IN pursuance of the provisions of clause (3) of Article 348 of the Constitution, the Governor is pleased to order the publication of the following English translation of notification no. 1511/XXIV-03- 2023-1294-2020, dated September 12, 2023 :

Dated Lucknow, September 12, 2023

WHEREAS under sub-section (1) of section 11 of the Right to Fair Compensation and Transparency in Rehabilitation and Resettlement Act, 2013 (Act no. 30 of 2013), the Government of Uttar Pradesh is satisfied that total of 72.923 hectares of land is required in Village- Chanchaliya Panari Tola Gurur, Pargana- Agori, Tehsil- Obra, District- Sonbhadra for public purpose, namely — construction of ash dyke in 2x660 MW Obra-C Thermal Project through Uttar Pradesh Rajya Vidyut Utpadan Nigam Limited in district Sonbhadra.

2. The Social Impact Assessment study was carried out by the State Social Impact Assessment Agency, and its recommendation was submitted to the appropriate Government which has been approved by the appropriate Government on November 7, 2022.

3. The summary of Social Impact Assessment report is as follows:

(a) Action for land acquisition for the construction of ash dyke in 2x660 MW Obra-C Thermal Project in district Sonbhadra is in public interest and it serves the public purpose.

(b) With the proposed project, there will be smooth, easy and uninterrupted power supply in the State and surrounding areas, which will lead to rapid development of not only the nearby region but also of the entire State and Country.

(c) The potential benefits from this project far outweigh the social costs and adverse impacts.

4. A total of 200 families are likely to be displaced due to land acquisition; and the unavoidable reason for this displacement is that the construction of ash dam is necessary for proper disposal of ash emitted during power generation from Obra-C Thermal Project. The said families are situated in the middle of the land to be reclaimed for the purpose of construction of the said ash dam. For this reason, the displacement of said families is inevitable.

5. Deputy Collector/Assistant Collector, Obra, Sonbhadra is appointed as Administrator for the purpose of Rehabilitation and Resettlement of the project affected families.

6. Therefore, the Governor is pleased to notify for general information that the land mentioned in the Schedule below is needed for public purpose:-

SCHEDULE

takes necessary steps to enter upon and take survey of the land, take levels of any land, dig and do all the Acts required for the proper execution of work as provided and specified under section 12 of the Act.

8. Under section 15 of the said Act, any person interested in the land, may within 60 days after the publication of this notification in the Gazette, make an objection to the acquisition of land in writing to the Collector, Sonbhadra/Special Land Acquisition Officer (Irrigation), Mirzapur.

9. Under section 11(4) of the said Act, no person shall make any transaction or cause any transaction of land i.e. sale/purchase, specified in the preliminary notification or create any encumbrances on such land from the date of publication of such notification till such time as the proceedings of land acquisition is completed, without prior approval of the Collector.

Note:- A plan of the land may be inspected in the office of the Collector, Sonbhadra for the purpose of acquisition.
