IN pursuance of the provisions of clause (3) of Article 348 of the Constitution of India, the Governor is pleased to order the publication of the following English translation of the Uttar Pradesh Dand Vidhi (Apradhon ka Shaman aur Vicharanon ka Upshaman) (Sanshodhan) Adhiniyam, 2023 (Uttar Pradesh Adhiniyam Sankhya 4 of 2023) as passed by the Uttar Pradesh Legislature and assented to by the Governor on August 18, 2023. The Grih (Police) Anubhag-9 is administratively concerned with the said Adhiniyam.

ACT
further to amend the Uttar Pradesh Criminal Law (Composition of Offences and
Abatement of Trials) (Amendment) Act, 1979.
IT IS HEREBY enacted in the Seventy fourth Year of the Republic of India as
follows :–
1. (1) This Act may be called the Uttar Pradesh Criminal Law (Composition of Short title and commencement Offences and Abatement of Trials) (Amendment) Act, 2023.
(2) It shall be deemed to have come into force with effect from 22nd March,
2023.
Amendment of 2. In section 9 of the Uttar Pradesh Criminal Law (Composition of Offences and
Ssection 9 of Abatement of Trials) (Amendment) Act, 1979, in sub-section (2), for the word and figures
U.P. Act no. 35 "December 31, 2016" the word and figures "December 31, 2021" shall be substituted.

hereby repealed.
(2) Notwithstanding such repeal, anything done or any action
taken under the provisions of the principal Act as amended by the
Ordinance referred to in sub-section (1) shall be deemed to have been
done or taken under the corresponding provisions of the principal Act as
amended by this Act as if the provisions of this Act were in force at all
material times.
4 mRrj izns'k vlk/kkj.k xtV] 21 vxLr] 2023STATEMENT OF OBJECTS AND REASONS
The Uttar Pradesh Criminal Law (Composition of Offences and Abatement of Trials) (Amendment) Act, 1979 (U.P. Act no. 35 of 1979) has been enacted to amend certain Central enactments to provide for the composition of certain offences and for abatement of certain criminal trials.
Section 9 of the aforesaid Act provides for abatement of trial of an accused for offences punishable under certain Central enactments and for abatement of certain proceedings pending before a certain date. The said section has been amended from time to time to change the period/date before which the aforesaid trials/proceedings can be abated. The aforesaid period of abatement was extended up to December 31, 2016 vide the Uttar Pradesh Criminal Law (Composition of Offences and Abatement of Trials) (Amendment) Act, 2019 (U.P. Act no. 21 of 2019). There is a possibility of disposal of larger number of cases pending in the Hon'ble Courts of the State of Uttar Pradesh if the aforesaid date is further extended.
In view of the above, it has been decided to amend section 9 of the aforesaid Act to extend the aforesaid period for abatement of certain trials or proceedings pending before a Magistrate to December 31, 2021.
Since the State Legislature was not in session and immediate legislative action was necessary to implement the aforesaid decision, the Uttar Pradesh Criminal Law (Composition of Offences and Abatement of Trials) (Amendment) Ordinance, 2023 (U.P. Ordinance no. 2 of 2023) was promulgated by the Governor on 22nd March, 2023.
This Bill is introduced to replace the aforesaid Ordinance.
