उत्तर प्रदेश राज्य में कतिपय विश्वविद्यालयों से सम्बन्धित विधियों को संशोधित और समेकित करने के लिये उत्तर प्रदेश राज्य विश्वविद्यालय अधिनियम, 1973 (राष्ट्रपति अधिनियम संख्या 10 सन् 1973) अधिनियमित किया गया है।

उत्तर प्रदेश सरकार ने गुणवत्ता पूर्ण उ(cid:6994)च शिक्षा प्रदान किये जाने हेतु प्रत्येक म(cid:7003)डल में एक राज्य विश्वविद्यालय स्थापित किये जाने का ल(cid:7023)य निर्धारित किया है। इस ल(cid:7023)य के अनुसरण में देवीपाटन म(cid:7003)डल, विन्ध्याचल म(cid:7003)डल एवं मुरादाबाद म(cid:7003)डल, प्रत्येक में उ(cid:6994)च शिक्षा की उपलब्धता lqfuf'pr किये जाने हेतु एक राज्य विश्वविद्यालय स्थापित किये जाने की आवश्यकता थी।

उपयु र्क्त के दृष्टिगत, देवीपाटन म(cid:7003)डल, गो(cid:7003)डा में, माँ पाटेश्वरी देवी राज्य विश्वविद्यालय, बलरामपुर, विन्ध्याचल म(cid:7003)डल, मिर्जापुर में, माँ विन्ध्यवासिनी राज्य विश्वविद्यालय, मिर्जापुर; और मुरादाबाद म(cid:7003)डल, मुरादाबाद में उत्तर प्रदेश राज्य विश्वविद्यालय, मुरादाबाद की स्थापना का उपबंध करने हेतु पूव(cid:7299)क्त अधिनियम, में संशोधन किये जाने का fofu'p; किया गया।

चू ंकि राज्य विधान म(cid:7003)डल सत्र में नह(cid:7277) था और पूव(cid:7299)क्त fofu'p; को (िcid:7059)यान्वित करने के लिए तुरन्त विधायी कार्यवाही की जानी आवश्यक थी, अतः राज्यपाल द्वारा दिनांक 08 नवम्बर, 2023 को उत्तर प्रदेश राज्य fo'ofo|ky; (संशोधन) अध्यादेश, 2023 (उत्तर प्रदेश अध्यादेश संख्या 18 सन् 2023) प्रख्यापित किया गया।

यह विधेयक पूव(cid:7299)क्त अध्यादेश को प्रतिस्थापित करने के लिए पुरःस्थापित किया जाता है।

IN pursuance of the provisions of clause (3) of Article 348 of the Constitution, the Governor is pleased to order the publication of the following English translation of the Uttar Pradesh Rajya Vishvavidyalaya (Sanshodhan) Vidheyak, 2023 introduced in the Uttar Pradesh Legislative Assembly on November 30, 2023.

further to amend the Uttar Pradesh State Universities Act, 1973.

IT IS HEREBY enacted in the Seventy-fourth Year of the Republic of India as follows :-

1. (1) This Act may be called the Uttar Pradesh State Universities Short title and commencement (Amendment) Act, 2023.

(2) It shall be deemed to have come into force with effect from November 8, 2023.

2. In section 4 of the Uttar Pradesh State Universities Act, 1973, (hereinafter

section 4 of referred to as the "principal Act"), in sub-section (1-A) after clause (k), the following

President's Act clauses shall be inserted, namely:-

no. 10 of 1973

as amended "(l) a University to be known as Maa Pateswari Devi State University,

and

Balrampur;

re-enacted by (m) a University to be known as Maa Vindhyavasini State University, U.P. Act no.

29 of 1974 Mirzapur;

(n) a University to be known as Uttar Pradesh State University,

Moradabad."

Amendment of 3. In section 50 of the principal Act, after sub-section (1-H), the following

section 50

sub-sections shall be inserted, namely :-

"(1-I) Until the First Statutes of Maa Pateswari Devi State University,

Balrampur are made under this section, the Statutes of the University of

Dr. Ram Manohar Lohiya Awadh University, Ayodhya as in force immediately

before the establishment of the said University shall apply to it subject to such

adaptations and modifications as the State Government may, by notification,

provide.

(1-J) Until the First Statutes of Maa Vindhyavasini State University,

Mirzapur are made under this section, the Statutes of the University of Mahatma

Gandhi Kashi Vidyapith, Varanasi, as in force immediately before the

establishment of the said University shall apply to it subject to such adaptations

and modifications as the State Government may, by notification, provide.

(1-K) Until the First Statutes of Uttar Pradesh State University,

Moradabad are made under this section, the Statutes of the Mahatma Jyotiba

Phule Rohilkhand University, Bareilly, as in force immediately before the

establishment of the said University shall apply to it subject to such adaptations

and modifications as the State Government may, by notification, provide."

Amendment of 4. In section 52 of the principal Act, after sub-section (2-G) the following

section 52

sub-sections shall be inserted, namely :-

"(2-H) Until the First Ordinances of Maa Pateswari Devi State University,

Balrampur are made under sub-section (2), the Ordinances of the Dr. Ram

Manohar Lohiya Awadh University, Ayodhya, as in force immediately before

the establishment of the said University, shall apply to it subject to such

adaptations and modifications as the State Government may, by notification,

provide.

(2-I) Until the First Ordinances of Maa Vindhyavasini State University,

Mirzapur are made under sub-section (2), the Ordinances of the University of

Mahatma Gandhi Kashi Vidyapith, Varanasi, as in force immediately before the

establishment of the said University, shall apply to it subject to such adaptations

and modifications as the State Government may, by notification, provide.

(2-J) Until the First Ordinances of Uttar Pradesh State University, Moradabad

are made under sub-section (2), the Ordinances of the Mahatma Jyotiba Phule

Rohilkhand University, Bareilly, as in force immediately before the establishment

of the said University, shall apply to it subject to such adaptations and

Power to remove 6. (1) The State Government may, for the purpose of removing any difficulty in

difficulties

relation to the establishment of Maa Pateswari Devi State University, Balrampur, or Maa

Vindhyavasini State University, Mirzapur, or Uttar Pradesh State University, Moradabad,

by order published in the Gazette, direct that the provisions of the principal Act shall

during such period, as may be specified in the order, have effect subject to such

adaptations, whether by way of modification, addition or omission as it may deem to be

necessary or expedient :

Provided that no such order shall be made after two years from the date of

commencement of this Act .

(2) Every order made under sub-section (1) shall be laid before both the Houses of

the State Legislature , as soon as may be, after it is made.

7. (1) The Uttar Pradesh State Universities (Amendment)

Repeal and saving

U.P. Ordinance no. 18 of 2023 Ordinance, 2023 is hereby repealed.

(2) Notwithstanding such repeal, anything done or any action taken under the provisions of the principal Act as amended by the Ordinance referred to in sub-section (1) shall be deemed to have been done or taken under the corresponding provisions of the principal Act as amended by this Act as if the provisions of this Act were in force at all material times.

STATEMENT OF OBJECTS AND REASONS

The Uttar Pradesh State Universities Act, 1973 ) President's Act no. 10 of 1973( has been

enacted to amend and consolidate the laws relating to certain Universities in the State of Uttar

Pradesh.

The Government of Uttar Pradesh has set a vision of establishing one State University in

each division to provide quality higher education. In pursuance of this goal, there was a need to

establish one State University each in Devipatan division, Vindhyachal division and Moradabad

division to ensure availability of higher education.

In view of the above, it was decided to amend the aforesaid Act to provide for the

establishment Maa Pateshwari Devi State University, Balrampur in Devipatan division, Gonda;

Maa Vindhyavasini State University, Mirzapur in Vindhyachal division, Mirzapur; and Uttar

Pradesh State University, Moradabad in Moradabad division, Moradabad.

necessary to implement the aforesaid decision, the Uttar Pradesh State Universities (Amendment) Ordinance, 2023 (U. P. Ordinance no. 18 of 2023 (was promulgated by the Governor on 8th November, 2023.

This Bill is introduced to replace the aforesaid Ordinance.
