IN pursuance of the provisions of clause (3) of Article 348 of the Constitution, the Governor is pleased to order the publication of the following English translation of the notification no. 2448/IX-1– 2024-402 SA-13, dated August 22, 2024 :

WHEREAS IN exercise of the powers under clause (2) of Article 243-Q of the Constitution of India read with sub-section (2) of section 3 of the Uttar Pradesh Municipalities Act, 1916 (U.P. Act no. 2 of 1916) Notification no. 2039/IX-1–2019-402SA-13, dated December 5, 2019 was issued and published in the Official Gazette on the same date with a view to constitute the transitional area Nagar Panchayat, Bhanpur in District Basti;
AND, WHEREAS, in Writ C No. 26863/2020 (Gaganram versus State of U.P. and 3 Others), the Hon'ble High Court of Judicature at Allahabad vide order dated July 29, 2024 has set aside the aforesaid notification dated December 5, 2019 insofar as it includes areas of village Kothila Khas in the final notification because these areas were not part of the preliminary notification dated May 24, 2016 issued/published in accordance with section 4 of the Uttar Pradesh Municipalities Act, 1916 read with Articl 243-Q (2) of the Constitution of India;
NOW, THEREFORE, in exercise of the powers under clause (2) of Article 243-Q of the Constitution of India read with sub-section (2) of section 3 of the Uttar Pradesh Municipalities Act, 1916 (U.P. Act no. 2 of 1916) and section 21of the Uttar Pradesh General Clauses Act, 1904 (U.P. Act no. 1 of 1904), the Governor is pleased to exclude the village Kothila Khas from the Schedule to Notification no.2039/9-1-2019-402SA-13, dated December 5, 2019.
Accordingly, Notification no. 2039/IX-1–2019-402SA-13, dated December 5, 2019 shall be deemed to be amended to the aforesaid extent.
