(अधिनियम संख्या 5 सन् 1938) की धारा 9 की उपधारा (1) के अधीन शक्तियों का प्रयोग करके , राज्यपाल तहसील सदर, जिला-राम र के (cid:7061)ाम टिकटगंज, पसिया र एवं आगा र के नीचे अ सूची में विनि(cid:7416)दष्ट गाटा संख्या वाले क्षेत्र, जिसका ल क्षेत्रफल 25.471 हे0/62.77 एकड़ है, को गोला चलाने के रेंज तथा रक्षा परिक्षेत्र के रूप में परिभाषित करती है जिसमें दिनांक 01 मार्च, 2023 को प्रारम्भ होने वाली और दिनांक 28 फरवरी, 2028 को समाप्त होने वाली पाँच वर्ष की अवधि के लिए के न्(cid:7076)ीय रिजर्व लिस बल रा ले क्षेत्र में गोला चलाने तथा तोप दागने का अ(cid:7012)यास किया जाना निम्नलिखित शत(cid:7300) के अध्यधीन प्राधिकृ त किया जा सकता है :-

1- के न्(cid:7076)ीय रिज़र्व पुलिस बल यु(cid:7373)ा(cid:7012)यास के प्रयोजन हेतु मुख्य रूप से अपनी भूमि का ही प्रयोग करेगा।

2- के न्(cid:7076)ीय रिजर्व पुलिस बल यु(cid:7373)ा(cid:7012)यास और खुले क्षेत्र में गोला चलाने तथा तोप दागने का अ(cid:7012)यास अधिनियम, 1938 के उपबन्धों का पालन करेगा।

3- के न्(cid:7076)ीय रिज़र्व पुलिस बल यह सुनि(िcid:7391)त करेगा कि पूर्ण सुरक्षा परिक्षेत्र में दर्शायी गयी भूमि पर

यु(cid:7373)ा(cid:7012)यास के दौरान जीवन और की न्यूनतम क्षति हो।

4- कोई सार्वजनिक मार्ग, यु(cid:7373)ा(cid:7012)यास के दौरान बंद नह(cid:7277) किया जायेगा। के न्(cid:7076)ीय रिजर्व पुलिस बल, यु(cid:7373)ा(cid:7012)यास के कारण निजी भूमि (फसलों) की (cid:7263)ई क्षति के मामले में यु(cid:7373)ा(cid:7012)यास और खुले क्षेत्र में गोला चलाने तथा तोप दागने का अ(cid:7012)यास अधिनियम, 1938 के उपबन्धों के अनुसार प्रतिकर का संदाय करेगा। यदि यु(cid:7373)ा(cid:7012)यास के दिवसों में मार्ग बंद कर दिये जाते हैं तो के न्(cid:7076)ीय रिज़र्व पुलिस बल अ(cid:7012)यास प्रारम्भ किये जाने के पूर्व माग(cid:7300) की संरक्षा करेगा और यातायात को रोके गा।

5- यद्यपि वन (संरक्षण) अधिनियम, 1980 के उपबंध उक्त खुले क्षेत्र में गोला चलाने के रेंज के सुरक्षा परिक्षेत्र हेतु लागू नह(cid:7277) है, किन्तु वन सरंक्षण के प्रयोजन के लिए, के न्(cid:7076)ीय रिज़र्व पुलिस बल विद्यमान वृक्षों के साथ छोटे-छोटे वृक्षों का चरणब(cid:7373) रूप से आरोपड़ करेगा जिससे कि वृक्षारोपण संहत हो जाय और क्षेत्र की ध्वनि प्रदूषण में भी कमी की जा सके ।

6- के न्(cid:7076)ीय रिजर्व पुलिस बल यु(cid:7373)ा(cid:7012)यास के दौरान वन संरक्षण के लिए पूर्ण प्रबंध करेगा और के न्(cid:7076)ीय रिजर्व पुलिस बल इस अवधि के दौरान कोई क्षति होने की स्थिति में नियमों के अनुसार प्रतिकर का संदाय करने के लिए भी उत्तरदायी होगा ।

7- के न्(cid:7076)ीय रिज़र्व पुलिस बल नियमों के अनुसार, (cid:7390)क्ति के जीवन, सम्पत्ति, पशु (मवेशी), फसलों आदि के किसी क्षति के लिए प्रतिकर का संदाय करेगा। उक्त रेंज का कमान अधिकारी गोलाबारी रेंज के अन्तर्गत और उसके निकट रहने वाले (cid:7390)क्तियों की सुरक्षा के लिए अके ले ही उत्तरदायी होगा।

8- के न्(cid:7076)ीय रिज़र्व पुलिस बल एक वचन पत्र देगा कि वह भविष्य में के न्(cid:7076) सरकार या राज्य सरकार द्वारा अधिरोपित शत(cid:7300) से आब(cid:7373) होगा ।

9- उक् त भूमि का नक् शा और विवरण जिला रामपुर के कलेक् टर कार्यालय में देखा जा सकता है।

इस प्रकार के न् (cid:7076)ीय रिजर्व पुलिस बल, रामपुर में करबला स्थित गोलाबारी रेंज की भूमि का विवरण निम्नानुसार है :-

THE Governor is pleased to order the publication of the following English translation of notification no. 441 /III-2023-7(vividh)-14, dated July 19, 2023 for general information :

Dated Lucknow, July 19, 2023

IN exercise of the powers under sub-section (1) of section 9 of the Manoeuvres Field Firing and Artillery Practice Act, 1938 (Act no. V of 1938), the Governor is pleased to define the area within Tehsil Sadar, Distt. Rampur, Village Ticketganj, Pasiyapur, and Agapur; gata no. specified in the Schedule below, total area of which is 25.471 Hectare/62.77 Acres, as firing range and absolute safety zone within which for a period of five years commencing on March 01, 2023 and ending with February 28, 2023 for carrying out field firing and artillery practice by the C.R.P.F. may be authorized subject to following conditions:-

1. C.R.P.F. shall prominently use its own land for the purpose of manoeuvres.

2. C.R.P.F. shall follow the provisions of the Manoeuvres, Field Firing and Artillery Practice Act, 1938.

3. C.R.P.F. shall ensure that there shall be minimum loss to life and property during manoeuvres on the land indicated in the Absolute Safety Zone.

4. No route for public shall be closed during manoeuvres. C.R.P.F. shall pay compensation as per the provisions of the Manoeuvres, Field Firing and Artillery Practice Act, 1938, in case of loss suffered by452_RPH_ Samanya Prasasan -2023_Data 4_ mRrj izns'k vlk/kkj.k xtV] 19 tqykbZ] 2023 5 the private land (crops) due to the manoeuvres. If, the routes are closed during the days of manoeuvres;

then C.R.P.F. shall guard the routes and stop the traffic before starting of exercise.

5. Though the provisions of the Forest (Conservation) Act, 1980 are not applicable to the safety zone of the said field firing range, but for the purpose of conservation of forest, C.R.P.F. shall plant small trees along with the existing trees in phases so that the plantation become compact and the noise pollution of the area can also be reduced.

6. C.R.P.F. shall make complete arrangements for the conservation of the forest during manoeuvres and C.R.P.F. shall also be responsible to pay compensation according to the rules in case of any loss during this period.

7. C.R.P.F. shall pay the compensation for any loss of life of person, property, animal (life stock), crops, etc. as per the rules. Commanding Officer of the said range shall solely be responsible for safety of the persons residing within and nearby of the firing range.

8. C.R.P.F. shall give an undertaking that it shall be bound by the conditions imposed by the Central Government or the State Government in future.

9. Map and details of land can be inspected in the office of Collector, District Rampur.
