IN pursuance of the provisions of clause (3) of Article 348 of the Constitution, the Governor is pleased to order the publication of the following English translation of the Uttar Pradesh Nazul Sampatti (Lok Prayojanarth Prabandh Aur Upyog) Vidheyak, 2024 introduced in the Uttar Pradesh Legislative Assembly on July 29, 2024.
THE UTTAR PRADESH NAZUL PROPERTIES (MANAGEMENT AND UTILIZATION FOR PUBLIC PURPOSES) BILL, 2024 A BILL
to provide for reservation of Nazul properties for public purposes, and to provide for matters connected therewith or incidental thereto.
WHEREAS it is expedient in the public interest to uniformly provide in regard to reservation of Nazul Lands for public purposes, and to provide for matters connected therewith or incidental thereto;
AND, WHEREAS, in order to deal with the multiplicity of litigations involving Nazul Lands, leading to diverse claims, it has become expedient to bring a legislation to protect the interests of the State Government in such Nazul Lands.
IT IS HEREBY enacted in the Seventy-fifth year of the Republic of India as follows:-
CHAPTER – I
PRELIMINARY
1. (1) This Act may be called the Uttar Pradesh Nazul Properties (Management and Utilization for Public Purposes) Act, 2024.
Short title, extent and commencement
(2) It extends to the whole of Uttar Pradesh. (3) It shall be deemed to have come into force with effect from the 7th day of March, 2024.
Definitions 2. In this Act, unless there is anything repugnant in the subject or the context, — a. "Nazul" means,—
(i) any land or building or land with building which is the property of Government on the basis of public records maintained by the Government ; or
(ii) all such properties, land or buildings in or near towns or villages which have been vested with the State Government as per Article 296 of the Constitution of India ; or
(iii) all such parcels of land and/or buildings in respect of which a Grant was executed under the erstwhile Government Grants Act, 1895 or under any executive authority of the erstwhile British Government; or
(iv) any parcel of land that is not private land and in respect of which rights of lease, license or occupancy have been granted under any instrument of law, as the Government may declare by a notification but would not include property which is administered as a State property under the control of the Board of Revenue or the Forest Departmentor the Irrigation Department, or which falls under the control of the Defence, Postal, Telegraph, Railway or any Department of the Central Government. b. "Nazul Register" means such register that the State Government may maintain for the purposes of this Act and in such manner as may be prescribed;
c. "Public entity" means any Central or State Government department, agency, or other instrumentality fully owned by the Central or State Government and would also include any other non-governmental public service institutions which may be rendering services in the field of education, health, social support or such other institutions of similar character as may be notified by the Government from time to time;
d. "Private entity" means an institution which is not a public entity.

(1) Notwithstanding any judgment, decree or order of any Court to the contrary or, any other law or any Government order for the time being in force, Nazul lands located in Uttar Pradesh shall not be converted to freehold in favour of private person or private entity after commencement of this Act.
(2) Notwithstanding anything contained in any other law relating to Government Grants or Nazul Lands as defined under this Act and notwithstanding the repeal of any such law, with or without its savings, or anything contained in section 6 of the General Clauses Act, 1897 Nazul lands located in Uttar Pradesh shall not be converted to freehold in favour of private person or private entity after commencement of this Act.
(3) Notwithstanding any judgment, decree or order of any Court to the contrary or, any other law or any Government Order for the time being in force, all proceedings or applications pending in any Court or before any authority seeking conversion of Nazul Land as freehold prior to commencement of this Act shall lapse and shall stand rejected and money if any deposited in that regard shall be returned with interest rate equivalent to Marginal Cost of fund based lending rate (MCLR) of State Bank of India from the date of such deposit, as far as practicable within six months from the appointed date.
(4) It is hereby declared that no person shall have any right in Nazul Land
except as hereinafter provided.
(5) All claims pending at whatever stage before any authority and/or Court
shall be dealt with as provided hereunder.
(6) After commencement of this Act, grant of Nazul land shall be done only to public entities after due process and in accordance with such policies and rules as may be prescribed from time to time.
(7) The Government may either continue lease of leaseholders of Nazul land whose lease is still continuing and who have been depositing the lease rent regularly and have not violated any conditions of lease, on such terms as the Government may prescribe from time to time or determine such leases.
(8) After expiry of the lease period such land shall automatically vest in State Government free from all encumbrances and such land shall be deemed to be re- entered upon by the State Government.
(9) The Government shall have the authority to resume physical possession where the erstwhile lessee does not surrender the possession of the Nazul Land on the expiry of the lease and the ground rent from the date of expiry of the lease till the resumption of physical possession shall be determined as per the rate fixed by the District Magistrate and recovered as arrears of land revenue.
(10) On determination of lease and resumption by the State Government, the lessee shall be compensated for the superstructure or the building raised by such lessee according to the provision of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013.
(11) All existing Nazul Land leaseholders shall be required to provide their details of the Nazul Land and building and the utilization of the Nazul Land and building in conformity of the lease conditions before the District Magistrate within a period of three months from the appointed date. Any non-compliance with the above requirement will be an adverse factor while the Government may act in regard to further considerations of all existing Nazul Land leases.
The Government shall conduct a periodic survey of all existing leases and where lease has not expired but the lessee is not utilizing the leasehold land in whole or part in accordance with conditions of the lease or such land is being used in violation of lease conditions, the State Government, on recommendation of the District Magistrate, may modify the lease by either reducing the lease period, by reducing lease area or both or altogether determining the lease as aforesaid :
Provided that opportunity of hearing shall be provided to the leaseholder by
the District Magistrate before sending his recommendation :
Provided further that the provisions of clause (10) shall mutatis mutandis
apply in respect of actions taken as abovesaid.
10 mRrj izns'k vlk/kkj.k xtV] 21 vxLr] 2024 (12) In all such cases where Freehold Deed has already been executed and itcomes to light that such Freehold Deed was executed by inducing fraud, or suppressing material information which would have had an effect on the decision of the Government to grant such Freehold, the Government shall have the power to cancel such Freehold Deed and resume the land and buildings :
Provided that before cancelling the Freehold Deed, the person in whose favour such Freehold Deed has been executed shall be heard by the District Magistrate in accordance with the procedure prescribed, and the District Magistrate shall pass a speaking order on the issue of cancellation :
Provided further that a party aggrieved by the decision of the District Magistrate shall have the liberty of filing an appeal before the Government within a period of 30 days from the date the decision of the District Magistrate which shall be heard by the Principal Secretary (Housing).
(13) No mutation shall be carried out in Nazul register except in the manner as prescribed.
4. Nothing contained in this Act shall prevent the Government from making arrangements to rehabilitate persons belonging to the Economically Weaker Section who may have been occupying the Nazul Land or building at the time of commencement of this Act.
Rehabilitation of persons belonging to the Economically Weaker Section
5. (1) Notwithstanding anything contained in section 3 of this Act, the Government may prescribe circumstances of exceptional character which may qualify for exemption from the provisions of this Act.
Power of the Government to grant exemption in certain cases
(2) An application showing special circumstances of exceptional character, can be considered by the Government keeping however in mind that the application is not vitiated by fraud, suppression of facts and similar circumstances.
6. Government may, by notification, make rules for carrying out the Power to make rules
provisions of this Act.
U.P. Ordinance 7. (1) The Uttar Pradesh Nazul Properties (Management and
no. 5 of 2024 Repeal and Saving
Utilization for Public Purpose) Ordinance, 2024 is hereby repealed.
(2) Notwithstanding such repeal, anything done or any action
taken under the provisions of the Ordinance referred to in
sub-section (1) shall be deemed to have been done or taken under the
corresponding provisions of this Act as if the provisions of this Act
were in force at all material times.

STATEMENT OF OBJECT AND REASONS
Due to various kinds of developmental activities of huge public importance that the Government of Uttar Pradesh has undertaken, there is a continuing and urgent requirement of land which can be made available to the concerned stakeholders for its utilization in such developmental activities. For the Government to make the land available for its use in these developmental activities, the recourse is to acquire land, which would entail incurring huge expenditure and facing enormous delays in the process.
The Government of Uttar Pradesh at present has parcels of land, called Nazul Lands, which have been leased out to various private individuals and private entities in the nature of Grants issued under the erstwhile Government Grants Act, 1895 and subsequent Government Grants (Uttar Pradesh Amendment) Act, 1960 or otherwise. The Government of Uttar Pradesh has also from time to time come out with policy of declaring such Nazul Lands as freehold. These policies have led to multifarious claims and has becomes a drain on this class of land bank. In view of the requirement of land as stated hereinabove, it is no longer in the interest of the State of Uttar Pradesh to continue with these policies and to permit conversion of mRrj izns'k vlk/kkj.k xtV] 21 vxLr] 2024 11 these Nazul Lands into freehold, in view of the public interest that is involved. In fact, if the Government re-enters its Nazul lands, it will result in land becoming available for the Government without there being a need for acquiring land under the Land Acquisition Laws.
After the repeal of the Government Grants Act, 1895 by the Parliament by Repealing and Amending (Second) Act, 2017, the Government of Uttar Pradesh has suspended all the policies in relation to the management and disposal of Nazul Lands. However, in view of the earlier policies of the Government of Uttar Pradesh which had provided for an option of freehold, huge amount of litigation is pending before Courts seeking conversion of Nazul Lands as freehold which has become a vexed question resulting in uncertainties with respect to the interest of the State Government involved in these lands.
Therefore, in view of such situation existing there is a need for a legislation which would adequately cater to the interests of the State Government so that the Nazul lands can be reclaimed by the Government for public use for developmental activities which otherwise are being hampered for want of land.
In view of huge public interest involved, while preserving Nazul Land, the State Government should use it only for public utility instead of declaring these lands as freehold in favour of private individuals/institutions, because the larger public interest is more important than providing benefits to private individuals/institutions. In view of the above, it was decided to end the uncertainties regarding the use of Nazul Land.
Since the State Legislature was not in session and immediate legislative action was necessary to implement the aforesaid decision, the Uttar Pradesh Nazul Properties (Management And Utilization For Public Purposes) Ordinance, 2024 was promulgated by the Governor on 07 March, 2024.
This Bill is introduced to replace the aforesaid Ordinance.
