çeq[k lfpoA mRrj çns'k vlk/kkj.k xtV] 6 uoEcj] 2024 3 IN pursuance of the provisions of clause (3) of Article 348 of the Constitution, the Governor is pleased to order the publication of the following English translation of notification no. 19/2024/1225/XXX-4-2024-30-4099(099)-151-2021, dated November 6, 2024

IN exercise of the powers conferred under section 3 of the Uttar Pradesh Motor Vehicles Taxation Act, 1997 (U.P. Act no. 21 of 1997) the Governor is pleased to exempt, for a period of three months from the date of publication of this notification in the Gazette, the transport vehicles registered before the date of publication of this notification in the Gazette from the payment of penalty for late payment of tax payable on the following terms and conditions: -
(1) All owners of transport vehicles or their legal heirs whose cases are pending before various Courts:
Provided that following vehicles shall not be eligible to avail this facility:-
(a) all types of transport vehicles registered on or after the date of issue of notification;
(b) all types of unregistered transport vehicles, on which due taxes have been payable before the date of notification and are pending due to not deposit.
(2) All owners of transport vehicles or their legal heirs whose appeals/revisions against taxes/penalties are pending before Deputy Transport Commissioner (Zone) or Deputy Transport Commissioner (Passenger Tax).
(3) They shall have to submit an application before the concerning Courts/Deputy Transport Commissioner (Zone) /Deputy Transport Commissioner (Passenger Tax), as the case may be, for withdrawal of the cases.
(4) The owners or financiers of such transport vehicles possession of which have been taken under section 51 of the Motor Vehicles Act, 1988 (Act no. 59 of 1988).
(5) All owners of transport vehicles or their legal heirs against whom Recovery Certificate has been issued for taxes and penalties up to the date of publication of this notification in the Gazette, shall also be eligible under this notification.
(6) The vehicle owners or his legal heirs shall have to submit the application with an amount of Rs.200/-, in case of three wheelers and Light Motor Vehicles (Gross Vehicle Weight up to 7500 kg) and an amount of Rs. 500/- for remaining Vehicles, as application fee to the Assistant Regional Transport Officer (Administration)/Taxation Officer as per the procedure laid down by the Department.
(7) Application shall be submitted from the date of publication of this notification in the Gazette till the date of having effect of this notification.
(8) No application shall be entertained after expiry of the period as specified in condition no. 7 above.
(9) This notification shall be published on the website- http://uptransport.upsdc.gov.in/en-us/ of the Transport Department and as well as in leading newspapers. Any information regarding this exemption would not be given separately to the owners of vehicles in person.
(10) Taxes and penalties deposited, before the date of publication of this notification in the Gazette, against any transport vehicle shall not be refundable.
(11) The owner shall deposit the total amount of taxes dues on the vehicles in 'lump sum'.
(12) The tax of any vehicle that is not in existence, shall be deposited upto the period of existence of the vehicle and if it is proved that the vehicle is not in existence as per the procedure mentioned in 4 mRrj çns'k vlk/kkj.k xtV] 6 uoEcj] 2024 rule 22 A of Uttar Pradesh Motor Vehicles Taxation Rules, 1998, then the writing off of the tax and cancellation of registration of vehicle shall be done as per the aforesaid rules.
(13) The applicant/beneficiary shall have to submit the application to Assistant Regional Transport Officer (Administration)/ Taxation Officer of the concerned district as per the procedure laid down by the Transport Department.
(14) The concerned Assistant Regional Transport Officer (Administration)/ Taxation Officer shall ensure follow-up action under this notification after examining the application on the basis of official record.
