NOTIFICATION
No.100/UP-LC/08/2023-MLA (1):- WHEREAS, the Election Commission of India, vide its Notification No.100/UP-LC/08/2023-MLA (1), dated 11th January, 2024 has notified the schedule for the bye election to the Uttar Pradesh Legislative Council for the vacancy against the seat of Dr. Dinesh Sharma that fell vacant on September 13, 2023; and
WHEREAS, the last date of withdrawal of candidatures for the above election was fixed as 22nd January, 2024 (Monday); and
WHEREAS, it is brought to the notice that the last date of withdrawal of candidatures, i.e. 22nd January, 2024 (Monday) is declared a 'Public Holiday' under Negotiable Instruments Act, 1881, by government of Uttar Pradesh, vide notification dated January 12, 2024;
NOW, THEREFORE, the Election Commission of India having considered the matter hereby makes the following amendments in its Notification No.100/UP-LC/08/2023-MLA (1), dated 11th January, 2024 in terms of Section 39 of the Representation of the People Act, 1951, namely;
For the existing entries at (c) and (d) in clause (B), the following entries shall be substituted;
"(c) the 23rd January, 2024 (Tuesday), as the last date for the withdrawal of candidatures; (d) the 30th January, 2024 (Tuesday), as the date on which a poll shall, if necessary, be taken; and"
