WHERE the preliminary notification under sub-section (1) of section 11 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (Act No. 30 of 2013), was issued by the State Government for the acquisition of total 72.9230 hectares of land in village Chanchalia Panari Tola Gurur Pargana Agori, Tehsil Obra, District Sonbhadra for public purpose i.e. construction of ash dam of 2x660 MW Obra C Thermal Project through Uttar Pradesh State Electricity Generation Corporation Limited in District Sonbhadra vide notification no. 1511/24-03-2023-1294-2020, dated September 12, 2023.
2. AND, WHEREAS, declaration under sub-section (1) of the section 19 of the aforesaid Act could not be issued within 12 month from the date of preliminary notification.
3. AND, WHEREAS, as per sub-section (7) of section 19 of the aforesaid Act, where no declaration is made under sub-section (1) of section 19 within twelve months from the date of preliminarily notification, then such notification shall be deemed to have been rescinded;
4. AND, WHEREAS, the District Magistrate Sonbhadra has requested with reason to extend the period of twelve months and the State Government is of the opinon that circumstances existed for the inadvertent delay;
5. NOW, THEREFORE, in exercise of the powers conferred by the last proviso to sub-section (7) of section 19 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, the Governor is pleased to extend for a period of 06 months for declaration under sub-section (1) of the section 19 aforesaid Act.
