IN pursuance of the provisions of clause (3) of Article 348 of the Constitution of India, the Governor is pleased to order the publication of the following English translation of the Uttar Pradesh Niji Vishwavidyalay (Dwitiya Sanshodhan) Adhiniyam, 2024 (Uttar Pradesh Adihiniyam Sankhya 11 of 2024) as passed by the Uttar Pradesh Legislature and assented to by the Governor on August 12, 2024. The Uccha Shiksha Anubhag-1 is administratively concerned with the said Adhiniyam.

THE UTTAR PRADESH PRIVATE UNIVERSITIES (SECOND AMENDMENT) ACT, 2024 (U.P. Act no. 11 of 2024) [As passed by the Uttar Pradesh Legislature] AN ACT

further to amend the Uttar Pradesh Private Universities Act, 2019.

IT IS HEREBY enacted in the Seventy-fifth Year of the Republic of India as

followes :–

1. (1) This Act may be called the Uttar Pradesh Private Universities (Second Short title and Commencement Amendment) Act, 2024.

(2) It shall be deemed to have come into force with effect from the 6th day of

March, 2024.

Amendment of Schedule 2 of U.P. Act no. 12 of 2019

2. In Schedule 2 of the Uttar Pradesh Private Universities Act, 2019 (hereinafter referred to as the "principal Act") after serial no. 38, the Columns of the said Schedule shall be amended as below and after serial no. 38 for the newly established Universities the following serial numbers shall be inserted, namely :-

Power to remove difficulties 3. (1) The State Government may, for the purposes of removing any difficulty in relation to the establishment of "Sharda University Agra" Agra, Uttar Pradesh, or Saroj International University, Lucknow, Uttar Pradesh or JSS University, Noida, Uttar Pradesh by order published in the Gazette, direct that the provisions of the principal Act shall during such period, as may be specified in the order, have effect subject to such adaptations, whether by way of modification, addition or omission, as it may deem necessary or expedient:

Provided that no such order shall be made after two years from the date of

commencement of this Act.

(2) Every order made under sub-section (1) shall be laid before both Houses of

the State Legislature, as soon as may be, after it is made.

Repeal and saving

4. (1) The Uttar Pradesh Private Universities (Amendment) Ordinance, 2024, the Uttar Pradesh Private Universities (Second Amendment) Ordinance, 2024 and the Uttar Pradesh Private Universities (Third Amendment) Ordinance, 2024 are hereby repealed.

(2) Notwithstanding such repeal, anything done or any action taken under the provisions of the principal Act as amended by the Ordinance referred to in sub-section (1) shall be deemed to have been done or taken under the corresponding provisions of the principal Act as amended by this Act as if the provisions of this Act were in force at all material times.

STATEMENT OF OBJECTS AND REASONS

The Uttar Pradesh Private Universities Act, 2019 (U.P. Act no. 12 of 2019) has been enacted to provide for the establishment of new Private Universities and incorporation of existing Private Universities in the State of Uttar Pradesh for imparting higher education and to regulate their functions and for matters connected therewith or incidental thereto.

In order to provide for the establishment of three new Private Universities, namely :– (i) "Sharda University Agra", Agra, Uttar Pradesh; (ii) Saroj International University, Lucknow, Uttar Pradesh; and (iii) JSS University, Noida, Uttar Pradesh, it was decided to amend Schedule 2 of the aforesaid Act.

Since the State Legislature was not in session and immediate legislative action was necessary to implement the aforesaid decision,the Uttar Pradesh Private Universities (Amendment) Ordinance, 2024 (U.P. Ordinance no. 1 of 2024), the Uttar Pradesh Private Universities (Second Amendment) Ordinance, 2024 (U.P. Ordinance no. 2 of 2024) and the Uttar Pradesh Private Universities (Third Amendment) Ordinance, 2024 (U.P. Ordinance no. 3 of 2024) were promulgated by the Governor on March 6, 2024.

This Bill is introduced to replaced the aforesaid Ordinance.
