IN pursuance of the provisions of clause (3) of Article 348 of the Constitution of India, the Governor is pleased to order the publication of the following English translation of the Uttar Pradesh Niji Vishwavidyalay (Chaturth Sanshodhan) Adhiniyam, 2024 (Uttar Pradesh Adhiniyam Sankhya 13 of 2024) as passed by the Uttar Pradesh Legislature and assented to by the Governor on August 12, 2024. The Uccha Shiksha Anubhag-1 is administratively concerned with the said Adhiniyam.
THE UTTAR PRADESH PRIVATE UNIVERSITIES (FOURTH AMENDMENT ) ACT, 2024
(U.P. ACT No. 13 of 2024)

ACT
further to amend the Uttar Pradesh Private Universities Act, 2019.
IT IS HEREBY enacted in the Seventy-fifth Year of the Republic of India as follows:–
Short title and 1. (1) This Act may be called the Uttar Pradesh Private Universities (Fourth
commencement Amendment ) Act, 2024 .
(2) It shall be deemed to have come into force with effect from the
4th day of July, 2024.
Amendment of 2. In Schedule 2 of the Uttar Pradesh Private Universities Act, 2019
Schedule 2 of (hereinafter referred to as the "principal Act") after serial no. 42, the Columns of the
U.P. Act no. 12 said Schedule shall be amended as below and after serial no. 42 for the newly of 2019
established Universities the following serial numbers shall be inserted namely :—

3. (1) The State Government may, for the purposes of removing any difficulty

University, Ghaziabad, Uttar Pradesh, by order published in the Gazette direct that the
provisions of the principal Act shall during such period, as may be specified in the
order, have effect subject to such adaptations, whether by way of modification, addition
or omission, as it may deem necessary or expedient:
Provided that no such order shall be made after two years from the date of
commencement of this Act.
(2) Every order made under sub-section (1) shall be laid before both Houses of
the State Legislature as soon as may be after it is made.

U.P. Ordinance 4. (1) The Uttar Pradesh Private Universities (Fifth
saving
no. 10 of 2024, Amendment) Ordinance, 2024 and the Uttar Pradesh Private
11 of 2024 Universities (Sixth Amendment) Ordinance, 2024 are hereby repealed.
(2) Notwithstanding such repeal, anything done or any
action taken under the provisions of the principal Act as amended by
the Ordinance referred to in sub-section (1) shall be deemed to have
been done or taken under the corresponding provisions of the principal
Act as amended by this Act as if the provisions of this Act were in force at all material times.

STATEMENT OF OBJECTS AND REASONS
The Uttar Pradesh Private Universities Act, 2019 (U.P. Act no. 12 of 2019) has been enacted to provide for the establishment of new Private Universities and incorporation of existing Private Universities in the State of Uttar Pradesh for imparting higher education and to regulate their functions and for matters connected therewith or incidental thereto.
In order to provide for the establishment of two new Private Universities, namely :–(i) G.S. University, Hapur, Uttar Pradesh; and (ii) HRIT University, Ghaziabad, Uttar Pradesh, it was decided to amend Schedule 2 of the aforesaid Act.
Since the State Legislature was not in session and immediate legislative action was necessary to implement the aforesaid decision, the Uttar Pradesh Private Universities (Fifth Amendment) Ordinance, 2024 (U.P. Ordinance no. 10 of 2024) and the Uttar Pradesh Private Universities (Sixth Amendment) Ordinance, 2024 (U.P. Ordinance no. 11 of 2024) were promulgated by the Governor on July 4, 2024.
This Bill is introduced to replace the aforesaid Ordinance.
