ORDINANCE
further to amend the Uttar Pradesh Gangsters and Anti-Social Activities (Prevention) Act, 1986 (U.P. Act no. 7 of 1986), the Uttar Pradesh Control of Goondas Act, 1970 (U.P. Act no. 8 of 1971), the Uttar Pradesh Recovery of Damages to Public And Private Property Act, 2020 (U.P. Act no. 11 of 2020), the Uttar Pradesh Dacoity Affected Areas Act, 1983 (U.P. Act no. 31 of 1983), the Uttar Pradesh Special Security Force Act, 2020 (U.P. Act 27 of 2020) and the Uttar Pradesh Prohibition of Unlawful conversion of Religion Act, 2021 (U.P. Act no. 3 of 2021).

NOW, THEREFORE, in exercise of the powers conferred by clause (1) of Article 213 of the Constitution of India, the Governor is pleased to promulgate the following Ordinance.
CHAPTER-I
PRELIMINARY
Short title, extent 1. (1) This Ordinance may be called the Uttar Pradesh Apradhik Vidhi
and
Sanshodhan Adhyadesh, 2024.
commencement (2) It shall extend to the whole of Uttar Pradesh.
(3) It shall come into force from 01 day of July, 2024.
CHAPTER- II
AMENDMENT OF THE UTTAR PRADESH GANGSTERS AND ANTI-SOCIAL
ACTIVITIES (PREVENTION) ACT, 1986
Amendment of section 2 of U.P. Act no. 7 of 1986 2. (1) In section 2 (a) of the Uttar Pradesh Gangsters and Anti-Social Activities (Prevention) Act, 1986, hereinafter in this chapter referred to as the principal Act, -
(a) for clause (a) the following clause shall be substituted, namely:-
"Sanhita" means the Bharatiya Nagarik Suraksha Sanhita, 2023;
(b) for sub-clause (i) of clause (b), the following sub-clause shall be
substituted, namely:-
"Offences punishable under Chapter VI, or Chapter XVII, or Section 351,
352, 353, 354, 355, 79 of the Bharatiya Nyaya Sanhita, 2023.";
(c) for sub-clause (ix) of clause (b), the following sub-clause shall be
substituted, namely:-
"Offences punishable under section 173 of the Bharatiya Nyaya Sanhita, 2023 or in preventing or obstructing any public election being lawfully held, by physically preventing the voter from exercising his electoral rights, or";
(d) in clause (d) for the words "public servant" means a public servant as defined in section 21 of the Indian Penal Code ", the words " public servant" means a public servant as defined in section 2(28) of the Bharatiya Nyaya Sanhita, 2023" shall be substituted;
(e) for clause (f) the following clause shall be substituted, namely:-
"words and phrases used but not defined in this Act and defined in Bharatiya Nagarik Suraksha Sanhita, 2023, or the Bharatiya Nyaya Sanhita, 2023 shall have the meanings respectively assigned to them in such Sanhita.";
3. In section 4 of the principal Act,—
Amendment of section 4
(a) in opening paragraph, for the words, figures and symbol "Code or the Indian Evidence Act, 1872" the words, figures and symbol "Sanhita or the Bharatiya Sakshya Adhiniyam, 2023" shall be substituted;
(b) in sub-clause (i) of clause (a), for the words and figures"section 107 or section 108 or section 109 or section 110 of the Code ", the words and figures "section 126 or section 127 or section 128 or section 129 of the Sanhita" shall be substituted.
4. In sub-section (1) of section 7 of the principal Act, for the word "Code", Amendment of section 7
the word "Sanhita" shall be substituted.
Amendment of section 9
5. In sub-section (3) of section 9 of the principal Act, for the words, figures and letters " clause (u) of section 2 of the Code, and the provisions of the Code shall have effect accordingly ", the words, figures and letters " section 2(1) (v) of the Sanhita and the provisions of the Sanhita shall have effect accordingly " shall be substituted.

(a) (i) in sub-section (2) for the words and figures " sub-section (1) of section 260 or section 262 of the Code" the words and figures "sub-section (1) of section 283 or section 285 of the Sanhita" shall be substituted;
(ii) for the words and figures"of sections 263 to 265 of the Code" the words and figures "sections 286 to 288 of the Sanhita" shall be substituted;
(iii) in the first proviso for the word "Code" the word "Sanhita" shall be substituted.
(b) in sub-section (3), for the words and figures "for the purposes of section 308 of the Code, be deemed to have been tendered under section 307 thereof" the words and figures "for the purposes of section 345 of the Sanhita be deemed to have been tendered under section 344 thereof." shall be substituted.
(c) in sub-section (4), for the word "Code", the word "Sanhita" shall be substituted.
(d) in sub-section (5), for the words, figures and symbols "Court under sub-section (3) of section 7 shall be dealt with as if such case had been transferred under section 406 of the Code to such Special Court." the words, figures and symbols "under sub-section (3) of section 7 shall be dealt with as if such case had been transferred under section 446 of the Sanhita to such Special Court." shall be substituted.
7. In sub-section (1) of section 11 of the principal Act, for the word "Code", Amendment of section 11
the word "Sanhita" shall be substituted.
8. In section 13 of the principal Act, for the word "Code", the word Amendment of section 13
"Sanhita" shall be substituted.
9. In section 14 of the principal Act,-
Amendment of section 14
(a) in sub-section (2) for the word "Code", the word "Sanhita" shall be substituted;
(b) in sub-section (3), for the word "Code" the word "Sanhita" shall be substituted.
10. In sub-section (5) of section 16 of the principal Act,–

for the words, figures and symbols, "anything to the contrary contained in the Indian Evidence Act, 1872 notwithstanding." the words, figures and symbols, "anything to the contrary contained in the Bharatiya Sakshya Adhiniyam, 2023 notwithstanding." shall be substituted.
Amendment of section 18
11. In section 18 of the principal Act, for the words, figures and symbols "The provisions of Chapter XXIX of the Code shall", the words, figures and symbols "The provisions of Chapter XXXI of the Sanhita" shall be substituted.
12. In section 19 of the principal Act,-

(a) in sub-section (1), for the word "Code", the word "Sanhita" shall be substituted;
(b) in sub-section (2), for the words and figures "Section 167 of the Code" the words and figures "Section 187 of the Sanhita" shall be substituted;
(c) in sub-section (3), for the words, figures and symbols "Sections 366, 367, 368 and 371 of the Code" the words, figures and symbols "Sections 407, 408, 409 and 412 of the Sanhita" shall be substituted;
(d) in sub-section (4), for the word "Code", the word "Sanhita" shall be substituted;
(e) in sub-section (5), for the word "Code", the word "Sanhita" shall be substituted.

Amendment of 14. After sub-section (2) of section 24 of the principal Act, the following sub-
section 24
section shall be inserted, namely:-
"(3) Any appeal, application, trial, enquiry or investigation pending before the
date on which the Bharatiya Nyaya Sanhita, 2023, Bharatiya Nagarik Suraksha
Sanhita,2023 and Bharatiya Sakshya Adhiniyam, 2023 comes into force, shall be
disposed of, continued held or made, as the case may be, in accordance with the
provisions of this Act, as inforce immediately before such amendments, as if these
amendments had not come into force."
CHAPTER- III
AMENDMENT OF THE UTTAR PRADESH CONTROL OF GOONDAS
ACT, 1970
15. In sub-clause (i) of clause (b) of section 2 of the Uttar Pradesh Control of
Goondas Act, 1970 hereinafter in this chapter referred to as the principal Act,–
Amendment of section 2 of U.P. Act no. 8 of 1971 for the words, figures, symbols and letters "an offences punishable under section 153 or section 153-B or section 294 of the Indian Penal Code or Chapter XV, Chapter XVI, Chapter XVII or Chapter XXII of the said Code ;", the words, figures, symbols and letters "an offences punishable under section 192 or section 197 or section 296 of the Bharatiya Nyaya Sanhita, 2023 or Chapter XVI, Chapter VI, Chapter XVII or Section 351, 352, 353, 354, 355, 79 of the Bharatiya Nyaya Sanhita, 2023;" shall be substituted.
16. In section 7 of the principal Act,-
Amendment of section 7
(a) in clause (b) of sub-section (1), for the words, figures and symbol "Criminal Procedure, 1973", the words, figures and symbol "Bharatiya Nagarik Suraksha Sanhita,2023" shall be substituted;
(b) in sub-section (2),-
(i) in clause (a) for the words, figures and symbol "provision of section 71 of the said Code, and the provisions of section 70 to 85 and 87 to 89 of the said Code", the words, figures and symbols "provision of section 73 of the Bharatiya Nagarik Suraksha Sanhita, 2023 and the provision of section 72 to 88 and 90 to 92 of the Bharatiya Nagarik Suraksha Sanhita, 2023 shall be substituted".
(ii) in clause (b) for the words, figures and symbol, "provisions of section 119 to 121, 123 and 124 of the said Code", the words, figures and symbols " the provisions of section 138 to 140, 142 and 143 of the Bharatiya Nagarik Suraksha Sanhita, 2023" shall be substituted;
(iii) in clause ( c ) for the words and figures, "provisions of section 445 to 447 of the said Code" the words and figures "section 490 to 493 of the Bharatiya Nagarik Suraksha Sanhita, 2023." shall be substituted.
Amendment of section 8
17. In section 8 of the Principal Act for the words, figures and symbol, "Indian Evidence Act,1872", the words, figures and symbol "Bharatiya Sakshya Adhiniyam, 2023" shall be substituted.
18. In the principal Act after section 16, the following new section shall be Insertion of new section 17 inserted, namely:-
"17. Any appeal, application, trial, enquiry or investigation pending before the
date on which the Bharatiya Nyaya Sanhita, 2023, Bharatiya Nagarik Suraksha Sanhita, 2023 and Bharatiya Sakshya Adhiniyam, 2023 comes

CHAPTER- IV
AMENDMENT OF THE UTTAR PRADESH RECOVERY OF DAMAGES
TO PUBLIC AND PRIVATE PROPERTY ACT, 2020
19. In section 2 of the Uttar Pradesh Recovery of Damages to Public and Private Property Act, 2020 hereinafter in this chapter referred to as the principal Act, Amendment of section 2 of U.P. Act no. 11 of 2020
(a) in clause (d) for the words and figures "section 425 of Indian Penal Code", the words and figures and symbols" section 324 (1) of Bharatiya Nyaya Sanhita, 2023" shall be substituted.
(b) in clause (e) for the words and figures "section 11 of Indian Penal Code", the words, figures and symbols " section 2 (26) of Bharatiya Nyaya Sanhita, 2023" shall be substituted.
Amendment of section 8
20. In sub-section 7 of section 8 of the principal Act, for the words, figures and symbols " of section 195 and Chapter XXVI of the Code of Criminal Procedure, 1973 (2 of 1974)", the words, figures and symbols "section 215 and Chapter XXVIII of the Bharatiya Nagarik Suraksha Sanhita, 2023" shall be substituted.
21. After sub-section (2) of section 29 of the principal Act, the following Amendment of section 29
sub-section shall be inserted, namely:-
"(3) Any proceeding under such Act pending before the date on which the Bharatiya Nyaya Sanhita, 2023, Bharatiya Nagarik Suraksha Sanhita,2023 and Bharatiya Sakshya Adhiniyam, 2023 comes into force, shall be disposed of, continued held or made, as the case may be, in accordance with the provisions of this Act, as inforce immediately before such amendments, as if these amendments had not come into force."
CHAPTER-V
AMENDMENT OF THE UTTAR PRADESH DACOITY AFFECTED AREAS
ACT, 1983
22. in the Uttar Pradesh Dacoity Affected Areas Act, 1983 hereinafter in this chapter referred to as the principal Act, in clause (g) of section 2 for the words, figures and symbol "Code of Criminal Procedure, 1973", the words, figures and symbol Amendment of section 2 of U.P. Act no. 31 of 1983
"Bharatiya Nagarik Suraksha Sanhita, 2023" shall be substituted.
23. In sub-section (1) of section 4 of the principal Act, for the words and Amendment of section 4
figures "section 21 of the Indian Penal Code", the words, figures and symbols "section 2 (28) of Bharatiya Nyaya Sanhita, 2023" shall be substituted.
24. In section 5 of the principal Act, in sub-section (2), in the Explanation, Amendment of section 5
for the words, figures and synbols " Explanation to section 9 of the Code of Criminal Procedure, 1973", the words, figures and symbols " Explanation to section 8 of the Bharatiya Nagarik Suraksha Sanhita, 2023" shall be substituted.
25. In sub-section (1) of section 6 of the principal Act, for the words, figures Amendment of section 6
and symbol "Code of Criminal Procedure, 1973", the words, figures and symbol "Bharatiya Nagarik Suraksha Sanhita, 2023" shall be substituted.
Amendment of
26. In section 7 of the the principal Act,-

(a) (i) in sub-section (2) for the words, figures and symbol"Code of Criminal Procedure, 1973", the words, figures and symbol "Bharatiya Nagarik Suraksha Sanhita, 2023" shall be substituted;
(ii) in the proviso of sub-section (2) for the words and figures " under section 207 of the said code and proceed to try the case as if the case had been committed to Court of sessions for trial under the provision of such Code", the words, figures and symbols "under section 230 of the Bharatiya Nagarik Suraksha Sanhita, 2023 and proceed to try the case as if the case had been committed to Court of sessions for trial under the provision of Bhartiya Nagarik Suraksha Sanhita, 2023 " shall be substituted;

the said Code", the words, figures and symbols "Bharatiya Sakshya
Adhiniyam, 2023 and the Bharatiya Nagarik Suraksha Sanhita,2023 shall in
so far as they are not in consistent with the provison of this Act, apply to the
proceedings before a Special Court and for the purposes of the provisions of
the Bhartiya Nagarik Suraksha Sanhita, 2023" shall be substituted.
(c) in sub-section (4) for the words, figures and symbol "section 308
of the said Code, be deemed to have been tendered under section 307",the
words, figures and symbol "section 345 of Bharatiya Nagarik Suraksha
Sanhita, 2023 be deemed to have been tendered under section 344" shall be
substituted.
Amendment of 27. In section 8 of the principal Act, for the words, figures and symbol
section 8
"Code of Criminal Procedure, 1973", the words, figures and symbol "Bharatiya
Nagarik Suraksha Sanhita, 2023" shall be substituted.
Amendment of 28. In section 9 of the principal Act, for the words, figures and symbols
section 9
"The provisions of sections 406, 407 and 408 of the Code of Criminal Procedure,
1973", the words, figures and symbols "The provisions of sections 446, 447 and 448
of the Bharatiya Nagarik Suraksha Sanhita, 2023" shall be substituted.
Amendment of 29. In section 10 of the principal Act, for the words, figures and symbol
section 10
"Code of Criminal Procedure, 1973", the words, figures and symbol "Bharatiya
Nagarik Suraksha Sanhita,2023" shall be substituted.
Amendment of 30. In section 11 of the principal Act,

(a) in sub-section (1), for the words, figures, letters and symbol "The
provision of clause (a) of the proviso to sub-section (2) of section 167 of the
Code of Criminal Procedure, 1973", the words, figures and symbols "The
provision of sub-section (2) of section 187 of the Bharatiya Nagarik
Suraksha Sanhita, 2023" shall be substituted;
(b) in sub-section (2), for the words, figures, letter and symbol "The
provisions of clause (b) of the proviso to sub-section (2) of section 167 of
the Code of Criminal Procedure, 1973", the words, figures and symbols
"The provisions of sub-section (2) of section 187 of the Bharatiya Nagarik
Suraksha Sanhita, 2023" shall be substituted.
Amendment of 31. In clause (a) of section 12 the principal Act, for the words "Indian Penal

38. Amendment of
39. In the Uttar Pradesh Special Security Force Act, 2020 hereinafter in this section 2 of U.P. chapter referred to as the principal Act, in sub-section (2) of section 2, for the words, Act no. 27 of
figures and symbols "Indian Penal Code, 1860 and the Code of Criminal Procedure, 2020
1973", the words, figures and symbols "the Bharatiya Nyaya Sanhita, 2023 and the Bharatiya Nagarik Suraksha Sanhita, 2023" shall be substituted.
Amendment of
40. In sub-section (2) of section 11 of the principal Act, for the words, section 11

41. After sub-section (2) of section 19 of the principal Act, the following section 19

Amendment of 42. In the Uttar Pradesh Prohibition of Unlawful conversion of Religion Act,
section 7 of U.P. 2021 hereinafter in this chapter referred to as the principal Act, in section 7, for the
Act no. 3 of 2021 words, figures and symbol "Code of Criminal Procedure, 1973", the words, figures
and symbol "Bharatiya Nagarik Suraksha Adhiniyam, 2023" shall be substituted.
Amendment of 43. After sub-section (2) of section 15 of the principal Act, the following
section 15
sub-section shall be inserted, namely:-
"(3) Any appeal, application, trial, enquiry or investigation pending before
the date on which the Bharatiya Nyaya Sanhita, 2023, Bharatiya Nagarik Suraksha
Sanhita, 2023 and Bharatiya Sakshya Adhiniyam, 2023 comes into force, shall be
disposed of, continued held or made, as the case may be, in accordance with the
provisions of this Act, as inforce immediately before such amendments, as if these
amendments had not come into force."
