STATEMENT OF OBJECTS AND REASONS
The Indian Stamp Act, 1899 (Act no. 2 of 1899) (hereinafter referred to as the "said Act") has been enacted to consolidate and amend the law relating to stamps.
Form a regular review of power of attorney deeds registered in the recent period, it has come to knowledge that some power of attorney deeds were being registered in favour of persons who were not members of family, and the authority of sell immovable property was being vested in such power of attorney, without mentioning any consideration in the said deed, and the said deeds were being registered after paying stamp duty of only Rs. 50/-. A large number of such cases had come to light in which immovable properties allotted by various authorities were being transferred by the allotees of the said properties on the basis of such power of attorney deeds only. Such cases have also come to light where due to changes in laws relating to power of attorney in other States, registration of power of attorney deeds in respect of immovable properties situated in other States were being done regularly in the State of Uttar Pradesh. Thus, misuse of provisions regarding chargeability of stamp duty on power of attorney deeds was causing an adverse impact on stamp revenue of not only Uttar Pradesh but also other States. In view of the above, it was decided to amend Article 48 of Schedule 1-B of the said Act.
Since the State Legislature was not in session and immediate legislative action was necessary to implement the aforesaid decision, the Indian Stamp (Uttar Pradesh ) Ordinance, 2023 (U.P. Ordinance no. 19 of 2023) was promulgated by the Governor on 28th December, 2023.
This bill is introduced to replace the aforesaid Ordinance.
