उत्तर प्रदेश साधारण खण्ड अधधधियम,1904 (उत्तर प्रदेश अधधधियम संख्या 1 सि् 1904) की धारा 21 के साथ पधित संयुक्त प्रान्त आबकारी अधधधियम, 1910 (संयुक्त प्रान्त अधधधियम संख्या 4 सि् 1910) की धारा 24 और 41 के अधीि शधक्तयों का प्रयोग करके , राज्य सरकार की पूर्व स्र्ीकृ धत से आबकारी आयुक्त, उत्तर प्रदेश, अधधसूचिा संख्या-27091/दस-लाइसेंस-59/2002-2003, धदिांक 14 माचव, 2002 द्वारा प्रकाधशत उत्तर प्रदेश, आबकारी (देशी शराब की फु टकर धबक्री के अिुज्ञापिों का व्यर्स्थापि) धियमार्ली, 2002 में संशोधि करिे की दृधि से धिम्िधलधखत धियमार्ली बिाते हैं:–

1. संधिप्त िाम और प्रारम्भ– (1) यह धियमार्ली उत्तर प्रदेश आबकारी (देशी शराब की फु टकर धबक्री के धलये अिुज्ञापिों का व्यर्स्थापि) (सत्रहव ाँ संशोधि) धियमार्ली, 2024 कही जायेगी।

(2) यह धदिांक 01 अप्रैल, 2024 से प्रर्ृत्त हुई समझी जायेगी।

2. धियम-2 का संशोधि–उत्तर प्रदेश आबकारी (देशी शराब की फु टकर धबक्री के धलये अिुज्ञापिों का व्यर्स्थापि) धियमार्ली, 2002 (धजसे आगे ''उक्त धियमार्ली'' कहा गया है) में िीचे स्तम्भ-1 में धदये गये धियम-2 के स्थाि पर स्तम्भ-2 में धदया गया धियम रख धदया जायेगा, अथावत््ः-

धनि तश से है, जो आसवनी स्िि पि सांदेर् होगी िथ

लाइसेंसधारी द्वारा फु टकर धबक्री के प्रयोजिाथव आबकारी र्षव

आसवनी द्व ि थोक आपूतियकि य से एक्स तितस्िलिी

में अपिी फु टकर दुकाि के धलए उसके द्वारा उिाई जािे र्ाली

प्र इस के अतिरिक्त वसूलनीर् होगी औि जो थोक

प्रत्याभूत तीव्र देशी शराब (36 प्रधतशत र्ी/र्ी के रुप में) की

आपूतियकि य द्व ि फु िकि ल इसेंसध िी से अतधकिम

मात्रा से है। तथाधप, यधद आबकारी र्षव के प्रारम्भ के पश्चात्

थोक मूल्र् के अतिरिक्त वसूल की ज सके गी, तकन्िु

कोई लाइसेंस धदया जाता है, तो आबकारी र्षव में शेष धदिों

अतिरिक्त प्रतिफल फीस की र्ह धनि तश, फु िकि

की संख्या के अिुसार अिुपाधतक रूप से उिकी न्यूितम

ल इसेंसध िी द्व ि सांदेर् ल इसेंस फीस के स पेक्ष

र्ाधषवक प्रत्याभूत मात्रा को घटा धदया जायेगा;

सम र्ोतजि नहीं की ज र्ेगी;

(ग) ''बेधसक लाइसेंस फीस'' का तात्पयव अधधधियम की धारा 24 (ग)''व तषयक न्र्ूनिम प्रत्र् भूि म त्र '' क ि त्पर्य के अधीि देशी शराब की फु टकर धबक्री के एकाधन्तक आबक िी आर्ुक्त द्व ि ज िी स म न्र् र् तवतनतदयष्ट धर्शेषाधधकार हेतु सम्पूणव आबकारी र्षव या उसके भाग के अनुदेशों के अनुसिण में ल इसेंस प्र तधक िी द्व ि र्थ धलए लाइसेंस प्रदाि धकए जािे के धिधमत्त प्रधतफल के उस तनर्ि औि ल इसेंसध िी द्व ि फु िकि तबक्री के भाग से है, जो लाइसेंसधारी के रूप में चयधित व्यधक्त द्वारा, प्रर्ोजन थय आबक िी वषय में अपनी फु िकि दुक न के उसको लाइसेंस प्रदाि धकए जािे के पूर्व, ऐसी दरों पर, जैसा तलए उसके द्व ि उठ ई ज ने व ली प्रत्र् भूि िीव्र देशी धक समय-समय पर राज्य सरकार के परामशव से आबकारी शि ब (36 प्रतिशि वी/वी के रुप में) की म त्र से है।

आयुक्त द्वारा अधधसूधचत की जाय, भुगताि धकया जाय।

िथ तप, र्तद आबक िी वषय के प्र िम्भ के पश्च ि् कोई

ल इसेंस तदर् ज ि है, िो आबक िी वषय में शेष तदनों

परन्तु यधद व्यर्स्थापि मध्य सत्र में होता है, तो

की सांख्र् के अनुस ि अनुप तिक रूप से उनकी

बेधसक लाइसेंस फीस अर्शेष अर्धध के न्यूितम प्रत्याभूत

न्र्ूनिम व तषयक प्रत्र् भूि म त्र को घि तदर् ज र्ेग ;

एतद्द्वारा प्रधतस्थाधपत धियम

(घ) ''बेतसक ल इसेंस फीस'' क ि त्पर्य अतधतनर्म की

(घ) ''देशी शराब'' में एक्सट्रा न्यूट्रल एल्कोहल (ई0एि0ए0) से

ध ि 24 के अधीन देशी शि ब की फु िकि तबक्री के

एक तन्िक तवशेष तधक ि हेिु सम्पूणय आबक िी वषय र्

उसके भ ग के तलए ल इसेंस प्रद न तकए ज ने के

धिधमवत ऐसी अल्कोहलीय सांद्रता र्ाली 25 प्रधतशत और 36 प्रधतशत (सादा, सुर्ाधसत और मसाला) शराब और 42॰8 प्रधतशत (सादा, सुर्ाधसत और मसाला) र्ाली उत्तर प्रदेश

तनतमत्त प्रतिफल के उस भ ग से है, जो ल इसेंसध िी के

रूप में चर्तनि व्र्तक्त द्व ि , उसको ल इसेंस प्रद न तकए

धिधमवत शराब (यू0पी0एम0एल0)भी सधम्मधलत है, जैसा धक समय-समय पर राज्य सरकार की पूर्व अिुमधत से आबकारी

आयुक्त द्वारा धियत की जाय;

ज ने के पूवय, ऐसी दिों पि, जैस तक समर्-समर् पि

ि ज्र् सिक ि के पि मशय से आबक िी आर्ुक्त द्व ि

अतधसूतचि की ज र्, भुगि न तकर् ज र्।

पिन्िु र्ह तक र्तद व्र्वस्थ पन मध्र् सत्र में होि

है, िो बेतसक ल इसेंस फीस अवशेष अवतध के न्र्ूनिम

प्रत्र् भूि म त्र के सम नुप तिक होगी,

(ङ) ''प्रतिफल फीस '' क ि त्पर्य आबक िी अतधतनर्म की

(ङ) ''दैधिक बेधसक लाइसेंस फीस'' का तात्पयव प्रधतफल शुल्क के उस भाग से है, जो धक अन्तररम लाइसेंस के प्राप्तकताव द्वारा ध ि -30 के अधीन ि ज्र् सिक ि द्व ि देशी शि ब की ऐसी दर से देय होगी जैसा धक राज्य सरकार की पूर्व स्र्ीकृ धत

से आबकारी आयुक्त द्वारा अधधसूधचत की जाय;

सांद्रि के अनुस ि प्रति लीिि की दि से तनध यरिि फीस से

है, जो देशी शि ब की आपूतिय किने से पूवय ल इसेंसध िी

द्व ि सिक िी कोष ग ि में जम की ज र्ेगी;

(च) ''दैधिक न्यूितम प्रत्याभूत मात्रा'' र्ाधषवक न्यूितम प्रत्याभूत

मात्रा का 1/365 र् ं भाग होगी,

(च)''देशी शि ब'' में एक्सट्र न्र्ूट्रल एल्कोहल (ई0एन0ए0)

से तनतमयि ऐसी अल्कोहलीर् स ांद्रि व ली 25 प्रतिशि

(सुव तसि) , 36 प्रतिशि (मस ल ) शि ब औि 42॰8

प्रतिशि (मस ल ) व ली उत्ति प्रदेश तनतमयि शि ब

(र्ू0पी0एम0एल0)भी सतम्मतलि है, जैस तक समर्-

समर् पि ि ज्र् सिक ि की पूवय अनुमति से आबक िी

आर्ुक्त द्व ि तनर्ि की ज र्;

(छ) ''आबकारी र्षव'' का तात्पयव 01 अप्रैल से प्रारम्भ होकर (छ) ''दैतनक बेतसक ल इसेंस फीस'' क ि त्पर्य प्रतिफल आगामी कलेन्डर र्षव के 31 माचव तक चलिे र्ाले धर्त्तीय शुल्क के उस भ ग से है, जो तक अन्िरिम ल इसेंस के र्षव से है;

प्र प्तकि य द्व ि ऐसी दि से देर् होगी जैस तक ि ज्र्

सिक ि की पूवय स्वीकृ ति से आबक िी आर्ुक्त द्व ि

अतधसूतचि की ज र्;

(ज) ''पररर्ार'' का तात्पयव दम्पधत्त (पधत या पत्िी), आधित पुत्रों, (ज)''दैतनक न्र्ूनिम प्रत्र् भूि म त्र '' व तषयक न्र्ूनिम

प्रत्र् भूि म त्र क 1/365 व ां भ ग होगी,

अधर्र्ाधहत पुधत्रयों और आधित माता-धपता से है और र्े इसमें शाधमल हैं;

एतद्द्वारा प्रधतस्थाधपत धियम

(झ) ''धिोहि धनि तश'' क ि त्पर्य ल इसेंस प्रद न किने के

(झ) ''प्रपत्र'' का तात्पयव इस धियमार्ली के साथ संलग्ि प्रपत्र

बेतसक ल इसेंस फीस की धनि तश के 1/10 भ ग के

बि बि धनि तश से है, जो व्र्तिक्रम की दश में इस

तनर्म वली के तनर्म 12 के उपबन्धों के अधीन जब्ि

तकर्े ज ने र्ोग्र् होगी;

(ञ) ''लाइसेंस प्राधधकारी'' का तात्पयव धजले के कलेक्टर से है;

(ञ) ''आबक िी वषय'' क ि त्पर्य 01 अप्रैल से प्र िम्भ

होकि आग मी कलेन्िि वषय के 31 म चय िक चलने

व ले तवत्तीर् वषय से है;

(ट) ''लाइसेंस फीस'' का तात्पयव बेधसक लाइसेंस फीस के (ि) ''परिव ि'' क ि त्पर्य दम्पतत्त (पति र् पत्नी), आतिि अधतररक्त, आबकारी अधधधियम की धारा 24 के अधीि देशी पुत्रों, अतवव तहि पुतत्रर्ों औि आतिि म ि -तपि से है शराब की फु टकर धबक्री के एकाधन्तक धर्शेषाधधकार के धलए औि वे इसमें श तमल हैं;

लाइसेंस प्रदाि धकए जािे के धलए प्रधतफल के शेष भाग से है,

जो लाइसेंसधारी द्वारा देय होगी। यह धिराधश दुकाि के धलए धियत र्ाधषवक न्यूितम प्रत्याभूत मात्रा पर उदग्रहणीय प्रधतफल

फीस के बराबर होगी;

परन्तु यधद व्यर्स्थापि मध्य सत्र में होता है, तो यह

अर्शेष अर्धध की न्यूितम प्रत्याभूत मात्रा में धिधहत

प्रधतफल फीस के बराबर होगी;

(ि) ''लाइसेंस फीस की माधसक धकस्त'' बेधसक लाइसेंस फीस के (ठ) ''प्रपत्र''क ि त्पर्य इस तनर्म वली के स थ सांलग्न

प्रपत्र से है;

अधतररक्त होगी जो लाइसेंस प्राधधकारी द्वारा धिधावररत माधसक

न्यूितम प्रत्याभूत मात्रा में धिधहत प्रधतफल फीस के बराबर

होगी और प्रत्येक माह देय होगी। तथाधप लाइसेंसधारी द्वारा

एक माह में उिाई गई देशी शराब की मात्रा में धिधहत प्रधतफल

फीस का समायोजि धियमार्ली के उपबन्धों के अधीि रहते

हुए लाइसेंस फीस की माधसक धकस्त के प्रधत धकया जा

सकता है;

(ि)''अनुक्रम''क ि त्पर्य ई/ल ििी प्रतक्रर् के म ध्र्म से

(ड) ''माधसक न्यूितम प्रत्याभूत मात्रा''- र्ाधषवक न्यूितम प्रत्याभूत मात्रा

को बारह समाि भागों में धर्भाधजत धकया जायेगा। इस प्रकार की ल इसेंसध िी के चर्न के तलर्े कतथि आध ि दुक नों की धिोहि धनि तश के अविोही क्रम से है;

गणिा में प्राप्त मात्रा माधसक न्यूितम प्रत्याभूत मात्रा होगी;

एतद्द्वारा प्रधतस्थाधपत धियम

(ढ) ''व्र्तक्त''क ि त्पर्य ऐसे व्र्तक्त से है जो इक्कीस वषय

की आर्ु से अन्र्ून, भ िि क न गरिक हो;

(ढ) ''प्रधतभूधत धिराधश'' का तात्पयव बेधसक लाइसेंस फीस के अधतररक्त लाइसेंस फीस के 1/10र् भाग के बराबर धिराधश से

है, जो धजला आबकारी अधधकारी के पि में धगरर्ीकृ त सार्धध जमा रसीद के माध्यम से अथर्ा ई-पेमेन्ट के माध्यम से जमा

की जायेगी और जो राज्य सरकार के समस्त दार्ों और देयों के

अन्तररम व्यर्स्थापि के बाद र्ापसी योग्य होगी;

परन्तु िर्ीकरण की धस्थधत में, पूर्व में िकद या राष्ट्ट्रीय बचत पत्र (एि0एस0सी0) अथर्ा बैंक गारंटी के माध्यम से जमा की गयी प्रधतभूधत तब तक मान्य होगी, जब तक इसकी र्ापसी ि कर दी जाय।

(ण) ''ल इसेंस प्र तधक िी'' क ि त्पर्य तजले के कलेक्िि

से है;

(ण) ''प्रधतफल शुल्क'' का तात्पयव आबकारी अधधधियम की धारा-30 के अधीि राज्य सरकार द्वारा देशी शराब की तीव्रता के अिुसार प्रधत लीटर की दर से धिधावररत फीस से है, जो देशी शराब की आपूधतव से पूर्व लाइसेंसधारी द्वारा सरकारी कोषागार में जमा की जायेगी।

(त) ''अधतररक्त प्रधतफल शुल्क'' का तात्पयव देशी शराब के आधटटमम ररटेल प्राइस को दो रुपये के अगले गुणक तक पूणावधकं त धकये जािे के फलस्र्रुप प्राप्त अन्तर की धिराधश से है, जो आसर्िी स्तर पर देय होगी तथा आसर्िी द्वारा थोक

(ि) ''ल इसेंस फीस'' क ि त्पर्य बेतसक ल इसेंस फीस के

अतिरिक्त, आबक िी अतधतनर्म की ध ि 24 के अधीन

देशी शि ब की फु िकि तबक्री के एक तन्िक

तवशेष तधक ि के तलए ल इसेंस प्रद न तकए ज ने के

तलए प्रतिफल के शेष भ ग से है, जो ल इसेंसध िी द्व ि

देर् होगी। र्ह धनि तश दुक न के तलए तनर्ि व तषयक

न्र्ूनिम प्रत्र् भूि म त्र पि उदग्रहणीर् प्रतिफल फीस

के बि बि होगी;

आपूधतवकताव से एक्स धडधस्टलरी प्राइस के अधतररक्त र्सूलिीय होगी एर्ं जो थोक आपूधतवकताव द्वारा फु टकर लाइसेंसधारी से अधधकतम थोक मूल्य के अधतररक्त र्सूल की जा सके गी, धकन्तु अधतररक्त प्रधतफल शुल्क की यह धिराधश, फु टकर लाइसेंसधारी द्वारा संदेय लाइसेंस फीस के सापेि समायोधजत िहीं की जायेगी।

पिन्िु र्तद व्र्वस्थ पन मध्र् सत्र में होि है, िो

र्ह अवशेष अवतध की न्र्ूनिम प्रत्र् भूि म त्र में

तनतहि प्रतिफल फीस के बि बि होगी;

(थ) ''धरोहर धिराधश'' का तात्पयव लाइसेंस की स्र्ीकृ धत के धलये पात्रता की शतों की पूधतव सुधिधश्चत धकये जािे के धलये आर्ेदि-पत्र के साथ जमा की जािे र्ाली बेधसक लाइसेंस

फीस की धिराधश के 1/10 भाग के बराबर धिराधश से है, जो

व्यधतक्रम की दशा में इस धियमार्ली के धियम 12 के

उपबन्धों के अधीि जब्त धकये जािे योग्य होगी।

(थ) ''ल इसेंस फीस की म तसक तकस्ि'' बेतसक ल इसेंस

फीस के अतिरिक्त होगी जो ल इसेंस प्र तधक िी द्व ि

तनध यरिि म तसक न्र्ूनिम प्रत्र् भूि म त्र में तनतहि

प्रतिफल फीस के बि बि होगी औि प्रत्र्ेक म ह देर् होगी।

िथ तप ल इसेंसध िी द्व ि एक म ह में उठ ई गई देशी

शि ब की म त्र में तनतहि प्रतिफल फीस क सम र्ोजन

तनर्म वली के उपबन्धों के अधीन िहिे हुए ल इसेंस फीस

की म तसक तकस्ि के प्रति तकर् ज सकि है;

एतद्द्वारा प्रधतस्थाधपत धियम

(द) ''अिुक्रम''का तात्पयव ई/लाटरी प्रधक्रया के माध्यम से लाइसेंसधारी के चयि के धलये कधथत आधार दुकािों की धरोहर धिराधश के अर्रोही क्रम से है।

(द) ''म तसक न्र्ूनिम प्रत्र् भूि म त्र ''- व तषयक न्र्ूनिम

प्रत्र् भूि म त्र को ब िह सम न भ गों में तवभ तजि

तकर् ज र्ेग । इस प्रक ि की गणन में प्र प्त म त्र

म तसक न्र्ूनिम प्रत्र् भूि म त्र होगी;

(ध) ''पोटवल'' का तात्पयव धर्धिधदवि रूप से धिधमवत इलेक्ट्राधिक टलेटफामव, धजस पर मधदरा धिमावण की प्रधक्रया से सम्बधन्धत इसके धर्तरण के समाटय अर्स्था तक की सूचिाओं को धर्धहत प्रारूप में अपलोड धकये जािे के प्रयोजि से है;

(ध) ''पोियल'' क ि त्पर्य तवतनतदयष्ट रूप से तनतमयि

इलेक्ट्र तनक टलेिफ मय, तजस पि मतदि तवतनम यण की

प्रतक्रर् से सम्बतन्धि इसके तवििण के सम टर् अवस्थ

िक की सूचन ओां को तवतहि प्र रूप में अपलोि तकर्े

ज ने के प्रर्ोजन से है;

(ि) ''ऋणशोधि िमता'' का तात्पयव फु टकर लाइसेंस की स्र्ीकृ धत के धलये आर्ेदि करिे हेतु आर्ेदक के धलये धिधावररत धर्त्तीय अहवता के मािदण्ड से है;

(न) ''प्रतिभूति धनि तश''क ि त्पर्य बेतसक ल इसेंस फीस

के अतिरिक्त ल इसेंस फीस के 1/10व भ ग के बि बि

धनि तश से है, जो तजल आबक िी अतधक िी के पक्ष

में तगिवीकृ ि स वतध जम िसीद के म ध्र्म से अथव

ई-पेमेन्ि के म ध्र्म से जम की ज र्ेगी औि जो ि ज्र्

सिक ि के समस्ि द वों औि देर्ों के अन्िरिम

व्र्वस्थ पन के ब द व पसी र्ोग्र् होगी;

पिन्िु नवीकिण की तस्थति में, पूवय में नकद र्

ि ष्ट्ट्रीर् बचि पत्र (एन0एस0सी0) अथव बैंक ग िांिी के

म ध्र्म से जम की गर्ी प्रतिभूति िब िक म न्र् होगी,

जब िक इसकी व पसी न कि दी ज र्।

(प) ''व्यधक्त'' का तात्पयव ऐसे व्यधक्त से है जो आर्ेदि करिे के समय इक्कीस र्षव की आयु से अन्यूि, भारत का िागररक हो;

(प) ''व्र्वस्थ पन'' क ि त्पर्य नवीकिण, ई-ल ििी

अथव ई-िेण्िि के म ध्र्म से दुक नों के व्र्वस्थ पन

अथव पुनयव्र्वस्थ पन से है, जो सम च ि-पत्र एवां

आबक िी तवभ ग की वेबस इि के म ध्र्म से पूवय

(ब) ''उत्तर प्रदेश धिधमवत शराब (यू0पी0एम0एल0) '' का तात्पयव ग्रेि एक्सट्रा न्यूट्रल एल्कोहल (ई0एि0ए0) से धर्धिधमवत ऐसी अल्कोहलीय सांद्रता र्ाली देशी धस्प्रट (मस ल ) से है, जैसा (ब) ''उत्तर प्रदेश धिधमवत शराब (यू0पी0एम0एल0) '' का तात्पयव ग्रेि एक्सट्रा न्यूट्रल एल्कोहल (ई0एि0ए0) से धर्धिधमवत ऐसी अल्कोहलीय सांद्रता र्ाली देशी धस्प्रट (सादा, सुर्ाधसत और मसाला) से है, जैसा धक समय-समय पर राज्य सरकार के पूर्व अिुमोदि से आबकारी आयुक्त द्वारा धियत की जाय।

(2) इस धियमार्ली में अपररभाधषत धकन्तु अधधधियम में पररभाधषत शब्दों और पदों के र्ही अथव होंगे जो अधधधियम में क्रमश्ः उिके धलए समिुदेधशत हों।

(क) (एक) राज्य सरकार द्वारा धर्धिधदवि प्रधतबन्धों एर्ं शतो के अधीि दुकाि के लाइसेंस का ऑिलाइि िर्ीकरण धकया जा सके गा।

(दो) िर्ीकरण ि होिे की धस्थधत में लाइसेंसधाररयों का चयि, आिलाइि आर्ेदि आमंधत्रत कर राज्य सरकार द्वारा यथा धर्धिधदवि ई-लाटरी अथर्ा ई-टेण्डर की प्रधक्रया के माध्यम से दुकािर्ार धकया जायेगा। धजला आबकारी अधधकारी, आिलाइि प्राप्त आर्ेदिों की संर्ीिा करेगा और पात्र एर्ं अपात्र आर्ेदिों की सूची, अपात्रता के कारणों को उधल्लधखत करते हुए तैयार करेगा और इस सूची को ई- लाटरी एर्ं ई-टेण्डर हेतु गधित धजला स्तरीय लाइसेंस सधमधत के समि प्रस्तुत करेगा।

एतद्द्वारा प्रधतस्थाधपत धियम

(ख) उक्त सधमधत आर्ंटि हेतु अहव एर्ं अिहव आर्ेदकों को धचधन्हत करेगी। ई-ल टरी की धस्थधत में अहव आर्ेदकों में से प्रत्येक दुकाि के धलये लाइसेंसधारी का चयि कम्टयूटर चधलत यादृधछछक धर्न्यास के माध्यम से धकया जायेगा। यादृधछछकीकरण प्रधक्रया सम्बधन्धत धियम के अधीि धर्धहत अिुक्रम के अिुसार देशी मधदरा, माडल शाप, धर्देशी मधदरा तथा बीयर की फु टकर दुकािों के क्रम में अपिायी जायेगी। ई- टेण्डर के माध्यम से लाइसेंसधारी के चयि की धस्थधत में उसी पूर्ोक्त अिुक्रम का पालि धकया जायेगा। धकसी भी आर्ेदक के पि सम्पूणव राज्य में सभी िेणी की देशी शराब, माडल शाप, धर्देशी मधदरा, एर्ं बीयर की कु ल धमलाकर दो से अधधक दुकािें आर्ंधटत िहीं की जायेंगी।

परन्तु यह धक पूर्ोक्त धिबबंधधि सीमा लाइसेंसधारी/ लाइसेंसधाररयों की मृत्यु की धस्थधत में धियम-8(क) में उधल्लधखत प्रधक्रया के अिुसार मृत लाइसेंसधारी/ लाइसेंसधाररयों के धर्धधक र्ाररस/पररर्ार के सदस्य /धिकट सम्बन्धी के पि में लाइसेंस िर्ीकरण/ िामान्तरण से सम्बधन्धत मामलों में लागू िहीं होगा।

परन्तु यह और धक धकसी आर्ेदक के पि में सम्पूणव राज्य में दो या दो से अधधक दुकािों के िर्ीकरण होिे की धस्थधत में र्ह ई-लाटरी के माध्यम से अग्रतर दुकािों के चयि हेतु पात्र िहीं होगा।

(ग) यधद चयधित आर्ेदक बेधसक लाइसेंस फीस या प्रधतभूधत धिराधश जमा िहीं करेगा और धर्धहत औपचाररकताए पूरी िहीं करेगा या धियत अर्धध में दुकाि हेतु उपयुक्त पररसर की व्यर्स्था करिे में अिम रहेगा तो लाइसेंस प्राधधकारी आर्ंटि को धिरस्त कर देगा और शासि द्वारा धर्धहत प्रधक्रया के माध्यम से दुकाि के पुिवव्यर्स्थापि हेतु आर्श्यक कायवर्ाही करेगा।

(घ) यधद धकसी धर्धशि दुकाि के धलए कोई आर्ेदि-पत्र प्राप्त िहीं हो या धकसी दुकाि के धलए कोई अभ्यथी उपयुक्त िहीं पाया जाये तो लाइसेंस प्राधधकारी दुकाि के पुिवव्यर्स्थापि हेतु शासि द्वारा धर्धहत प्रधक्रया के माध्यम से तत्काल उपाय करेगा।

धकया जाता है तो अपिे चयि की सूचिा की प्राधप्त के 03 कायव धदर्सों के भीतर बेधसक लाइसेंस फीस की सम्पूणव धिराधश जमा करेगा। उससे यह अपेिा की जायेगी धक र्ह प्रधतभूधत धिराधश का आधा भाग अपिे चयधित होिे की सूचिा के 10 कायव धदर्सों के भीतर और अर्शेष प्रधतभूधत धिराधश अपिे चयि होिे की सूचिा के 20 कायव धदर्सों के भीतर जमा कर दें।

धकया जाता है तो अपिे चयि की सूचिा की प्राधप्त के 03 कायव धदर्सों के भीतर बेधसक लाइसेंस फीस की सम्पूणव धिराधश जमा करेगा। उससे यह अपेिा की जायेगी धक र्ह प्रधतभूधत धिराधश का आधा भाग अपिे चयधित होिे की सूचिा के 10 कायवधदर्सों के भीतर और अर्शेष प्रधतभूधत धिराधश अपिे चयि होिे की सूचिा के 20 कायव धदर्सों के भीतर जमा कर दें। आर्ेदक द्वारा बेधसक लाइसेंस फीस का समस्त भुगताि अधधमाित्ः ई-पेमेन्ट के माध्यम से धकया जायेगा। धजला आबकारी अधधकारी के पि में

धगरर्ीकृ त प्रधतभूधत धिराधश, सार्धध जमा रसीद के माध्यम से अथर्ा ई-पेमेन्ट के माध्यम से जमा की जायेगी। परन्तु िर्ीकरण की धस्थधत में पूर्व में िगद या राष्ट्ट्रीय बचत पत्र (एि0एस0सी0)अथर्ा बैंक गारंटी के माध्यम से जमा की गयी प्रधतभूधत तब तक मान्य होगी, जब तक इसकी र्ापसी ि कर दी जाय।

आर्ेदक द्वारा बेधसक लाइसेंस फीस का समस्त भुगताि अधधमाित्ः ई-पेमेन्ट के माध्यम से धकया जायेगा। धजला

आबकारी अधधकारी के पि में धगरर्ीकृ त प्रधतभूधत धिराधश, सार्धध जमा रसीद के माध्यम से अथर्ा ई-पेमेन्ट के माध्यम से

अिुर्ती र्षव में, दुकाि का लाइसेंस लाइसेंसधारी की इछछा पर राज्य सरकार द्वारा यथा धिधावररत उपभोग के मािदण्ड के अिुसार िर्ीकृ त धकया जा सके गा। िर्ीिीकरण हेतु बेधसक लाइसेंस फीस एर्ं प्रधतभूधत के अन्तर की धिराधश राज्य सरकार द्वारा धिधावररत समयार्धध में जमा की जायेगी।

परन्तु, यधद र्ह धर्धहत अर्धध के भीतर आधारभूत लाइसेंस फीस या प्रधतभूधत धिराधश जमा करिे में धर्फल रहता है तो उसका ल इसेंस धिरस्त हो जायेगा;

परन्तु, यधद र्ह धर्धहत अर्धध के भीतर आधारभूत लाइसेंस फीस या प्रधतभूधत धिराधश जमा करिे में धर्फल रहता है तो उसका चयि धिरस्त हो जायेगा;

स्तम्भ-2 एतद्द्वारा प्रधतस्थाधपत धियम

परन्तु यह और धक ई लाटरी/ई टेण्डर के माध्यम से लाइसेंस व्यर्धस्थत होिे की दशा में, उसकी धरोहर धिराधश तथा आधारभूत लाइसेंस फीस के साथ ही साथ प्रधतभूधत धिराधश, यधद उसके द्वारा जमा की गयी है, तथा लाइसेंस के िर्ीकृ त होिे की दशा में उसकी गत र्षव की जमा प्रधतभूधत का पन्द्रह प्रधतशत तथा िर्ीकरण फीस र् आधारभूत लाइसेंस फीस, यधद उसके द्वारा जमा की गयी हो, राज्य सरकार के पि में समपहृत कर ली जायेगी और उक्त दुकाि को तत्काल सरकार द्वारा यथाधर्धहत रीधत से पुिव्यवर्स्थाधपत कर धदया जायेगा।

  शाधस्तयों के  अधतररक्त प्रधतभूधत धििेप समपहृत कर ली जायेगी।    अधतररक्त प्रधतभूधत धििेप समपहृत कर ली जायेगी।

तनबन्धन एवां शिे

1. धियम-13 के उपबन्धों के अिुसार लाइसेंसधारी मूल्य एर्ं प्रधतफल शुल्क अधधमाित्ः ई-पेमेन्ट के द्वारा जमा करिे के पश्चात् देशी शराब का उिाि थोक अिुज्ञापि सी0एल0-2 के गोदाम से करेगा।

2. धियम-14 के उपबन्धों के अिुसार लाइसेंसधारी को लाइसेंस फीस की माधसक धकस्त माह की अधन्तम धतधथ तक जमा करिी होगी।

3. देशी शराब(यू॰पी॰एम॰एल॰) की बोतलों/असेधटटक धिक पैक के लेबुलों पर दायी ओर शीषव पर 1X1 सेंटीमीटर के स्पष्ट्ट दृश्यमाि बोल्ड फांट में तीव्रता एर्ं अधधकतम् फु टकर मूल्य मुधद्रत धकया जायेगा। फु टकर लाइसेंसधारी छपे हुए अधधकतम् फु टकर मूल्य से अधधक िहीं र्सूल करेगा।

एतद्द्वारा प्रधतस्थाधपत प्रपत्र

4. भूगृहाधद पर और उसके बाहर उपभोग के धलए मुहरबन्द पेट/शीशे की बोतलों/असेधटटक धिक पैक में देशी धस्प्रट/यू॰पी॰एम॰एल॰ की धबक्री उसी गद्दी से होगी। पररसर के एक अंश को अलग रखा जायेगा, जह ं के र्ल उपभोग के धलए अिुमधत होगी। पररसर में उपभोग के धलए भी खुली देशी धस्प्रट/यू॰पी॰एम॰एल॰िहीं परोसी जायेगी तथा िोस अपधशि प्रबन्धि धियम 2016 के अिुसार दुकािों पर उपभोग धकये जािे के पश्चात् खाली हुई पेट/शीशे की बोतलों तथा असेधटटक धिक पैक एर्ं उि पर प्रयुक्त ढक्किों को िि करके हटािे की धजम्मेदारी दुकाि के धर्क्रे ता/लाइसेंस/ आसर्क की होगी ।

5. धर्धहत तीिता और मात्रा की देशी शराब/यू॰पी॰एम॰एल॰की धबक्री मुहरबन्द पेट/शीशे की बोतलों एर्ं असेधटटक धिक पैक में की जायेगी, धजस पर शुल्क के भुगताि के प्रमाण के रूप में आबकारी धर्भाग द्वारा अिुमोधदत सुरिा कोड चस्पा हो।

6. लाइसेंसधारी लाइसेंस प्राधधकारी द्वारा यथा धर्धहत प्रपत्र और रधजस्टर में धियधमत और सही-सही दैधिक लेखा रखेगा, और उसे उत्तर प्रदेश आबकारी के पोटवल पर भी एस.एम.एस. करेगा/अपलोड करेगा और जब कभी सिम धिरीिण प्राधधकारी द्वारा मांगा जायेगा, तो उक्त लेखा रधजस्टर को प्रस्तुत करेगा। लाइसेंसधारी धबक्री इत्याधद का लेखा भी प्रस्तुत करेगा और यथा अपेधित सामग्री और दस्तार्ेजों की सुधर्धा देगा और उन्हें उपलब्ध करायेगा।

7. देशी शराब/यू॰पी॰एम॰एल की धबक्री को छोड़कर धजसके धलए धक लाइसेंस धदया गया है, लाइसेंसधारी को लाइसेंस प्राप्त पररसर में कोई अन्य व्यर्साय चलािे की अिुमधत िहीं दी जायेगी।

8. लाइसेंस प्राप्त पररसर, 14 अप्रैल (अम्बेडकर जयन्ती), 15अगस्त (स्र्तंत्रता धदर्स), 02 अक्टूबर (ग ंधी जयन्ती), 26 जिर्री (गणतन्त्र धदर्स) और तीि ऐसे अधतररक्त धदिो जैसा धक लाइसेंस प्राधधकारी द्वारा बन्दी के धलए अधधसूधचत धकया जाय, को छोड़कर धबक्री के धलए सभी धदर्सों पर प्रात्ः 10 से राधत्र 10बजे तक खुला रहेगा। लाइसेंस प्राधधकारी सुसंगत धर्धधयों के अधीि कािूि और व्यर्स्था या सामान्य धिर्ावचि से सम्बधन्धत धक्रया कलापों आधद के कारण से भी दुकाि की बन्दी का आदेश दे सकता है। उपरोक्त धदर्सों पर से दुकाि की बन्दी के धलए कोई प्रधतफल देय िहीं होगा।

परन्तु यह धक धर्शेष अर्सरों पर कधतपय अर्धध के धलए धबक्री के घंटों में, जैसा धक राज्य सरकार उधचत समझे, पररर्तवि धकया जा सके गा।

9. लाइसेंसधारी देशी शराब/यू॰पी॰एम॰एल के सम्पूणव स्टाक का भण्डारण के र्ल लाइसेंस प्राप्त पररसर में ही करेगा। र्ह ट्रैक एण्ड ट्रेस प्रणाली के अन्तगवत धर्धहत सुरिा कोड के अिुसार बोतलों की स्कै धिंग के धलये दुकाि पर यथाधर्धिधदवि पी0ओ0एस0 (टर्ाइंट ऑफ सेल) यंत्र रखेगा।

10. लाइसेंसधारी दुकाि के प्रर्ेश द्वार पर आबकारी आयुक्त द्वारा अिुमोधदत धकये गये प्रपत्र साइज में एक सहज दृश्य साइिबोडव लगाएगा, धजसके ऊपर लाइसेंसधारी का िाम, पदिाम, दुकाि की अर्धस्थधत, लाइसेंस की अर्धध, दुकाि खुलिे र् बंद होिे का समय और लाइसेंस प्राधधकारी द्वारा यथा धर्धहत अन्य सूचिाएँ भी मोटे अिरों में अंधकत की जायेंगी। साईि बोडव में धिम्िधलधखत सूचिा को प्रदधशवत करिा होगा्ः-

">दुकाि के बाहर आस-पास या सार्वजधिक स्थाि पर शराब पीिा र्धजवत है। इस संबंध में कोई भी उल्लंघि दण्डिीय होगा।

> शराब पीकर गाड़ी चलािा जािलेर्ा हो सकता है। > शराब पीकर गाड़ी चलािा जािलेर्ा हो सकता है।

कृ पया शराब पीकर गाड़ी ि चलायें।"

11. लाइसेंसधारी लाइसेंस प्राप्त पररसर के भीतर पयावप्त संख्या में बेंचों, तख्तों, कु धसवयों और मेजों सधहत समुधचत रूप से बैििे की व्यर्स्था कर सकता है। लाइसेंसधारी द्वारा उपभोक्ता को धगलास, पािी, बफव , सोडा, स्िैक्स र् धर्धभन्ि खाद्य पदाथो को पका कर उपलब्ध करा सके गा।

12. लाइसेंसधारी धकसी भी व्यधक्त को धर्क्रे ता के रूप में सेर्ायोधजत िहीं करेगा, जो 21 र्षव से कम आयु का हो या धकसी संक्रामक रोग से ग्रस्त हो या आपराधधक, पृष्ठभूधम का हो या मधहला हो। लाइसेंसधारी को सरकार द्वारा समय-समय पर यथाधर्धहत शुल्क के संदाय पर धर्क्रे ताओं हेतु धजला आबकारी अधधकारी द्वारा जारी फोटोयुक्त िौकरिामा प्राप्त करिा होगा और जब धिरीिणकताव प्राधधकाररयों द्वारा मांगा जाये तो, उसे प्रस्तुत करिा होगा।

13. लाइसेंसधारी धकसी भी व्यधक्त को धर्धहत सीमा से अधधक देशी शराब/यू॰पी॰एम॰एल िहीं बेंचेगा जब तक धक आबकारी मैिुअल प्रथम खण्ड 1995 संस्करण के देशी शराब के आयात- धियावत, पररर्हि र् कब्जे में रखिे की धियमार्ली के धियम-28 (3)के अिुसार अिुज्ञा प्रदाि की गई हो।

14. धकसी ऐसे व्यधक्त को धबक्री िहीं की जायेगी जो21 र्षव से कम 14. धकसी ऐसे व्यधक्त को धबक्री िहीं की जायेगी जो21 र्षव से कम आयु का हो या पदधारी जो र्दी में हो।

आयु का हो या पदधारी जो र्दी में हो।

15. लाइसेंसधारी द्वारा धकसी भी दशा में बोतलों और पात्रों या उिके लेबुलों, सुरिा कोड, धपल्फरप्रूफ कै प (चोरी रोधक ढक्किों) या मोहरों से धबगाड़ करिा, धर्कृ त करिा सर्वथा धिधषद्ध है।

16. लाइसेंसधारी अपिे लाइसेंस प्राप्त पररसर में कोई भी दुग्ध, शकव रा (चाश्नी), रंग, सुगंधध (अकव ), सुरिा कोड धिमावण करिे र्ाला यंत्र, लेबुल, कै टसूल, मुहर या कोई अपायकर सामग्री िहीं रखेगा।

17. लाइसेंसधारी या उसके धर्क्रे ता के धलए दुकाि की गद्दी पर या उस स्थाि से 5 धफट की दूरी पर जह ं धर्क्रय के धलए देशी शराब/यू॰पी॰एम॰एल भण्डाररत की गई है, पािी का रखिा सर्वथा धिधषद्ध है।

18. लाइसेंसधारी पररसर की समुधचत देख-रेख और सफाई के धलए उसकी िाधलयों आधद का कृ धमिाशक पदाथव से साफ धकया जािा सधम्मधलत है, उत्तरदायी होगा।

19. पररसर के भीतर प्रयुक्त सभी कु ल्हड, पत्तलों आधद को कू डे 19. पररसर के भीतर प्रयुक्त सभी कु ल्हड, पत्तलों आधद को कू डे

े़ के धलए धिधमवत खाली स्थािों या इस प्रयोजिाथव रखे गए ढक्किदार कू ड़ेदािों में तत्काल हटा कर डाल धदया जायेगा, धजसे धक धर्क्रय के धिधावररत घण्टों के दौराि कम से कम दो बार साफ धकया जायेगा।

20. लाइसेंसधारी/ धर्क्रे ता और उसके पररर्ार के धसर्ाय पररसर, धजसमें दुकाि धस्थत है, का प्रयोग आर्ास के स्थाि के रूप में िहीं धकया जायेगा।

21. लाइसेंसधारी द्वारा अपिी धबक्री बढ़ािे के धलए खरीददारों को प्रलोभि देिा या आकधषवत करिा सर्वथा धिधषद्ध है। द्यूत या िृत्य कायवक्रम करािा भी सर्वथा धिधषद्ध है।

22. लाइसेंसधारी लाइसेंस की समाधप्त पर अधतररक्त शेष स्टाक के धिस्तारण के धलए धजला आबकारी अधधकारी को ररपोटव करेगा, धजसे धियम-18 के अिुसार धिस्ताररत धकया जायेगा।

23. लाइसेंसधारी आबकारी आयुक्त या लाइसेंस प्राधधकारी द्वारा समय-समय पर धिगवत सामान्य या धर्धिधदवि अिुदेशों का पालि करेगा।

यह लाइसेंस धिम्िधलधखत धिबन्धि र् शतों के यह लाइसेंस धिम्िधलधखत धिबन्धि र् शतों के अध्यधीि है, इसमें से धकसी का व्यधतक्रम करिे अथर्ा उत्तर प्रदेश आबकारी (देशी शराब के फु टकर अिुज्ञापिों का व्यर्स्थापि) धियमार्ली,2002 यथासंशोधधत) के धियम-21 में यथा र्धणवत उपबंधों का उल्लंघि करिे पर अथर्ा उत्तर प्रदेश आबकारी अधधधियम, 1910 अथर्ा स्र्ापक ओषधध एर्ं मि्ः प्रभार्ी पदाथव अधधधियम 1985 के अधीि धकसी अपराध के धलए दोष

अध्यधीि है, इसमें से धकसी का व्यधतक्रम करिे अथर्ा उत्तर प्रदेश आबकारी (देशी शराब के फु टकर अिुज्ञापिों का व्यर्स्थापि) धियमार्ली,2002 यथासंशोधधत) के धियम-21 में यथा र्धणवत उपबंधों का उल्लंघि करिे पर अथर्ा उत्तर प्रदेश आबकारी अधधधियम, 1910 अथर्ा स्र्ापक ओषधध एर्ं मि्ः प्रभार्ी पदाथव अधधधियम 1985 के अधीि धकसी अपराध के धलए दोष धसद्ध होिे पर लाइसेंस धारक का लाइसेंस धिरस्त हो जायेगा और सुसंगत धर्धधयों के अधीि अधधरोधपत धकन्हीं शाधस्तयों के अधतररक्त प्रधतभूधत धििेप समपहृत कर ली जायेगी।

धसद्ध होिे पर लाइसेंस धारक का लाइसेंस धिरस्त हो जायेगा और सुसंगत धर्धधयों के अधीि अधधरोधपत धकन्हीं शाधस्तयों के अधतररक्त प्रधतभूधत धििेप समपहृत कर ली जायेगी।

3. देशी शराब/यू॰पी॰एम॰एल॰की पेट/शीशे की बोतलों/ असेधटटक धिक पैक के लेबुलों पर दायी ओर शीषव पर 1X1 सेंटीमीटर के स्पष्ट्ट दृश्यमाि बोल्ड फांट में तीव्रता एर्ं अधधकतम् फु टकर मूल्य मुधद्रत धकया जायेगा। फु टकर लाइसेंसधारी छपे हुए अधधकतम् फु टकर मूल्य से अधधक िहीं र्सूल करेगा।

In exercise of the powers under sections 24 and 41 of the United Provinces Excise Act, 1910 (U.P. Act no. IV of 1910), read with section 21 of the Uttar Pradesh General Clauses Act, 1904 (U.P. Act no.1 of 1904), the Excise Commissioner, Uttar Pradesh with the previous sanction of the State Government hereby makes the following rules with a view to amend the Uttar Pradesh Excise (Settlement of Licenses for Retail Sale of Country Liquor) Rules, 2002 published vide Notification

no. 27091/X- Licenes-59/2002-2003, dated March 14, 2002:

THE UTTAR PRADESH EXCISE (SETTLEMENT OF LICENSES FOR RETAIL SALE OF COUNTRY LIQUOR) (SEVENTEENTH AMENDMENT) RULES, 2024

1. Short title and commencement–(1) These rules may be called the Uttar Pradesh Excise (Settlement of Licenses for Retail Sale of Country Liquor) (Seventeenth Amendment) Rules, 2024.

(2) They shall be deemed to have come into force with effect from 1st April, 2024.

2. Amendment of rule-2– In the Uttar Pradesh Excise (Settlement of Licenses for Retail Sale of Country Liquor) Rules, 2002 (hereinafter referred to as the "said rules") for rule 2 set out in Column-I below, the rule as set out in Column-II shall be substituted, namely:-

2-Definitions

(n) 'Individual' means a person who is the citizen of India not below the age of twenty-one years;

(n) "Security amount" means a sum equal to the 1/10th part of the license fee excluding basic license fee, to be deposited through Fixed Deposit Receipt pledged in favour of District Excise Officer or through e-payment refundable after the final settlement of all the claims and dues to the State Government.

Provided, in case of renewal security deposited earlier through prior in cash or through National Saving Certificate (N.S.C.) or Bank Guarantee shall be acceptable till it is not refunded;

(o) "Licensing Authority" means the Collector

of the District;

(o) "Consideration fee" means a fee fixed, per liter by the State Government under Section 30 of the Excise Act according to the strength of the country liquor to be deposited in the Government Treasury by the licensee before taking supply of country liquor;

(p) "License Fee" means the remaining part of consideration fee for grant of license for exclusive privilege of retail sale of country liquor under section-24 of the Act, payable by the licensee, in addition to the basic license fee. This sum shall be equal to the consideration fee leviable on the annual minimum

guaranteed quantity fixed for the shop:

Provided that if settlement is done in midsession it will be equal to consideration fee leviable on minimum guaranteed quantity.

(p) "Additional Consideration fee" means difference amount obtained as a result of rounding off the optimum retail price of country liquor to the next multiple of two rupees, which shall be payable at Distillery level and recoverable by distillery from wholesale supplier in addition to Ex-Distillery Price and which in turn could be recovered by wholesale supplier from retail licensee in addition to maximum wholesale price. But this amount of additional consideration fee shall not be adjusted against the license fee payable by retail licensee;

(q) "Earnest Money" means the amount equal to 1/10 of the amount of basic license fee, to be tendered with application form, for ensuring the fulfillment of the eligibility conditions for the grant of license and is liable to be forfeited in case of default under provisions of rule-12 of these rules;

(q) "Monthly Installments of License Fee" It shall be in addition to basic license fee which shall be equal to the consideration fee involved in the minimum guaranteed quantity of a month fixed by the licensing authority and shall be payable every month. However the consideration fee involved in the quantity of the country liquor lifted during the month by the licensee, may be adjusted against the monthly installments of the licence fee subject to the provisions of these rules;

(r) "Hierarchy" means the earnest money of shops in the descending order purported to be the basis for the selection of licensee through the process of e/lottery;

(t) "Security amount" means a sum equal to the 1/10th part of the license fee excluding basic license fee, to be deposited through Fixed Deposit Receipt pledged in favour of District Excise Officer or through e-payment refundable after the final settlement of all the claims and dues to the State Government.

10- Selection of licensee-

(a) (i) License of shop may be renewable online under the terms and conditions specified by the State Government.

(ii) In case of non-renewal, licensees shall be selected shop wise through the process of e-lottery or e-tender, as specified by the State Government, through inviting online applications. District Excise Officer shall scrutinize the applications received online and prepare list of all eligible and ineligible applications, describing the reasons of ineligibility and shall put up this list before the District Level Committee of Licensing constituted for e-lottery and e-tender.

is made by any of his legal heirs or

(b) The said committee shall identify eligible and ineligible applicants. In case of lottery the licensee shall be selected for each shop from amongst the eligible applicants through the computer driven randomized arrangement. Randomization process shall be adopted in the order of country liquor, model shops, foreign liquor and beer shops as per prescribed hierarchy under respective rule. In case of selection of licensee through e-tender the same aforesaid sequence shall be adopted. Not more than two shops including all categories of country liquor, model shop, foreign liquor and beer shall be allotted in favour of an applicant in the entire State.

Provided that aforesaid restriction limit shall not be applicable to matter related to renewal and mutation of licences in favour of legal heir/family member/close relative of deceased licencee/licencees in the event of death of licencee/licencees as per procedure mentioned in Rule-8(a):

(c) In case the selected applicants does not deposit the required basic licence fee or security amount and does not fulfill the prescribed formalities or is unable to arrange suitable premises for the shop within the stipulated period, the Licensing Authority shall cancel the allotment and take steps for resettlement of the shop through the process as prescribed by the Government.

(d) In case there is no application for a particular shop or no candidate is found suitable for a shop, the Licensing Authority shall take immediate steps for resettlement of the shop through the process as prescribed by the State Government.

The License is subject to the following terms and conditions the infraction of any of which or violation of the provisions as expounded in Rule-21 of U.P. Excise (Settlement of licenses for retail sale of country liquor) rules- 2002 (as amended) or conviction for any offence under the U.P. Excise Act 1910 or Narcotics Drugs and Psychotropic Substances Act, 1985 shall make the licensee(s) liable for cancellation of the license and forfeiture of security deposit, in addition to any penalties imposed under the relevant laws.

TERMS AND CONDITIONS

1. The licensee shall lift country liquor from CL-2 Godown of wholesale licensee after payment of cost and consideration fee in accordance with the provisions of rule-13 preferably by e-payment.

2. The licensee is liable to pay the monthly installment of license fee by the last day of the month in accordance with the provisions of rule-14.

3. Maximum Retail Price and strength shall be printed in visible bold font of 1x1 centimeter on the right top of labels of bottles/ Aseptic Brick Pack of country liquor/(U.P.M.L.). The retail licensee shall not charge more than the printed maximum retail price.

4. The Sale of Country Spirit in sealed pet/glass bottles/Aseptic Brick for consumption both "on" and "off" the premises shall be allowed from the same Gaddi. A portion of the premises shall be set apart where only "on" consumption shall be permitted. Even for "on" consumption the country spirit/U.P.M.L shall not be served loose and licensee/salesman/distiller shall be responsible for disposing of pet/glass bottles and Aseptic Brick Packs as well as capsules affixed upon them after being consumed at the shop as per Solid Waste Management (SWM) Rules, 2016.

5. The sales shall be made in sealed pet/glass bottles and Aseptic Brick of country liquor/ U.P.M.L of prescribed strength and capacity carrying security Code as approved by the Excise Department, as proof of payment of consideration fees.

The licensee shall maintain a regular and accurate daily account in the form and register as prescribed by the Licensing Authority and SMS upload the same on Uttar Pradesh Excise portal be produced for inspection whenever asked by the competent inspecting authority. 7. The licensee shall not be allowed to carry on any other business on the licensed premises except sale of Country Liquor /U.P.M.L for which license is granted.

The licensed premises shall remain open for sale on all days from 10.00 am to 10 pm, except on 14th April (Ambedkar Jayanti), 15th August (Independence Day), 2nd October (Gandhi Jayanti), 26th January (Republic Day) and upto 3 more days as notified for closures by the Licensing Authority, Licensing Authority may also order closure of shop on account of law and order or General Election related activity etc. under the provisions of relevant laws. No Consideration fee shall be given for the closure of shop on above dates/days.

Provided that the sale hours may be changed on special occasions for certain duration as the State Government may deem fit.

9. The licensee shall store entire stock of Country Liquor /U.P.M.L in the licensed premises only. He shall be required to maintain P.O.S (point of sale) equipment as specified for scanning of bottles as per prescribed security code under the Track and Trace System.
