भूमि अज(cid:330)न, पुनवा(cid:330)सन और पुन(cid:826)य(cid:330)व(cid:830)थापन म(cid:336) उचित (cid:366)तिकर और पारदशि(cid:330)ता अधिकार अधिनियम, 2013 की धारा 11 की उपधारा (1) के अधीन उ(cid:797)तर (cid:366)दे श सरकार का यह समाधान हो गया है कि नाग(cid:303)रक उ(cid:493)यन विभाग, उ(cid:517)र (cid:366)देश शासन के मा(cid:559)म से लोक (cid:366)योजन अथा(cid:330)त् नॉएडा इ(cid:802)टरनेशनल एयरपोट(cid:330), जेवर के वि(cid:721)ारीकरण हेतु जिला-गौतमबु(cid:544)नगर, तहसील जेवर, परगना जेवर के (cid:356)ाम र(cid:590)ैरा म(cid:336) कु ल 1.5940 है(cid:387)ेयर भूमि की आव(cid:692)कता है। 2-सामाजिक समाघात निधा(cid:330)रण एजे(cid:588)ी के (cid:349)प म(cid:336) गौतमबु(cid:544) वि(cid:695)वि(cid:552)ालय, जिला गौतमबु(cid:544)नगर (cid:554)ारा सामाजिक समाघात निधा(cid:330)रण अ(cid:559)यन किया गया है तथा fo'ofo|ky; ने रा(cid:475) सरकार को अपनी अनुशंसाएं (cid:366)(cid:721)ुत कर दी ह(cid:339), जिसने उसकी अनुशंसाओं को प(cid:361) सं(cid:421)ा-106/2021/2466/छ(cid:596)न-2021-31/2016((cid:720)ेज-2), दिनांक 22 दिस(cid:638)र, 2021 (cid:554)ारा अनुमोदित कर दिया है।
3-सामाजिक समाघात निधा(cid:330)रण (cid:303)रपोट(cid:330) का सारांश नि(cid:635)ानुसार है ः -
नॉएडा इ(cid:802)टरनेशनल एयरपोट(cid:330), जेवर के वि(cid:721)ारीकरण ((cid:720)ेज-2/फे ज-1) की प(cid:303)रयोजना के विकास हेतु कु ल 1365 है(cid:779)टेयर भूमि की आव(cid:692)कता है। भूमि इ(cid:700)तमीकरण (Land Optimization) पर आधा(cid:303)रत तकनीकी समिति ने (cid:586)ूनतम भूमि आव(cid:692)कता के (cid:349)प म(cid:336) 1365 है(cid:387)ेयर भूमि (सरकारी भूमि को स(cid:304)(cid:643)लित करते (cid:352)ए) निधा(cid:330)(cid:303)रत किया है। (cid:366)(cid:721)ावित (cid:830)थल पर वि(cid:830)थापन को कम करने हेतु कोई आनुक(cid:304)(cid:665)क विक(cid:665) उपल(cid:617) नही ं है। वि(cid:830)थापित प(cid:303)रवारों को सड़क, पानी, fo|qr, मल-नाली, पाक(cid:330) , सामुदायिक भवन, वि(cid:552)ालय, चिकि(cid:534)ालयों जैसी मूलभूत सुविधाओं के साथ-साथ सामाजिक एवं सां(cid:715)ृ तिक पृ(cid:703)भूमि के अनु(cid:349)प म(cid:304)(cid:573)र/म(cid:304)(cid:719)द इ(cid:529)ादि जैसे धामि(cid:330)क (cid:830)थलों को भी उपल(cid:617) कराना होगा, जैसा कि सामाजिक समाघात निधा(cid:330)रण (cid:303)रपोट(cid:330) म(cid:336) निधा(cid:330)(cid:303)रत किया गया है।

ऐसे वि(cid:830)थापन का अप(cid:303)रहाय(cid:330) कारण यह है कि नॉएडा इ(cid:802)टरनेशनल एयरपोट(cid:330), जेवर के वि(cid:721)ारीकरण हेतु 1365 है(cid:387)ेयर भूमि अति (cid:586)ूनतम (absolute bare minimum) (cid:349)प म(cid:336) अपे(िcid:407)त है तथा वि(cid:830)थापन को कम करने हेतु कोई अ(cid:586) आनुक(cid:304)(cid:665)क विक(cid:665) उपल(cid:617) नही ं है।
5- iz'uxr प(cid:303)रयोजना के विकास हेतु अपे(िcid:407)त 1365 है(cid:779)टेयर भूमि म(cid:336) से निजी 1181.2793 है(cid:779)टेयर भूमि के स(cid:817)ब(cid:802)ध म(cid:336) भूमि अज(cid:330)न, पुनवा(cid:330)सन और पुन(cid:681)(cid:330)व(cid:830)थापन म(cid:336) उचित (cid:366)तिकर और पारदशि(cid:330)ता अधिकार अधिनियम, 2013 की धारा-11 के अधीन पूव(cid:330) म(cid:336) अधिसूचना सं(cid:421)ा 84/2022/1701/छ(cid:596)न-2022-31/2016((cid:720)ेज-2), दिनांक 18 नव(cid:638)र, 2022 जारी की गई। उ(cid:389) अधिसूचना म(cid:336), राज(cid:738) (cid:356)ाम र(cid:590)ेरा की गाटा सं(cid:421)ा 222/1, 222/2, 1012/1, 1012/2 एवं 1012/3 के (cid:830)थान पर गलत भूख(cid:503) सं(cid:421)ा 221/1, 221/2, 1212/1, 1212/2 एवं 1212/3 (cid:366)काशित हो गए थे। उ(cid:779)त अधिनियम की धारा 11 की उ(cid:779)त अधिसूचना म(cid:336) (cid:366)काशित गलत गाटा सं(cid:783)याओं को पृथक् करते (cid:352)ए भूमि अज(cid:330)न, पुनवा(cid:330)सन और पुन(cid:681)(cid:330)व(cid:830)थापन म(cid:336) उचित (cid:366)तिकर और पारदशि(cid:330)ता अधिकार अधिनियम, 2013 की धारा- 19(1) के अधीन अधिसूचना सं(cid:421)ा 53/2023/282/छ(cid:596)न-2023-31/2016((cid:720)ेज-2), दिनांक 18 अ(cid:366)ैल, 2023 जारी की गई। भूमि अज(cid:330)न, पुनवा(cid:330)सन और पुन(cid:681)(cid:330)व(cid:830)थापन म(cid:336) उचित (cid:366)तिकर और पारदशि(cid:330)ता अधिकार अधिनियम, 2013 से स(cid:817)ब(cid:304)(cid:576)त पूव(cid:330) म(cid:336) जारी अधिसूचना दिनांक 18 नव(cid:638)र, 2022 म(cid:336) गलत (cid:366)काशित भूख(cid:503) सं(cid:421)ा 221/1, 221/2, 1212/1, 1212/2 एवं 1212/3 के (cid:830)थान पर अब सही भूख(cid:503) सं(cid:421)ाएं 222/1, 222/2, 1012/1, 1012/2 एवं 1012/3, जिनका कु ल (cid:407)े(cid:361)फल 1.5940 है(cid:779)टेयर है, को इस अधिसूचना (cid:554)ारा अधिसूचित किया जा रहा है।
6-उ(cid:517)र (cid:366)देश शासन ने अधिसूचना सं(cid:421)ा 414/एक-13-2014-7क(8)/2014, दिनाँक 6 अग(cid:721), 2014 के मा(cid:559)म से यह उपब(cid:304)(cid:576)त किया है कि स(cid:638)(cid:304)(cid:576)त तहसील के यथा(cid:304)(cid:830)थति सहायक dysDVj या fMIVh dysDVj को, अपनी-अपनी (cid:407)े(cid:361)ीय अधिका(cid:303)रता के भीतर (cid:366)भावित प(cid:303)रवारों का पुनवा(cid:330)सन एवं पुन(cid:826)य(cid:330)व(cid:830)थापन हेतु (cid:366)शासक नियु(cid:389) किया जाएगा। (cid:366)(cid:827)नगत प(cid:303)रयोजना के लिए भूमि अज(cid:330)न, पुनवा(cid:330)सन और पुन(cid:681)(cid:330)व(cid:830)थापन म(cid:336) उचित (cid:366)तिकर और पारदशि(cid:330)ता अधिकार अधिनियम, 2013 की धारा-11 के अधीन अधिसूचना सं(cid:783)या 84/2022/1701/छ(cid:596)न-2022- 31/2016((cid:720)ेज-2), दिनांक 18 नव(cid:638)र, 2022 जारी की गई। fMIVh dysDVj, जेवर, जिला गौतमबु(cid:544)नगर को प(cid:303)रयोजना से (cid:366)भावित प(cid:303)रवारों के पुनवा(cid:330)सन एवं पुन(cid:826)य(cid:330)व(cid:830)थापन के (cid:366)योजन के लिए (cid:366)शासक नियु(cid:389) किया गया, जिसके (cid:554)ारा प(cid:303)रयोजना के लिए पुनवा(cid:330)सन और पुन(cid:826)य(cid:330)व(cid:830)थापन योजना तैयार कर आयु(cid:779)त, पुनवा(cid:330)सन और पुन(cid:826)य(cid:330)व(cid:830)थापन से अनुमोदित कराई जा चुकी है।
7-अतएव, रा(cid:475)पाल सव(cid:330)साधारण की सूचना के लिए अधिसूचित करती ह(cid:339) कि नीचे दी गई अनुसूची म(cid:336) उ(cid:304)(cid:671)(cid:304)खत भूमि की लोक (cid:366)योजन अथा(cid:330)त् नॉएडा इ(cid:802)टरनेशनल एयरपोट(cid:330), जेवर के वि(cid:830)तारीकरण के लिए आव(cid:692)कता है ः -

8-रा(cid:475)पाल dysDVj, जिला गौतमबु(cid:544)नगर को, भूमि अज(cid:330)न के (cid:366)योजन हेतु भूमि सव(cid:337)(cid:407)ण (cid:366)ार(cid:641) करने, उसे संचालित करने हेतु आव(cid:692)क कदम उठाने, किसी भूमि का समतलीकरण करने, अवमृदा की खुदाई करने अथवा उसका वेधन करने तथा पूव(cid:342)(cid:389) अधिनियम की धारा 12 के अधीन यथा उपब(cid:304)(cid:576)त एवं विनिदि(cid:330)(cid:700) समुचित काय(cid:330) नि(cid:707)ादन के लिए अपे(िcid:407)त अ(cid:586) सम(cid:721) काय(cid:330) करने के लिए भी (cid:366)ाधिकृ त करती ह(cid:339)।

IN pursuance of the provisions of clause (3) of Article 348 of the Constitution, the Governor is pleased to order the publication of the following English translation of notification no. 75/2023/781/Chhappan–2023-31-2016(Stage-2), dated July 18, 2023.

UNDER sub-section (1) of section 11 of The Right to Fair Compensation and Transparency in Rehabilitation and Resettlement Act, 2013, the Government of Uttar Pradesh is satisfied that a total of 1.5940 hectares of land is required in the village Ranhera, Pargana Jewar, Tehsil Jewar, district Gautambuddha Nagar for public purpose, namely, expansion of the Noida International Airport, Jewar through the Civil Aviation Department, Government of Uttar Pradesh.
2. Social Impact Assessment study was carried out by the Gautam Buddha University, District Gautambuddha Nagar as Social Impact Assessment agency and the University submitted its recommendations to the State Government, which has approved its recommendations vide Letter no. 106/2021/2466/Chhappan-2021-31/2016(Stage-2) dated 22nd December, 2021.
3. The summary of the Social Impact Assessment Report is as follows:-
A total land area of 1365 hectares is required for the expansion (Stage-2/ Phase-1) of Noida International Airport, Jewar. The technical committee based on land optimization has laid down 1365 hectares (including government land) as minimum land requirement. There are no other alternative options available on the proposed site to minimize the displacement. The displaced people have to be provided with basic amenities like Roads, Water, Electricity, Sewer, Park, Community Buildings, Schools, Hospitals along with religious places like Temples/Mosques etc., in accordance with their social and cultural background as laid down in the Social Impact Assessment report.
4. A total of 02 families are likely to be displaced due to said land acquisition.
The reason necessitating such displacement is that 1365 hectares of land which is required for the expansion of the Noida International Airport, Jewar is absolute bare minimum that is needed and no other alternative options are available to minimize the displacement.
5. Out of 1365 hectares of land required for the development of the project in question, Notification Number 84/2022/1701/Chhappan-2022-31/2016 (Stage-2), dated 18th November, 2022 issued earlier under Section-11 of The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 regarding 1181.2793 hectares of private land, in place of Gata Numbers 222/1, 222/2, 1012/1, 1012/2 and 1012/3 in the said notification of Revenue village Ranhera incorrect Plot numbers 221/1, 221/2, 1212/1, 1212/2 and 1212/3 were published. Notification Number 53/2023/282/Chhappan-2023-31/2016 (Stage-2), dated 18th April, 2023 issued under Section-19(1) of The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 has been issued leaving the incorrectly published plot numbers in the said notification under Section- 11 of the Act. In place of incorrectly published plot numbers 221/1, 221/2, 1212/1, 1212/2 and 1212/3 in the previously issued Notification Dated 18th November, 2022 of The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, now correct plot numbers 222/1, 222/2, 1012/1, 1012/2 and 1012/3 having total area 1.5940 hectares are being notified in this Notification.

The Government of Uttar Pradesh vide Notification no. 414/I-13-2014-7ka(8)-2014, dated 6th August, 2014 has provided that the Assistant Collector or Deputy Collector, as the case may be, of the concerned Tehsil shall be appointed Administrator for Rehabilitation and Resettlement of the affected families within the respective territorial jurisdiction thereof. For the project in question, Notification number 84/2022/1701/Chhappan-2022-31-2016 (Stage-2), dated 18th November, 2022, was issued under Section-11 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. Deputy Collector, Jewar, District Gautambuddh Nagar was appointed as Administrator for the purpose of rehabilitation and resettlement of the project affected families, by whom the Rehabilitation and Resettlement Scheme for the project has been prepared and same was approved by the Commissioner, Rehabilitation and Resettlement.
7. Therefore, the Governor is pleased to notify for general information that the land mentioned in the Schedule given below is needed for public purpose, namely, the expansion of the Noida International Airport, Jewar:-

8. The Governor is also pleased to authorize Collector, District Gautambuddha Nagar, for the purpose of land acquisition, to take necessary steps to enter upon, conduct survey of land, take levels of any land, dig or bore into the sub-soil and do all other Acts required for the proper execution of work as provided and specified under section 12 of the aforesaid Act.
9. Under section 15 of the aforesaid Act, any person whose interest lies in the land in question may within a period of 60 days after the publication of this notification, make an objection to the acquisition of land in the locality in writing to the Collector, District Gautambuddha Nagar.
10. Under section 11(4) of the aforesaid Act, no person without prior approval of the Collector, District Gautambuddha Nagar shall make any transaction or cause any transaction of land i.e. Sale/Purchase, specified in this notification or create any encumbrances on such land from the date of publication of this notification in the Gazette till such time as the proceedings of land acquisition are completed.
NOTE :– A site plan of the land taken up for such acquisition can be seen in the office of the Collector, district Gautambuddha Nagar.
