives used

solely for agricultural purposes;

solely for agricultural purposes;

(ii) Motor ambulances owned by charitable institutions and used solely for the conveyance of sick or injured;

(ii) Motor ambulances owned by charitable institutions and used solely for the conveyance of sick or injured;

(iii) Motor vehicles either owned by Government or for the time being in the service of the Government;

(iii) Such motor vehicles as are owned by Government or are for the time being in the service of the Government.

(iv) Motor vehicles scrapped in the Registered Vehicle Scrapping Facility Centre established under Motor Vehicles (Registration and functions of Vehicle Scrapping Facility) Rules, 2021 issued under the Central Motor Vehicle Rules, 1989 for one year from the date of this notification.

(v) any electric vehicle (EV) purchased and registered in the State of Uttar Pradesh over a period of 03 years from the date of notification of Uttar Pradesh Electric Vehicle Manufacturing and Mobility Policy, 2022,i.e., 14.10.2022;

(vi) any electric vehicle (EV) manufactured, purchased and registered in Uttar Pradesh in the fourth and fifth year of effective period of Uttar Pradesh Electric Vehicle Manufacturing and Mobility Policy, 2022 notified on 14.10.2022 covered under sub-rule (v).

Explanation :– In sub-rule (v), Electric vehicles (EV) means all automobiles using an electric motor that are driven by either batteries, ultra- capacitors or fuel cells. This includes all 2-wheeler, 3-wheeler and 4-wheeler Strong Hybrid Electric Vehicle (HEV), Plug in Hybrid Electric Vehicle (PHEV), Battery Electric Vehicle (BEV) and Fuel Cell Electric Vehicle (FCEV).
