सा0प0नि0&30 उत्तर प्रदेश साधारण ख(cid:7003)ड अधिनियम, 1904 (उत्तर प्रदेश अधिनियम संख्या 1 सन् 1904) की धारा 21 के साथ पठित संयुक्त प्रान्त आबकारी अधिनियम, 1910 उत्तर प्रदेश (अधिनियम संख्या 4 सन् 1910) की धारा 24-ख और 41 के अधीन शक्तियों का प्रयोग करके , आबकारी आयुक्त, उत्तर प्रदेश राज्य सरकार की पूर्व स्वीकृ ति से अधिसूचना संख्या-17951/दस- लाइसेंस-33/एफ0एल0, माडल शाप/2003-04 दिनांक 03 सितम्बर, 2003 द्वारा प्रकाशित उत्तर प्रदेश आबकारी (विदेशी मदिरा की माडल शाप के लिए फु टकर अनु(cid:6980)ापनों का (cid:7390)वस्थापन) नियमावली, 2003 में संशोधन करने की दृष्टि से निम्नलिखित नियमावली बनाते हैं-

उत्तर प्रदेश आबकारी (विदेशी मदिरा की माडल शाप के लिये फु टकर अनु(cid:6980)ापनों का (cid:7390)वस्थापन) (सोलहवॉ संशोधन)नियमावली,2023

1-संक्षिप्त नाम और प्रारम्भ-(1)यह नियमावली उत्तर प्रदेश आबकारी (विदेशी मदिरा की माडल शाप के लिये फु टकर अनु(cid:6980)ापनों का (cid:7390)वस्थापन)(सोलहवाँ संशोधन) नियमावली, 2023 कही जायेगी।

(2)यह दिनांक 1 अप्रैल, 2023 से प्रवृत्त (cid:7263)ई समझी जायेगी। 2-उत्तर प्रदेश आबकारी (विदेशी मदिरा की माडल शाप के लिये फु टकर अनु(cid:6980)ापनों का (cid:7390)वस्थापन) नियमावली, 2003,(जिसे आगे उक्त नियमावली कहा गया है),में नीचे स्तम्भ-1 में दिये गये नियम-2 के स्थान पर स्तम्भ-2 में दिया गया नियम रख दिया जायेगा, अर्थात्ः-2 mÙkj izns'k vlk/kkj.k xtV] 21 tqykbZ] 2023 bZ0 स्तम्भ-1 विद्यमान नियम

2-परिभाषाएं-

(घ्)"दैनिक लाइसेंस फीस" का तात्पर्य सम्पूर्ण वर्ष के लिए (घ्)"दैनिक लाइसेंस फीस" का तात्पर्य सम्पूर्ण वर्ष के लिए निर्धारित लाइसेंस फीस के 1/365 वें भाग से है।

कम ती(cid:7087)ता के मादक पेय से प्राप्त समान राजस्व से है।

कम ती(cid:7087)ता के मादक पेय से प्राप्त समतुल्य राजस्व से है;

(त)"प्रतिभूति धनराशि" का तात्पर्य लाइसेंस फीस के अनुसार (त)"प्रतिभूति धनराशि" का तात्पर्य लाइसेंस फीस के अनुसार राज्य सरकार द्वारा यथा निर्धारित धनराशि से है,जो जिला राज्य सरकार द्वारा यथा निर्धारित धनराशि से है,जो जिला आबकारी अधिकारी के पक्ष में गिरवीकृ त सावधि जमा आबकारी अधिकारी के पक्ष में गिरवीकृ त सावधि जमा रसीद रसीद/बैंक गारंटी के माध्यम से अथवा ई-पेमेन्ट के माध्यम के माध्यम से अथवा ई-पेमेन्ट के माध्यम से जमा की जायेगी से जमा की जायेगी तथा जो राज्य सरकार के समस्त दावों तथा जो राज्य सरकार के समस्त दावों और देयों के अन्तिम और देयों के अन्तिम निस्तारण के प(cid:7391)ात् वापस किये जाने निस्तारण के प(cid:7391)ात् वापस किये जाने योग्य है;

(थ)''ऋणशोधन क्षमता'' का तात्पर्य फु टकर लाइसेंस की

स्वीकृ ति के लिये आवेदन करने हेतु आवेदक के लिये

पुन(cid:7390र्)वस्थापन से है, जो समाचार पत्र एवं आबकारी विभाग की वेबसाइट के माध्यम से पूर्व नोटिस एवं संसूचना

देकर सप्ताह के किसी दिन में हो सकता है। आगामी वर्ष के

लिये दुकानों का (cid:7390)वस्थापन विगत वित्तीय वर्ष की समाप्ति

के पूर्व किया जा सकता है।

(2) इस नियमावली में परिभाषित किन्तु अधिनियम में

परिभाषित शब्दों और पदों के वही अर्थ होंगे जो अधिनियम परिभाषित शब्दों और पदों के वही अर्थ होंगे जो अधिनियम

में (cid:7059)मशः उनके लिये समनुदेशित हैं।

3- नियम-4 का संशोधन-उक्त नियमावली में, नीचे स्तम्भ-1 में दिये गये विद्यमान नियम-4 के स्थान पर स्तम्भ-2 में

दिया गया नियम रख दिया जायेगा, अर्थात्:-

तहसील कार्यालय और जिला आबकारी अधिकारी कार्यालय धनराशि को प्रद(cid:7414)शत करने वाली सूची कलेक्टर-कार्यालय, तहसील कार्यालय और जिला आबकारी अधिकारी कार्यालय

और प्रभारी उप आबकारी आयुक्त कार्यालय में प्रद(cid:7414)शत की

जायेगी। यह सूचना आबकारी विभाग की वेबसाइट

वर्ष की आयकर विवरणी की छायाप्रति (पांच) विहित छायाप्रति (चार)विहित प्रा(cid:7271)प में शपथ पत्र(पॉच)

राज्य सरकार द्वारा यथानिर्धारित दर से प्रसंस्करण राज्य सरकार द्वारा यथानिर्धारित दर से प्रसंस्करण फीस व उस पर देय मूल्य संव(cid:7414)धत कर / माल और सेवा कर का भुगतान आन लाइन किया जायेगा ।

4- नियम-7 का संशोधन- उक्त नियमावली में, नीचे स्तम्भ-1 में दिये गये विद्यमान नियम-7 के स्थान पर स्तम्भ-2 में दिया गया नियम रख दिया जायेगा, अर्थात् :-

8-आवेदक की पात्रता की शत(cid:7288)-

परन्तु यह और कि यदि संयुक्त रूप से दो (cid:7390)क्तियों द्वारा लाइसेंस अनुपलब्धता की स्थिति में उसका विधिक वारिस यदि अन्यथा पात्र हो, लाइसेंस की शेष अवधि के लिए लाइसेंसधारक बना रह सकता है।

परन्तु यह और कि यदि संयुक्त रूप से दो (cid:7390)क्तियों द्वारा लाइसेंस प्राप्त किया गया हो, तो किसी एक भागीदार की मृत्यु की स्थिति में जीवित (cid:7390)क्ति मृतक के विधिक वारिस (वारिसो) के साथ यदि अन्यथा पात्र हों, लाइसेंसधारी बना रह सके गा या दोनो (cid:7390)क्तियों की मृत्यु की दशा में उसके विधिक वारिस (वारिसो) यदि अन्यथा पात्र हो/हों अनु(cid:6980)ापनधारी बना रह सकता है/ रह सकते हैं। ऐसे दोनों (cid:7390)क्तियों के उत्तरदायित्वों में कोई भेद नह(cid:7277) किया जायेगा और दोनों संयुक्त (cid:7271)प से और अलग-अलग उत्तरदायी होगे।

(ख) आवेदन पत्र प्राप्त किये जाने के लिये नियत अवधि के प्राप्त किया गया हो, तो किसी एक भागीदार की मृत्यु की स्थिति में जीवित (cid:7390)क्ति एवं उपयु र्क्तानुसार चयनित मृत लाइसेंसधारी का नामनिद(cid:7287)शिती अथवा विधिक वारिस,यदि अन्यथा पात्र हों, लाइसेंसधारक बना रह सकता है। दोनों (cid:7390)क्तियों के विधिक उत्तरदायित्वों में कोई भेद नह(cid:7277) किया जायेगा, जो संयुक्त (cid:7271)प से और अलग-अलग उत्तरदायी होंगे;

(ख) आवेदन पत्र प्राप्त किये जाने के लिये नियत अवधि के प्रथम प्रथम दिवस पर इ(cid:7333)ीस वर्ष की आयु से अधिक हो।

(ग) अधिनियम के उपबन्धों या त(cid:7373)ीन बनायी गयी किसी दिवस पर इ(cid:7333)ीस वर्ष की आयु से अधिक हो;

(ग) अधिनियम के उपबन्धों या त(cid:7373)ीन बनायी गयी किसी नियमावली के अधीन आबकारी लाइसेंस धारण करने करने के लिये (cid:7390)ति(cid:7059)मी/काली सूची में न हो या विव(cid:7414)जत न किया गया हो। कोई (cid:7390)क्ति, जो आबकारी अपराध के लिये दोषसि(cid:7373) पाया गया हो, लाइसेंस धारण करने से स्वतः विव(cid:7414)जत हो जायेगा जब तक कि उसे सक्षम न्यायालय द्वारा पूर्णतः और अन्तिम रूप से दोशमुक्त न किया गया हो।

(गग)आवेदक किसी एक दुकान के लिए स्वयं के नाम से मात्र नियमावली के अधीन आबकारी लाइसेंस धारण करने करने के लिये (cid:7390)ति(cid:7059)मी/काली सूची में न हो या विव(cid:7414)जत न किया गया हो। कोई (cid:7390)क्ति, जो आबकारी अपराध के लिये दोषसि(cid:7373) पाया गया हो, लाइसेंस धारण करने से स्वतः विव(cid:7414)जत हो जायेगा जब तक कि उसे सक्षम न्यायालय द्वारा पूर्णतः और अन्तिम रूप से दोषमुक्त न किया गया हो;

(गग)आवेदक किसी एक दुकान के लिए स्वयं के नाम से मात्र एक एक आवेदन पत्र प्रस्तुत किये जाने के लिए पात्र होगा।

परन्तु नवीकरण की स्थिति में आवेदक एवं सह-आवेदक आवेदन पत्र प्रस्तुत किये जाने के लिए पात्र होगा:

परन्तु नवीकरण की स्थिति में आवेदक एवं सह- दोनों पात्र होगें और नवीकरण हेतु दोनों की सहमति आवश्यक होगी।

(घ) निम्नलिखित की पुष्टि में पब्लिक नोटरी द्वारा सम्यक रूप आवेदक दोनों पात्र होगें और नवीकरण हेतु दोनों की सहमति आवश्यक होगी;

(घ)निम्नलिखित की पुष्टि में पब्लिक नोटरी द्वारा सम्यक रूप से से सत्यापित शपथ-पत्र प्रस्तुत करेगा,

(एक) यह कि उसके पास समय-समय पर यथासंशोधित उत्तर सत्यापित शपथ-पत्र प्रस्तुत करेगा,अर्थात:-

(एक)यह कि उसके पास समय-समय पर यथासंशोधित उत्तर प्रदेश आबकारी की दुकानों की संख्या एवं स्थिति नियमावली, 1968 के उपबन्धों के अनुसार उस स्थान पर माडल शाप खोलने हेतु उपयुक्त परिसर है अथवा उसने किराये पर उस स्थान पर उपयुक्त परिसर का प्रबन्ध किया है।

प्रदेश आबकारी की दुकानों की संख्या एवं स्थिति नियमावली, 1968 के उपबन्धों के अनुसार उस स्थान पर माडल शाप खोलने हेतु उपयुक्त परिसर है अथवा उसने किराये पर उस स्थान पर उपयुक्त परिसर का प्रबन्ध किया है;

(दो)यह कि उसके दुकान का प्रस्तावित परिसर किसी विधि (दो)यह कि उसके दुकान का प्रस्तावित परिसर किसी विधि अथवा नियमों का उल्लंघन करके नि(cid:7414)मत नह(cid:7277) किया गया है।

(तीन)यह कि उसका एवं उसके परिवार के सदस्यों का नैतिक (तीन)यह कि उसका एवं उसके परिवार के सदस्यों का नैतिक चरित्र अ(cid:6994)छा है और उनकी कोई अपराधिक पृष्ठभूमि नह(cid:7277) है और संयुक्त प्रान्त आबकारी अधिनिमय, 1910 या स्वापक ओषधि और मनः प्रभावी पदार्थ अधिनियम, 1985 के अधीन द(cid:7003)डनीय किसी अपराध या किसी अन्य सं(cid:6980)ेय एवं गैर जमानती अपराध के लिये दोषसि(cid:7373) नह(cid:7277) किया गया हो।

(चार) यह कि लाइसेंसधारी के रूप में उसके चयनित हो जाने की दशा में जिला, जह(cid:7292) का निवासी है, के जिला कलेक्टर या सम्बन्धित जिला के पुलिस अधीक्षक/ वरिष्ठ पुलिस अधीक्षक या सम्बन्धित पुलिस कमिश्नरी के पुलिस आयुक्त द्वारा नामित, सहायक पुलिस आयुक्त की पंक्ति के अनिम्न अधिकारी द्वारा जारी प्रमाण-पत्र लाइसेंस निर्गत होने के पूर्व यह दर्शाते (cid:7263)ये प्रस्तुत करना होगा कि उसका एवं उसके परिवार के सदस्यो का नैतिक चरित्र अ(cid:6994)छा है एवं उनकी कोई अपराधिक पृष्ठभूमि या आपराधिक अभिलेख नह(cid:7277) है।

(पांच)यह कि वह किसी ऐसे (cid:7390)क्ति को वि(cid:7059)े ता या प्रतिनिधि के रूप में नियोजित नह(cid:7277) करेगा जिसकी कोई अपराधिक की दशा में जिला, जहाँ का निवासी है, के जिला कलेक्टर या सम्बन्धित जिला के पुलिस अधीक्षक/ वरिष्ठ पुलिस अधीक्षक या सम्बन्धित पुलिस कमिश्नरी के पुलिस आयुक्त द्वारा नामनि(cid:7416)दष्ट, सहायक पुलिस आयुक्त की पंक्ति के अनिम्न अधिकारी द्वारा जारी प्रमाण-पत्र लाइसेंस निर्गत होने के पूर्व यह दर्शाते (cid:7263)ये प्रस्तुत करना होगा कि उसका एवं उसके परिवार के सदस्यो का नैतिक चरित्र अ(cid:6994)छा है एवं उनकी कोई आपराधिक पृष्ठभूमि या आपराधिक अभिलेख नह(cid:7277) है;

(प(cid:7292)च) यह कि वह किसी ऐसे (cid:7390)क्ति को वि(cid:7059)े ता या प्रतिनिधि के रूप में नियोजित नह(cid:7277) करेगा जिसकी कोई आपराधिक पृष्ठभूमि होगी, जैसा कि उपरोक्त ख(cid:7003)ड-(तीन) में उल्लिखित है या जो किसी सं(cid:7059)ामक या छु आ-छू त रोग से (cid:7061)सित हो या इ(cid:7333)ीस वर्ष से कम आयु का हो या महिला हो।

लाइसेंसधारी को जिला आबकारी अधिकारी से अपने प्राधिकृ त वि(cid:7059)े ता/प्रतिनिधियों के फोटोयुक्त पहचान पत्र प्राप्त करेगा।

(छः)यह कि उस पर किसी सार्वजनिक देयों का या सरकारी पृष्ठभूमि होगी, जैसा कि उपरोक्त ख(cid:7003)ड-(तीन) में उल्लिखित है या जो किसी सं(cid:7059)ामक या छु आ-छू त रोग से (cid:7061)सित हो या इ(cid:7333)ीस वर्ष से कम आयु का हो या महिला हो।

लाइसेंसधारी जिला आबकारी अधिकारी से राज्य सरकार द्वारा समय-समय पर यथाविहित फीस संदाय करने पर अपने प्राधिकृ त वि(cid:7059)े ता/प्रतिनिधि का फोटोयुक्त नौकरनामा प्राप्त करेगा;

(छः)यह कि उस पर किसी सार्वजनिक देयों का या सरकारी देयों देयों का बकाया नह(cid:7277) है।

(सात)यह कि वह ऋणशोधक्षम है और आवश्यक निधि रखता है या कारोबार के संचालन के लिये आवश्यक निधि का का बकाया नह(cid:7277) है;

(सात)यह कि वह ऋणशोधक्षम है और आवश्यक निधि रखता है या कारोबार के संचालन के लिये आवश्यक निधि का प्रबन्ध प्रबन्ध कर लिया है, जिसका (cid:7390)ौरा, यदि अपेक्षित होगा, तो लाइसेंस प्राधिकारी को उपलब्ध करा देगा।

(आठ)यह कि आवेदक बार काउसिल से रजिस्ट्रीकृ त अधिवक्ता नह(cid:7277) है। यदि लाइसेंस प्राप्त कर लेने के प(cid:7391)ात् उसे बार कर लिया है, जिसका ब्यौरा, यदि अपेक्षित होगा, तो लाइसेंस प्राधिकारी को उपलब्ध करा देगा;

(आठ)यह कि आवेदक बार काउसिल से रजिस्ट्रीकृ त अधिवक्ता नह(cid:7277) है। यदि लाइसेंस प्राप्त कर लेने के प(cid:7391)ात् उसे बार काउसिल में रजिस्ट्रीकृ त अधिवक्ता पाया जाता है तो लाइसेंस निरस्त कर दिया जायेगा। राज्य सरकार का कर्मचारी लाइसेंस स्वीकृ ति हेतु आवेदन करने के लिये भी अनर्ह होगा।

(नौ)यह कि लाइसेंसधारी के (cid:7271)प में चयन हो जाने पर ऐसे काउसिल में रजिस्ट्रीकृ त अधिवक्ता पाया जाता है तो लाइसेंस निरस्त कर दिया जायेगा। राज्य सरकार का कर्मचारी लाइसेंस स्वीकृ ति हेतु आवेदन करने के लिये भी अनर्ह होगा;

(नौ)यह कि लाइसेंसधारी के (cid:7271)प में चयन हो जाने पर ऐसे चयन चयन के 48 घंटे के भीतर धरोहर धनराशि का बैंक (cid:7071)ॉ(cid:7010)ट, जिसे आन-लाइन आवेदन के साथ अपलोड किया गया हो,को जिला आबकारी अधिकारी के कार्यालय में जमा कर दिया जायेगा।

(दस)यह कि उसने धरोहर धनराशि के बैंक (cid:7071)ा(cid:7010)ट का प्रयोग के 48 घंटे के भीतर धरोहर धनराशि का बैंक (cid:7071)ॉ(cid:7010)ट,जिसे आन-लाइन आवेदन के साथ अपलोड किया गया हो,को जिला आबकारी अधिकारी के कार्यालय में जमा कर दिया जायेगा;

(दस)यह कि उसने धरोहर धनराशि के बैंक (cid:7071)ा(cid:7010)ट का प्रयोग इस इस चरण में किसी अन्य दुकान के आवेदन हेतु नही किया है।

(ङ)राज्य सरकार की पूर्व स्वीकृ ति से आबकारी आयुक्त द्वारा चरण में किसी अन्य दुकान के आवेदन हेतु नही किया है;

(ङ) राज्य सरकार की पूर्व स्वीकृ ति से आबकारी आयुक्त द्वारा यथा निर्धारित धरोहर धनराशि का बैंक (cid:7071)ॉ(cid:7010)ट, जो सम्बन्धित दुकान के जिला के जिला आबकारी अधिकारी के पक्ष में जारी हो, की स्कै न प्रति आनलाइन आवेदन के साथ आवेदक द्वारा अपलोड की जायेगी। लाइसेंसधारी के रूप में चयन हो जाने की दशा में धरोहर धनराशि का बैंक (cid:7071)ा(cid:7010)ट चयन के पष्चात् 48 घंटे के भीतर सम्बन्धित जिला आबकारी अधिकारी के कार्यालय में जमा करना आवश्यक होगा, जिसे आवेदक को सभी देयताओं के भुगतान के प(cid:7391)ात् वापस कर दिया जायेगा।

यथा निर्धारित धरोहर धनराशि का बैंक (cid:7071)ॉ(cid:7010)ट, जो सम्बन्धित दुकान के जिला के जिला आबकारी अधिकारी के पक्ष में जारी हो, की स्कै न प्रति आनलाइन आवेदन के साथ आवेदक द्वारा अपलोड की जायेगी।

स्तम्भ-1 विद्यमान नियम

स्तम्भ-2 एत(cid:7375)ारा प्रतिस्थापित नियम

(दो) लाइसेंस का नवीनीकरण न होने की स्थिति में

(दो) लाइसेंस का नवीनीकरण न होने की स्थिति में लाइसेंसधारियों का चयन आनलाइन आवेदन आमंत्रित करने के लाइसेंसधारियों का चयन आनलाइन आवेदन आमंत्रित करने के माध्यम से राज्य सरकार द्वारा यथा विहित ई-लाटरी अथवा ई- माध्यम से राज्य सरकार द्वारा यथा विहित ई-लाटरी अथवा ई- निविदा के माध्यम से दुकानवार किया जायेगा। जिला आबकारी निविदा के माध्यम से दुकानवार किया जायेगा। जिला आबकारी अधिकारी आनलाइन प्राप्त आवेदनों की संवीक्षा करेगा और समस्त अधिकारी आनलाइन प्राप्त आवेदनों की संवीक्षा करेगा और पात्र एवं अपात्र आवेदनों की सूची तैयार करेगा, जिसमें समस्त पात्र एवं अपात्र आवेदनों की सूची तैयार करेगा, जिसमें अपात्रता के कारणों का उल्लेख होगा और यह सूची ई-लाटरी अपात्रता के कारणों का उल्लेख होगा और यह सूची ई-लाटरी तथा ई-निविदा हेतु गठित लाइसेंस की जिला स्तरीय समिति के तथा ई-निविदा हेतु गठित लाइसेंस की जिला स्तरीय समिति के समक्ष प्रस्तुत करेगा।

आवेदक के पक्ष में सम्पूर्ण प्रदेश में सभी (cid:7088)ेणी की देशी सभी (cid:7088)ेणी की देशी शराब, माडल शाप, विदेशी मदिरा, एवं

बीयर की कु ल मिलाकर दो से अधिक दुकानें आवंटित नह(cid:7277) की शराब, माडल शाप, विदेशी मदिरा, एवं बीयर की कु ल जायेंगी।

परन्तु यह कि पूव(cid:7299)क्त निब(cid:7304)धन राज्य सरकार द्वारा निर्धारित परन्तु यह कि पूव(cid:7299)क्त निब(cid:7304)धन सीमा लाइसेंसधारी/ मानद(cid:7003)डों के अनुसार लाइसेंसो के नवीकरण एवं अनु(cid:6980)ापी की लाइसेंसधारियों की मृत्यु की स्थिति में नियम-8(क) में मृत्युकी दशा में विधिक वारिस के पक्ष में अनु(cid:6980)ापन के नामान्तरण उल्लिखित प्र(िcid:7059)या के अनुसार मृत लाइसेंसधारी से सम्बन्धित मामलों के लिए लागू नह(cid:7277) होगा।

/लाइसेंसधारियों के विधिक वारिस/परिवार के सदस्य/निकट

सम्बन्धी के पक्ष में लाइसेंस नवीकरण और नामान्तरण से

सम्बन्धित मामलों के लिए लागू नह(cid:7277) होगा।

प्राधिकारी दुकान के पुर्न(cid:7390)वस्थापन हेतु शासन द्वारा विहित

प्र(िcid:7059)या के माध्यम से तत्काल उपाय करेगा।

7- नियम-10 का संशोधन- उक्त नियमावली में, नीचे स्तम्भ-1 में दिये गये विद्यमान नियम-10 के स्थान पर स्तम्भ-2 में दिया गया नियम रख दिया जायेगा, अर्थात्ः-

10- लाइसेंस फीस और प्रतिभूति धनराशि का भुगतान- यदि किसी आवेदक को लाइसेंसधारी के (cid:7271)प में चयनित यदि किसी आवेदक को लाइसेंसधारी के (cid:7271)प में चयनित किया जाता है तो अपने चयन की सूचना की प्राप्ति के तीन कार्य किया जाता है तो अपने चयन की सूचना की प्राप्ति के तीन कार्य दिवसों के भीतर लाइसेंस फीस की सम्पूर्ण धनराशि जमा करेगा। दिवसों के भीतर लाइसेंस फीस की सम्पूर्ण धनराशि जमा करेगा।

स्थिति में पूर्व में नकद अथवा राष्ट्रीय बचत-पत्र के माध्यम से

जमा की गयी प्रतिभूति तब तक स्वीकार्य होगी, जब तक इसकी

वापसी न कर दी जाय।

परन्तु नवीकरण की स्थिति में पूर्व में नकद अथवा

राष्ट्रीय बचत-पत्र अथवा बैंक गारंटी के माध्यम से जमा की

गयी प्रतिभूति तब तक स्वीकार्य होगी, जब तक इसकी वापसी

न कर दी जाय।

अनुवर्ती वर्ष में दुकान का लाइसेंस, लाईसेंसधारी की इ(cid:6994)छा पर अनुवर्ती वर्ष में दुकान का लाइसेंस, लाईसेंसधारी की इ(cid:6994)छा पर राज्य सरकार द्वारा यथा निर्धारित मानद(cid:7003)ड के अनुसार नवीकृ त राज्य सरकार द्वारा यथा निर्धारित मानद(cid:7003)ड के अनुसार नवीकृ त किया जा सके गा। नवीकरण हेतु लाइसेंस फीस एवं प्रतिभूति के किया जा सके गा। नवीकरण हेतु लाइसेंस फीस एवं प्रतिभूति के अन्तर की धनराशि राज्य सरकार द्वारा यथा विनि(cid:7416)दष्ट निर्धारित अन्तर की धनराशि राज्य सरकार द्वारा यथा विनि(cid:7416)दष्ट निर्धारित अवधि में जमा की जायेगी।

अवधि में जमा की जायेगी:

परन्तु, यदि वह विहित अवधि के भीतर लाइसेंस फीस परन्तु, यदि वह विहित अवधि के भीतर लाइसेंस फीस या या प्रतिभूति धनराशि जमा करने में विफल रहता है तो उसका प्रतिभूति धनराशि जमा करने में विफल रहता है तो उसका चयन चयन निरस्त हो जायेगा;

परन्तु यह और कि ई लाटरी/ई टे(cid:7003)डर के माध्यम से लाइसेंस (cid:7018)यवस्थित होने की दशा में,उसकी धरोहर धनराशि तथा लाइसेंस (cid:7018)यवस्थित होने की दशा में,उसकी धरोहर धनराशि लाइसेंस फीस और प्रतिभूति धनराशि, यदि उसके द्वारा जमा की तथा लाइसेंस फीस और प्रतिभूति धनराशि, यदि उसके द्वारा गयी है, तथा लाइसेंस के नवीकृ त होने की दशा में उसकी गत जमा की गयी है, तथा लाइसेंस के नवीकृ त होने की दशा में वर्ष की जमा प्रतिभूति का 15 प्रतिशत तथा नवीकरण फीस व उसकी गत वर्ष की जमा प्रतिभूति का 15 प्रतिशत तथा लाइसेंस फीस, यदि उसके द्वारा जमा की गयी हो, राज्य सरकार नवीकरण फीस व लाइसेंस फीस, यदि उसके द्वारा जमा की के पक्ष में समप(cid:7265)त कर ली जायेगी और उक्त दुकान को तत्काल गयी हो, राज्य सरकार के पक्ष में समप(cid:7265)त कर ली जायेगी और सरकार द्वारा यथाविहित रीति से पुन(cid:7390र्)वस्थापित कर दिया उक्त दुकान को तत्काल सरकार द्वारा यथाविहित रीति से जायेगा।

पुन(cid:7390र्)वस्थापित कर दिया जायेगा।

हेतु निर्धारित प्रतिफल शुल्क के समतुल्य की विदेशी मदिरा, बीयर, वाइन एवं कम ती(cid:7087)ता के मादक

hereby makes the following rules with a view to amend the Uttar Pradesh Excise (Settlement of Retail

Licences for Model Shop of Foreign Liquor) Rules,2003 published vide Notification no. 17951/X-Licence-

33/F.L.Model Shop/2003-2004, dated September 03, 2003.

THE UTTAR PRADESH EXCISE (SETTLEMENT OF RETAIL LICENCES

FOR MODEL SHOP OF FOREIGN LIQUOR)

(SIXTEENTH AMENDMENT) RULES, 2023

1. Short title and commencement-(1) These rules may be called the Uttar Pradesh Excise

(Settlement of Retail Licences for Model Shop of Foreign Liquor)(Sixteenth Amendment) Rules, 2023.

(2) They shall be deemed to have come into force with effect

from 1st April, 2023.

2. Amendment of Rule 2–In the Uttar Pradesh Excise (Settlement of Retail Licences for Model Shop for Foreign Liquor) Rules, 2003, (hereinafter referred to as the "said rules") for rule-2 set out in Column-I below, the rule as set out in Column-II, shall be substituted, namely:-

(a) "Act" means the United Provinces Excise Act, 1910 as amended from time to time;

(b) "Additional Consideration fee" means difference amount obtained as a result of rounding off the maximum retail price of foreign liquor and beer to the next multiple of 10 rupees, which shall be payable at Distillery/Brewery level and recoverable by distillery/ brewery from wholesale supplier in addition to Ex-Distillery Price/Ex-Brewery price and which in turn could be recovered by wholesale supplier from retail licensee in addition to maximum wholesale price;

(c) "consideration fee" means a fee for foreign liquor ,wine, beer and low alcoholic beverages as fixed by the State Government under section 30 of the Act, which shall be deposited in treasury by the licensee prior to supply of foreign liquor, wine, beer and low alcoholic beverages.

(d) "Daily License Fee" means 1/365th part of the fixed license fee for the whole year;

(e) "Earnest money" means the amount equal to one-tenth of the amount of licence fee, to be tendered with application form, for ensuring the fulfillment of the eligibility conditions for the grant of license and is liable to be forfeited in case of default under provisions of rule-10 of these rules;

(f) "Excise Year" means the financial year commencing from 1st April to 31st March of the next calendar year;

(g) "Family" means and includes spouse (husband or wife), dependent son (s), unmarried daughter (s) and dependent parents;

(h) "Foreign liquor" means and includes spirit or liquors imported into India or spirits or liquors made in India, and sophisticated or coloured so as to resemble in flavour or colour as liquor imported into India and includes Malt Spirit, Whisky, Rum, Brandy, Gin, Vodka, wine and Liqueurs and also includes draught beer, beer brewed in India and low alcoholic beverages (LAB);

(i) "Form" means the form appended to (i) "Form" means the form appended to

these rules;

(j) "Hierarchy" means the earnest money of shops in the descending order purported to be the basis for the selection of licensee through the process of e/lottery;

(k) "Individual" means a person who is the citizen of India not below the age of twenty- one years;

(l) "License fee" means a sum fixed in consideration of the grant of the license as body wise for exclusive privilege for selling of foreign liquor, beer, Wine and low alcoholic brewages in a Model Shop and for giving facilities of bar, additional license fee fixed from time to time shall also be included thereto.

Provided that if such shop is settled/ re-settled during middle session for the remaining period of the year, then license fee for shop shall be determined in proportion to the remaining period of the excise year.

(n) "Portal" means the electronic platform created specifically for the purpose of uploading information in the prescribed form with regard to the process of manufacturing liquor up to the terminal stage of its distribution;

(o) "Quarterly Minimum Guaranteed Revenue" means the equivalent revenue from Foreign liquor, Beer, Wine and low alcoholic beverages as fixed by the licensing authority in accordance with the general or specific instructions issued by the Excise Commissioner and guaranteed by the licensee to be lifted by him for his retail shop during a quarter of an Excise year for the purpose of retail sale.

(o) "Monthly Minimum Guaranteed Revenue" means the equivalent revenue from Foreign liquor, Beer, Wine and low alcoholic beverages as fixed by the licensing authority in accordance with the general or specific instructions issued by the Excise Commissioner and guaranteed by the licensee to be lifted by him for his retail shop during a month of an Excise year for the purpose of retail sale.

(p) "Security amount" means a amount as fixed by the State Government according to the licence fee to be deposited through Fixed Deposit Receipt /Bank Guarantee pledged in favor of District Excise Officer or through e-payment refundable after the final settlement of all the claims and dues to the State Government.

(q) "Solvency" means financial eligibility criteria set for an applicant applying for the grant of retail license;

(a) Whenever a new licence is proposed to be granted in an area or locality, the Licensing Authority shall invite the applications for this purpose after giving wide publicity through, daily newspapers having foremost circulation in that area and website of the district as well as website of the Excise Department (www.upexcise.in).

(b) Model shops for which the Collector propose to grant licence shall be uploaded by District Excise Officer on shop master developed by N.I.C. along with a list exhibited shop-wise licence fee, security amount, and the earnest money at the Collector's office, Tehsil offices and the offices of the District Excise Officer and the Deputy Excise Commissioner of the charge. This information shall be displayed on the website of Excise Department (www.upexcise.in) along with the website of each District.

5- Amendment of rule-8- In the said rules, for the existing rule-8 set out in Column-I below, the rule as set out in Column-II shall be substituted, namely:-

8-Eligibility conditions for applicant :-

held by two persons, in the event of death of either

of them, the survivor along with the nominee or

legal heir of the deceased licensee, selected as

above, if otherwise eligible, may continue to hold the license. No distinction will be made between

the legal liabilities of the two persons who will be

jointly and severally responsible;

Provided further that if a license is jointly held by two persons, in the event of death of either of them, the survivor along with the legal heir (s) of deceased if otherwise eligible, may continue to hold the license or in case of death of both persons their legal heir(s), if otherwise eligible may continue to hold the license. (b) be above twenty-one years of age on the first day of the period fixed for receiving application.

(c) not be a defaulter/ blacklisted or debarred from holding an excise license under the provisions or any rules made under the Act. Any person who has been convicted of any excise offence shall be automatically debarred from holding the license until and unless fully and finally acquitted by the competent court of law.

(cc) The applicant shall be eligible to make only one application in his own name for any one shop. Provided, in case of renewal, applicant and co-applicant both shall be eligible and their mutual consent for renewal shall be essential.

(d) submit an affidavit duly verified by notary public as proof of the following namely;

(i) that he possesses or has an arrangement for taking on rent a suitable premises in that locality for opening the Model Shop in accordance with the provisions of Uttar Pradesh Number and Location of Excise Shop Rules, 1968 as amended from time to time.

(ii) that his proposed premises of the shop has not been constructed in violation of any law or rules.

(iii) That he and his family members possess good moral character and have no criminal background and have not been convicted of any offence punishable under United Provinces Excise Act, 1910 or Narcotics Drugs and Psychotropic Substances Act, 1985 or any other cognizable and nonbailable offence.

(iv) That in case he is selected as licensee he will furnish a certificate issued by the District Collector or Superintendent of Police/Senior Superintendent of Police of the concerned district or an officer not below the rank of assistant commissioner of police nominated by the police commissioner of the concerning police Commissionerate of which he is the resident, showing that he as well as his family members possess good moral character and have no criminal background or criminal record, prior to the issuance of licence.

(v) that he shall not employ any salesman or representative who has criminal background as mentioned in clause (iii) or, who suffers from any infectious contagious diseases or is below twenty- one years of age or a women. Licensee shall have to obtain Identity Cards bearing photographs of his authorized salesman / representative from District Excise Officer.

(vi) that he is not in arrear of any public dues or Government dues.

6. Amendment of rule-9- In the said rules, for the existing rule-9 set out in Column-I below, the rule as set out in Column-II shall be substituted, namely:-

9.Selection of licensee- The Collector/ Licensing Authority shall identify areas for model shops and after prior approval from Excise Commissioner invite online applications after giving wide publicity through news papers having circulation in the District and such other means which he may deem fit. Licensee for a particular area shall be selected among the eligible candidates by the District Level Committee which is as follows:-

(a) (i) Licenses of shops shall be renewed online under the terms and conditions as specified by the State Government.

(ii)In case of non-renewal, of licences, licensees shall be selected shop wise through the process of e-lottery or e-tender as specified by the State Government through inviting online applications. District Excise Officer shall scrutinize the applications received online and prepare list of all eligible and ineligible applications, describing the reasons of ineligibility and shall put up this list before the District Level Committee of Licensing constituted for e-lottery and e-tender.

(ii) In case of non-renewal of licences, licensees shall be selected shop wise through the process of e-lottery or e-tender as specified by the State Government through inviting online applications. District Excise Officer shall scrutinize the applications received online and prepare list of all eligible and ineligible applications, describing the reasons of ineligibility and shall put up this list before the District Level Committee of Licensing constituted for e-lottery and e-tender.

(b)The said committee shall identify eligible and ineligible applicants. In case of e-lottery the licensee shall be selected for each shop from amongst the eligible applicants through the computer driven randomized arrangement. Randomization process shall be adopted in the order of country liquor, Model Shops, foreign liquor and beer shops as per prescribed hierarchy under respective rule. In case of selection of licensee through e-tender the same aforesaid sequence shall be adopted. Not more than two shops including all categories of country liquor, model shop, foreign liquor and beer shall be allotted in favour of an applicant in the entire State:

(b)The said committee shall identify eligible and ineligible applicants. In case of e-lottery, the licensee shall be selected for each shop from amongst the eligible applicants through the computer driven randomized arrangement. Randomization process shall be adopted in the order of country liquor, Model Shops, foreign liquor and beer shops as per prescribed hierarchy under respective rule. In case of selection of licensee through e-tender the same aforesaid sequence shall be adopted. Not more than two shops including all categories of country liquor, model shop, foreign liquor and beer shall be allotted in favour of an applicant in the entire State:

Provided that the aforesaid restriction shall not be applicable to the matter related to renewal of licenses and mutation of licence in favor of legal heir in the event of death of licencee as per the criteria laid down by the State Government.

Provided also that in case of renewal of two or more shops in favour of any applicant in the entire State, he will be ineligible for selection of further shops through e- lottery.

(c) In case the selected applicants does not deposit the required amount and does not fulfill the prescribed formalities or unable to arrange suitable premises for the shop within stipulated period, the Licensing authority shall cancel the allotment and take immediate necessary steps for resettlement of the shop through the process as prescribed by the Government.

(d) In case there is no application for a particular shop or no candidate is found suitable for a shop in first round of e/lottery the Licensing Authority shall take immediate steps for resettlement of the shop through the process prescribed by the Government.

Provided that aforesaid restriction limit shall not be applicable to matter related to renewal and mutation of licences in favour of legal heir/family member/close relative of deceased licencee/ licencees in the event of death of licencee/ licencees as per procedure mentioned in Rule- 8(a):

Provided further that in case of renewal of two or more shops in favour of any applicant in the entire State, he will be ineligible for selection of further shops through e- lottery.

(c) In case the selected applicant does not deposit the required amount and does not fulfil the prescribed formalities or is unable to arrange suitable premises for the shop within stipulated period, the Licensing authority shall cancel the allotment and take immediate necessary steps for resettlement of the shop through the process as prescribed by the Government.

(d) In case there is no application for a particular shop or no candidate is found suitable for a shop in first round of e-lottery the Licensing Authority shall take immediate steps for resettlement of the shop through the process prescribed by the Government.

7. Amendment of rule-10-- In the said rules, for existing rule 10 set out in Column-I below, the rule as set out in Column-II shall be substituted, namely:-

10. Deposit of license fee and Security amount-

In case an applicant is selected as licensee, he shall deposit the entire amount of licence fee within three working days of being intimated of his selection. He shall be required to deposit half of the security amount within ten working days of intimation of his selection, and balance of the security amount within twenty working days of intimation of his selection. Entire amount of license fee shall be deposited by the applicant preferably through E-payment, security amount will be deposited through Fixed Deposit Receipt/ Bank Guarantee pledged in favor of District Excise Officer or through e-payment. Provided, in case of renewal security deposited prior in cash or through National Saving Certificate shall be acceptable till it is not refunded.

Entire amount of license fee shall be deposited by the applicant preferably through E-payment, security amount will be deposited through Fixed Deposit Receipt pledged in favor of District Excise Officer or through e-payment:

Provided that in case of renewal security deposited prior in cash or through National Saving Certificate or Bank Guarantee, the same shall be acceptable till it is not refunded.

Existing rule

In subsequent year, the licence of the shop may be renewed on the desire of the licensee according to the parameter as fixed by the State Government, entire amount of license fee and difference of security shall be deposited for renewal within stipulated period as specified by the State Government.

Provided, if he fails to deposit the amount of license fee and security amount within prescribed period, his selection shall stand cancelled;

Provided further that in case of licence being settled through the e-lottery/ e-tender, his earnest money and license fee as well as the security amount, if deposited by him, and in case of licence being renewed, fifteen percent of security amount of last year along with renewal fee and licence fee, if deposited by him, shall also be forfeited in favour of State Government and the said shop shall be resettled forthwith, in manner as prescribed by the Government.

Rule as hereby substituted

Provided that if he fails to deposit the amount of license fee and security amount within prescribed period, his selection shall stand cancelled:

8. Amendment of rule-12-- In the said rules, for existing rule-12 set out in Column-I below, the rule as set out in Column-II shall be substituted, namely:-

(a)The licensee under these rules shall obtain sufficient supplies of all prevalent registered brands of foreign liquor/wine/beer/low alcoholic beverages from any wholesale license (F.L.2/FL- 2B) of the Districts after making full payment of cost price of Foreign Liquor and beer including all Taxes, Consideration fee (including additional consideration fee) as levied from time to time. If the (F.L.2/FL-2B) license is not sanctioned in the concerned district, the licensee shall obtain supplies of foreign liquor including wine, beer and low alcoholic beverages from wholesale license (F.L.2/FL-2B) of other district/districts with prior permission of the Excise Commissioner. In case of insufficient supply of any district, district excise officer shall seek the orders from Excise Commissioner and ensure supply within twenty four hours.

(b) "Licensee shall be under obligation to regularly lift Foreign Liquor, Beer, Wine and LAB to ensure steady and continuous quality supply as per the seasonal requirements of the customers as well as to remove any chances of spurious supplies in the market. He shall regularly place written indents on portal or messages to the wholesaler. In order to meet the above requirements the licensee shall be under obligation to lift in each quarter, Foreign Liquor, Beer, Wine and LAB at least equivalent to the consideration fee involved in the quantity of Foreign Liquor, Beer, Wine and LAB lifted in the preceding year or as calculated for each quarter."

(c) (i) Provided, In case the licensee fails to lift liquor (Foreign Liquor, Beer, Wine and LAB) at least equivalent to his Quarterly Minimum Guaranteed Revenue in a quarter, lifting for the next quarter shall be withheld.

(ii)The licensee shall make a request for condonation of delay and for lifting of liquor equivalent to the shortfall in Quarterly Minimum Guaranteed Revenue of that quarter along with an affidavit. Upon condonation, the licensee shall deposit an additional security equivalent to the shortfall in Quarterly Minimum Guaranteed Revenue.

(iii) Additional security so deposited shall be refunded after lifting of liquor equivalent to such short fall in previous quarter along with Quarterly Minimum Guaranteed Revenue of the next quarter.

(iv)In case licensee fails to lift liquor equivalent to the Quarterly Minimum Guaranteed Revenue of one or more quarters before the end of financial year, then the additional security and security deposited by him shall be adjusted against such shortfall of revenue and the remaining security shall be refunded.

Column II

(c) (i) In case the licensee fails to lift liquor (Foreign Liquor, Beer, Wine and LAB) at least equivalent to fixed Monthly Minimum Guaranteed Revenue in a month, then he shall be expected to deposit the additional security equivalent to remaining part of revenue of concerned month within 10 days, failing which the licence shall stand cancelled automatically and further proceedings shall be initiated to recover the loss of revenue as per Rules. The unsold stock on the shop shall also be forfeited.

(ii) After deposit of additional security made within the stipulated time and delay being condoned in lifting the shortfall in Monthly Minimum Guaranteed Revenue of previous month, licensee shall be allowed to lift the shortfall in revenue of previous month along with Minimum Guaranteed Revenue of the current month.

(iii) Additional security so deposited shall be refunded after lifting of liquor equivalent to such short fall in previous month along with Monthly Minimum Guaranteed Revenue of the next month.

(iv In case licensee fails to lift liquor equivalent to the Monthly Minimum Guaranteed Revenue of one or more months before the end of financial year, then the additional security and security deposited by him shall be adjusted against such shortfall of revenue and the remaining security shall be refunded.

If the additional security and security deposited is insufficient for adjustment against the shortfall in revenue, the revenue remaining shall be recovered as if it were arrears of land revenue .

(d)(i)The licensee desiring to transfer Quarterly Minimum Guaranteed Revenue of his shop, which he is not able to lift, to another shop or shops, may be allowed such transfer of such portion(quota) on quarterly basis, within an excise district.

(ii)The transferor licensee shall make a request along with the consent of the transferee licensee to the District Excise Officer of the district. The terms of transfer shall be decided by both the transferor and transferee licensees mutually.

(iii)On approval of the request of the transferor licensee, the quota agreed upon to be transferred by him shall be deducted from his Quarterly Minimum Guaranteed Revenue and shall be deemed to have been lifted and it will be added as a transferred Quarterly Minimum Guaranteed Revenue in the account of the transferee licensee. This quantity will be over and above the original Quarterly Minimum Guaranteed Revenue of the transferee licensee and his obligations regarding lifting of his original quota shall not be affected.

Provided that the total quota transferred under this provision shall not exceed 20% of the Quarterly Minimum Guaranteed Revenue of the transferor licensee.

Column II

If the additional security and security deposited is insufficient for adjustment against the shortfall in revenue, the revenue remaining shall be recovered as if it were arrears of land revenue .

No compensation shall be given for the closure of shop on above grounds.

The licensed premises shall remain open for sale on all days from 10.00 am to 10 p.m. except on 14th April (Ambedkar Jayanti), 15th August (Independence Day), 2nd October (Gandhi Jayanti), 26th January (Republic Day) , and upto 3 more days as notified by the Licensing Authority. He may also order for closure of shop on account of law and order or General Election related activity under the provisions of relevant laws. No compensation shall be given for the closure of shop on above grounds:

Provided that the sale hours may be changed on special occasions for certain duration as the State Government may deem fit.

4. Sale at the licensed premises shall be made for consumption "off" and "on" the premises and licensee/salesman shall be responsible for disposing of remaining PET/glass bottles/cans/ /Tetrapack as well as capsules affixed upon them after being consumed at the shop as per the SWM Rules 2016.

5. No quantity less than one standard Nip bottle of 60Ml. of liquor shall be sold to any person. No. sale be made to a person below the age of 21 years.

6. The sale shall be made in sealed bottles/cans/Tetrapack of standard capacity and of prescribed strength and which is affixed with security code approved by Excise Department, as proof of payment of consideration fee. Licensee shall also keep arrangement for consumption of liquor and provide tumbler, water, ice, soda, snacks and other cooked edibles.

7. The licensee shall maintain a regular and accurate daily account in the form and register (FL-25A), as prescribed by the Licensing Authority and the account register shall be uploaded on the (www.upexcise.in) portal of the department and produced for inspection whenever asked by the competent inspecting authority. The licensee shall also furnish account of sales etc. and facilitate and provide the material and documents as required by the inspecting authority.

8. The licensee shall store entire stock of Foreign Liquor/wine/beer/low alcoholic beverages in the licensed premises only. He shall be required to maintain P.O.S (Point Of Sale) equipment as specified for scanning of bottles as per prescribed security code under the Track and Trace System.

The licensee shall affix conspicuous signboard at the entrance to the shop in the form/size approved by the Excise Commissioner on which the name of the licensee, designation, location of shop, period of license, opening and closing time of shop and such other information as prescribed by Licensing Authority in bold letters shall be printed.

3. Maximum retail price and strength will be printed in visible words of 1x1 centimeter on the label of bottles/cans/tetra packs of Foreign Liquor/ beer/ wine/LAB. The retail licensee shall not charge more than the printed M.R.P.

5. No quantity less than one standard Nip bottle of 60Ml. of liquor shall be sold to any person. No. sale be made to a person below the age of 21 years.

The sale shall be made in sealed bottles/cans//Tetrapack of standard capacity and of prescribed strength and which is affixed with security code approved by Excise Department, as proof of payment of consideration fee. Licensee shall also keep arrangement for consumption of liquor and provide tumbler, water, ice, soda, snacks and other cooked edibles.

Sale at the licensed premises shall be made for consumption "off" and "on" the premises and licensee/salesman shall be responsible for disposing of remaining PET/glass bottles/cans/Aseptic Brick Pack as well as capsules affixed upon them after being consumed at the shop as per the SWM Rules 2016.

10. The licensee shall not employ any person as salesmen who is below 21 years of age or is suffering from any infectious and /or contagious diseases, or has criminal background or a woman. The Licensee shall have to obtain identity cards of the salesmen bearing their photographs duly issued by the District Excise Officer, which shall be produced as and when demanded by inspecting authorities.

7. The licensee shall maintain a regular and accurate daily account in the form and register (FL-25A), as prescribed by the Licensing Authority and the account register shall be uploaded on the (www.upexciseportal.in) portal of the department and produced for inspection whenever asked by the competent inspecting authority. The licensee shall also furnish account of sales etc. and facilitate and provide the material and documents as required by the inspecting authority.

8. The licensee shall store entire stock of Foreign Liquor/wine/beer/low alcoholic beverages in the licensed premises only. He shall be required to maintain P.O.S (Point Of Sale) equipment as specified for scanning of standard bottles as per prescribed security code under the Track and Trace System.

15. The premises in which the shop is situated, shall not be used as a place of residence except by the licensee/ salesmen.

16. The licensee is strictly forbidden from having recourse to any form of blandishment or inducement to the customer with a view to increase his sales such as dancing floors or gambling.

The licensed premises shall remain open for sale on all days from 10.00 am to 10 pm except on 14th April (Ambedkar Jayanti), 15th August (Independence Day), 2nd October (Gandhi Jayanti), 26th January (Republic Day) and upto 3 more days as notified for closure by the Licensing Authority. Licensing Authority may also order closure of shop on account of law and order or General Election related activity etc. under the provisions or relevant laws. No compensation shall be given for the closure of shop on above basis.
