IN pursuance of the provisions of clause (3) of Article 348 of the Constitution of India, the Governor is pleased to order the publication of the following English translation of the Uttar Pradesh Rajya Vishwavidyalay (Sanshodhan) Adhyadesh, 2023 (Uttar Pradesh Adhyadesh Sankhya 18 of 2023) promulgated by the Governor. The Uchcha Shiksha Anubhag-1 is administratively concerned with the said Ordinance.

THE UTTAR PRADESH STATE UNIVERSITIES (AMENDMENT)

ORDINANCE, 2023

(U.P. ORDINANCE NO. 18 OF 2022)

[Promulgated by the Governor in the Seventy-fourth Year of the Republic of India ]

AN

ORDINANCE

further to amend the Uttar Pradesh State Universities Act, 1973.

WHEREAS the State Legislature is not in session and the Governor is satisfied that circumstances exist which render it necessary for him to take immediate action;

NOW, THEREFORE, in exercise of the powers conferred by clause (1) of Article 213 of the Constitution of India, the Governor is pleased to promulgate the following Ordinance:-

Short title

1. This Ordinance may be called the Uttar Pradesh State Universities (Amendment) Ordinance, 2023.

Amendment of 2. In section 4 of the Uttar Pradesh State Universities Act, 1973, (hereinafter

section 4 of

referred to as the "principal Act"), in sub-section (1-A after clause (k), the following

President's Act clauses shall be inserted, namely:-

amended and "( l ) a University to be known as Maa Pateswari Devi State University,

re-enacted by Balrampur;

U.P. Act no. 29 of 1974

(m) a University to be known as Maa Vindhyavasini State University,

Mirzapur;

(n) a University to be known as Uttar Pradesh State University,

Moradabad;"

Amendment of 3. In section 50 of the principal Act, after sub-section (1-H), the following

section 50

sub-sections shall be inserted, namely :-

"(1-I) Until the First Statutes of Maa Pateswari Devi State University,

Balrampur are made under this section, the Statutes of the University of

Dr. Ram Manohar Lohiya Awadh University, Ayodhya as in force immediately

before the establishment of the said University shall apply to it subject to such

adaptations and modifications as the State Government may, by notification,

provide.

(1-J) Until the First Statutes of Maa Vindhyavasini State University,

Mirzapur are made under this section, the Statutes of the University of

Mahatma Gandhi Kashi Vidyapith, Varanasi, as in force immediately before the

establishment of the said University shall apply to it subject to such adaptations

and modifications as the State Government may, by notification, provide.

(1-K) Until the First Statutes of Uttar Pradesh State University,

Moradabad are made under this section, the Statutes of the Mahatma Joytiba

Phule Rohilkhand University, Bareilly, as in force immediately before the

establishment of the said University shall apply to it subject to such adaptations

and modifications as the State Government may, by notification, provide."

Amendment of 4. In section 52 of the principal Act, after sub-section (2-G) the following sub-

section 52

sections shall be inserted, namely :-

"(2-H) Until the First Ordinances of Maa Pateswari Devi State University,

Balrampur are made under sub-section (2), the Ordinances of the Dr. Ram

Manohar Lohiya Awadh University, Ayodhya, as in force immediately before

the establishment of the said University, shall apply to it subject to such

adaptations and modifications as the State Government may, by notification,

provide.

(2-I) Until the First Ordinances of Maa Vindhyavasini State University,

Mirzapur are made under sub-section (2), the Ordinances of the University of

Mahatma Gandhi Kashi Vidyapith, Varanasi, as in force immediately before

the establishment of the said University, shall apply to it subject to such

(i) Until the establishment of Maa Districts of Ambedkar

Pateswari Devi State University, Nagar, Ayodhya, Bahraich,

Balrampur.

Barabanki, Gonda and

Sultanpur.

(ii) Upon the establishment of Maa Districts of Ambedkar

Pateswari Devi State University, Nagar, Ayodhya,

Balrampur.

Barabanki, and Sultanpur ."

(b) for the entries appearing at serial no. 7, the following entries shall

substituted, namely :-

"7. Mahatma Joytiba Phule Rohilkhand University, Bareilly -

(i) Until the establishment of Uttar Districts of Bareilly,

Pradesh State University, Budaun, Pilibhit,

Moradabad.

Shahjahanpur, Moradabad,

Bijnor, Amroha (Jyotiba

Phule Nagar), Rampur and

Sambhal.

(ii) Upon the establishment of Uttar Districts of Bareilly,

Pradesh State University, Budaun, Pilibhit,

Moradabad.

(c) for the entries appearing at serial no. 10, the following entries shall

substituted, namely :-

"10. Mahatma Gandhi Kashi Vidyapith, Varanasi -

(i) Until the establishment of Maa Districts of Varanasi,

Vindhyavasini State University, Chandauli, Bhadohi (Sant

Mirzapur.

Ravidas Nagar), Mirzapur,

Sonbhadra

(ii) Upon the establishment of Maa Districts of Varanasi,

Chandauli."

(d) for the entries appearing at serial no. 13, the following entries shall

substituted, namely :-

"13. Siddharth University, Kapilvastu, Siddharth Nagar -

(i) Until the establishment of Maa Districts of Balrampur,

(ii) Upon the establishment of Maa Districts of Basti, Sant

6. (1) The State Government may, for the purpose of removing any difficulty in

by order published in the Gazette, direct that the provisions of the principal Act shall

during such period, as may be specified in the order, have effect subject to such

adaptations, whether by way of modification, addition or omission as it may deem to be

necessary or expedient :

Provided that no such order shall be made after two years from the date of

commencement of this Ordinance .

(2) Every order made under sub-section (1) shall be laid before both the Houses of

the State Legislature , as soon as may be, after it is made.
