िजसे आगे मूल अिधिनयम कहा गया है , की धारा 28 म(cid:336) श(cid:616) ^^कारावास से, िजसकी अविध छह मास तक हो सके गी या जुमा(cid:330)ने से, जो एक हजार (cid:348)पये तक हो सके गा ,या दोनों से ** के (cid:830)थान पर श(cid:616) ^^जुमा(cid:330)ने से जो दस हजार (cid:348)पये तक हो सके गा^^] रख िदए जाय(cid:336)गे।
नई धारा 28 क का
3-मूल अिधिनयम ,1965 की धारा 28 के i"pkr~ fuEufyf[kr धारा बढ़ा दी जाएगी , बढ़ाया जाना
28क ) 1 अपराध, रा(cid:475)
इस अिधिनयम के अधीन द(cid:503)नीय कोई (
सरकार (cid:554)ारा अिधसूचना के मा(cid:559)म से यथा िविनिद(cid:330)(cid:700) िकसी स(cid:407)म अिधकारी (cid:554)ारा अथा(cid:330)त्: - ^^vijk/kksa dk "keu
अिभयोजन सं(cid:304)(cid:830)थत िकये जाने के पूव(cid:330) या प(cid:686)ात् अिभयु(cid:389) (cid:554)ारा आवेदन िकये
जाने पर ऐसे अपराध हेतु उपबंिधत अिधकतम पचास (cid:366)ितशत जुमा(cid:330)ना की
धनरािश के िनिम(cid:517) यथा िविहत रीित से (cid:366)शिमत िकया जा सकता है:
पर(cid:566)ु यह िक इस धारा के अधीन (cid:366)शमन का उपबंध के वल (cid:366)थम
अपराध का(cid:303)रत िकये जाने हेतु उपल(cid:617) होगा।

(कोई अपराध (cid:366)शिमत िकये जाने के िलए (cid:366)(cid:529)ेक आवेदन यथा िविहत
रीित से िकया जायेगा।

(जहाँ िकसी अपराध का (cid:366)शमन ,कोई अिभयोजन सं(cid:304)(cid:830)थत िकये जाने
के पूव(cid:330) िकया जाता है वहां ऐसे अपराधी
िजसके स(cid:638)(cid:576) म(cid:336) अपराध इस (cid:366)कार ,
,के िव(cid:349)(cid:544) ऐसे अपराध के संबंध म(cid:336) कोई अिभयोजन (cid:366)शिमत िकया जाता है
सं(cid:304)(cid:830)थत नही ं िकया जायेगा।
)4 (जहाँ िकसी अपराध का शमन ,कोई अिभयोजन सं(cid:304)(cid:830)थत िकये जाने के
प(cid:686)ात् िकया जाता है वहां उप -धारा ) 1
(म(cid:336) िनिद(cid:330)(cid:700) अिधकारी (cid:554)ारा (cid:586)ायालय , जहाँ
वाद ल(cid:304)(cid:638)त हो के िल(cid:304)खत सं(cid:466)ान म(cid:336) लाया जायेगा और अपराध के शमन की ,
ऐसी नोिटस िदये जाने पर (cid:681)(cid:304)(cid:389), िजसके िव(cid:348)(cid:544) अपराध इस (cid:366)कार (cid:366)शिमत
िकया गया हो "

कितपय अिध(cid:703)ानों म(cid:336) िनयोिजत (cid:681)(cid:304)(cid:389)यों को बोनस का संदाय करने और उससे स(cid:638)(cid:304)(cid:576)त िवषयों का उपबंध करने के िलये बोनस संदाय अिधिनयम, 1965 (अिधिनयम सं(cid:421)ा 21 सन् 1965 )अिधिनयिमत िकया गया है।
िविनधान के संवध(cid:330)न के (cid:366)योजनाथ(cid:330) िविनयामकीय तथा अनुपालन संबंधी भार को कम करने और औ(cid:552)ोिगक तथा आिथ(cid:330)क ि(cid:354)याकलाप को गित देने हेतु उ(cid:552)ोग संवध(cid:330)न और आ(cid:566)(cid:303)रक (cid:681)ापार िवभाग, भारत सरकार, ने ऐसे
''अपराधों का अिधिनयमों, िनयमों और िविनयमों को समा(cid:593) करने या उ(cid:590)(cid:336) अपराध की (cid:373)ेणी से मु(cid:389) करने का िनदेश िदया है, जो वत(cid:330)मान समय म(cid:336) उपयोगी नही ं है। भारत सरकार (cid:554)ारा िदये गये पूव(cid:342)(cid:389) िनदेश के अनुसरण म(cid:336), ^^कारावास और जुमा(cid:330)ना** के उपबंध के (cid:830)थान पर ^^जुमा(cid:330)ना** रख कर और पूव(cid:342)(cid:389) अिधिनयम की धारा 28 के प(cid:686)ात् एक नयी धारा
शमन'' बढ़ाकर पूव(cid:342)(cid:389) अिधिनयम की धारा
28 का संशोधन करने का िविन(cid:686)य िकया गया।
तदनुसार बोनस संदाय

NOTIFICATION MISCELLANEOUS
IN pursuance of the provisions of clause (3) of Article 348 of the Constitution, the Governor is pleased to order the publication of the following English translation of the "Bonus Sandaay (Uttar Pradesh Sanshodhan) Vidheyak, 2024 introduced in the Uttar Pradesh Legislative Assembly on July 30, 2024.
THE PAYMENT OF BONUS (UTTAR PRADESH AMENDMENT) BILL, 2024
A
BILL
further to amend the Payment of Bonus Act, 1965 in its application to the State of Uttar Pradesh.
IT IS HEREBY enacted in the Seventy-fifth Year of the Republic of India as follows:-
1. (1) This Act may be called the Payment of Bonus (Uttar Pradesh Short title and commencement Amendment) Act, 2024.
(2) It shall come into force with effect from the date of its publication in the Gazette.
Amendment of
2. In section 28 of the Payment of Bonus Act, 1965, hereinafter referred to as section 28 of the "principal Act", for the words "with imprisonment for a term which may extend to Act no. 21 of
six months, or with fine which may extend to one thousand rupees, or with both", the 1965
words "with fine which may extend to ten thousand rupees" shall be substituted.
Insertion of
3. After section 28 of the principal Act, 1965, the following section shall be new Section inserted, namely :-
28A
28A (1) Any offence punishable under this Act, may be "Composition of Offences compounded on the application of accused, before or after institution of
prosecution by such Competent Officer, as the State Government may by
notification specify, for a sum of fifty percent of the maximum fine
provided for such offence, in such manner as may be prescribed:
Provided that the provision of the compounding under this section
shall be available only for commission of First offence.
(2) Every application for the compounding of an offence shall be
made in such manner as may be prescribed.
(3) Where any offence is compounded before the institution of any
prosecution, no prosecution shall be instituted in relation to such offence,
against the offender in relation to whom the offence is so compounded.
(4) Where the composition of any offence is made after the
institution of any prosecution, such composition shall be brought by the
officer referred to in sub-section (1) in writing to the notice of the court
in which prosecution is pending and on such notice of the composition of
the offence being given, the person against whom the offence is so
compounded shall be discharged." mRrj izns'k vlk/kkj.k xtV] 21 vxLr] 2024 5 STATEMENT OF OBJECT AND REASONS The Payment of Bonus Act, 1965 (Act no. 21 of 1965) has been enacted to provide for the payment of bonus to persons employed in certain establishments and for matters connected therewith.
IN order to reduce regulatory and compliance burden for the purpose of investment promotion and to give impetus to industrial and economic activity, the Department for Promotion of Industry and Internal Trade, Government of India has directed to abolish or decriminalize such Acts, rules and regulations, which are not useful at the present time. In pursuance of the aforesaid direction of the Government of India it has been decided to amend section 28 of the aforesaid Act by substituting the provision of 'imprisonment and fine' with 'fine' and to insert a new section providing for "Composition of Offences" after section 28 of the aforesaid Act .
The Payment of Bonus (Uttar Pradesh Amendment) Bill, 2024 is introduced accordingly.
